New Bill Attempts to Forestall Thousands of Temporary State Cannabis Licenses Expiring
Press release from the office of Senator Mike McGuire:
Currently, there are over 10,000 temporary state cannabis licenses in the state system that will be expiring between now and the month of July 2019. In March alone, over 1,000 temporary growing licenses issued by the California Department of Food and Agriculture are set to expire.
The State – under current law – has no ability to extend a temporary license, despite the fact thousands are set to expire. To make matters worse, thousands of applicants who wanted to comply with the law and applied for a temporary license did so in the last quarter of 2018, leaving a massive backlog for the state regulating agencies.
As the temporary licenses come due, if the state can’t approve or deny an annual license prior to the temporary license expiring, the license holder – for example, the grower, farm, distributor or retailer – will no longer be operating legally and will be kicked into the black market.
“Bottom line is this: This bill will protect thousands of cannabis farmers, in particular, who did the right thing and applied for and secured a state license. But because their temporary license is about to expire, and because of the inability to extend their license due to existing state law, they could be forced into the black market. Obviously, this can’t stand which is why we’re moving quickly to keep a legal, regulated market here in California from collapsing,” Senator McGuire said.
“We have many folks in the cannabis industry who have worked hard to comply with new rules and requirements, and we have, from the start, experienced some growing pains as state and local governments have also worked hard to get their processes running smoothly,” said co-author Assemblymember Jim Wood. “This bill will provide some short-term relief to those who have submitted their annual license applications on time and allow the various state agencies to catch up with the volume of applications that have been submitted.”
This massive volume of temporary licenses creates the real risk that not all provisional annual license applications can be processed prior to temporary licenses expiring. There are an estimated 10,000 temporary licenses expiring in 2019 – 23 today alone will go from legal to illicit, at no fault of their own. This is the worst way to transition a multi-billion dollar agricultural market – which employs tens of thousands of Californians. Without legal licenses, there isn’t a legal, regulated market in California.
“We can’t afford to let good actors who want to comply with state law fall out of our regulated market just because timelines are too short and departments have been unable to process applications. Without legal licenses, there isn’t a legal, regulated market here in the Golden State,” Senator McGuire said.
SB 67 will fix this. The bill allows the state to extend temporary licenses held by licensees while their annual application is being processed, so long as the annual application was submitted before the temporary license expired.
SB 67 will also improve the provisional annual license process in the state. It allows licensing authorities to do all in their power to convert temporary licenses to provisional annuals. SB 67 allows licensing authorities to grant provisional annuals to those without temporary licenses once the backlog of applications for those with temporary licenses is resolved. It also extends provisional licenses to July 1, 2020.
SB 67 creates a short-term solution to avoid an impending crisis. It requires any licensing authority who uses the extension authority to provide certain metrics – how many temporary licensees have submitted annual applications, how many have not, and how many temporary licenses have expired – to the legislature about how the provisional annual applications are being processed. This reporting will allow the Legislature to continue the conversation about licensing through the 2019 legislative session.
SB 67 was approved in its first Senate committee today with an 8 to 0 vote in the Senate Business and Professions Committee.

Most of us on temps are well aware that our properties would not, and will not EVER pass into permanent status due to a variety of reasons including most notably protecting the endangered species and stupid environment, ppfffftttt! Most simply extend this ‘temporary ‘ pass as long as possible that allows us to cheat the system and save tons of money while we cause some pretty serious environmental destruction along the way. I actually make a product that helps cancer patients so the doctors say since ’96. I would like more research done to study what effects it really has for patients and I wanna know am I really making a medicinal product or just subsiding pain. There is billions Billy and every legal states revenues continue to rise year after year. The product I make for cancer patients does not get you AFU their is absolutely zero euphoric effect. It is a solvent free crystalline that I make by just applying heat and pressure. I did make the product with a solvent in the beginning but for the last decade all solvent free. I have been delivering this product to a hospital in another state since ’96. I risk taking it to them and they risk losing their license. The hospital staff not me make the claims about its effectiveness for its patients.

Not on the commercial concentrate end but yes- some hospital staff including doctors are supportive of their patients’ medical cannabis use as they see pain relief on an intimate level. Those who bring the medicine at personal risk and cost are good people and I do my best to help. Yes- don’t need fancy stuff because living here in paradise is reward enough. They are giving those with Temporary licenses priory over those with Annual Cannabis Cultivation applications who do not hold a Temporary license. If you live in a County without CEQA in place, you will receive a Provisional license until your Annual Cannabis Cultivation license is approved so that you can grow.
If your Temporary license is about to expire, call 1-833-CALGROW (1-833-225-4769), and make sure to follow up with an email to [email protected]. Give them your Temporary license number, and ask if your application is being processed. Let them know that you are checking to make sure your application does not get lost in the system. If your Temporary license has recently expired, call them anyway to let them know about your situation.

Medicare is not the same as MediCal. The first has been paid for for decades before most get to use it then usually has such holes in coverage that supplemental policies are necessary. MediCal pays much more at a lower cost but depends on funding mostly by people who will never get to use it.
That is always the kicker with medical care- someone has to pay for it. The major ddbates are between those who don’t pay for their care and those who do pay for their own plus pay for those who don’t. For the payers, the numbers of those they can carry in addition addition to themselves is always a sore spot.

We grow this plant here because it closely resembles the landrace of the plant. Maybe some day we will openly talk about these advantages cause I am curious to know how many others are truley aware. Climate has nothing to do with the plant except for when you seed and when you harvest. Latitude is the main factor. A landrace is a plant that has no other genetics bred into the plant. Two other factors beyond latitude determine the plants color, taste and smell you will have to learn these important factors on your own. Landraces are everywhere but the plant originated in China. Take a looksy at what latitude Afghanistan and Humboldt are on. Trinity County is ideal for growing Afghan dominant strains as is Humboldt. That is as much knowledge I wish to share. As I stated let the competition begin!
As far as hybrids I am not a big fan of what you youngins are doin to the plant. I can take a hybrid like jellato and call it whatever and not one person will call me out and say it is jellato that is how sad it is getting genetically speaking.
The oversupply does not seem to be affecting the cost of $20 a gram at a dispensary. Seems like $10 a gram is the average despite media and state numbers. See for yourself.

No one asks for Oregon grown weed, they do ask for Humboldt though. I was even in Colorado on St Patrick’s day last year and proved my point. Held up an 1/8 th in a bar and just belched out Humboldt and almost got mobbed, lol. Free us from these shackles and let us compete! The only place where Humboldt Weed is not recognized is in Humboldt and that is a shame. All good those southern states will always show us love.
There are people mobbing the Kardashians too. But fashions change and competing means keeping up with change. Humboldt is no longer has the dubious distinction of being the most infamous provider. It will soon have to compete based on prices and value and critic’s reviews and clever advertising. That type of competition takes work, not resting on past laurels. Nothing is settled yet as to what place Humboldt Co will have. Maybe it will only be nostalgia unless there is an active marketing campaign just like any other business.

Closest practitioner to us is in Fort Brag. I sure wish we had someone here in Humboldt w/Bowen knowledge. It’s a, how can i say this, alignment of energy fields. I’ve sent several people w/back problems to Sandra Gustaffson in Santa Rosa. She also trains people. My point is, they don’t advertise. She also does live blood analysis lab work. Fungus aka cancer can be detected up to two years ahead of knowing it otherwise.

I agree with everything you stated. I also travel throughout the 48 and Humboldt is still renowned. All I have to do is say I am from Humboldt and the next comment said to me is usually “got any weed.” I do not think we need to market as much we just need to be able to cross state lines and keep our product clean. It is a multi billion dollar industry and we deserve our share.

My neighbor actually has a CA Interim Permit. She applied for the CA Annual Permit by 12/31/18, which was supposed to qualify her for ’90 bonus days’ added onto the 120 that the Interim offered, but she has not yet gotten a notification that her Interim is now valid (through end July, I believe). What’s up with that?

Why, why are the department’s not approving permanent permits. How many were approved today, yesterday or the day before. What is the holdup and who or whom is not doing their job. Where did the millions of dollars go the state has collected.

The (i)nterest, that’s never printed, is the cost for using the evil created paper.
