Cal Poly Targeted by Trump’s Civil Rights Office Alleging White, Asian Discrimination

The Trump Administration’s nation-wide effort to reform higher education by cutting federal funding for institutions with DEI policies is in progress. This week, the Department of Education’s Office for Civil Rights (OCR) has opened investigations into 45 universities under Title VI, focused on the schools’ “civil rights obligations to end the use of racial preferences and stereotypes in education programs and activities,” according to a March 14 press release by the Department.
According to the press release, Cal Poly Humboldt’s graduate program is among three California universities-UC Berkeley and Cal State San Bernardino are the other two–which have landed on the wrong side of the Trump Administration’s overhaul of higher learning institutions – all of which it claims have discriminated against students on the basis of “race, color, and national origin”.
These investigations cite use of any Diversity, Equity and Inclusion (DEI) policies and programs as problematic. According to the “Dear Colleague Letter” referenced in the press release, DEI efforts are misguided and harmful to college campuses. The press release compares the policies to racial segregation and warned that DEI programs are reminiscent of America’s past mistakes, stating, “In a shameful echo of a darker period in this country’s history, many American schools and universities even encourage segregation by race at graduation ceremonies and in dormitories and other facilities.”
As Cal Poly Humboldt takes stock of the latest development from the feds, the University has not had time to respond directly to the press release. Instead, Cal Poly Humboldt has offered this statement from the California State University Chancellor’s Office.
The CSU has recently learned of the investigations and will be reviewing and seeking to understand the nature of the claim and will cooperate with the Department of Education Office of Civil Rights in any investigation. The CSU continues to comply with longstanding applicable federal and state laws and CSU policies and does not discriminate or provide preferences on the basis of race, sex, color, ethnicity or national origin.
CSU remains committed to fostering an inclusive and equitable learning environment that is open to all. CSU respects the diverse opinions and viewpoints of our students, staff and faculty.
Alice Finen, a local teacher and alumni of HSU who was a vocal advocate of pro-Palestine student protests on campus (which have been cited as “antisemitic” according to a complaint on behalf of “Student A” submitted against CPH by the Brandeis Center recently) Finen told us, “I do not believe that Humboldt discriminates against white or Jewish students by prioritizing minority groups through DEI. I believe and know that DEI makes CPH stronger, safer and better for everyone. The more diverse population we have on campus the more opportunities we are all provided.”
The Department of Education’s Office for Civil Rights press release asserts that the 45 schools have discriminated against prospective or current students by participating in an educational DEI program. Specifically looking at one graduate studies program in particular, the Office of Civil Rights (OCR) says “by partnering with “The Ph.D. Project,” an organization that purports to provide doctoral students with insights into obtaining a Ph.D. and networking opportunities, but limits eligibility based on the race of participants,” these colleges are infringing on the rights of students. The Ph.D. Project, as described on its website, “encourages and supports historically underrepresented candidates on their journey to acquiring a PhD” via “conferences, mentoring, and networking.”
The “Dear Colleagues letter” reads, “American educational institutions have discriminated against students on the basis of race, including white and Asian students, many of whom come from disadvantaged backgrounds and low-income families. These institutions’ embrace of pervasive and repugnant race-based preferences and other forms of racial discrimination have emanated throughout every facet of academia.”
In the press release, U.S. Secretary of Education Linda McMahon stated, “[This] announcement expands our efforts to ensure universities are not discriminating against their students based on race and race stereotypes.”

These colleges are teaching nothing but agendas and it needs to be stopped!!! White, black, Red, Yellow all need exact same treatment or it IS racist. Why is this fact so hard for ppl to understand. Divide and conquer is the oldest trick in the book and the polarization of our children and the indoctrination in to identity politics and eugenic programs is appalling. Colleges and universities ought to be able to consider other factors — including that some students were academically disadvantaged based on living in a school district with limited resources.
I’ll believe the anguished cries of “treat everyone the same” are sincere when they start advocating for all schools to be equitably funded and all children to have equal educational opportunity — because that’s not what we have now.
Well it’s true, people always scream about protecting the minority, when the fact is, white people are the minority, we should keep our nations protected at all costs and not allow people to scam us out of the little we have. There aren’t even a billion white people in this world, when there are billions of everyone else.
Prior to 1492 there were maybe only a handful of Portuguese, Picts, and Norse who ever got shipwrecked on North America. Now the USA’s 350,000,000 person population is 58%white. So I’d say white people have gained a pretty good representation in these parts.
Spaniards had been tearing things up in the southeast/gulf region of the US a while before the Mayflower landed to settle… millions of people had to be “cleared out,” subjugated or murdered before we were able to establish a white population on this continent! Lest, we forget.

My daughter is very white, was the only senior in her rural white school, and yet had no college readiness training, no college counseling, and had to travel for two hours to take an SAT at 7:00 on a Saturday. None of this helped her outcomes. All these were because administrators just go through the motions, and try to get to the end of their day and don’t care, or have adversarial attitudes towards their students. The 7:00 am SAT time wasn’t to harness student excellence, it was to get the test proctor back to their weekend. There was no security justification, and indeed, after it was too late for my kid, testing was allowed at their own school, and now SATs are considered of low value, and culturally biased anyway. (Before you get your lily white panties in a bunch, remember “culturally biased” works against poor rural white kids too. How many SAT questions are about skiing, versus the weight of a steer?)

What you seem to be saying is that a test trying to be able rate the readiness of all eligible students nationwide was designed to disadvantage your daughter because it wasn’t adapted to her small rural existence? As evidenced by using sking in questions rather than steer weights? That her school was so small it only had one person in the whole senior class but still shouldn’t have disadvantaged her by not offering college readiness training? Or college counseling? Or have required her to travel two hours to take a test starting at 7am?
And this is evidence that all the brouhaha about race misses the point that it’s economic status that is the major discriminatory factor? Not race at all? Despite the fact that there are Asian children of immigrants- presumably not wealthy- complaining that race quotas limited their access?
So, in a world where education above high school level doesn’t have the capacity to teach every person who wants it, how do you remove these economic impediments?
My point is that the factors keeping an average citizen’s kid out of higher education today is economic not racial. My daughter’s case might be tangential. In her case it should have been simple to offer some guidance. The principal’s kids got into great schools. At any given highschool in Marin County she would have had a pack of counselors paid to pay attention. Left to test scores and economic means, where do you think the student body of a university in Arcata would come from? Where do they come from now? I bet it’s not Humboldt county. Cal Poly Humboldt should offer scholarship preference to local students. Fill up a quota of class room seats for Humboldt kids starting from best test scores and grades and working down. Only after those seats are filled, start with the best test scores of kids from Marin.That would be a form of affirmative action.
One thing that pops out if you look at reality is that these affirmative programs are more an issue of scholarships. If you can pay the tuition it’s not an issue. In our society white people (the majority) have greater means to pay, are more likely to attend university, and are less likely to be applying for scholarships.
Well I agree that local students should be a priority. But that kind of would mean there has to be some sort of university respect for the communities in which they exist. And that would be so unlikely a viewpoint from the Ivory Tower .
Admissions are still an issue. And calPoly is in the pell grant churning business. Maybe not Harvard or Stanford or Berkeley but in the vast number of lesser schools, there are much fewer private pay students. Maybe private pay would keep a student from being eliminated by being unable to afford school but denied admission? With Student loans and grants being so common and the attitude of most students so feckless about it, I doubt as if there are that many in that position.

Rural living presents its own set of unique challenges (as well as perks IMO!)
Considering that white male landowners were the only people eligible to vote in the U.S.’s not-so-distant-past, it’s short-sighted to divorce race from class completely. Yes, class struggle is the basis of the issue. Race as an indicator has always correlated with income level in this country, irrespective of merit. DEI programs help(ed?) underprivileged white kids, too.

nobody is asking these institutions and students for input toward racial integration, the changes are being instituted via threats and other destabilizing approaches.
meanwhile the programs they want to eliminate impact our tribes and the very Latinos this administration wants to round up and deport. the tribes have gone through it for 150 years. we’ve all read the stories about the slaughter, and seen the poverty. these peoples are finally getting their head above water and that process is helped by the university supporting native education, making coursework relevant to their lives. That doesn’t take one thing away from any other ethnicity being students there. it is not a competition.
Times have changed the stories. 100 or even 75 years ago, common stories in the US media involving Native Americans mostly told of murderous attacks against settlers by Indians, where settlers were depicted as seeking a better life and the Indians trying to keep them out of their territories by violence. It was war.
Now just try to find a mention of these in the story of the European westward migration. Indian massacres used to mean white people being killed by native tribes, isolated settlers being slaughtered. Now it pretty much is all white people killing Indians and no mention of the reverse. And no war. Only genocide.
However nowhere until the last couple of years has anyone tried to spin the story to equate that illegal immigrants are identical to Indian tribes and deporting such is the same racism that colored the earlier stories. You might be confusing the movie Dances With Wolves with History. Do you have an example of any contemporary non fiction book that is so one sided as to only portray settler aggression? Disney animated musicals tend to have really “Black and white” good-evil plots, but that’s not the totality of the information available to people.
Most up to date American history books I’ve read describe pre-European societies here as diverse, complex and often confrontational. They describe European societies as diverse, complex, and confrontational. The mixing of the two took place over 500 years, and is still ongoing. Splinters of European society like firearms, horses, and disease spread far ahead of actual European people through existing trade networks. Poor Europeans seeking opportunities were on the front lines clearing forests and trapping in neighborhoods that had already seen 200-300 years of local upheaval linked to new disease and new tools. The details are added to common knowledge every day from records, archeology…you can go stand in the Alamo, or Fort Quebec. History isn’t Liberal or Conservative, it just is. Interpret how you like, but pretending it didn’t happen doesn’t help.

Exactly! It’s always been more of a class-struggle in my perspective. Public schools are funded by property taxes, so wealthier neighborhoods with higher property values have more resources for education than the schools in areas with lower property values. Personal economic status has historically been influenced (if not dictated) by race in this country. Redlining… the struggle for suffrage and desegregation happened BECAUSE discrimination was written into the law originally. That is why DEI measures, the 1968 Fair Housing Act and more are critical to CORRECT the INHERENT imbalances that were integrated into our laws and gave White Americans more rights than non-White Americans for centuries. People are seriously brainwashed into thinking that it’s a “level playing field” out here ?

I agree. It was shown years ago that SAT and other “standardized” tests were culturally (and other reasons) biased just to begin with. That is, some questions were so regionally or culturally or language specific that nobody but maybe 3 people in the room would ever answer certain questions correct no matter how intelligent they were. Or anything with an essay when you have a student from another country, like foreign exchange students. This caused a lot of kids to get much lower scores unnecessarily just on how the tests were written. And of course, colleges put far too much emphasis on a number score than say, actually interviewing a prospective student and get to know them and see if they’re a good fit for a study program, or help them with their goals.

Just to clean up your history a bit, remember, Africans ponied up what the slavers demanded. Africans we’re not the ones organizing the sugar and cotton plantations across the Atlantic. Once trans Atlantic slave kidnapping was outlawed, Southern Slaveholders ramped up the breeding and sale of humans here domestically. It was quite a big business that increased up to the Civil war.

If people make up demographics to use as hostile rhetoric, they shouldn’t be surprised when people take them at their word. DEI has created such an institutional advantage that minorities not infrequently found their identities coopted.
But even earlier, the pushing of social generational quilt created such a desire to avoid it that enough white people pretended to be minorities. Especially native American minorities where it is so common that a word has been created for it- Pretendianism. But even in black communities there have been pretenders. Colleges and especially women in colleges seem to have been heavy into it.
It used to be the other way around. Non white people “passed” as white for the advantage. But no one can ever say that white people, especially white women, are not adept at the game. The old joke that denile is not just a river in Egypt applies.

Hey Darlene, did you happen to receive a college education and career, and retirement despite all the Ethnics? How did you counsel your non white clients? Tell them to go back where they came from? If a white person was stressing on their lot in life, did you point out it was a Mexicans fault? For this to work well, wouldn’t everyone have to start from the same starting line. What happens when someone is born with a disability, gets one while on the job, or someone else trips them? Isn’t there a need for a safety net? recompense for injuries? or legal intervention to stop the stronger from taking from the weaker?
Of course there’s a need for a safety net. But there’s no need for apron strings or an umbilical cord main lining “welfare” for extended periods of time. A hand up, not hand outs.
The ultimate extrapolation of that sort of thinking is that a comatose person is due a job which comes down to a another body (or a series ofaround. Being hired as a “safety net.” Because – ta da- everyone is required to be able to be given the place they want whether they can do it or not. There has to be a real limit to compensation. And that is where DEI has taken over. Any such official limits are themselves a violation of the idea there is Equity possible. That Diversity doesn’t turn out to be divisiveness and Inclusion means turn a blind eye to it.
My first but not last contact with this thinking was being assigned a spanish speaking secretary by a manager who was himself an immigrant from a Spanish speaking country. The trouble was none of the people he worked with spoke Spanish, including me, none of the customers spoke Spanish either. The real hitch came when it turned out he didn’t understand English either. I ended, after trying to design his work to compensate, and when that didn’t work, doing his work, my own and the extra work he generated by confusing the heck out everyone. You’d think that the solution would be obvious but it wasn’t. He stayed until the collapse forced the manager to move him. Where he repeated the failure and the office only escaped when he became so depressed he moved back home. Without notice. Couldn’t even find him for weeks. According to your idea, we should have hired a Spanish to English translator for him. Or hire a translator in the first place except there was no need for a translator at all. Your experience happens to be an inverted reflection of mine! I have often missed out on work opportunities for lack of Spanish skills. I plan to take a formal class this fall. It will definitely make me more competitive in the job market! I have picked up on many common and useful phrases in the language, because a significant number of my coworkers have spoken Spanish as a first language. Since I don’t have a college degree, my employment has been limited to retail/customer service… Sun Valley… Kohl’s… Grocery Outlet… If I had Spanish skills I could have been a team lead or manager, and earned a bit more than I was able to as a non-Spanish speaker! I’m eager to learn the language comprehensively. Communication is power. Why wallow in ignorance, when the easy alternative promises opportunity for success?
What if you never had entitlements to begin with? Americans are born into poverty every day, by no fault of their own. Higher education (necessary to earn a livable wage) is out-of-reach for many disadvantaged youth… And those who do get through school may end up with “wasted” degrees when they don’t find job opportunities in their field-of-study, and now are burdened with loans they must try to pay off on barista-wages.
Starting a business in this economy sounds like a gamble, no matter how brilliant the idea… Competing with established corporations with substantial budgets for advertising, and franchises on the “corporate teat,” sounds daunting. Most people starting a business won’t see a profit from it for three to five years… most of us don’t have that long to wait for money to come in. Angel investors are in short supply.
What’s more, our success is of the least concern to the people who currently hold the most power in this country. They care about their own comfort and maintaining their position… We are peasants, they watch us squabble and profit from our division, allowing us just enough comfort and freedom to prevent riots from breaking out–not an inch more. The remainder of the fruits of our labor is theirs for the taking.
Well…we should stand together. Together against the mega-wealthy who are grabbing up yet more wealth as we speak. But they are using race and skin color- the oldest of strategies to get us to fight each other instead of of joining together to fight them. Ok this article is about Linda McMahon of the World Wrestling gladiator drama entertainment, now head of the Dept. of Education, cutting off funding to schools that had students who protested the actions of a foreign country, Seems like Bibi can really pull Trump’s strings and make him dance! Either that, or the administration’s new policy is to only fund white only boy’s schools like the good ol days.
Recognizing what our ancestors left us with doesn’t require “blame” to be placed on modern people. It merely asks modern people to account for history accurately in order to move forward in an informed manner so that historical cycles of violence may be broken. Remember redlining? And hairstyle-based discrimination in the workplace? Many schools don’t share a balanced perspective on history with students, precisely because they originate from the same structures that uphold everyday discrimination based on background and race.
I think the idea that Black and Brown (and Native American and Asian) people are a “Boogeyman” is racist. The blame is misplaced. It’s not that the Boogeyman is not “real,” it’s that non-white Americans aren’t the “problem” that some (i.e. Darlene) believe them to be. Only racist people see an issue with the proliferation of non-white people. White women have benefitted the most from DEI programs, black people the least. Educate yourself. A teacher for heavy equipment operator school said, Women by far make the best heavy equipment operators, they are more careful, and skilled than men. It wasn’t that long ago women would have zero chance getting a heavy equipment job, because those jobs only went to men, yet it turns out women are actually often superior to men driving equipment. Without DEI they wouldn’t have hired the most qualified who are actually women.
Diversity, Equity and Inclooosion may have been rolled out with good intentions but became a bludgeon to a couple of races over time. Way simpler to accept applicants based on meritocracy. Best and brightest get to shine.

An appeals court on Friday lifted a block on President Donald Trump‘s executive orders ending federal support for diversity, equity and inclusion (DEI) programs.
A panel of three judges ruled the orders can be enforced during a pending lawsuit, reversing a nationwide injunction from U.S. District Judge Adam Abelson in Baltimore, the Associated Press reported.
Two of the judges on the 4th U.S. Circuit Court of Appeals said the orders “could raise concerns” about First Amendment rights, but found Abelson’s “sweeping block went too far,” according to the report.
Abelson, a Biden nominee, previously ruled the orders violated the First Amendment right to free speech and were unconstitutionally “vague,” as they did not define DEI.
The ruling followed a lawsuit filed by the City of Baltimore, the National Association of Diversity Officers in Higher Education, the American Association of University Professors and the Restaurant Opportunities Centers United, which alleged the executive orders were presidential overreach and anti-free speech.
They argued the president’s power “is not limitless.”
Trump’s orders directed federal agencies to terminate all “equity-related” grants or contracts, and required federal contractors to certify that they don’t promote DEI.
The administration argued in court that the ban only affected DEI programs violating federal civil rights laws.
“What’s happening is an overcorrection and pulling back on DEI statements,” attorney Aleshadye Getachew said in a hearing.
While the president secured a win with the latest injunction, a similar federal lawsuit was filed in D.C. U.S. District Court on Wednesday challenging DEI executive orders including: “Ending Radical and Wasteful DEI Programs and Preferencing;” “Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government;” and “Ending Illegal Discrimination and Restoring Merit-Based Opportunity.”
The second complaint was filed by NAACP Legal Defense Fund and Lambda Legal on behalf of nonprofit advocacy organizations.
White House spokesman Harrison Fields told the New York Times that “the radical leftists can either choose to swim against the tide and reject the overwhelming will of the people, or they can get on board and work with President Trump to advance his wildly popular agenda.”

Once upon a time, Universities taught subjects that got you ahead in life such as arithmetic, Science, and literature.
There are some great shop classes at CR. Really practical trades training down there!

Usually these subjects are covered in the first two years as General Ed requirements related to a major. You can also pick them up cheaper at a community college. I’d imagine there’s a stricter requirement for the pace of GE completion if you are on a scholarship or financial aid. If your trust funds is paying for it, there’s more time for electives like pottery or Mayan hieroglyphics.

If it doesn’t, it means that DEI sees no issue that makes its existence necessary. What is astonishing is that anyone would think it doesn’t mean there are too many white people or Asians and that needs fixing. This is a zero sum game. If the presence of one demographic is too high, then it is fixed by reducing it. So not okay.

Except the work that needs doing is getting equal respect for education in the various groups themselves. Getting black students to graduate from High School, which is free and readily available, is hard whereas Asian students do it easily.
Maybe DEI in the work place would give education a higher place as it could be seen as a tangible benefit. But that was not needed for Asian students, who have a culture of respect for education even when they don’t have it themselves.
Somehow the DEI culture provides a defeatist attitude where, even if you are very qualified, you may lose out to someone less qualified if you don’t meet the demographic while simultaneously, if you do meet the demographics, people will always wonder if you meet the qualifications. And the effort is a burden on everyone.
Personally I think that what has happened is that education has been cheated to make DEI work. And way too many people have wasted energy getting a degree when they don’t have the motivation to use it no matter what race. A high school degree is often meaningless and a college degree has taken its place. Only 4 years later and at at a much higher cost.
