[UPDATE 4:04 p.m.] Gas Station Attendant Charged With Homicide Acted in Self-Defense, Says HCSO

Humboldt County Sheriff’s Office investigators have determined the suspect of last week’s homicide in Blue Lake acted in self-defense.

On July 2, 2020, at about 9:45 p.m., Humboldt County Sheriff’s deputies were dispatched to a business on the 200 block of Blue Lake Blvd. in Blue Lake for the report of an armed robbery with shots fired. Deputies located an unidentified male subject outside of the business with a gunshot wound to the chest. Despite lifesaving efforts, the man succumbed to his injuries on scene.

Upon initial investigation, deputies learned that the male subject was the suspect attempting to rob the business. The man approached an employee, later identified as 39-year-old Mark Anthony Nelson Jr., and a patron, who were outside of the business. The subject brandished what appeared to be a firearm and the two fled. The man entered the store and proceeded with the robbery. The man was later shot when he exited the business.

Humboldt County Sheriff’s Criminal Investigators responded to the scene to begin their investigation. As part of that investigation, investigators interviewed witnesses and served a search warrant at the business. During the search, deputies located a stolen firearm which had been concealed inside the business. Investigators also reviewed surveillance footage depicting the inside of the business. It should be noted that the business did not have functioning surveillance cameras outside the business, where the shooting occurred, thus complicating the investigation.

While providing an initial statement, Nelson Jr. denied shooting the robbery suspect and provided information inconsistent with the evidence at the scene. Nelson Jr. also denied possession of the stolen firearm. Through further investigation, it was determined that Nelson Jr. made efforts to conceal the firearm prior to law enforcement arrival. A bullet consistent with evidence collected at the scene was located in Nelson Jr.’s pocket during a search of his person.

Based upon evidence gained through the investigation, it was determined that Nelson Jr., who is legally prohibited from possessing weapons, had been in possession of the stolen firearm and had used the firearm to shoot the robbery suspect. With consideration of all these investigative pieces, investigators arrested Nelson Jr. for violations of murder (PC 187(a)), possession of stolen property (PC 496(a)) and convicted felon in possession of a firearm (PC 29800(a)).

Investigators continued their investigation in the following days, re-interviewing subjects and further examining evidence. As part of this investigation, associated electronic devices and vehicles were searched.

On the evening of July 5, the Humboldt County Sheriff’s Office was contacted to file a missing person’s report for 53-year-old Jeffrey Allen Kirwan of Santa Rosa. Based upon the facts of the missing person’s report, investigators determined that the missing person may be the unidentified decedent from the robbery and homicide in Blue Lake.

The decedent of the homicide was later confirmed as Kirwan through fingerprints.

On July 7, Nelson Jr. agreed to provide an additional statement to investigators. While speaking with investigators, Nelson Jr. admitted to shooting the robbery suspect and asserted that the shooting was in self-defense. This statement was consistent with the investigation and evidence located at the scene.

Based upon the continued investigation and the totality of evidence reviewed to date, investigators have determined Nelson Jr. to have acted in self-defense. Nelson Jr. will be released from the Humboldt County Correctional Facility pursuant to PC 849(b)(1).

Additionally, through further investigation, deputies have determined the decedent, Kirwan, to be a possible suspect of a recent robbery at a Trinidad business. The investigation into that case is ongoing.

All information collected through this investigation will be submitted to the Humboldt County District Attorney’s Office for review and a final determination of charges.

UPDATE 4:04 p.m.: Press release from the Humboldt County District Attorney:

Humboldt County District Attorney (DA) Maggie Fleming has declined to prosecute the employee of the Patriot Gas Station in Blue Lake for killing the person who robbed that business on the night of July 2, 2020. The employee has stated he acted in self-defense. No witness statements or other evidence contradict that assertion. The employee also stated he possessed a gun in response to a recent prior robbery at his workplace. In reaching her decision before the person arrested had to be either charged or released – within 2 court days of their arrest – the DA benefitted from a complete and efficient investigation by the Humboldt County Sheriff’s Office.

I agree this is good news, but the 2nd Amendment absolutely had something to do with this. If the US had never guaranteed our right to keep arms, there would be no guns available to private citizens, and this fellow would not have been able to defend himself.

The right of self defence and possession of the best tools for that defense (firearms) predates our constitution which merely recocognises that right of the people.

On a side note the gun used was stolen. Was it not?

California’s useless gun sales laws only create a thriving black market where there is no waiting or background checks.

Our hero…even though he didn’t ultimately have to return, or do anything but walk away to save his life, he chose to return to the robbery in progress, become judge jury and executioner, and promptly pegged that mfkr in the chest upon exit. Commiting a robbery with a gun should serve as a GOOD LESSON for other out of towners, who think Humboldt is easy pickings.

He made a poor decision , and it cost him his life

Maybe people who like using guns will think about the consequences of threatening another human being with violence.

I’m guessing that the original story of the employee leaving the scene and then returning to shoot the robber was incorrect. It would be hard to be in fear of your life if you voluntarily returned. Good shoot afterall.

I agree that the DA made the right decision even though there are inconsistencies. Good Luck to Mark!

However, it should be pointed out that Thirdeye’s funny “Karen” jab promotes divisive racial stereotyping. It’s easy to laugh at the mental image of an entitled Karen but if there were a “Kesha” or “Maria” meme it would be denounced as racist.

If he was white, he’d still be in jail. He is a felon WITHOUT the right to possess a firearm. Read that again because its the law.
But somehow the spineless District attorney doesn’t want to touch this “political BLM hot potatoe scenario” even if the felon is GUILTY of parole violations. Why make laws to protect society when no justice system wants to enforce them?
The law is the law but now with any black person who commits a crime in Humboldt we have to walk on eggshells to not draw attention and rage of the BLM agenda. This is total BS!!!
I’m happy that the scum Kirwan is dead because of his criminal activities and KARMA (oh my heavens!!!!) He was a threat to the safety of society.

What makes you so sure? Nobody was marching in the street for Mark. Looks like the case was considered on its merits and there was the extenuating circumstance of the store he worked at having been robbed recently. A token penalty for the weapons violation would be appropriate. Let him return to being the productive, positive citizen he was before this episode.

if they pursue the gun charge he can take it all the way to the supreme court (if they will hear him) and he can get gun rights back for felons (at least not violent felons). i dont think they want to open that can

I agree with you… I am a citizen of blue lake and we heard the shot thought it was fireworks then the emergency siren went off seconds after… Within 30 minutes of the news coming out I had over 10 different people who do not even live in the community who have just used the gas station there call me and say they surely hope that it wasn’t Mark that got shot

The next morning when the news came out and we saw that Mark had been arrested for murder we got together a group of citizens who went and hired him a lawyer and the investigator team in his defense as we believe the California has laws that go against citizens constitutional rights of being able to protect themselves… We believe that Humboldt County is a dangerous place and that with the catch and release system here in California that citizens are constantly being attacked and can do nothing about it. The police can’t even put the habitual offenders behind bars. The legal team and the friends of Mark who don’t even know him but just know that every time we went to the patriot Station he made us feel better than any other employees ever have there… We band together and if the county wouldn’t of came to the conclusion that they would’ve more of us would’ve united against the cause for Mark… I am so happy for him and hope he returns to work or continues to make people smile and feel good about life whenever he may go. I hope he uses this experience to help others even more than he was. Mark you are a real one and I hope you spring forward and flourish from this.

This is the right conclusion to the case. Law enforcement did their job correctly based on the facts they had and the investigators did their job and sorted through discrepancies. This is textbook self defense regardless of Mark’s initial statement. He most likely convoluted his story out of fear but did the right thing and told the truth. The violent robber that was terrorizing the community would still be out and very well may have murdered an innocent person if he hadn’t been stopped. Mark is going to live the rest of his life knowing he took someone else’s and even though he, in my opinion, is in the right it’s a heavy burden. Good luck to him moving forward.
