Is It a Sign? Hoopa Tribal Chairman Tears Down Political Billboard; Some Argue He’s Silencing Dissent
Political differences brought tempers to a head in the Hoopa Tribe on Monday when Tribal Chairman, Byron Nelson, tore down a sign protesting his policies on land that tribal member Virgil Pole says is his.
Pole’s daughter, Stevie, caught Nelson’s actions on video.
Virgil Pole argues that the destruction of the sign is emblematic of Nelson’s acts since being sworn in as chairman in June.
“He is overstepping his authority,” Pole told us. “He’s making decisions far beyond his position.” Pole had posted the sign protesting not only the recent firing of three members of the Hoopa Tribal Police including the Chief Dana Norton but what, Pole saw, as an entire overthrow of policies that had been put in place previously. He said he had posted the sign to express his political views and Nelson illegally removed it.
One side of the sign stated, “Attention by order of [Chairman] Nelson-The Hoopa Valley will no longer have its own police protection. Jurisdiction over you and these lands will now be under County Sheriff Honsal’s rule.”
The other side got more personal. It stated, “For Sale Sovereignty…For info contact B. Nelson Jr. between naps at Hoopa Tribal Office.”

“It’s all about drugs,” he told us. “Everything they are trying to project–about the firing of the police chief, the giving away of sovereignty…It’s just a smokescreen.”
He says that he is struggling to get rid of rampant drug use in the area. “I reinstated [random] drug testing for all tribal employees and tribal council members,” he said. “The past chairman had ordered it to not take place anymore. The first thing I did was to reinstate that.”
One of the issues causing tensions in Hoopa (like thoughout the rest of the Emerald Triangle) is cannabis. Nelson explained that he thinks his position on the controversial crop is causing some tribal members to fight his decisions. “I ran on the issue [of eradicating] the widespread marijuana grows on our reservation,” he explained.
Nelson said he isn’t against marijuana. “When I went to Humboldt [State College], I enjoyed that,” he told us yesterday in an interview over the phone. “I believe that everyone should be able to have their share of marijuana for household personal use. But a few people are advocating widespread grows.”
He believes those are his opponents. “These are the people that are fighting me,” he explained. But he says he isn’t worried. “I won by a large margin,” he told us. He said he has begun changing the tribe’s policies around cannabis issues. He told us, for instance, that though the last tribal chairman had stopped allowing Humboldt County to do aerial surveillance looking for large marijuana grows, he has reinstating that option.
He said that the firing of the three Tribal officers was something he couldn’t talk about because “that’s a personnel issue.” Though he did say, “The past chairman was still controlling [the now former] Police Chief by making calls and so forth.”
But in the main Nelson argued that the Tribe had to speed up getting the MOU (Memorandum of Understanding) with the Humboldt County Sheriff’s Office. “We couldn’t make arrests or jail anybody [with the tribal police force] the way it has been operating,” he told us. “They were like a security force.”
In a full page ad Nelson posted in the Two Rivers Tribune yesterday, he argued,
Despite all the fabricated outrage by a few tribal members over how our sovereign rights are being threatened by the county of Humboldt, this explosive issue can really be defined by one simple explanation: it is an effort by certain individuals to maintain our Tribal Police Department at an ineffective level so that they can continue with their illegal activities without any police oversite. Marcellene Norton, a former councilmember who says she worked in education for 33 years for the tribe–most of it as the education director–disagrees with Nelson. She says she believes that “Honsal’s agreement would give the Sheriff full control over Tribal Police.”
She argues, “[This would be] the tribe giving up their sovereignty…Under federal laws, our tribal police have jurisdiction full authority to enforce laws.” She alleges that if Sheriff Honsal would just agree to allow those arrested by tribal police to be put in the Humboldt County jail, the tribal police could operate independently of the Sheriff’s Office. “I understand the trouble is with Sheriff Honsal,” she claimed. “All we need really is a booking agreement with the County.”
Last week, Norton organized a meeting to discuss concerns about the firing of the Police Chief (a relative of hers) and another officer. (Since then a lieutenant has also been fired.) “I was amazed,” she said. “At least 100 people packed into this small room–both Indian and non Indian because tribal police jurisdiction affects everybody both Indian and Non-Indian.”
She said that some residents were threatened that they would be terminated from their jobs for going. “One officer said [during the meeting] he was told that if he attended…, he would be fired,” she told us. “People are afraid of losing their jobs.”
Other local residents we spoke to mentioned they were afraid of speaking out publicly about their concerns with Nelson’s decisions for fear of losing their jobs working for the tribe.
The video of Nelson destroying the sign reinforced Marcellene Norton’s fears. “I couldn’t believe it when I saw the video,” she told us. “That’s destruction of private property and it’s against our freedom of expression…I can’t understand his behavior and I can’t understand why the council is just sitting there. They have the authority to reprimand him and the authority to remove him…Now we are facing a dictatorship…The community is becoming very outraged about what is happening here.”
She feels that Nelson and the Tribal Council aren’t addressing the real issues of opioid and hard drug addiction on the reservation. “It seems that the council and the chairman want to focus in on the marijuana–and they are not doing anything about the heroin and meth,” she said. “Hoopa has the highest distribution of opioid drugs [per a Humboldt County report]…Those are the serious problems we have here on the reservation and I haven’t seen Council addressing the problems.”
But Nelson argued in his ad in the Two Rivers Tribune that the fight against him is a fight against the children of the tribe and their future.
…Ultimately it is the children that are hurt the worst from the drug
epidemic in our Valley. The money that goes into maintaining a drug high is diverted from the amount necessary to care for the children.Drugs also lead to domestic violence which affects the children in so many damaging ways….So remember, all this hatefulness directed towards me, is not about the firing of the police chief or that I am giving away our sovereign rights to the county. It is about maintaining the drug industry in the valley. And for me, it really is about protecting the children of the valley, and for those that have yet to come.
But Virgil Pole, who posted the sign on what he believes was his property, said he sees the Chairman tearing down it down as silencing his voice and stopping his right to peaceful protest decisions he feels are harmful to the tribe and its police force that was just beginning to recover from years of turmoil.
Chairman Byron Nelson, who argues that the sign was slanderous and was posted illegally on a public utility pole, said, “I got more compliments from doing that than anything.”
But, he added, “I won’t do that anymore.”
A new sign has replaced that taken down. It references fears that some tribal members have expressed that Nelson will terminate the jobs of anyone who might oppose him: “Your Safety expendable + at risk–Nelson threatens to fire entire firehouse.” (Note: No one has reported to us having witnessed Nelson making such a threat.)
As of this morning, at 10:20, the sign is still standing.

Dissent in any community is dangerous- just look at the US right now. But in a community that relies on kinship as much as some tribes do, it awfully hard to pull back animosity. Nothing outsiders can do but watch.
Marcellene was wrong in her statement that 100 people came out to support Dana, it was probably around 50 not counting children and at least half of those were only there to find out what was going on not to support anyone. Also the officer that said he was told he would lose his job had earlier stated that he “had heard a rumor” that if he attended the meeting he would lose his job he wasn’t actually told that from the new chief. I think Marcellene is blowing this all out of proportion just because her grandson was fired.
I disagree with you. Did you actually count the people. Two people counted people in the building and I understand several were outside because there was standing room only and it was very warm. The meeting wasn’t about Dana Norton; as the notice read it was about Direction of the Police Dept.

I actually did count people, and there were only 51 people INSIDE the building, again not counting kids! Whoever counted for you probably counted kids as well as the people who stood outside not wanting to be seen (one of which was one of your main supporters councilman Pole). And please, dont even try to pretend in any way that you are concerned about anyone else but your grandson. I think Chairman Nelson needs to get a grip reality. This guy is a few bricks short of a full load, and his nutty actions seem to point in that direction. The folks in Hoopa need to have him recalled before he goes completely power hungry.

Thank you “facts” for finally speaking factual truths and not just propaganda. I don’t agree with the personnel decision made with the previous Chief of Police, I feel he did a great job picking up our Police force that was in tatters. It’s a hard job to have to work with revolving council members and their personal agendas being forced upon you. However the former Chairman , Ryan Jackson, had fires a dozen Tribal employees without following proper Personnel Policies and Procedures and just claimed “sovereignty” which is his million dollar word he likes to throw around when he doesn’t have any intelligent justification on this actions. Just look at the huge Outsourced Lawyer fees that were spent through this run in office. Oh you might not be able to find that as easily since the Tribal Budget was kept secret instead of posted quarterly to the Membership like it is supposed to be.
Facts are Ryan was only a Valet in Sacramento and has no prior education or experience before running for Council that would have qualified him for the position. He got elected for being the “popular Joe” by having a large family to support him in votes. He reached out to many people for help in assisting him run the Tribe, so I don’t know why he’s slandering the new Chairman for doing the same thing but being straight forward and public about it.
My guess is he is just mad that now he doesn’t have the $2,000 weekly (or by-weekly) Council I come, his huge expendable Chairman’s budget to use as he pleases to buy votes from Tribal members. He doesn’t have a Tribal Cellphone, Laptop or Government Vehicle to use. But at least his girlfriend still has a Tribal Housing Unit that she got put in priority over many other members who have been waitlisted.
Last note, I agree with Marcellene that Byron needs to focus on the real epidemic with fighting the serious opioid epidemic that is really effecting our people in the valley. Get out of the old ages with the anti-marijuana campaign.

To the best of my knowledge, all three Guests are different people. It is the default name in the comment box so it gets used frequently. My preference is for people to use their real names, then my next preference would be a pseudonym that stays the same, followed by a pseudonym that changes, and then least favorite is to use one that is commonly used causing confusion.
As you can see, however, I’m not much for enforcing conformity to a set of rules.

I tried using my real name for a while, my first name that is. I would never post my complete name (Kim has it), believing as I do there are some seriously deranged people reading and posting on this site, and I live where someone could easily cause me harm without much risk to themselves. After posting with my real first name, a name no one else was using, someone came along and posted something nasty and used the same name as I was using (this happened twice). A troll? I don’t know.
I read Kim’s articles because I like to try to stay informed, and I care about our community. I read the posts because I like to (try to) understand how and what other people think. I post because no one else will listen to me, and I have something to say, like we all do.
I think Kim does a great and balanced job keeping everyone in line here. She has showed me that putting your best foot forward instead of just spouting negative bs is the best way to move thinking and ideas forward. Kind of like what my young hippy friends taught me. I’m surprised she hasn’t gone looney toons from running this site. More patience than I will ever have, that’s for sure. Keep up the good work, Kim, and thanks.

What is a large marijuana grow? This guy wants to tear down plants that were in the ground before he was elected. Back then it was legal. Now suddenly there is a helicopter flying over my 50 plants (for my whole family) and taking pictures. I’m worried now the Sheriff’s coming.For what? I was in compliance with everything before? Meanwhile, the doctors are prescribing pills to people he knows are selling them on the black market. Not to mention, everyone knows which houses are selling meth and heroin. Yet marijuana is a drug causing domestic violence, and child neglect? I say that because that’s the drug he is using tribal monies to fight. I have a question I’m hoping someone can answer for me. How much of the problems in the Hoopa Valley are the result of non-tribal members? I’m wondering, because a significant amount of the negativity around marijuana grows in Round Valley is from outsiders. I don’t want to hate on Bulgarians, but you all know what I’m talking about…
As far as drug dealing goes, a large portion of the problems come from outsiders. This political mess is straight up Hoopa tho! #notmytribe #sadlyitis #overit

I grew up in Hoopa and I am a Tribal member. I remember the sherriff’s presence always in down town hoopa and i have to say Hoopa was alot different back then, better than it is now. I do feel that depending on your family tribal police lacked being unbiased and transparent. And with all the drugs in the community now, maybe the sherrifs being back in town will help clean it up. At least they dont care who your family is or who your related too, if your breaking the law you get treated like everyone else. What has tribal police done to erraticate all the drug dealers in the valley? What was the plan to better our community with all the federally deputized officer’s we had? Our community, our council, our cheif all need to work together not against one another if we want any kind of future for our children.

I’ve only skimmed the article and I don’t really have a side I’m taking in the tribal dispute. Pretty much it’s not my business.
However, I do want to comment on the irony of censorship. Until the signs were torn down, the only people who would have seen them are those driving that road. Now thousands, maybe tens of thousands will see them. Chairman Nelson might as well have hired a public relations firm for his opponents.

Three Council persons held separate District meetings. All saying they never saw documents or heard what was taking place with the police Believe it?
Joe Davis posts daily scriptures to facebook, but stood up in his District meeting and told the crowd how he don’t know anything about Police problems and never saw or read anything. We know Byron promised Jude’s Uncle Keith Hostler, if Keith’s family supported him and he was voted in he would reinstate him back into his Manager position because he had been demoted. Byron did try but it may not have happened for whatever reasons. Now he lets Keith harass the employees and spew evil about the new Director.

Haha haha, at last someone brought up one of Ryan’s political hires! Creating a position for his Brother Norvin Jude Hostler (Ryan’s sister’s husband and Ryan’s mentor aka the “Trooth Surum, “Joe Blough” and possibly “Slipperiest Eel” and the ultimate henchman and online bully), who ran another department into the Red for so many years failing at his job and using it to support his hobby of Hydro Boat Racing. What’s better? He got a $20,000 increase in pay with his new “lieutenant” position. Hmmm…now I wonder why the new Chairman let him go as well? He wasn’t even certified or qualified. All he knows how to do is pay a lawyer to do his paperwork for him and make him look smart.

Leilani’s husband commented on someone’s post how byron shouldnt act that way as a council representative yet when his wife was jumping down a tribal members throat for expressing their own opinion on facebook he didnt say a word then. I went to Marcellene’s meeting and thought it went well… but I was curious why Ryan’s nephew wasnt there? Considering he may be next on the chopping block you’d think he would be there supporting his uncle and ex boss. I heard hes been playing suck up to Chief Masten and cutting off his own uncle’s, now that Jude was also let go. Personally I think what happened to Jude was wrong, hes a tribal member and should have been given a chance! Dana isnt Hupa, neither was that other guy Hoss. Let’s worry about our own people first, I’m sure we have qualified tribal members that can take up those positions. Council needs to do better at supporting us tribal members first. I thought little Bobby Kane was interested in the chief of police job? Hes a tribal member at least.

Or his alleged relationship with known drug dealers, that seems like a big no no to me. Anyway, I’d love to see some kind of follow up from you, love reading your stories! I would caution that people can make up whatever they want and say it without proof. I’d take everything in the comment section with a block of rocksalt unless you have proof otherwise. The Flat Earth theory even gets brought out occasionally here. So please read critically.
