Proponents of Eureka Housing Initiative Sue City Over Election Placement

Press release from Eureka Housing for All and Downtown Vitality Initiative:

Humboldt COunty cOurthouseMike Munson and Michelle Costantine-Blackwell, proponents of the City of Eureka Housing for All and Downtown Vitality Initiative, have filed suit against the city seeking judicial relief from the city’s apparent intent to improperly postpone an election on the Initiative until November 5, 2024. The lawsuit also alleges the city violated the Elections Code by failing to certify the Initiative at the City Council’s October 3, 2023, regular meeting.

The Housing for All Initiative has been placed on tonight’s City Council agenda. At tonight’s meeting, the council can take one of two actions: (1) adopt the ordinance directly or (2) submit the ordinance to voters. According to the Agenda Summary prepared by city staff, the Initiative would be placed on the November 5, 2024, ballot. According to the Elections Code, the city must place the Initiative on the March 5, 2024, ballot, the next statewide general (not just primary) election.

The Council can correct the mistakes and avoid needless litigation by voting tonight to adopt or place the Initiative on the March 5, 2024, ballot.

Once again, the incompetent Eureka city council Gets another Suit. I wonder why the city hall parking lot is all fenced off.
Are they going to turn that lot into a 6 story apartment complex 2? We need more housing downtown. They could put a parking lot in Myrtle town and used buses into Old Town to their apartment. Does the city council all live in old town and walked to city hall.

The City was following the law; it’s the entitled rich folks who can’t be bothered to follow it that you should be angry at.

This sue happy coalition should be called “We Are Stopping Progress”. (WASPs) is suing the city over a handful of parking lots and stirring things up with a ballot initiative that gained signatures with false information.

Mixed used live/ work in downtown is a great way to improve Old Town. And as for parking …. . Going to Friday Night Market this summer, I had to drive around old town an entire minute and walk 3 blocks to get to the fun. Other than ADA parking for busy events, I don’t see the need to halt progress.

Look at a zoning map and Eureka is pretty much built out within city limits. The Eureka school district owns the old Jacobs campus site and is selling it to the CHP. The Arkley initiative sure looks like a loophole to funnel money to WASP candidates in the upcoming city council race. Maybe WASPs Fullerton or Constantine will run again on their tired old anti progress platform.

The initiative was not misleading. It also states the objective. Stop crying about it. People who signed it and now dont like it are the same who would vote for someone like Joe Biden and komola harris.
build low income apartments on parking lots will make no parking for down town. The current curb upgrades also remove two parking spaces at each block. This is an anti auto program to get cars out of oldtown. So businesses will be less likely to occupy this new slum. The incompetents in city hall are doing this to compile with state and fed grand money.

Oh boy, wait until AB 413 goes into effect and there’s no parking within 20′ of all intersections! Then you’ll really have something to yell about!
