Joseph Hale, Humboldt’s Only Family Law Mediator on Leave After Arrest by DA’s Office

Taking the legal community and even courthouse staff by surprise, Humboldt County’s only court-approved family law child custody mediator, Joseph Hale, was arrested Wednesday afternoon and booked by the Sheriff’s Department on misdemeanor charges related to invasion of privacy of a sexual nature.

According to Samantha Kargas, Public Information Officer at the Humboldt County Sheriff’s Office, “Mr. Hale was arrested by the Humboldt County District Attorney’s Office,” and was charged with PC647j(2).

This is a misdemeanor charge from the District Attorney’s office. Specifically, Hale is accused of violating Penal Code 647j2, which reads as follows:

A person who uses a concealed camcorder, motion picture camera, or photographic camera of any type, to secretly videotape, film, photograph, or record by electronic means, another, identifiable person under or through the clothing being worn by that other person, for the purpose of viewing the body of, or the undergarments worn by, that other person, without the consent or knowledge of that other person, with the intent to arouse, appeal to, or gratify the lust, passions, or sexual desires of that person and invade the privacy of that other person, under circumstances in which the other person has a reasonable expectation of privacy.

Hale’s job in Humboldt County is of critical importance to the family law court. Once involved in a custody dispute, a family is required by law to attempt to mediate an agreement for terms of custody and visitation. Currently, the managing staff of the Family law department are making plans for coverage and attempting to address the pile of work left in limbo with Hale’s unexpected absence.

In regard to the family law debacle currently unfolding in the courthouse, local Family Law Attorney out of Fortuna, Callie Buck, told us,

Although I can not speak about Mr. Hale’s current circumstances, it is very unfortunate that we now don’t even have one mediator when we need at least two or three. I think this is just another reason why the county/ court system needs to be actively hiring a second ( or third mediator.) Families are already often having to wait 3-4 months before their case can go to mediation. A lot of times this means a parent will have to go at least that long without even visiting with their child(ren.) Our public service is doing a major disservice!

It is my understanding that the county has been actively hiring for the role for years, but due to the fact that the pay rate being offered is so low, the position still sits vacant. Hopefully, the human resources/ hiring department reevaluates the situation. The county once again is blatantly ignoring the needs of the families of this community.

In response to an email inquiry as to courthouse functions in Mr. Hale’s absence, Humboldt Superior Court CEO Kim Bartleson replied to say, “The court has no comment at this time.” However, multiple sources from inside the courthouse who preferred to remain anonymous told us that as indicated by an internally circulated staff email – which did not mention the charges against Hale – that a plan to assist the courthouse mediation functions was in motion, although details were scant.

The staff at the courthouse believed that Hale may have been out with COVID, but after seeing the booking photo and the associated charges, one anonymous staff member noted, “This is shocking.”

When reached for comment on the matter, local Criminal Defense Attorney Kathleen Bryson emphasized that everyone is entitled to a vigorous defense, and that an arrest does not necessarily equate to guilt. Bryson stated, “I love Joe Hale. I have known him for 17 years. To be arrested is different from being found guilty. I would suggest that we let the court system do its work. Allow the DA to do her job. Then, if he is charged with the same thing as he was arrested for, or something more, or something less, let him have the same rights as anyone else to zealous and effective counsel.”

Providing us input we did not expect, Bryson added, “I can say one thing though. I can speak from experience of the family law scene. I was minors’ counsel from 2005 to 2007 before I became a deputy DA. I do know that it is very political. I do not know who his alleged accuser is. However, that person will undergo the same level of scrutiny as that applied to Joe.”

Joseph Hale, now released on his own recognizance, has been the sole family court mediator in the courthouse for several years, handling the full scope of the mediated cases sent to his office, on the third floor of the courthouse. This mediation process is exclusive to families needing to work out their custody and visitation conundrums, and involves each party to a family law case meeting with Hale directly to discuss the sticking points of co-parenting.

This is a state-mandated element of resolving family law disputes via the courthouse, which ideally results in a mediated agreement that saves the family from enduring a trial or potentially tumultuous litigation, where their mutual fate rests largely in the hands of the Family Court Judge in Department 6.

On any given week at the courthouse, there are dozens of family court cases being heard by a judge, and each of those seeking custody or visitation orders are mandated to participate in court-ordered mediation with Joseph Hale, at least once, and for some families, it is a repeated adventure.

The family law mediator, also known as the Child Custody Recommending Counselor (CCRC), is responsible for hearing each party’s side of the story, and negotiating a mutually agreeable resolution as to timeshare between the two parents or guardian of the minor child/ren involved in the matter. Sometimes, the mediator is tasked with also interviewing the child involved, if the child is over the age of 14.

Following the mediation session, which involves interviews with each party separately and together, Hale would then provide a written report to the Court and the parties, making recommendations as to custody, visitation, and any co-parenting issues that arise apart from child support issues.

These “recommendations” are frequently considered by the court and simply adopted as court orders, if they are agreed to by each party to the matter. The mediator has a significant impact on outcomes in the Family Law court, and indeed, can be effective in saving the court, as well as the parties involved, a lot of time and money.

Without a mediator on deck at the courthouse, there are sure to be delays in moving cases forward smoothly, because those cases that are set for mediation, and the resulting “return from mediation” court dates may need to be re-calendared by the court. This delay would be much to the dismay of courthouse staff, local attorneys, and most devastatingly, to the families whose routines and court cases depend on an efficiently run courthouse for their very stability and often for their collective sanity.

I disagree. Many times children need someone other than their parents to help figure these things out. Contentious divorces when children are involved can be helped greatly by a mediator. Hopefully, the county can get their act together.

The mediator works with divorcing parents to come up with a child visitation plan. If the parents cannot agree, then the mediator files a report with the court to make a recommendation for how visitation will be configured. It is an essential service.

I’m just wondering if anybody who is stoked about the Court Ruling on R v W is going to move from a State like California to a State like Texas, because of their stance against abortion. Have you considered that? Would their society be better? Isn’t that part of your reasoning? Abortion is wrong, so a place without it is somehow better, right? The premise is always that States can now thwart the will of some of their population, And they can just go to another state. If limiting abortion access made such a difference in your quality of life, wouldn’t you want to live in a State with restrictions you favor?

I agree with you 110% as it is rare that a commitment to a community nor job satisfaction or motivation to do a job can be bought, and dedication is a mentality and not an element based on salary. An example would be the recent pay raise of 15% for one lucky county employee. Still, I think it would have been more deserved and more fortunate for our county and not the employee if the person in question had chosen not to leave because their heart could not go rather than their family would not. Regardless of the job description or position, the loss of a single employee should not result in emotional suffering to the families who now must wait even longer for the resolution of their court case which is not the employee in question’s fault but the failure to properly plan for any eventuality or as they say – what no plan B!

This comes as no surprise to anyone familiar with the family court in Humboldt County. We’ve been calling out Joe Hale and Greg Elvine Kreis for years. In very many cases they don’t actually want to resolve anything with the child’s well-being in mind. They are more concerned with playing politics and favorites instead of upholding any sense of justice. They only hire people willing to brown nose. They won’t hire anybody that would possibly intrude on their fiefdom. They protect their control and power first and foremost before serving the public.

I had my case referred to him and I was so excited to actually sit down with someone and make a point without being interrupted or worse by the other parent.

Hate to pile on top of this guy in the middle of a bad situation but it was a real disappointment to sit down and be interrupted by hail and have him lead the conversation off in these unrelated tangents that wasted this very precious opportunity to communicate with a referee there for once.

I was really hoping he would get annoyed with her and say: Hold on hold on hold on this bitch needs to shut up cuz this dude is right about pretty much everything.

I know I’ve just poisoned the conversation and I sound like I’m being sarcastic but it’s mostly true. I overcame a long uphill battle and had my say in the raising of my kid and eventually had soul custody and things went on beautifully. Hang in there single parents it’s a brutal process but there’s just no substitute for time spent with your kid, consistent loving and positive time spent together is what it’s all about.

True that good people can do bad things and also that good people can change in time to become bad people. Seen it too and too much! But we are talking here about an accusation, not a determination of criminal behavior. I don’t know the guy but I appreciate people who have known him for a long time expressing their loyalty. They may be crushed later on by the evidence but until it is presented I think that loyalty is a trait to be admired, not insulted. I have been cast as the bad guy and submitted to the rumor mill unjustly and so I know it is possible that the view may turn upside down…But yeah those environmentalists that sold out for mega-grow money they especially piss me off too!!

So true about the false accusations that can ruin an otherwise, somewhat decent reputation.

The problem is, is that the pubic at large, even ones family and “friends”, will still consider a person guilty after they have been accused, even if those accusations are deemed to be totally false. The errant accuser suffers no such dishonor, or the eternal negative consequences they initiated.

Regardless if this guy is guilty or not, his name is now “mud”!

If the allegations are untrue, unfortunately, the damage has been done…

No, the problem is that the accusation will be headlines but the end of the process will not even likely be mentioned anywhere. Unless it suits the media’s agenda.
And of course the “errant” accuser can make headlines too. Again if it fits the agenda. On the other hand, the accusers could have been brushed off for years without ever getting justice at all.

Agreed, people can turn on a dime, and hide things very well. In a small community, loyalty saves bad people from seeing justice every day. Someone will always vouch for you… and get their loyal friends to vouch as well. Chances are we’ve all done it before and didn’t know it. Also, when I worked for HDVS it was not uncommon to hear conversation about how clients didn’t feel heard in mediation. But what can you do about that? I’m so sick of mismanagement and shady practices everywhere I look in our county.

I have literally been going through this with him for 4 fucking years!!!! I’m sick too my stomach every day walking past my kids bedroom empty. Waiting for him to wake up. I don’t even know what to say right now except I start trial FINALLY in a couple week. Pray this doesn’t stop it from going forward!

A district attorney is a prosecutor not a peace officer therefore has no more power of arrest other than that of a private citizen making a citizen’s arrest. If a DA actually made the arrest they could not bet able to prosecute. Perhaps the DA used an investigator from the office who is a sworn peace officer. But the statement that it was the DA’s Office that arrested him is misleading.

He was a horrible mediator that bullied parents into agreements. He is one reason a child was abused by his father because Joseph bullied the mother into giving the father an excessive amount of visitation time despite the father’s serious mental health issues. Joseph Hale sided with the father because he clearly saw himself in him. May he take accountability for the harm he’s done in Humboldt.

Kathleen Bryson you are getting on my nerves, sticking your neck out like that saying how much you love him and have known him for 17 years.

Also to the writers of this post, to turn this story into coverage of lack of workers for a job, really minimizes the fact that he is being investigated for these crimes, and there are real victims behind this. innocent until proven guilty of course, but I would hope the community could be open to the fact that influential members of your community can always surprise you….

This little creep made court Hell for my us. Now to find out he was taking creepy pictures of women is sickening but not surprising. I hope Karma brings him what he truly deserves. He tried to approach me at the market with a big smile trying to shake my hand after our case was finished. I turned around and ran. Thanks Humboldt Courthouse for the worst experience of my life.
