Ukiah Police Department Officers Tase, Pepper-Spray, and Punch Naked, Mentally Ill Man [Warning Graphic Video May Be Difficult for Some Readers]

Video footage of Ukiah Police Department officers pepper-spraying, tasing, and hitting a naked man with closed fists has drawn community ire with many seeing the officers’ use of force as excessive.

According to reporting by Justine Fredrickson of the Ukiah Daily Journal, officers were dispatched to the 1400 block of South State Street in response to reports of a naked man walking in the road. Officers found Ukiah man Gerardo Magdaleno when UPD Lieutenant Andy Phillips said he became “aggressive and took a fighting stance.”

Frederickson’s reporting on the circumstance indicates Ukiah Police Lt. Phillips believes Magdaleno was under the influence of methamphetamine. Phillips told Frederickson it is  “very common for people under the influence of meth to get very hot and take their clothes off. [Magdaleno] was taken to the hospital to make sure he wasn’t suffering from meth psychosis.”

Veronikita Diaz, Gerardo Magdaleno’s sister, told us a nurse informed their family that her brother experienced facial fractures and a concussion as a result of the incident.

The first video of the interaction between Magdaleno and a UPD officer begins with the civilian falling onto his back possibly due to being shocked by a taser. Magdaleno stands back up, seemingly dazed and argumentative when the officer apparently begins pepper-spraying him while yelling, “Get on the ground!”

The second video begins with Magdaleno surrounded by three UPD officers, two are pulling outwardly on his arms and another is trying to get control of his torso or legs. Magdaleno maneuvers out of that position and falls to the ground on his back. Two of the officers kneel down next to him punching his torso and his head. A fourth officer appears on the scene and the group of officers successfully flip Magdaleno onto his stomach to handcuff him. One officer is clearly punching Magdaleno in the back of the neck and head while three others dogpile on him in an attempt to subdue him. In the midst of the activity, a visible flash can be seen on Magdaleno’s back indicating one of the officers tased him while another continued to punch the back of his head. Finally, a fifth officer appears on the scene just as the struggle between the officers and Magdaleno begins to subside.

Mendocino County Sheriff’s Office Public Information Officer Captain Greg Van Patten told us that deputies have had several prior contacts with Magdaleno which he characterized as “possibly mental health-related.” Regarding yesterday’s incident, Captain Van Patten said deputies were dispatched to reports of a naked individual on Laws Avenue and South State Street, “right near the store” where the video was filmed. According to Captain Van Patten, deputies arrived at the incident after Magdaleno was detained and he demonstrated signs of “physical exertion being sweaty and overheated. Deputies gave him water to help him cool down.”

Gerardo Magdaleno’s sister Veronikita Diaz said her brother was under the influence of LSD during the encounter. She said he suffers from depression and “if he runs out of his lithium [a depression medication] he has a deep depression crisis and he tries to remedy with anything he can find.” She said that the Ukiah Police Department “knew him and his disorders well” and there “was no need for that.”

Diaz said, “Police brutality needs to stop. We are a small community. This could have been de-escalated very easily.

According to the Mendocino County Sheriff’s Office Booking Log, Magdaleno was booked into the county jail yesterday for charges associated with the videotaped incident. They included possessing drug paraphernalia, disorderly conduct due to alcohol, and resisting or threatening an officer.

Mendocino County Sheriff’s Captain Van Patten confirmed that on March 2, 2021 Magdaleno was booked into the Mendocino County jail for charges relating to sodomy against a victim under 10-years-old appeared. Captain Van Patten there was no District Attorney filing after Magdaleno’s arrest for these charges. 

A document from the Mendocino County District Attorney’s Office entitled “Local Defendants Removed to State Prison in 2017” indicates Magdaleno was given a 32-month prison term for “Resisting by Use of Force.”

Magdaleno was featured in the Anderson Valley Advertiser’s booking log column “Catch of the Day” for December 23, 2019, where he was supposedly arrested in Boonville for a community supervision violation.

We reached out to criminal defense attorney Andrea Sullivan, who has defended people throughout the Emerald Triangle. We asked her for her thoughts on the Ukiah Police Department officers’ use of force as seen in the video.

Sullivan’s primary concern with the first video was the officer not attempting to deescalate the situation. Sullivan noted that she did not see the lead up to the video, but the “officers use of f-bombs was clearly agitating [Magdaleno].” When officers deal with individuals experiencing mental episodes, Sullivan said, “[B]est practices say they should calmly talk with them.”

Sullivan expressed concern that at the beginning of the second video there were no obvious signs that the officers were attempting to handcuff Magdaleno. She said they appeared to be “beating someone for the sake of beating him.” Sullivan was especially shocked that an officer began to tase Magdelano while other officers dogpiled on him because “other officers can be injured” when they are physically touching someone who is being tased.

The Ukiah Police Department’s Policy Manual has an entire section dedicated to use of force concerns. Section 300.3 dictates that “officers shall use only that amount of force that reasonably appears necessary given the facts and totality of the circumstances known to or perceived by the officer at the time of the event to accomplish a legitimate law enforcement purpose.”

When assessing the “reasonableness of force,” the policy says evaluations must “allow for the fact that officers are often forced to make a split-second decision about the amount of force that reasonably appears necessary in a particular situation.”

Policy 302 requires the establishment of a “Use of Force Review Board” in which UPD will “objectively evaluate the use of force by its members to ensure that their authority is used lawfully, appropriately, and is consistent with training and policy.”

Policy 302.3 says that when an employee’s actions result in death or very serious injury to another the employee will be placed in a temporary administrative assignment.

Ukiah Police Department has faced public scrutiny in the last few months after former Sergeant Kevin Murray was dismissed when accusations emerged of his involvement in a November 2020 incident of sexual battery, burglary, and drug possession resulting in charges being filed with the Mendocino County District Attorney’s Office. A second set of charges were filed one month later accusing Murray of rape and forcible oral copulation in 2014.

We reached out to the Ukiah Police Department for comment last night via email with the intention to publish at 10:00 a.m. if we did not get a response. Over the phone this morning, Lieutenant Andrew Phillips told us that a press release would be published by noon, and in the interest of including UPD’s perspective, we chose to hold off. At 1:00 p.m. Lieutenant Phillips emailed us, apologized the press release was not ready and said it would be ready in “an hour or so.” As of 2:27 p.m.the press release has yet to be released so we have chosen to publish it because an important story can get buried if it goes out too late on a Friday afternoon.

The man was non-compliant its clear. But he was not aggressive, he was standing still. I couldn’t tell if he had his fists clenched, but he was not holding any weapons and obviously didn’t have any hidden. What about talking to the guy to assess the situation? It looks like he was walking away from them when they tased him. I didn’t see any conversation, just the police escalating the situation.

The article says they have a file on him and his mental illness. They have had previous contact with the man. Did they automatically jump him using force based on the notes in the file and/or experiences they have had with him? Not really an excuse for escalating the situation immediately but it could have something to do with why they did.

I just don’t see how a naked man is such a threat to the police who are “armed and dangerous”. Everyone knows to proceed with caution when the police are around. Mentally ill people regardless of whether or not they are on meth, don’t always know that. Being high on meth with or without clothes is also not a reason to tase and beat a person.

A 5150 call is one of the most dangerous calls for LEO’s to make…There’s no safe or easy was to contain people in this condition…5150 refers to the California law code for the temporary, involuntary psychiatric commitment of individuals who present a danger to themselves or others due to signs of mental illness. It has been more generally applied to people who are considered threateningly unstable or “crazy.”

he was naked on the street he is clearly not a coward. plus there were no children with him. the previous arrest is “alleged” and in this country one is innocent until proven guilty. We do not have any facts other than he was charged. Save your judgement and punishment for the time when/if he is proven guilty. I know the story of the video-augrapher she was at work and saw a naked man who was getting tased and mased by the cops so she pulled out her phone and started recording it. If you pay attention to the news there is also another person that was parked across the street who recorded this also. After all this happened the girl from the store called me and I posted this online. In no way should our officers who are there to protect and serve our community be acting like a bunch of thugs beating up an unarmed person, punching, kicking and even tasing this man after he was already down on the ground in cuffs! Thank god someone got a video of this happening. Kinda makes you wonder how often this does happen when nobody is around to record it and blast it to the media.

Ok lets not start badmouthing LSD. This guy is the furthest thing from an LSD trip. Very few LSD trips end in naked fights. Naked OK but its not a promoter of violence. Lets leave LSD out of this one and focus on the fact that a guy with a previous rap sheet was found naked and combative. Deffinitely may have some mental issues and those are tricky at best. Pretty sure they could have arrested/ apprehended this chap with less violence and certainly less harm. This guy has a pretty dicey past no matter how you address the convictions. Sodomy is an act of aggression no matter how its performed.

Perhaps you should spend some time on the front lines and educate yourself with first hand experience before opening your mouth and expressing thoughts in regards to a situation I’m pretty sure your sheltered life has never provided! Mental health assistance such as medications, placement, and therapy is always provided and offered to individuals within the system and those looking to receive help, especially in this Liberal controlled state! If you were educated you would know Its actually the law, and no ER would “turn him away” in fact they are forced by law to provide help even knowing it will be short lived and go no where….. all at the tax payers expense!!!
The problem is with COMPLIANCE!!! Most unstable individuals are non-compliant with medications and prefer street drugs and street life over sobriety and stability! So reality check yourself…. nobody forced this person to have a bad “trip” and make more bad choices he made the choice himself! If he truly wanted help or wanted his medications he would of had them!

First responders know drug induced psychosis and paranoia causes “super human” strength in people that can cause serious harm to those intervening!! Perhaps PD they should let a “good samaritan” intervene with their alternative tactics next time and watch them learn this lesson first hand, bet there unrealistic opinion of tactics used would change dramatically!!

This is why people talk about defunding the police. De-escalation should be the first response in situations like this. “Punching”? Screaming “f-bombs”? These behaviors are absolutely unacceptable from those sworn to serve and protect. There are no circumstances that justify this police response to a clearly unarmed (naked) and disturbed individual.

That was just stupid. The cop reminded me of a scared yapping little dog. The guy was obviously not all there but didn’t seem to be actively attacking him or motivated to do so. Yeah he fake punched, but he was so out of it it looked like a joke. Screaming like that just made it worse. The punching afterwards was not necessary. If you’re that scared wait for back up before escalating it.

Yes it’s always police brutality when viewed through murky video – by leftists. I was in the L.A. during the 92 riots. People killed and businesses burned to the ground all because a career criminal would not do what police told him to do. Saint Floyd was flying on various drugs when he was taken down last year. His heart gave out. He was already going to die. He said “I can’t breath” long before he was “brutalized.” Yes, anxiety and drug use cause career criminals (Saint Floyd brutally attacked a woman and had a long felony rap sheet) to have problems with breathing when they are caught passing fake bills (also a felony). What we SHOULD be talking about is simple: why are the mentally ill on the streets taking LSD when they should be with their families, in a nonprofit home, etc.? Why does society have to be degraded by their actions? People CHOOSE to take drugs they cannot handle. Libs blame those who have to clean up the mess. There would be no mess if people took responsibility for their actions, or their friends and families took care of their own. If someone is violent on a regular basis, then lock them up to protect society. Instead, we blame the messenger and the result is the revocation of liberty and the destruction of society. If you are always looking for bad cop behavior, you will find it. If I spent all day long following the Bored of Stuporvisors around, I bet I could jot down dozens of little infractions, and a few felonies too. They did, after all, repeatedly violate our Constitutional rights with the scamdemic.
Stop blaming those who have to clean up your mess, libs. You made a permissive, out of control culture (starting in the 60’s), you are now seeing the consequences of your selfish, arrogant, anti-American choices.

Well said! Unfortunately we have turned into a society where no one is held accountable for their actions. Those who have to deal with the fallout from drug abuse are blamed for what others perceive as mishandling of the situation. What if the cops just ignored this behavior and that person harms or kills another innocent person; then they would be blamed for not doing their job. Police can’t win in today’s world.

People high on meth, bathsalts, synthetic MJ, LSD, and anything are unpredictable. While I sympathize with this persons sister if she knows that he runs out of money or whatever to get his meds then she should step up to help him and not expect the police or anyone else to step in to do the job. We as first responders cannot force anyone to do anything but we also have a right to protect ourselves and go home to our families. He has choices albeit he is making unhealthy and unsafe one he has them – he could have gone to the emergency room or a clinic to get a prescription for his medications or get himself admitted to a healthcare facility.

Enough with the blaming first responders – they are doing a very difficult job and if you think you can do better go get the education required and step up!

In this instance it looks like the UP could use more training and so have more confidence and less emotional reaction. I don’t see any reason to punch him so much after getting him under control.

How hot was that pavement? We are issued warnings about protecting our dogs paws from hot pavement, but a naked man under the influence of LSD should just lay on the hot pavement willingly.
UPD needs mandatory training in de-escalating situations with mentally ill persons and those under the influence. The naked fellow had no weapon, as they could clearly see.
Facial fractures and a concussion? I’d get a lawyer if he were my family member.

It’s hard to understand this behavior until you know someone you care about who suffers from mental illness. He needed help, not a beating. It would have taken more time but the original police officer should have tried to de-escalate the situation. Let’s fund every police department so they have a mental health squad ready to respond to these kind of incidents. Trying to knock him unconscious by repeatedly punching him in the face and head as he lay on the ground was definitely over-the-top excessive, even if he was out of his mind. All officers should be educated with mental illness de-escalation techniques. Next they should train Jui-jitsu and learn how to subdue someone without the beating.

Wow, what I see is resisting arrest, verbal demands with failure to comply, then pepper sprayed with failure to respond, and attempted taser, least invasive moves, then the naked man is coming towards the officers after Asked to get on the ground, wow, too much here in the video, instruction, instruction, instruction !!!!!! No compliance and even if its drug induced psychosis, it’s a fact that a person can have double the strength and adrenaline going, can have and do have the ability to fatality assault police officers, nurses, doctors, staff on the regular…..and they do, speaking from experienced as a medical professional…. take downs rarely go according to plan, personally I have been hit, kicked, charged, and more in a controlled setting…. by men just like this, unpredictable and drugged….. sorry mental illness does not excuse a person from protection of themselves, and that does not exclude police officers….. I’ve witnessed unprovoked assaults on staff, resulting in permanent injuries, by men similar to this one…. pretty soon the idea of policing will be walking away, and the public will have to deal with men like this, at the rate we are going, then we will see reality and mayhem….
If Hitting the head is a tactical response, I don’t know about that but maybe it is….remember when police officers die it’s noble and commended, but if they are using their words and getting no response, and the person comes towards them and not complying with intent, hands on are normally the next step, even in other settings…..remember somebody called the police, naked man on the street and acting inappropriately, I’m assuming and police are not sure what the man has taken, or how altered he is…. family members have lied to me about patients and there personal diagnosis’s, and it’s not up to a police officer to make these judgements, just listen to details and continue to seek containment in the moment… so yes education is our best friend, but remember professionals get hurt everyday by the ones you call innocent or mentally ill…

In mental health situations t we don’t lay hands on them and oftentimes just watch. Keep him safe from his self and others. That’s the biggest duty here when people are not mentally right is to get them to place where they can be protected until they’re sober again or can be put somewhere for their safety. That doesn’t mean beat the shit out of them ,knock their teeth out, give them skull fractures and brain damage. Then throw them in a cell handcuffed face down. Anybody ever had a skull fracture before? Live to tell about it? Does the benefit outweigh the risk? If beating him will better all then beat away. The officer’s hand…would be interesting to look at fracture points and forces required to produce injuries.
Is it TRULY smart to have police forces punching people? Boxers wear gloves for a reason.

I work in healthcare and have been physically attacked and verbally assaulted by patients who are “ not in their right mind” and it is inexcusable. There are laws that now protect personnel in emergency rooms and icus from patients regardless of reason. Done of these protections should be in place for law enforcement as well.
Glad you non mental health can just standby and watch but if that is the future of healthcare then I after forty years want no part of it.

Cheers to you. We have to explain to our foreign exchange students and the parents we sponsor the process of our legal system. It can be difficult explaining to a European parent of a mentally handicap individual that the police broke there son’s jaw for not providing his identity fast enough.

In this case. Implied immunity is what they hide behind. At that point everyone from the phone manufacturer the video was taken on all the way to the communications equipment used to convey the urgent call to hurt a citizen all become fair game. Did he stumble on a crack in the pavement? Was it a prior complaint on the crack?

It’s a pretty shocking video until you continue to read the story and find out this guy’s background of raping a child under the age of 10 not only a month ago but he’s even out on bail for it at the moment.

After finding out this guy raping little kids all that contempt for the police kind of just washes away and you feel like the tax dollars are being put to good use.

I’m proud to Back the Blue!!! The disgusting and disrespectful language and actions towards law enforcement is sickening considering the hippacritical people that mistreat law enforcement are usually the FIRST to call on them when they feel threatened, offended or need help!
If this guy was intimidating them, violated their children or family I doubt there “deescalation” tactic ideas would be sufficient! Have you ever tried to rationalize with someone on Crystal Meth or LSD in psycosis state?????
Not a single person who complains about law enforcement has the actual courage to go face to face with danger, instead they hide behind judgement like cowards until the time comes that they actually need police help…. who would you call if this obviously drug induced psychosis individual ended up in your backyard? I’m failing to see a problem with this encounter. Far simpler solution comes to mind instead of spraying chemicals all over messing with the environment when the suspect would not comply with the officer’s orders to get on the ground.
