Toledo Arraigned on Protest-Related Charges, Calls Case ‘Political Repression’

Cal Poly Humboldt student organizer Rick Toledo addressed local press and supporters before he entered not guilty pleas to three misdemeanor charges stemming from a February sit-in at Nelson Hall, telling press and supporters gathered outside the courthouse that he believes that the prosecution is part of a coordinated effort to silence campus activism. 

Toledo appeared before the Honorable Judge Joyce Hinrichs facing misdemeanor charges of assault, battery, and false imprisonment – all arising from an incident during the February 27 protest in which he allegedly physically blocked an administrator from preventing other students from entering a doorway. 

Speaking at the press conference ahead of the arraignment, Toledo told the crowd, “I still believe that protesting is not a crime. I stand for free speech, and I think that what they are doing to me is a sign of the times – a sign that they are facing pressure from the Trump administration and federal bodies with far-right agendas that would love to silence people who stand up for what’s right.”

The Humboldt County District Attorney did not file a fourth charge – conspiracy to commit a crime – which was included in the original Ramey arrest warrant. 

Toledo said Monday he has received no update on whether the DA intends to pursue it. “They haven’t filed it yet, but it could be that they’re considering filing it still,” Toledo said.

“My thought is that they took all of my technology – they raided my house, took my computer, my phone, all these things – and I think they’re desperately trying to find something that they can use to prove that conspiracy,” adding, “I think that’s probably why it’s still floating right now.”

However, as of Monday afternoon, the conspiracy charge had not been filed, and Toledo has not been able to recover his technology, including his work laptop and cell phone.

Full Court Press 

Cramming into what a bailiff described as “one of the courthouse’s smallest courtrooms”, the deputy notified the group of roughly two dozen supporters before the proceedings began that not only would protest signs not be allowed in the court room per order of the court, but that the audience would be limited due to space limitations. 

The room was full, with three bailiffs standing by. Each deputy was observed carefully eyeing the group of protesters who were clad in kufiyas with some wearing t-shirts printed for the occasion aimed at advocating for the protest demands of students: Divestment to “remove $500,000 from apartheid, genocide, war” and also to “become a Sanctuary campus” while advocating for free speech on campus.

With a phone banking action taking place at the same time, student activists and supporters on college campuses from coast to coast were asked to call in to the Humboldt County District Attorney’s office demanding that the charges be dropped, it was unclear whether the court was aware of the social media campaign to lobby on Toledo’s behalf – but in any case, issued the explicit warning that any person seen with their cell phone out would be ejected from the hearing immediately. 

That warning is not typically issued at the outset of court hearings, while it is commonly understood that phones and electronic devices are to be silenced while in the courtroom. But, in a case that has been leveraging social media to like-minded students and affinity organizations (such as other chapters of SDS) as a way of drumming up support for Toledo’s case, the strict ‘no phones out’ clarification was not surprising.

As for the far-reaching support for him evident on Instagram, Toledo said the national solidarity response – from SDS chapters, immigrant rights organizations, and climate groups – has sustained him. “Sometimes I think people feel the crushing weight of the people in power who want to bring an iron fist down upon us – but we have to remember that there is a strong network of people fighting back all around the country, and we all stand with each other, and we will not give up so easily.”

School Conduct Case

Toledo remains on suspension from Cal Poly Humboldt and has not been able to return to classes. A conduct hearing was held recently, and he said he is scheduled to meet Friday with a university official to review a proposed resolution agreement.

He said he does not expect a fair process. “The way that the school works, it is a kangaroo court,” he said.

Toledo has speculated that administrators at Cal Poly are fed up with his activism and work as a student organizer with Students For a Democratic Society on campus. “No matter what I do, no matter where I appeal it, the Vice President has the power to override any and all decisions made by lower bodies.” 

Explaining that he was optimistically cautious, Toledo said he ultimately understood that he was at the mercy of the University’s disciplinary system. “So if they’re just set on taking me down, they will do that. The only defense I have at that point is to defeat these charges, apply public pressure, and potentially pursue legal avenues after that, if necessary.”

His criminal defense attorney, Matthew Kellegrew of the Civil Liberties Defense Center, appeared via Zoom for Monday’s arraignment and is expected to appear in person as the case proceeds. Kellegrew appeared via Zoom for the arraignment on Toledo’s behalf.

“In 2024,” Toledo told reporters, “when we had the occupation of Siemens Hall, they used police brutality… they brutalized students who were trying to do a sit-in. They immediately responded with violence and trying to silence them and criminalize them for standing with the people that are experiencing genocide.” 

However, at the time Cal Poly Humboldt stated, they were concerned about the “continuing destruction of property and other lawlessness in the central part of campus. This has caused complex operational challenges that require the closure of other facilities on campus.

Toledo argued the pattern has only worsened since then, with time, place and manner policies tightened across CSU and UC campuses under pressure from state officials. “On many campuses,” Toledo asserted the tightening has “created a chilling effect where people are scared to go and speak out and fight back because of how heavy-handed it is.” 

‘Waste’ of a Case

Toledo closed his remarks with a direct appeal to District Attorney Stacy Eads to drop the charges against him. “Listen to the people,” Toledo said, as he made eye contact with the camera, “This is not what people want their money going towards. Pursuing a case like this is a waste of resources. It is a waste of time. It is repressive.”

Toledo continued, “There are real things out here that require your attention – real problems, real things we could be putting money towards for the county and for the city. And this is not it. This is a waste, and it is shameful.”

He also acknowledged the financial strain the case has placed on him personally, noting he may need to find work immediately depending on the outcome of the university conduct process, and that fundraising efforts are underway.

It does raise the issue of what the chant “no justice, no peace” means in the real world. And the power of those who distrupt to effect much more than their personal weight by extreme partisan rhetoric.

There was an article about a man who ran music festivals for punk rockers. At some point he made a very small donation to Trump as a protest against Biden. But when it became public it was used to essentially rally enough people who patronized his business to ruin him. An anti-Trump discovered it and, saying “When I would listen to Trump’s rhetoric about ICE — I’ve got friends who are undocumented. Supporting that in a financial way, supporting someone saying my trans friends don’t exist, and to do so coming from a music scene that to me is accepting and kind and certainly not ripping families apart, I couldn’t in good conscience let that go,” started a social media campaign that ended up canceling this manager’s season. The bands scheduled to play complained about losing their income along with all the venues and workers that hosted them.

It’s not unusual for someone to say here that freedom of speech does not mean freedom from consequences. But at what point does making someone pay for having a difference of opinion become itself a tyranny run by the mindless? Is all thinking now to be controlled by those most prone to demagoguery? That is seen on this site every day where the slightest disagreement has commenters abusing other commenters by consigning them to whatever stereotype they hate.

Well one test of the value of the cause is the amount of sacrifice willingly accepted. This man is an example of someone whose willingness to sacrifice others but not himself is the epitome of the shallowness of principles when confronted by his own, unreasonable expectation he shouldn’t have to pay for them. It is they way of so many here who blame and blame, love disruption, but resent any idea that they themselves should pay a price for their making other’s suffer. Other’s suffering is dismissed. No empathy for them.

DEI is a defective idea for government, no matter how many cities in the clouds you dream of. Authoritarian and subject to all sorts of abuse. There’s zero empathy.

The constant deflection that Trump does something bad does not make anything the leftist extremists do any better. This is the very attitude that ensures Trump owns you. Whatever he does must be countered by his opponents doing at least as bad but not infrequently worse. Then Trump counters and the left counters, etc. It’s a race to ruin. Easy to mindlessy follow. Why you are so agreeable to be so Trump like when you constantly complain about him is a mystery. The opposite of Trump is being tolerant of those who oppose you but steadfast in your own actions. You simply refuse to tolerate any opposition.

The way to get better is to be better, not worse. It takes some self discipline and some integrity. And not overreacting and thinking one more push of a bad behavior that has failed repeatedly will do it. What that led to was Biden and more Trump. Even if you push Trump out, you just create another Trump to take over.

Many on the left don’t like to hear things they disagree with. My friend just was unfriended by a lifelong friend recently. It still astounds me that the left has shut down all conversations they just don’t like, get people fired, delete posts, stop talking to family members, and unfriending lifelong loyal friends over identity politics or who they voted for.

20 years ago this wasn’t a thing. People were allowed to disagree and say so. They were allowed to make jokes. They were allowed to rib each other a bit for the enjoyment of both parties.

I’ve had republican friends, libertarian friends, socialist friends, friends who didn’t like any form of government, religious friends, atheist friends, agnostic friends, pagan friends, Christian friends, punk friends, hippy friends, poor friends, rich friends, gay friends, black friends, Persian friends, Jewish friends, European friends, lesbian friends, gender bending friends, and friends who were apolitical.

It wasn’t a problem 20 years ago. What has gone so wrong? Why can’t we disagree and laugh at our differences and still care about each other anymore?

It does. But not next door to armaments nor active military units of any kind. Just doesn’t happen. And if there was military action going on, there children would not be in them anyway. And there was never a “girl’s school” at all on a military base. Which sort of raises different questions about Iran.

There’s plenty of lame asses all over but hardly any of them are the sort of questioning souls that name themselves “yabut.” I’m not sure what those sorts call themselves.

He’s framing this as a free speech issue, but describing conduct. Speech is protected. Physically blocking access, taking over buildings, disrupting other students and going hands on, isn’t speech, it’s control of shared space and battery.

That’s exactly the behaviors that Time, Place, and Manner rules exist to prevent.

Saying “we decide when and where speech happens” isn’t a rights argument, it’s an assertion of authority over everyone else! What’s missing is any acknowledgment of the impact on other students. Once you cross from expression into interference, the law ignores your message and focuses on criminal actions. That’s why this isn’t a First Amendment case, it’s a conduct issue. I’m shocked at the mindless supporters holding space. Sad commentary on their intellect.

The law typically demands damages for this type of case to have teeth. Yet there are no damages, no bodily harm, no property damages. So where’s the case? This looks like polticial theater to me. Whether you like the hippy guy or not this prosecution is a waste of money. School policy should be handling this.
