Groundbreaking Lawsuit Challenges Federal Government’s Discontinuation of School Mental Health Grant

Public Counsel, Morrison Foerster, and the California Tribal Families Coalition have filed a groundbreaking lawsuit with national implications on behalf of McKinleyville Unified School District challenging the federal government’s decision not to continue funding a $7 million, five-year school mental health grant.
The lawsuit alleges the federal government abruptly and unlawfully announced its intent to discontinue the grant, flatly violating regulations that require the government to base continuation decisions solely on grantee performance. Instead, the government — without even conducting a performance review — cited only shifting political priorities as the basis for its decision. The lawsuit asks the court to order the government to comply with its own regulations. A victory could open the door for hundreds of other districts affected by similar decisions to seek relief.
With just one counselor for its 850 students, McKinleyville — located in remote Humboldt County — relied on the School-Based Mental Health Services Grant to hire two more professionals, in addition to developing evidence-based policies and practices.
“This funding is a life-or-death issue for the kids in our rural corner of California,” said Julie Giannini-Previde, the district superintendent. “This funding could change hundreds of lives by providing mental health services to students who literally can’t get it anywhere else.”
The entire nation is facing a youth mental health crisis — with more than one in seven youth ages 6 to 17 experiencing a mental health disorder. At the same time, more than 50% of young people who need it have difficulty accessing mental health care.
The problem is particularly acute in Humboldt County, where 58% of youth have experienced traumatic events like abuse or homelessness more than once. By high school, more than 20% have considered suicide. Humboldt County also has a significant Native population, whose members have been subjected to intergenerational trauma that has often been the direct result of federal policies.
With few providers and a six-hour round trip to the nearest city, school-based care is the only option for many of Humboldt County’s youth. Paying for care is also a major challenge, as
roughly 60% of county students come from lower-income families.
“The Administration’s decision denies children in rural, high-poverty communities the services they need to meaningfully access education,” said Amanda Mangaser Savage, Strategic Litigation Counsel at Public Counsel. “It treats these children — many of whom come from Native communities harmed for generations by the federal government — as disposable.”
The suit, McKinleyville Union School District v. U.S. Department of Education, was filed in the United States District Court for the Northern District of California.
“We filed this lawsuit to ensure that the Department of Education complies with the law and its own regulations before discontinuing critical mental health funding for children in poor rural communities,” said David Wiener of Morrison & Foerster LLP. “The Department’s unilateral change to its ‘priorities’ is not a lawful basis for discontinuing this much-needed funding for vulnerable students in Humboldt County.”
The district will seek an injunction to rescind the non-continuation decision and to require going forward that any decisions be based solely on grantee performance, as the law requires. A coalition of state attorneys general filed a similar suit earlier this year on behalf of multiple states.

Far more harm to the mental health of children has come from the far left indoctrination at California public schools than by the above listed reasons, many of which are bogus. I have no faith in any far left mental health treatment after observing it for many years. I believe a lot more programs than just this one should be defunded. Schools should teach core subjects which is not happening. The medical needs of children should happen through medical facilities, not schools.

Having to live within your means is what normal people do , it is why couples have less children because they only have children they can afford to raise , people that have children and expect everyone else to pay for their food healthcare education and in most cases housing power and phone bills are a large part of the current problem. Then with all that money, the leftists STILL can’t provide the children a quality education! How about we cut out some of the administrative positions, healthcare positions and meal services from the schools? Maybe then the kids could get what they REALLY need out of school… reading, writing, arithmetic, science and physical education.
They can go to a health facility for healthcare, they can eat at home, and with less social services, less administrators are needed.

Beyond a school nurse to determine whether a child is actually sick or faking it to get out of class, school is for learning only. Whether medical facilities are available in a community is a whole separate subject, but should never be part of the education budget. It may be difficult to do, but the health of a child is the job of parents, not the school. Far left ideology wants to make it the business of the school, but it is morally reprehensible to indoctrinate kids and then when it destroys their lives try to force the government to pay to fix their mistakes.

40 something mom of two teens. Have always had 2+ jobs through my teens, 20’s, 30’s . Supported myself through school. My husband and I have raised my boys to work hard, be a team player in sports, be responsible for themselves and their actions, and going to school, treating teachers and staff with respect, doing the best they can at their class work is what their job is. Lots of family outdoor backpacking, river, and camping trips. Home “farm” chores were part of their weekly life, ( we’ve got chickens, a big vegetable garden, land to work). I’m a medical provider in the community. This is our life in a nutshell as in this comment field I feel I need to explain myself, though very likely will get shot at anyways.
I have one teen that is doing great in his highschool, is very self motivated. Loves to fish and work out and has aspirations for the future. Communicates well and follows boundaries. Broken ones seem to be life lessons, not life threatening.
Have my other son who has had multiple suicide attempts, several 5150 holds in the ER when he was trying to take his life and nearly succeeded, severe anxiety, depression, dove into self medicating with substances very hard, needing Narcan to save his life before the age of 16. Is an amazing athlete and is an amazing human at so many things but unfortunately went away from the positive into the pit of self medicating and self harm. Both of my boys same schools, same household. WE NEED ALL THE HELP WE CAN GET FOR OUR KIDS! Nature vs.Nurture? Believe me, I ask myself this daily, almost hourly. My husband and I will beat ourselves up about it the rest of our life. My kiddo with the struggles is alive, for now. He has friends circling the drain, and we have been able to remove him from the area and get him the help he needs, for now. When he is 18, it is an entirely different story.
This is NOT the group to take away resources from. Our youth should be the primary group to focus on, from my standpoint. Take away the blame that each of us may see from our biased viewpoint and just help these kids while we still can. I will never understand the why, and believe me I will always point to myself even without looking at the comments on this article. Hearing that our Mckinleyville educators and district are fighting for our kids, trying to get the services back that were already granted to them, fills me with a little hope that is nearly gone from this parent that has done all I can to save my kid.Our county has nearly zero valuable mental health resources for our kids, native and non-native. It is an epidemic we need to tackle, in all facets of our rural population, which is all of us.
Parents with problems and poor parenting skills set up kids for problems. The school environment also can create challenges for kids. School counselors can help. Due to confidentiality laws you don’t hear about abuse situations that counselors and school psychologists intervene with to protect the youth.
