Senator McGuire ‘Deeply Disappointed’ After Controversial Law to Require Presidential Candidates to Disclose Tax Returns Struck Down

A controversial law that would have required all candidates to disclose five years of their tax returns before appearing on the California primary ballot was struck down by the California Supreme Court. Clearly aimed at current US President Donald Trump, the law had been signed by Governor Gavin Newsom. Trump is the only presidential candidate not to release at least one year of tax returns in the last 40 years with the exception of Gerald Ford who only released summaries of the return.

The portion of the law requiring candidates for Governor to release their tax returns was not affected by the ruling.

Senators Mike McGuire and Scott Wiener, who sponsored the bill, sent out a press release in response to today’s ruling. We’ve included it below:

 “Today’s decision flies in the face of what the American people have come to expect from presidential candidates – transparency,” Senator Mike McGuire said. “Every presidential candidate for the past 40 years has released their tax returns, with the exception of the current occupant of the White House. If he has nothing to hide, why wouldn’t he release them?”

“Transparency is the foundation of accountability in government, and the Court’s decision to deny this critical information to the people of California is perplexing. This commonsense legislation applies equally to all candidates, from all political parties, including the Governor of California. This is a simple requirement that any candidate can meet. We are deeply disappointed with this ruling.”

“I’m deeply disappointed in this ruling,” said Senator Scott Wiener. “Today’s ruling is a loss for our democracy. SB 27 is a basic government transparency bill. There’s nothing onerous or odd about a purely administrative requirement to produce tax returns. Under the Court’s rationale, a candidate could claim we can’t force them to disclose their address or phone number. People running for President are seeking the most powerful office in the world – a position with the power to decide whether our planet will survive. Requiring them to provide financial transparency is neither extreme nor unreasonable.”

According to the LA Times,

Thomas W. Hiltachk, who represented the Republican Party in the case, called the decision “a victory for every California voter.”

The California Constitution “provides that all presidential candidates shall be placed on the ballot, and the Legislature may not impose additional restrictions on their access to the ballot,” he said.v

this was of course a totally unreasonable request for any one running for any office. i wouldnt want to release my taxes to run for office. do you think i want anyone to know how much money i have? if there is any crime committed then the irs will prosecute, then that becomes pubic knowledge. no crime, why pry.

McGuire, we are deeply disappointed in you, and this democrat state. Gas is $4 a gallon here, in Texas, it is $1.99 a gallon. Milk is $1.62 a gallon in Texas, it’s $3.oo for a half gallon in Fortuna, and it’s not even organic. Plus, the milk people are shipping our milk to Yuba City, and to Umpqua Oregon, at 5 mpg, so green. You hurt the poor, you hurt children, you hurt the working poor. We young republicans are going to get you out of office, and put someone in who can eleviate the tremendous tax burdens put in by the Democrats. Someone who will help the poor, help the children. Remember, Trump has helped the poor and working poor so much, in fact, he has helped people more than McGuire has, helping lift so many out of poverty. Perhaps Mike, you could study the brilliance of the Donald, and bring some of the ideas he has here, to help us in your district. Right now, we have to deal with a loser like you, a child hurter.

Part of democracy is being allowed to vote for the candidate of your choice. If not submitting tax returns is a deal breaker for you, do not vote for that candidate. Problem solved. But there is no guarantee that a majority of voters will agree with you about said candidate. Such is life.

It piss’s me off to no end that all these Representatives of the people that are elected to do a job, spend all their time trying to undermine the President. This law would not have prohibited anyone from running for office but would have required tax disclosure for candidates listed on the primary ballot only. I am sad to see that the court did not understand this.

Disingenuous talk. It steps around any real issues in order to reach a petty goal when it should have stopped at the first hurdle. We have reached a level of cupidity in politics I never thought to see. I always knew that many politicians were good a disregarding the very documents that created their power but I never thought that so much of the public would be so willing to eviscerate the Constitution that is their only protection out of spite.

McGuire just doesn’t get it. Tax returns are privileged. Hes basically useless. Same goes for Huffman. Fix our roads, forget the trails. Fix our rivers so we have fish, not grapes. Better yet, stay in Marin county and leave us alone.

First, releasing tax returns during audit could have adverse effects for you and your businesses. It could cause anyone who has a grievance with you to use the information in the returns to their advantage, or to discredit your information with the IRS.
