Supreme Court to Decide If Federal Gun Ban for Marijuana Users Violates Second Amendment

Cannabis firearm gavelYesterday, the U.S. Supreme Court agreed to hear a case that could decide whether people who use marijuana can legally own guns under federal law.

At issue is a long-standing federal rule that bars anyone who is an “unlawful user of or addicted to any controlled substance” from possessing firearms. While that includes all illegal drugs, it also applies to cannabis, even in states like California where marijuana is legal.

The challenge argues that the rule violates the Second Amendment right to keep and bear arms, a right the Supreme Court has interpreted more broadly since its 2022 decision in New York State Rifle & Pistol Association v. Bruen. That ruling emphasized that the Second Amendment protects the right to own and carry guns, and said any gun law must be consistent with that tradition.

The case, United States v. Hemani, began after FBI agents in Texas found a handgun, marijuana, and cocaine in the home of Ali Danial Hemani. The Fifth Circuit Court of Appeals struck down the law as unconstitutional when applied to Hemani, saying it could only apply to people who were “presently impaired.”

Federal prosecutors with the Trump administration are urging the Court to restore the ban, arguing that habitual drug users with guns create safety risks and that the restriction has roots in early American laws disarming people considered dangerous, such as “habitual drunkards.” The Scotusblog writes that U.S. Solicitor General D. John Sauer argued the law,

“imposes a limited, inherently temporary restriction—one which the individual can remove at any time simply by ceasing his unlawful drug use.” Second, [Sauer] wrote, the law “stands solidly within our Nation’s history and tradition of regulation” of firearms, a key inquiry in determining whether gun restrictions are constitutional. Sauer characterized the law as “a modest, modern analogue” of early American restrictions on the possession of guns by “habitual drunkards.” Third, he added, “habitual illegal drug users with firearms present unique dangers to society—especially because they pose a grave risk of armed, hostile encounters with police officers while impaired.”

Hemani’s lawyers countered that while some early laws barred people from carrying weapons while intoxicated, they didn’t disarm sober individuals for past or occasional use. The Fifth Circuit agreed, saying there was no historical basis for stripping gun rights from someone who isn’t under the influence.

The same law was used to convict President Biden’s son, Hunter Biden, last year after a jury found he had lied about drug use when buying a handgun. He was later pardoned by his father.

The Court’s ruling could have far-reaching effects in places like the Emerald Triangle, where many residents, according to state law, legally use cannabis but still fall under federal definitions of “unlawful users.” In rural counties, such as Humboldt, Trinity, and Mendocino, gun ownership is common.

The case will be argued early next year, with a decision expected by summer 2026. For now, the federal ban remains in effect nationwide even in the Fifth Circuit’s jurisdiction, meaning marijuana users are still prohibited from owning firearms even in states like California where cannabis is legal.

Some mental health diagnoses will keep you from owning a firearm. Or even a driver’s license. That’s one reason why some people resist getting treatment for something is the fear of having a license privilege pulled due to a diagnosis.

The case the Supremes are hearing came out of Texas.
California comes up because that’s where most of us are reading this from, and our State has decriminalized the possession of weed. Plus as mentioned, our region grows weed, possesses weed, and guns, likely at higher per capita rates in combination than anywhere else.

The truth is CA doesn’t really regulate your gun unless you get caught breaking the law with it. Pop into Nevada and buy any magazine, or accoutrements you want.
If you want to get mad at the State of California over a real issue of “Taking”, Consider your notional outrage at perceived gun restrictions, then compare the reality with what CA has done with commercial trucks. Any truck over ten years old is pretty much not allowed on the road unless you get a lawyer and pay to file a restrictive exemption. Doesn’t matter if it has low miles, or cost you $100,000. That is over a very theoretical abstract notion of “excessive deaths” attributed to air pollution. Meanwhile, we cannot seem to muster that attitude over the very concrete excessive deaths from $200 firearms.
Besides, if we applied science instead of stigma, pot users probably have a better safety record than the general public as far as gun ownership.

MUCH more likely an authoritarian fascist regime. It has taken the R party 50 years to get here, but, as a minority of individual voters, they’re finally here and they have no intention of letting it go. And I’d ask the same question – “does our Constitution mean anything anymore?” Separation of powers? 1st Am.? 4th Am.? 5th, 6th, 8th, 14th? I’m all for the 2nd Am., and I’d lay long dollar my collection outshines yours, but not for the nutbag open and concealed carry cowards who are just puffing themselves up.

Jan 6, 2021 made it abundantly clear that Trump cares nothing about American Democracy and human rights. We saw the videos and watched the Hearings. If Trump calls forth his Flying Monkeys for a Third Term, what then? The October, 2023 attack on Israel revealed citizens trapped in their bomb shelters with no personal firearms to speak of. Trapped like animals while the police are minutes, hours, or days away. It’s not a democracy if the losing side gets to attack the Capitol with impunity. I hope the Republicans are happy. You got your madman and no riots like when you lose. Oh, happy day!

It’s very simple.

Felony? Once you’ve served your time and successfully completed parole, by all means, a felon (violent or not) should be allowed to own and carry a gun and also be able to vote and enjoy any other right of any other US citizen.

If the Founding Fathers had a problem with people using laudanum, opium, hemp, alcohol, cocaine or any other substance in use at the time of the Constitution’s ratification (or being a criminal, wife beater, crazier than a shit house rat, or any other reason) and owning a weapon, they would have included that disclaimer in the second amendment.

Since they didn’t, any law, federal, state or local, prohibiting ANY US citizen from owning or carrying a weapon for any reason, is a violation of that person’s second amendment rights.

There is controversy over who sees what, when someone scans your drivers license.
Theoretically, everyone who owns a registered firearm, who has their license scanned or info recorded at a dispensary has set themselves up for firearms confiscation and possibly prosecution.
A quick AI sift of firearms purchase records, matched with dispensary purchases would be all it would take to seal your fate .

I didn’t know about this law.
But I do remember the issue with Hunter Biden. At the time, I thought it applied to “illegal” drugs, chemicals . I didn’t realize it applied to all federally categorized drugs…
Yes, that provision needs to be revisited, especially with so many states legalizing pot.
It seems anachronistic.
I don’t think it could boil down to politics, either.
As many right wing republicans use pot as do democrats.
But I could see orange try to skew this as an anti blue issue.

Pot simply needs to be removed from the list of federally prohibited substances. It is long overdue.

At a time, I would have said that there was a double standard – alcohol being legal and pot not – based purely on profits. Follow the money. Alcohol was legally profitable, whereas pot was not.

But now, big business is involved in pot. They are raking in the dough.

With capitalists involved, we’ll probably see the laws change swiftly.

It is immoral how alcohol is so readily pushed and advertised as socially acceptable.

So many, many lives have been and are being destroyed because of alcohol. Yet it continues to be flaunted as a perfectly reasonable practice.

I understand the prohibitionists of the 19th and 20th centuries.

They saw the catastrophe of the use and abuse of alcohol.

It is far more dangerous than anything grown from the earth and should be very stringently controlled.

It’s bogus, the state has nullified the federal prohibition of “marihuana”, but the federals assert control over a basic right to armed self-defense, where you are required to incriminate yourself or face federal charges for making false statements. This is how the Siskiyou Sheriff limits CCW to his pals and exclude those in political disfavor (Cannabis users). This goes far beyond something like reckless use of a firearm WHILE INTOXICATED.
