‘We Will Not Accept the Response’: Students Remain Overnight in Cal Poly Humboldt’s Nelson Hall

On the heels of a full day of protest at Cal Poly Humboldt, a group of student activists conducting a sit-in protest settled in for an unplanned overnight stay in Nelson Hall after administrators closed the building.

With the bathrooms inside Nelson Hall locked as a consequence of the sit-in, many student protesters within Nelson Hall occupying room 102 had chosen to remain rather than leave to access facilities. Some reported urinating in a “piss bucket” rather than leaving the building.

Rather than abandon the cause and leave their fellow protesters behind, students said they made the choice to use bottles or the bucket due to lack of access to facilities. University staff explained to students within and outside of Nelson Hall that they were free to leave the protest to find a bathroom at any time. To leave, protesters argued, would give way to administrators’ attempts to curtail their free speech activity.

This was not a fair choice, they explained. “This is inhumane!” said one student, as another explained that “there are students here menstruating- and admin thinks it’s ok to block bathroom access,” they said.

Being wary of academic and possibly criminal repercussions for their on campus protest activity, students providing this video asked that their identities be blurred in light of a possible Time, Place and Manner policy violation. 

Those student demands were initially issued a week earlier, during a brief occupation of Siemens Hall. At the time, students requested further divestment from war-related investments, a protective and proactive written sanctuary policy for the campus, and for the CSU to accommodate employment requests from union staff and non-union staff alike. 

A written response from Cal Poly Humboldt’s (CPH) new Vice President Michael Fisher was received by the student group inside Nelson Hall. In regard to divestments, it read, “the Cal Poly Humboldt Foundation Board continued its work towards Environmentally and Socially Responsible Investments… and will commit to continuing this work as part of their next Finance & Investment Committee meeting.”

Cal Poly Humboldt offered four bullet points as follows: 

  • Our University commits to continuing our stance of not voluntarily sharing individual student data.
  • The University has taken, and will continue to take clear, lawful, and actionable steps to address ICE and CBP activity on our campus and provide space and resources to support our communities and populations that are at risk today and into the future.
  • We will continue to revisit our publicly posted protocols that help ensure the safety and well being of undocumented and immigrant students.
  • Our Community Resilience Task Force has been active and will continue to build a community network that provides support for our students and community members in preparation and recovery from ICE activity.

In addition, the letter from CPH to students also contained this explanation of the situation with the Union. “We value our employees and commit to providing a platform so their voices can be heard, on our campus, at the Chancellor’s office and in Sacramento, “ it said but it pointed out that Cal Poly Humboldt has little control over the bargaining that it conducted between the Chancellor’s Office and unions.

A tent was set up in the walkway area outside Nelson Hall, only to be removed by CPH staff against the objection of students. The student who offered the tent could be heard saying, “I just don’t want [administrators] to destroy it,” as the tent was positioned in front of the protest zone.

After reviewing the official statement produced by Fisher, the group of student demonstrators was not satisfied. The student protest group formulated an official response to the administration while barricaded in Nelson Hall. [See full release here]. 

“We, the students, will not accept the response from the Cal Poly Humboldt campus administration. We do not believe that our demands have been adequately addressed.”

Their demands center on three primary issues: divestment from war-related investments, implementation of what they call a “true sanctuary policy,” and honoring promised raises for Teamsters and other organized labor on campus.

Regarding divestment, students argue that “less than one percent of investments” the university says it has “is not zero” and they call for the university to fully divest from any corporation manufacturing weapons, regardless of other products produced by those companies.

On sanctuary policy language, students objected to phrasing that the university will not “voluntarily” share student data, arguing that this leaves room for compliance with federal requests. They are calling for what they describe as an enforceable sanctuary policy rather than symbolic language.

On labor issues, students expressed dissatisfaction with the CSU’s revocation of previously negotiated salary increases for Teamsters and criticized what they described as direct outreach to non-unionized employees offering a one-time bonus.

While student protestors remained inside, roughly two dozen students and community members stood by in support, observing the student protest from outside.  Water bottles and pizzas were delivered to the protesters under threat of trespass and violation of Time, Place and Manner policy.

Currently, students inside Nelson Hall say they plan to remain overnight. The University advised them that they are  in violation of the TPM policy and as the situation headed into the weekend, the students haven’t clarified what steps they will take next. And neither has the CPH administration.  Any additional information provided from Administrators or from student activists will be reflected in future reporting as the situation continues to develop.

Nice touch with the Kirkland branded water bottles. They shouldn’t be drinking them if Costco in anyway supports Israel or it’s functions (they do sell Kosher foods).

Of Defence projects involving cyber security, quantum technology, nuclear weapons and the management of national laboratories focused on national defence.

Ironic isn’t it? Only THEY can protest or utter THEIR opinions yet THEY think the present administration is trashing the constitution. I don’t think THEY get it. We ALL have the very same freedom of expression.

It’s just that the adults in our country don’t feel the need to carry signs and spend some of our valuable time resisting the inevitable: elections have consequences.

Maybe someone should remind all the protesters we have viewed for over a year, they are not a majority and a democratic Republic is based on majority rule and that’s why Trump is president. Ya think?

Obviously they need way heavier course work! The soft professors have abandoned academic rigor, which leaves lots of time for the unchallenged students to run a campsite-without-plumbing protest inside a secured building!

I’m not dismissing the right to protest. Fueled by naivety and the idealism of youth, this unfortunately reads as a pot luck of grievances and a desperate attempt to look edgy and important.

Aiming fury at investment portfolios, federal immigration and foreign policy from the floor of Nelson Hall? It is a wildly misguided, disorganized performance piece that broadcasts exactly how little awareness they have of how the world actually works. Some battles are symbolic only, and this one is… aggressively symbolic.

Also aggressively unhygienic. 🤮

Meanwhile…. the professors at Cal Poly continue to lower academic expectations and will probably give extra credit for “participatory civil disobedience,” all while pulling $200k+ in salaries and benefits funded by the public… So if anyone wants to talk about misallocated money, maybe we should start there.

Shut off all utilities (electricity, water, natural gas). Lock all doors to entry (egress only). No one and nothing allowed in. Station university police at all exits. Wait them out. Arrest folx as they choose to leave. Prosecute for trespassing and any other crimes committed. Take disciplinary action against any who are students, including expulsion. Negotiations complete! No violence necessary.

They are not doing anything constructive except to disrupt the regular students and classes. Time for the President to give all of them their walking papers and get rid of them. Dear students, you have expressed your opinion and made your points. CPH has responded and acknowledged your message, take it as a win and go home without causing damage to the building or yourselves. The goal should be to move the needle, not to demand complete capitulation.

Dear CPH, I applaud the desire to allow free expression of opinion by your students but you need to enforce clear policies that distinguish between speech and holding the rest of the campus hostage to demands. You’ve acknowledged their expression of opinion, now make a clear statement that the students must leave by noon today or face expulsion.

A civil society only functions when rights, responsibilities, and consequences are respected by everyone, protester and protested alike.

CPH is in a really difficult position, the balance of power isn’t in their favor. They’re forced to walk on eggshells, knowing they could be fired if their words make even the most radical student uncomfortable. Meanwhile, students can direct intense hostility at whoever they want or even take over parts of the university and still be rewarded with praise and treated like heroes.
The takeovers will continue as long as these incentives remain.

The adults in the room need to grapple with a difficult reality that not every student protest should be facilitated or legitimized. Its not even about Palestine at this point, its about the pursuit of attention and the desire to recreate the sense of power these students felt during last years occupation.
The demands are not practical or achievable, everyone including the students understand this, and yet it persists for show.

Aileen Yoo, Cal Poly Humboldt’s director of news and information, emailed the following update a few minutes ago:

At approximately 2 a.m. on Saturday, 20 individuals occupying a meeting room in Nelson Hall East exited on their own, and the University was able to clear and secure the building. There were no arrests or injuries.
