‘No Permits, No Plants,’ Says Humboldt County Sheriff After Assisting in SoHum Raid Yesterday

“In case you forgot… #nopermitsnoplants,” the Instagram account of the Humboldt County Sheriff’s Office stated in the announcement yesterday. The photos included with this story went along with the post.
Although, the Sheriff’s Department didn’t say where the raid occurred, reports from residents in the area indicate it occurred near Harris, roughly east of Garberville.
“The Marijuana Enforcement Team is back in action,” Sheriff Billy Honsal posted on his Instagram account. “Just a reminder…. no county or state permit…we will be paying you a visit.”

I think the sheriff will be very busy this season, judging by the soil and supplies getting hauled.
National Guard still going to help out this season? They could keep a platoon busy just in my neighborhood.
The one industry that has caused some prosperity in Humboldt… it becomes legal, so they make it almost impossible to get a permit and then go around destroying the crops that don’t have a permit…. IF the County would get their act together and make it easy and quick to get a permit and then make it not terribly horribly expensive, the entire county’s financial situation would improve in one season. I see insanity going on here. Other places have had success. Wake up, Humboldt County leadership. YOU are the problem now that it is legal. YOU are the ones ruining crops by making almost impossible to get permits. YOU SHOULD be assisting the businesses and helping them in every way to be permitted and prosperous and causing our local economy to improve. (and I am not involved in any way and do not use the stuff, either).
When the supervisors have their and their families fingers in the green pie of course they’re going to shut it off and make it difficult.

You can’t wait until legalization put a crunch in your bottom line to get all pro-business. Humboldt Co officials have never been pro business as much as they were the clients of a few important people. And you were warned about the government and the fact that while it might treat illegal activity casually, it will never be careless of its funding.

Humboldt hinterlands used to be great for pot growing when it was $5000/lb (inflation-adjusted historical price). Lower prices have exposed the shortcomings of growing pot in areas not suited for intensive agriculture. The marginal aspect of those lands was another reason land was affordable without a high volume of product back in the day. Welcome to the real world of agricultural economics.

The real s*** has already started hitting the fan. People that bought big rural homesteads or their second home / get away up north when the mkt was high 2014- 17 are having a great moment of reckoning. The pre-foreclosure and foreclosure rate is through the roof there are so many places on the Foreclosure market. And in desperate attempts to sell at any price people are slashing six-figure numbers off of the asking ; they are holding overpriced Parcels so their taxes are high from the start, their mortgages are high, the market has plummeted by at least 40% , and it’s getting harder and harder if not impossible to squeeze a buck out, anywhere.

Do people actually think that magically 1 yr into legalization the farmers in Humboldt all support themselves 100% through legal weed sales ? Please wake up. And give me a break.
The elephant in the room is the bottleneck in the distribution flow. The white Market growers aren’t able to get their stuff to the consumer, and even if they could we are growing multi-fold what can be consumed in California so it’s obviously going somewhere.
All that aside, I wasnt sympathizing or defending anyone upside down now in a huge mortgage with drastically reduced means, I was only pointing out that those declines and foreclusures are a harbinger of what is to become the norm for some time. The rural housing/acreage inventory is exploding while values are plummeting. This is going to take a while to recover. Will there will be some loosening of enforcement on the part of water board and even the county? Who knows?

Before we see a lot of whining in print about this, you will need to get your permits, and most of your legal ducks in a row, before setting up your 9000 plant grow… Also note, you will need to comply with all environmental laws, water and fish/wildlife law, and follow all applicable labor law, pay minimum wage, and, pay your taxes too!
It’s a business, just like you all always wanted! You can’t get $5000/lb, or, probably, even $1500/lb, but, it may be worthwhile, yet, to grow a large amount of “stupidity weed”… It was recently posted on this site that a person should expect a “profit” of $100,000 on a $1,500,000 crop… 7% does not seem like a reasonable return, for this kind of investment, when you consider all the attendant risks. Maybe it beats working a job, I don’t know…

Ahh no , we wanted it to be like the business of selling tomatoes, or camomile. We didn’t want laws that favored the former megagrowers and captured regulation to drive the vast majority out of the market under threat from a hired military force.
This off-season prices held better than they have for years! People are getting $1600 for deps and $1850 for indoor. Yes the price will be lower this fall but but it looks like it will be better than previous years going back quite awhile. I’d say there are not too many growers, just too many giant growers.

I can only hope growers have to go thru all of the same processes and costs as Green Diamond. In fact, I think you have a great idea. In addition to your permitting process, I think it would be absolutely fair and right for each grow site to have to go thru a cannabis harvest plan like the timber harvest plans, along with the hearing process and mediation plan for traffic, noise, etc. awesome idea!!
No timber harvest plans for under three acres so…if small marijuana growers had the same rules then they would have it easier than they do now.
Maybe that’s because 3 acres of trees is not going to be commercially viable, so will not be a likely reason for greedy misuse of the environment, will not use water diverted illegally from creeks or hopefully and there’s damn few blackmarkets for logs where profits are sold to avoid paying taxes. While I have seen some improvements to the timber industries because of laws and public pressure, still clear cuts abound… and old growth is disappearing… Why does the timber industry do this extensively anyways? , If They sustainable harvested tracks, left a varied canopy, left some of the smaller trees, they wouldn’t have to necessarily “replant” with fire prone tree farms. The remaining trees would grow to be merchandise able age sooner. The forest ecosystem would be healthier, the fire danger would be less. I am actually seeing this implemented on some level, but I also see a ton of clearcuts still.. And the herbicide use.. that is outstandingly under-regulated..
I would actually like to see some of the fees and taxes they charge the Timber industry, I seriously doubt they implement $10,000 a DAY for a undersized culvert.. I met a couple who wanted to buy land, and have a 600 square foot grow to supplement their income, and provide personal smoke. According to them, they ended up finding out that permits are for grows much larger than that, and you cannot have a new grow unless it is located on prime ag soil. Only parcels with evidence of having broken the law, and had an illegal grow prior to 2016 can get a permit outside of prime ag soil. I was going to sell land to them but there was never an illegal grow on it before, and its not “prime ag soil”.

Spikie- Better check that out again. The “legalization” proposition we passed contained language that made it superior to the medical Prop 215. Any contradictions between the 2 props would be referred to the new state agency created by the new prop and resolved. Guess what? They have resolved that there is now no medical in CA….They said we don’t need it because now we have legalization! Perhaps I am wrong? Please somebody prove me wrong. There is no 99 plant medical exclusion any more- we voted that away…to be “free” and “safe”.
There was never any codified California 99 plant allowance. The completely unofficial 99 plant limit came about merely as insurance against the Federal 5 year mandatory sentence for 100 plants or more. As a nod to practicality, State prosecutors generally went along with that dotted line rather than attempt to individually sort out the validity of prescription volumes.
215 (and 64) merely allow(ed) for the doctor to prescribe whatever amount is medically determined to be appropriate and one must (then and now) be able to justify in court the amount you are growing against the prescription IF forced to do so. There has been no change to this between 215 and 64.
Correction…you DID mean to say Doctor “recommends” and not Doctor “prescribes”… Because as long as it is illegal Federally NO DOCTOR can legally write a prescription for medical marijuana without risking their professional status as a Doctor.

County technically has no written limits on medical square footage with an amount reasonable to your condition on parcels over 5 acre .

They explained is a three-prong needle; the county doesn’t care so much about square footage of your personal, or for that matter your medical . (On parcels over 5 acres) the 150 is up to 1 acre . 250 of to 5..but then u also have to go through the needle of the water board and fish and game. And in my opinion the waterboard you have to watch out for. (One water board goon told me you can’t use the water to water more than 6…per parcel!) ….but now I’m hearing that medical should be covered under domestic use and is exempt ( that was from one of the agencies that works with the water board) well hopefully we’ll get to the bottom of all this .

That may well be a particular County/Local requirement, post 64 — but it’s not a requirement of 64 itself. The Prop 64 mandated limit is the same as with 215 … based on Doctor’s recommendation with no plant number limit other than that.
My county (Mono) requires registration (trivial) for medical grows (those over 6 plants) and for two years straight now there have been multiple registered and out in the open 99 plant medical grows in the county without a single issue. Neighbors have asked about it at BOS meetings and the County has told them that all it legal with both State and County on this.
Again, the 99 plant number became the ‘defacto’ limit to stay under the Federal 5 year minimum sentence for 100 or more plants. It’s not a state thing.

When you get your card at the Humboldt health and human services department you have to give them your doctor’s recommendation. A 99 plant recommendation will not keep the county from giving you a 215 card.
Also why would a doctor put themselves in a situation that doesn’t follow the law of proposition 215.
Also why would an attorney put themselves in a bad position as to give advise pertaining to a 99 plant recommendation.
It was a Humboldt County Medical ordinance- 100 sq ft with a cap of 99 plants within that 100 sq ft. It was geared towards the indoor that was proliferating at the time.

Pretty massive op, this is the kind of grows they should be enforcing and not going after small people with a few plants or low square footage like myself. Under 1000 square foot they should leave you alone or give you a permit for 500-1000 bucks. Rediculous I hope they enjoy the slums that Humboldt county will be when all the small mom and pops leave to other counties and only a few mega grows remain that spend no money here. Big out of state money will buy them up aswell eventually and Humboldt will have nothing to show. Good freakin’ luck.

Personally, I think there needs to be something reasonable in place for 100 to 2500sq ft, in place, because that is the beginning of the smallest license you can get. In some counties you can actually get an indoor license for 500 to 1500sq ft of “indoor”. I don’t think it’s an easy license though. And it’s not because of that county, even if the county is reasonable, the state licensing process is not. The state is hell bent at protecting corporate profits and an illusionary tax base they think they have, and they are lossing revenues because of it. It’s way too easy for the big players to break the rules, and very difficult for the smaller players to even get a hold on a single permit..

John Ford as head of the Planning Department receives his direction from the Board of Supervisors. That’s how it is on paper. However we can’t help but wonder what goes on in these private strategy meetings and discussions behind closed doors. I imagine that the Supervisors are also interacting with representatives from the state, perhaps working out deals with them. The state wants control and knows that Humboldt County is an epicenter of resistance. Governor Gavin Newsom has assured friends and family members who have invested heavily in the new “legal” industry that he will do whatever it takes to insure returns on their investments. From multiple sources I hear he has some “5 Year Plan” to increase the regulated market while decreasing the Original Market. So there are different wheels spinning and we are not privy to how they intersect because it’s done behind closed doors, in private. Sound like corruption much? I see the individual county supervisors as equally corrupt as the state and busy protecting their biggest supporters who they have worked with in guiding permits through the county system. The video I shared showed 2 Autonomous men freely, without dictators over lording their every move and idea, building their own shelter, successfully and completely manually.

I have heard of no actual raids. I do have photos and some reports of National Guard coming over 299. But in spite of the rumors, not even a third hand account of a raid.
I traveled 299 on Monday and saw a staggering amount of National Guard vehicles with all kinds of equipment. I’m no National Guard Reserve but it looked as if they were preparing for some sort of large scale drill or exercise…. or raid.
Saw that too. Large military cargo type truck caravan. That was a first for me to see on the 299.

I saw this in LA, they have raided a bunch of grows in Riverside county as well. If they are getting warrants, there at least they are getting warrants. It seems like the Sherriff here has an idea they are not needed any more…??
If they are getting warrants it means they are stabilizing prices. Maybe even sending prices up. So now everybody is back in full this year and every year…forever. They can never win. For sure.. they cannot even enforce these laws in the urban areas. There are a huge amount of unpermited deliveries and dispensaries all over So Cal. They keep waiving thier fist saying.. They will get them alll…they never do. In fact, they just multiply.. Actually, I think to combat the “problem”, bring more folks into the Cali Market, (distribution, and dispensary side) and “truely legalize” it. I mean allow more permitted outlets. They are operating illegally anyway, Why not make it easier and affordable them to get permits, and increase distribution? I worked in the unpermitted dispensaries in San Deigo. Years ago, my boss had 15 store fronts and its just a whack a mole game. They hit a few, they close, then he throws a few more up. Shit sometimes they just re open the same store after enough time passed. He made millions and is still doing it to this day. Most of the people down there dont know or care which store front is the actual state regulated. Most just care about cheap prices. Humboldts over they are coming after everyone with abatements don’t matter how small they will get you. I thought I was so small I never would get a notice, small fish big pond. Time to leave this place the original market lives on and the road is bright ahead and they will never end the original market. We found a nicer place in Oregon where we can live in peace and grow our crops and raise animals and homestead. Have fun with the poisoned environment, and corporate grows. We want community where we can share resources and live off the land. The back to the land movement is over in Humboldt and all that is left is competition, greed, poisoned water sheds, and divided communities.
No doubt. This CAMP PAIN to fuel the 1% of growers at the cost of civil and human rights, and the economy is unreal. I have spent sometime in So Cal, and your right about the dispensaries. The stuff they have there a lot of time reflects how terrible quality it is. Price seems most important. I have a group of people there that truely appreciate my visit when I can, because even in a sea of compitition, they truely appreciate anything I can bring them.

Thanks I have really enjoyed your comments, aswell as farce’s comments. This really is a sad situation just trying everyday to stay positive. We have been thinking about moving to Oregon forever. This is just the push we needed and we just so happen to find a nice place for rent, heck we will even be able to plant in july and get a run in up there just gonna be alot of work, and then next year it will be business as usual.
Also in Oregon there are no marijuana felonies, which is nice.

The water issue for 6 plants is interesting. Am unclear about that. This, though, may well be where it pays off to have fought the agencies trying to take ALL the water! According to your situation, you may have water the state can’t tell you what to do with (non-jurisdictional water, like many ponds, and some ‘springs’). Still, good question. I will ask an attorney. Shocked by the raid, per the article? Not shocked at all. Just making the point, you seem to have missed, that when the HCSO says ‘No permit, no plants’, that is not true. Each household can have 6 plants. (Yes. the 6 plants are for ‘personal use’ and the greenhouse scene is definitely ‘commercial’).

Actually Farce, I think we have terroir.. because, I think that actually Cannabis plants preform differently at different elevations, because of the amount of UVB rays in the light.. it’s akin to coffee farms. The higher the elevation, the better the coffee is known to be. That is why I don’t like the fact they all want everyone to move to the bottoms. Cannabis preforms differntly to different elevations and moisture levels. Low bottoms are actually not the best place for Cannabis. That isn’t where a lot of Cannabis evolved. Maybe sativas, but Indicas came from the Kush mountains. People can fight Mother Nature true.. maybe hemp is better served as a row crop.. but in my mind Cannabis belongs in an environment similar to where evolved.. in the hills… Of course polititions know sooo much about how to farm cannabis..

I got a abatement notice for 700 square feet!!!! And the lawyer I saw said he dealt with cases as little as 10 plants!! I wish I was lying. If it werent true I wouldnt moving.

I live in a residential neighbor hood with city water in willow creek they sent out a ton of notices in the area alot of ppl I know got them aswell. We have been growing here for 5 years neighbors have been too. Wasnt complaint driven. We just found a new spot in Oregon and will be putting up a second run there by July 1st luckily. Goodbye Humboldt!!!
According to the ordinances, technically they can fine you $10,000.00 a day for 1 plant over 6… personally that is A HUGE reason I am so alarmed! Not sure if they will, but they might.. No oversight, no jury no judge no panel.. it’s a disgrace, it really is.. guilty before innocent… just sayin..

Um R-DOG no, I’ll give you a great example I knew this guy quite a few years back his trade was Heavy Equipment but he decided to dip his grow toes in the water. He grew lots of weed and a time when it sold for 3 or $4,000 a pound and lined his pockets and bought lots of equipment so he could make other money. His weed was never that fantastic. Then after awhile better product started becoming available more people were involved in it and he couldn’t really get rid of anyting. He was sitting on top of easily 200 lb contacted me and wanted to see if we could spin some bubble hash with it. Mind you this was 2 years post Harvest outdoor product by the time it ran through the bbs in spite of the finest technique it came out brown and like dry sand. There was no oily material left to it entire process wound up in the compost pile. He is passed away now but I will never forget that because at the end if the day schwag is schwag no matter how you package it, process it, or hype it up. So really depends on what it is. Truly, it doesn’t all sell eventually…

I could find a commentor a week for a year telling you politely your wrong, or crazy.

Unfortunately, it’s true… Internet free speech has been taken to a grey area of private domain. Kym is the “property keeper” here…. This is her blog, and I might challenge her sometimes to keep the integrity of a journalist, and maintain objectivity, it’s her blog, and I think she does a fairly good job of reporting on issues that Clear Channel conglomerates never will. Especially local news. I think reading Central and Brian battle is entertaining, way better that Fox News, Although TRB kinda acts like a bully sometimes… even though I appreciate facts.. I also appreciate different perspectives..
But it’s a difficult position to be in maintaining free speech. Personally, I don’t like rasist trash smeared everywhere, not to say it is here, or a anybody is..I am actually thankful it’s not.
Kym has deleted some of my comments too sometimes, and it’s a tough position, and she has let a few through that were a bit much, but I actually appreciate Kym gatekeeping because there are a lot of regimion racist bull out there, I personally am thankful to never hear.. And no matter what, who’s ever comment is deleted, someone might get “pissed”… Maybe a speperate thread, Brian vs Central… unabridged, take it outside and let er roll… reader discretion advised no zenophobic bull though… Just a thought lol.. I will have to say, I think Kym’s blog is fairly open, and I have been trying to keep to the rules a bit more.. A lot of the liberesqe forums out there have completely shut out alternate voices. I got completely banned from a Democrat forum for defending Jill Stein, no warnings.. So Kyms forum isn’t too repressive.. Just my 2cents.. Don’t get banned ya’ll. Maybe take it easier on Kym….
