Five Years After Unsolved Homicide Of David Josiah Lawson, A Family’s Continued Fight For Justice Faces Election Of A New Humboldt County District Attorney

It has been five long years for the family of David Josiah Lawson, a black student at Humboldt State University now known as Cal Poly Humboldt, who was tragically stabbed to death on April 15th, 2017 at a house party not far from campus.  The Lawson family has advocated tirelessly for a resolution to the case, which they allege was severely compromised by police mishandling of the crime scene, and further missteps in the process of evidence collection and gathering of witness testimony. 

After five years without a conviction in the homicide of the student, the Lawson family and the community at large have seen the changing leadership of three Arcata police chiefs, two university presidents, have heard from several investigation consultants and detectives, and one extensive, damning independent Police Investigation Review.  Adding to the changes and indeed the challenges that so much passing time has brought to the community, the county’s electorate is poised to vote in a new District Attorney who would potentially inherit the case.  

With the nuances of science further complicating the investigation process for a small-town police department that already struggles to address complicated crimes with limited resources, Ms. Lawson expressed a mix of hope and frustration during a phone interview this week.  Speaking candidly, her faint Jamaican accent came through clearly as she expressed how happy she was to hear of the changing of the guard at the county’s District Attorney’s Office.  Lawson was anxious to see how this may impact the potential prosecution of a suspect for the homicide of her son. Lawson told us, “I want to know they will be the voice for victims and their families. Whoever is elected to be the new DA – we’re going to hold them to the highest standard.  We’re going to hold them accountable, just like we did Maggie Fleming.” 

She added, “I know there’s no perfect District Attorney. I understand that. I know there’s no perfect law enforcement officer. I understand that. But Humboldt County needs a District Attorney that have integrity, that care about the people of the community – especially the black, brown and indigenous community.  We need leadership to care about that small percentage of people in Humboldt County.”

Reflecting on the length of time that has passed, Lawson wondered if the outcome would have been different if the roles had been reversed. “I still cannot believe it has been five years, and still no justice. They have the evidence to prosecute and to hold my son’s murderer accountable. Why is it taking five years?”  Holding back tears at times, she vowed to “get justice for DJ, and for Humboldt County,” because she said “there are so many murders swept under the rug in Humboldt.”  With the current Arcata Police Chief Brian Ahearn standing firm on his department’s evidence pointing to one suspect, Kyle Zoellner, the Lawson family and members of the Justice for Josiah Committee remain focused on that one person as the culprit in the death of Lawson.  The fact that DNA found on the knife was confirmed to be of Lawson and of Zoellner, but also presented an unidentified combination of DNA in addition, leaves room for speculation and doubt as to who else may have had contact with the weapon.  Zoellner has also filed a lawsuit against the City of Arcata, alleging false arrest.   

In response to our inquiry for feedback regarding the future of the Lawson case in light of the District Attorney’s role soon to be filled by a new Prosecutor, DA Maggie Fleming offered this insight:

“Ethical District Attorneys simply work on cases as they arise, they neither pre-determine cases to prosecute nor delay action on any cases that should be prosecuted, using the fundamental guideline that cases should be charged when doing so serves justice and when admissible evidence creates the expectation of convincing a jury of guilt.  Under evidence-based – as opposed to political – decision-making by District Attorneys, cases are not “passed” from one DA to the next.

The currently available evidence in the Lawson case has been well-presented by the Humboldt County District Attorney’s Office to a criminal grand jury, which chose not to indict anyone.  The grand jury’s conclusion does not affect the potential for future prosecution.  

The case remains, unfortunately, one of many open homicide investigations in Humboldt County.  The District Attorney’s Office continues to communicate with the Arcata Police Department (APD) on the investigation and has recently joined APD in encouraging the California State Attorney General’s Office to provide additional investigative resources.  The District Attorney’s Office immediately charged someone in the Lawson case when police reports indicated prosecution was possible, but testimony at the preliminary hearing contradicted critical content in the police reports.  We remain ready to effectively prosecute any homicide whenever the evidence allows.  I hope the Humboldt County District Attorney’s Office will retain an ethical approach to charging and the capability to effectively prosecute homicides after my tenure as DA ends.”

Regardless of who the prosecutor is, Charmaine Lawson is determined to see a resolution to the matter, telling our reporter in a phone interview that she has coordinated with the City of Arcata to meet with California’s new Attorney General, Rob Bonta to discuss what can be done.  Not only is the City of Arcata supporting her request that the AG weigh in on the case and ideally take on the prosecution of the matter, but according to Lawson, the effort also has the backing of legislators from CA’s Second District, both Jared Huffman and Senator Mike McGuire, who was recently appointed as California’s State Senate Majority Leader.  

A letter signed by both the City Manager of Arcata, Karen Deimer, as well as the Chief of Police, Brian Ahearn, was delivered to the AG’s office in late January of this year asking for assistance in prosecuting the case. This is the second formal request, and mentions the outcome of the Criminal Grand Jury which declined to indict anyone in the spring of 2019.  The letter specifically noted that the Arcata Police Department had taken the case back for further investigation, and states in part that the department does recognize that as a small department, that it lacks the resources and “depth of expertise” needed for the case. 

The long-awaited meeting between Lawson’s family and AG Bonta is scheduled with the AG in Los Angeles this week, and Arcata’s City Manager will be in attendance along with Charmaine Lawson and members of the Lawson family. Congressman Mark Takano of the 41st District in Riverside County is also supporting Charmaine Lawson in her quest for justice in the five year old case. 

Charmain Lawson told us by phone from Los Angeles prior to traveling north for the 5-year memorial anniversary, “[T]here is no interest in solving DJ’s case in Humboldt County. So I had to reach out to the Attorney General to let him see that we have the evidence. It is there.  But because of the bias against my son, justice has not been served.”  While the meeting is sure to offer some insight to the family in regard to what may or may not be done on the part of the State Attorney General, the path forward to obtain justice is muddied, if not riddled with obstacles.  

Witnesses of the April 2017 tragedy are asked to call, anonymously or not, the Arcata Police tip-line at area code (707) 825-2590. In regard to receiving public input and potential witness statements, Police Chief Ahearn previously invited witnesses or people with information to reach out to him directly, offering us this statement. “The Arcata Police Department Dispatch phone number is (707) 822-2424. My cellphone number is (707) 601-6943. Also, the attached Public Service Announcement is Facebook compatible. Please help us get the word out that we need people to come forward.”

This is quite startling to read in the context of the pending litigation by Zoellner. The remainder of Zoellner’s lawsuit, which is set for trial in July, is essentially an argument regarding the charging summary that Arcata Police Detective Eric Losey prepared and sent to the DA. 

That report contained an inaccurate summary of a witness statement and there is argument as to what role that inaccurate information played in the DA’s decision to file charges against Zoellner and as to whether the DA learned of the inaccuracy before or during the preliminary hearing. This quote seems to directly comment on that.

I can’t even imagine the loss that this family feels. What happened that night might have been captured on a cell phone video, or eyewitnesses may know what happened. But the Arcata police department botched the investigation , if it was over their heads they should have contacted superior authorities immediately. They should have gotten a hold of everyone’s devices at that party. Once again, I am sorry for your loss.

Why isn’t there one source that lays out all the evidence, cut and dry and still speculative, for the public to consider. As the public is hammered with cries of foul from both sides, these actions are affecting the integrity of both our trust in the police as well as the future of our hiring processes within, so it’s deserving. From what I’ve seen, the doubt is more than reasonable, but certain parties insist otherwise. What aren’t we seeing?

And what was botched by the Arcata Police? There are facts missing? Obviously someone is guilty of taking his life. And after five years who has guilt on their hands? Could it be someone so close to Josiah that wasn’t considered and they are acting too innocent? Could it be that like other cases I have read about the person was not considered because everyone thought the person was too unlikely to have been the suspect. Everyone has motive if only the truth were known. Motivation is a slippery slope.

No parent should have to suffer the loss of her child. I’m sorry for her pain.

With that said, the most logical scenario I can come up with is that Josiah (based on court testimony) punched or shoved a woman, got in a fight with Zoellner, and Elijah Chandler tried to stab Zoellner but stabbed Lawson by accident.

Chandler spent the days after the stabbing pointing the finger of blame at everyone else. A skinny little white guy marched into a party to fight everyone? No one at the party got cell video of the incident? Really? Anyone actually believe that?

I think Chandler has a lot of karma coming his way.

thats interesting about chandler i looked into this case extensively and i never heard that theory but certainly when josiah lawson and the other 2 brothers were beating the shit out of kyle 3 against one- a fact which is established in court- anybody could have stabbed him. in my old neighborhood when 3 people jump on one guy, all hell could break loose. anybody who doesnt like that kind of behavior might step in… theres no way to say for sure without some more eyewitness testimony or confessions i suppose. if somebody asks if you stole something, try not to make a race war out of it. sorry for all the friends and family members who have suffered through all of this needless tragedy. https://lostcoastoutpost.com/2017/apr/27/eyewitness-alleges-police-emt-racism/

Can’t be sure because so much speculation has been brought out and all the case information is not shared with the public. But I seem to remember Lawson saying she had a video or tape of some kind that proved who killed her son, but was waiting to reveal it. What ever happened to thay tape? Anyone else remember that ?

When I saw the initial booking photo, I was thinking the same thing. This actually had nothing to do with tweakers, unless you include the drugs being taken by attendees at the party. Your so called “tweaker” is actually a young chef coming home from work who had his chef knife set out in the car. He didn’t attend the party was there to pick up his girlfriend, who did attend the party. He ended up going in the party to look/ask around for his girlfriend’s missing phone. He didn’t go in there with a knife. He got jumped by young amped up dudes and either someone tried stabbing him and got Josiah by accident or Jo got stabbed by someone trying to protect Zoellner. This had nothing to do with race unless you assume race had something to do with why Jo and the other boys jumped Zoellner. (By the way, Zoellner’s girlfriend is a native american and Zoellner is the furthest thing from a violent kid as you can get – kid who likes to sit in front of his computer for hours gaming. Josiah was known for getting into fights and it’s interesting that Josiah’s social media was wiped clean of any photos or references to his past fights soon after his murder. He definitely did not deserve to die but tragedies happen and he may not have been completely without some responsibility. It’s BS that this got blown into the narrative of a another racist killing. That’s was not the motive here.

this is a case of poor journalism fanning the flames of divide and conquer and doubt as directed by the masters of the new world order. this direction is put upon us so subtly through covert means that people have a hard time seeing it, or realizing that they are brainwashed and socially engineered by the banking dynasty and allied criminal families. PARIS WRIGHT testified under oath “im not gonna lie kyle zoellner was being respectful when asking about the missing cellphone.” he also testified that he ‘had a hard time pulling josiah lawson off of kyle zoellners unconscious body’ which josiah had in a head and body lock,and again pariswright stated under oath in court that he ‘was worried that josiah lawson was going to kill kyle zoellner.” i could go on and on about this. paris wright was promptly kicked out of the Brothers United fraternity for telling the truth in court. i wasnt there but at least i took the time to read the court transcripts. according to one Grand Jury member i think i recall him saying that they thought maybe kyle did it, but without evidence how could they charge him. and he also said that even if kyle didit, there was plenty of evidence for self defense. certainly black people are killed for no reason by white racists and cops and police error but personally i dont think this case is a very good example. the football team was cancelled shortly after this due to cumulative impacts of riverside attitude. who will tell the people? nobody wants to say the things i have said here. sorry its not my fault i wasnt there all of this is hearsay but go ahead and look into it for yourselves if you really care, which actually, in my opinion you dont. because if you did you would already know 5 years later. its just like 911- 20 years later you still have questions about that? obviously you dont really care enough to try to figure it out which isnt very difficult, and i think youre racist as hell for not speaking up about the truth of it, which is opposite of “muslims did it.” of course im very sorry for the needless loss of life over this ridiculous bullshit.

I have been compiling publicly available documents related to this case and have transcripts that cover the testimony of several individuals at the preliminary hearing. I looked back through the transcripts to find the testimony you speak of.

The testimony about Zoellner’s behavior being “respectful” was actually from Kyle Castillo, not Paris Wright. This is what Kyle Castillo actually testified to:

Q. And in no way Kyle was aggressive towards you or anybody else.
A. No, he wasn’t. I ‘m not going to lie . He was not at all. He — he didn’t even — you know, he didn’t seem like he wanted a problem, anyway. 

The testimony you describe about Lawson being found holding Zoellner in a headlock was from Paris Wright and what you describe seems reasonably accurate to the transcript. There was somewhat lenghty testimony to that so I won’t post the quotation here. If there is interest in full transcripts, I can make the available.

So, for the semester after this party, BU was everywhere silencing anyone who asked about the multiple conflicting testimonies. But Paris was marked after his honesty by BU. Uncool, unkind, unnecessary.

Paris was an honest, affable and very participatory fellow student in the classes we shared. He was into speaking truth and being straightforward even when he would later change his mind due to new information he hadn’t had before.

He spoke truth as he saw and understood it. And sometimes, he was wrong. But he owned that when it was proven he was in the wrong (in class, etc.). His testimony turned the case into a true mystery for me.

I believe Paris expressed what he saw or experienced. I actually liked talking to him after class, because wrong or not, he was as honest as one could be and always hated liars, because “I was lied about a lot as a child.”

Elijah was a bully and a bit of a hothead. He didn’t bother me, but I only ever had one class with him. I was not a party kid, but did a lot of tutoring and worked for a retail computer and support company (married older student guy).

I never knew Josiah, but he had raised heck with people at the Greens, where my wife and I lived, a couple of times. I am sad for his mother, and nobody of his age should be dying of stab wounds. RIP.

In all honestly, knowing those parties, I cannot rule out someone drunk or high stabbing Josiah with intent or not while he tried to apparently kill the tweaker kid.

Kyle has been busted for possession of meth and his mom has been arrested 3 times for the same charge. you can thank the republican team John Chiv for that info. if you think Humboldt has a meth problem, visit pretty much anywhere in Contra Costa County and rethink that thought.

wheres your empathy for kyle getting beat down horrifically for no reason 3 against one, and then charged with murder without evidence? hes probably going to get money from the county anyway whether people like it of not. im sure its very difficult where to draw the line regarding peoples sympathies as a moderator. but thanks for allowing people at least some kind of freedom of speech, and josiahs mother has a right to try to get more answers too. i hope her persistence pays off somehow. one thing i usually say about people that die is “at least they lived.” josiah lawson no doubt had good qualities and i remember it was said he wanted to be a cop, but that was later changed to him wanting to be a lawyer… lord knows god rest his soul and its too bad he had to die over some bullshit.

No parent sends their kid to college expecting them to die. No one goes to a party thinking they’ll get stabbed. But the posthumous sainthood of Lawson is ridiculous. He attacked a guy at a party AFTER assaulting one of the women. He didn’t deserve to die for that, but he was no innocent victim.

She refuses to acknowledge that her son and his friends were beating the hell out of the dismissed accuser and that after extensive review there was inadequate evidence showing he was the person who stabbed her son. She blames the police, the judge, the da, the grand jury and the city of arcata and refuses to accept that her son was the lead attacker and instigator. The arcata police bungled every aspect of this crime. From mishandling evidence, to not controlling the scene, to letting other people access evidence and scene. Pointedly, tainted evidence is no evidence. Failure to control scene reduces most every aspect of witnesses. Maybe not the cops fault, as they are not routinely exposed to murder scenes with a chaotic surrounding is enough to put small town individuals in more of a defense mode, as opposed to taking control. I also believe arcata council greatly contributed to the unsolving by not supplying the personnel to adequately address every aspect. If you do not properly train employees, and you don’t give your employees the personnel they need, how can you ask your employees to do a good job? They can’t. I blame arcata for cutting budgets for public safety, very, very, irresponsible, at the expense of all involved

I talked to the secretary of the lawyer that was defending Hansen. The statement was:
Your brother shot you – in sort of a question tone of voice.
The answer in disbelief was “He did!”
Interpreted by the DA as an answer that her brother shot them.
The person who told me this heard the recording made of the Hansen girl. In other words she did not say her brother shot them She responded in surprise when the questioner said her brother shot them.

There was $200k paid out from the city of Arcata in civil suit , plus monies were set aside for reward, and a MURAL. The lawsuit admits no wrong doing per say, but payments were defined as “compensatory damages.”

Life is a crap shoot . Your kid might make the right life choices. Or they might not. They might cross paths with people who make bad ones. And law enforcement routinely botch investigations . We can’t go back.

At some point Charmaine will hopefully stop writing shit-stirring press releases, spun and regurgitated by compliant “journalists,” and just do with her time what she would have done if the events of that night hadn’t happened , but now with the benefit of a couple extra $ hundred G.

This horrible case has always wreaked of racism. If it had been a blond girl who was killed, they would have turned over every rock.
The legacy of the KKK in McKinleyville and north coast has left a stain on our county.
I used to think it was only the deep south that was prejudice.
But that disease is epidemic in this country.
It needs to be confronted and rooted out.
Teach your children well.
