Innocent McKinleyville Man Wins $850,000 Settlement After Sonoma County K-9 Attack

A McKinleyville man, Adam Gabriel, a former Marine and member of the military police, has secured an $850,000 settlement from Sonoma County after a police K-9 tore into his arm during a 2021 traffic stop for a crime he did not commit. Another man was arrested for the crime that same night.

“Adam was a very successful amateur bodybuilder looking to become a professional bodybuilder, and this injury took him out of the running…,” his attorney Izaak Schwaiger told us during a phone interview with Gabriel. “[I]t was a serious injury.”

Gabriel told us, “I spent six nights in the hospital…with a blood clot, then they wanted to amputate my arm. I wouldn’t let them.”

Schwaiger said the settlement will help Gabriel return to his former life. “Hopefully, with the settlement proceeds, he’s going to be able to get some care and maybe get back in the competition,” he explained.

The Incident

On June 2, 2021, Gabriel was visiting a friend in Sonoma County when he was surrounded by sheriff’s deputies who initially believed his car matched a suspect vehicle involved in a nearby carjacking. However, according to Judge James Donato in his order regarding the request by the defense for summary judgement (read the entire document here), “Undisputed evidence establishes that Deputy [Shawn] Forghani did not believe during the incident that Gabriel fit the description of the carjacking suspect, and knew that Gabriel’s car was a different color than the suspect’s Subaru. He also saw no indication that Gabriel had a weapon.” Nor did Gabriel look like the suspect description of a bald Hispanic male.

Gabriel was sitting at a stop sign with his small French bulldog in the passenger seat when officers arrived. “Next thing I know, a lot of bright lights were on me, and I was surrounded by several Sonoma County Sheriff’s officers with their guns drawn, yelling to get out of the vehicle.”

According to Judge Donato, “Gabriel complied by turning off the car, throwing his keys to the pavement, and putting both hands in the air out of the driver’s-side window.”

Note that several statements made in the video which was posted about a month subsequent to the event were known at the time of publication to be untrue including that Gabriel’s vehicle matched the make, model and color of the suspect’s vehicle.

However, Gabriel did not immediately exit the vehicle. According to the Judge, “Gabriel hesitated for about two minutes” though he kept his hands out of the drivers window.  He questioned the officers on why he was stopped and whether he was being arrested. Gabriel feared an ex-girlfriend might have set him up. He told us that “she had been sending messages and threats…she was dating a cop, and was gonna have them do harm to me. So…originally, I thought it was a hit job….Because there was no reason in my mind that I could think of why I was in this situation.”

In addition, he didn’t think the officers were acting professionally. “I was a military police officer in the Marine Corps, right? I had experience. I had some police training, and it just didn’t seem like any of their procedures were….protocol at all… .”

Eventually, however, as seen in the video above, Gabriel exited the vehicle and followed the commands to raise his hands in the air, walk towards Deputy Forghani and to kneel. Eventually, he was told to crawl. Gabriel said he had trouble understanding the commands. “So I heard a lot of yelling, and their dog was barking, and it was hard to make out what was being the orders or the commands,” he explained.

When he didn’t quickly begin to crawl on the pavement, Deputy Forghani released a police K-9, which bit Gabriel’s right bicep. The video shows that Gabriel was on his knees with his hands in the air when the K-9 was sent in to bite him.

Gabriel’s bicep was torn and bled a great deal.

“I saw the dog jumping at me from about five feet away,” Gabriel told us. “[It] sunk its teeth into my bicep and start ripping at it violently… They pulled the dog off and scraped me off the ground, put handcuffs on me while my arm was dripping blood.”

The former Marine said, “They sat me on the bumper of a fire engine where there was a paramedic who basically just looked at my arm and said, ‘Take this guy to the hospital.'”

But the deputies didn’t take him to the hospital, they took him to the jail where, he says they tried to goad him. “While my arm was still bleeding, my arms were… hands… handcuffed, behind my back in excruciating pain, [they] walked me into the county jail and were continued to poke at me and try to provoke me into doing something that would, you know, like a chargeable offense, because at this point, I believe they knew I wasn’t the guy they were looking for, and were looking [to] charge me with something to cover for themselves. So they’re being very provocative.”

Gabriel suffered severe injuries, including nerve damage and lasting disfigurement.

According to Gabriel’s statement to the court,

Gabriel told us, “I was in constant pain, constant pain for the next at least four to five months. I didn’t sleep. My arm swelled up like a balloon all the way from the shoulder all the way down to my hand. It was very painful for a long time. ”

And, adding insult to injury in Gabriel’s mind, the Sonoma County Sheriff’s Department put out misleading information about the incident. According to a press release put out by the Sonoma County Sheriff the day following the bite, “[Gabriel] was treated and released from a local hospital.”

Gabriel’s attorney Izaak Schwaiger explained,

The statement is crafted with a purpose in mind other than transparency, so you can only rely on it so much.

The statement that Adam was “treated and released from a local hospital” ignores the fact that Adam was “released” to a higher level of care in SF, because the local hospital was not able to manage his level of injury…

The press release never says that it was the wrong car, and that they knew it was the wrong car.

The overall impression of the press release is that Gabriel was involved with the car jacking though the Judge stated, “Deputy Forghani knew from the start of the incident that Gabriel did not match the description of the suspect…Nothing in the way of actual evidence indicated that Gabriel was engaged in criminal activity.”

Legal Proceedings

Gabriel filed a lawsuit against Sonoma County, alleging excessive force in violation of his Fourth Amendment rights. U.S. District Judge James Donato denied the county’s motion for summary judgment in March 2024, criticizing the sheriff’s office for its use of force despite Gabriel’s clear compliance.

Gabriel’s attorney, Izaak Schwaiger emphasized that Gabriel posed no threat to officers. “He was on his knees, hands in the air, surrounded by armed deputies. There was absolutely no justification for releasing the dog,” Schwaiger said.

In addition Schwaiger told us, “[Y]ou got to remember that…whenever cops beat somebody up, they will always, 100% of the time, arrest them for resisting arrest. And there’s a reason for that. There’s a Supreme Court case called Heck v. Humphrey and…the court says that if you’re convicted of resisting arrest, then you can’t sue the cops for excessive force. I mean, that’s a overly simplistic distillation…, but that’s what it means, and that’s how cops understand it. So when cops go hands on and beat someone up, they always arrest them for resisting as an insurance policy of them not getting sued.”

It is worth noting that the Sonoma County District Attorney did not pursue any charges against Gabriel.

The Settlement

The county settled for $850,000. Schwaiger noted that the settlement likely reflects the strength of Gabriel’s claims and the county’s unwillingness to risk further exposure. He argued that though the County’s insurance company pays the settlement in the short term, that in the long term through increased premiums, the taxpayers suffer. (See Press Democrat article here)

“[I]f you have a department that’s…incapable of seeing that they’ve done something wrong, and thus incapable of adjusting and changing that, that client’s going to continue to cost you a shitload of money, and so the county is costing their insurance carriers a shitload of money. Ultimately, the taxpayer does have to pay for that.” Schwaiger stated. “Until the department is willing to acknowledge its mistakes and implement changes, incidents like this will continue.”

Gabriel expressed mixed feelings about the resolution. “I’m glad it’s over, but no amount of money can undo the damage. I hope this makes them think twice before doing this to someone else.”

Lasting Impact

Gabriel hopes his case will inspire greater accountability. “You know, I didn’t serve my country honorably…to be treated like a criminal and to be slandered like this by…cowards, to be honest, because that’s what they are, and that’s the way they behaved….[All] they had to do was ask for an ID or walk over while I was on my knees and put handcuffs on me. They didn’t need to use force like that.”

The Sonoma County Sheriff’s Office has not announced any policy changes in response to the lawsuit. The K-9 involved has since retired, but no disciplinary actions were taken against Deputy Forghani or other officers involved.

The picture of the dog lunging at him while he’s on his knees with his arms raised is conclusive proof of police brutality.

And the injuries are horrendous – looks to me like his attorney wimped out instead of pushing for lots more – no way Sonoma County wanted this in front of a jury.

This is terrible and quite disgusting. More common than anyone knows. I love the fact of they charge you with resisting arrest so you can’t sue. Have seen it over and over and over again. The nasty comments from management teams and people belittling those doing little else but living. Opportunities to become victims and irretrievably damaged around every corner when assholes like these are willing to Shell out there abusive tactics. I hope this video makes it to where it is used as a standard and citable case. Like the case of STEVE NEROTH a condition of the settlement was for the videos to be released on multiple media sires.

Thank you for this, and I suspect that the hesitation around exiting the vehicle was the problem…

In all encounters with law enforcement, follow the orders of the officer promptly, and these days, expect to be shot if you don’t.

I have never been in this situation, but, three years later, the County can say whatever it wants…

The Judges statement appears to be a contract for payment and cessation of claims thereby.

I don’t want to study this closely, but there was a load of shit going on here, and using deadly force was entirely unnecessary and way outside the lines of use of deadly force…

I still say there is something funny going on here, but as in the case of Zeke Flatten, a bit of experience in law enforcement and making assumptions about reasonable expectation of procedure, seems inadvisable.

Upon review, it looks like the Judge wrote an even more confusing opinion, and it is obvious that the Officers here were trying to catch a “carjacker” out of “Mountain View” in a Green Subaru… Somewhere along the line, the genius Deputies decided that a White Man with a beard was also a Hispanic Man who was bald… And that the Subaru had magically transformed itself from Green to Silver…

This was all three years ago…

Where did this all happen, Cotati, which is right next door to Mountain View, as we all know…

This is why I never, ever would buy a Subaru, since they all look the same and since everyone in Northern California has one, and since they are all powered by an old VW engine with Plastic Valve Covers…

Heck, this could happen to anyone, even a Techie in the Mission in a White Tesla 3…

The Press Democrat stated that the Department had numerous excessive force charges and awards, so clearly, there is a leadership void and a training issue.

The danger comes from the fear mongering police leadership put the officers through. I’m an old person with a fluffy dog and the chp approached me all shaky with his hands on his gun for criminy sake.

Let me guess:

One entry-level, underpaid, undertrained, overworked deputy will get fired. They do deserve it, because they committed a violent crime. Or maybe they won’t; it’ll all get covered up and they’ll keep their job.

But there will be ZERO consequences for the people who hired, trained, and supervised the deputy that committed this crime, or the people who put out the video that contained statements that “were known at the time of publication to be untrue.” They’ll keep running their department the same way, keep the same hiring and training practices, keep paying out $850,000 of taxpayer money every time one of their bad hires fucks up, and keep lying about it and trying to cover it up.

“Until the department is willing to acknowledge its mistakes and implement changes, incidents like this will continue.” They never will acknowledge any mistakes, because they never face any real consequences. Fire them all. Start over. They can all re-apply for their jobs, PROVE that they had nothing to do with this violent crime, and make a case for why they deserve to continue to be employed as police officers.

I hear the “one bad apple” saying all the time in this context. “It’s not every cop, it’s just one bad apple.” You ever had one bad apple in a bowl of good apples? The other apples start to rot. The rotten apple turns the good apples shitty. If one bad cop is supported, defended, and covered for by other cops, doesn’t that make them all bad cops?

We grant the police an extraordinary amount of power over us. We allow them to use (deadly) force against us, and detain us, with the understanding that it benefits society to grant them a monopoly on violence, and that they’ll use that violence appropriately and proportionally to defend us. It’s a social contract. But when the police repeatedly break that social contract with no consequences, when they use violence against innocent people, lie about it, and get away with it, it raises the question…why should we continue to do what they tell us? Why should we let them continue to perpetrate violence against us?They won’t even own up to their mistakes when they get it wrong.

The victim in this incident said it best: “Cowards.” Every “good cop” that doesn’t take a stand against this kind of thing is just another bad cop.

Not all cops are bastards.

But Deputy Shawn Forghani of the Sonoma County Sheriff’s Department sure is. In fact, I’ll go further: Deputy Forghani is a violent criminal operating under the protection of a badge he doesn’t deserve, a dishonest person, someone who clearly cannot control his emotions, and he deserves to lose his job and go to jail for a long time. Deputy Forghani is a stain on the profession of police officer.

He also doesn’t deserve to own a dog for the rest of his life.

The Sonoma County Sheriff’s Department operates outside the law and brings shame upon every police department doing good work. They intentionally disseminate false information through the media in a shameful attempt to cover up the violent crimes of their employees. They are liars. Many people in that department deserve to lose their jobs and never work in a position of authority again.

I really hope they try to sue me for defamation, because then they would have to prove me wrong. Show me the false statement in this comment.

The supervisors will back him up and hide everything lie and deny constant issue constant problem with any type of agency. Jesus, you got the guy on the ground, guns drawn and you’re probably “afraid for my dear life even with overwhelming firepower” so you let the dog loose. This gross overreaction should have 2 or a 3 in front of that 8 in the settlement. If you’re going to go all in on what turned out to be not the right guy, it needs to be an expensive mistake.

There should be a sizable personal penalty for illegal orders given by a cop. No one- no one- should be ordered to crawl on the ground. Then attacked when they passively don’t comply. What purpose is served by that order other making the police feel in control.
I’m very much afraid I would have found myself in the same situation because there are some things are simply too demeaning and I will not do and crawl on the ground is one of them. Almost never even for my own safety and certainly not to make the cop feel safer.

It’s unbelievable that it is legal to allow dogs to attack suspected criminals. Unfortunately the comparison of people’s behaviors to Nazis has been dramatically misapply to the point that the comparison hardly has any meaning anymore. But in this case I think it’s apt.

Handle it like banks used to in loan departments decades ago, before banks could operate in more than one state. I had some relatives who worked for them many, many years ago, like the 50-60s-70s, and at one time (looking at you BofA) loans were much harder to get than now. They didn’t use credit scores and other profit-only metrics. You had to prove you could afford toilet paper and life itself to get a meeting with a loan officer. On the business side, that same loan officer’s financial ass was on the line for making a bad deal. That is, you were personally liable for a bad deal, so if you didn’t want to lose that house the bank got you as a condition of employment, you didn’t make bad deals. Now apply that policy to law enforcement and see how fast people take a pause on overreactions when they could lose their homes over it.

So, if one of the deputies thinks from the very START of this incident that this car & driver were NOT a match of the car thief, WHY WASN’T IT DE-ESCALATED ??? And why was the K-9 even brought of the patrol vehicle ???

We see cops use a LOT of force, sometimes excessively, on tv shows like ‘Cops’… putting knees on somebody’s neck & head while they’re already on the ground, kneeling on somebody’s back which can affect a suspects ability to breathe.

There is NO uniform training across this country, state to state, and in California the POST (Police Officer Standards Training) that cops must train under & be certified only trains cops in technical procedures, but ignores cops emotions, going ape shit during arrests, and lying to the D.A & Judges to cover their ass

As an American, cops lying repulses me to no end. They’ve done it to me, they’ll do it to you… and they swear an oath when hired, and the swear an oath when submitting a case to the D.A., and they’ll lie in court under oath.

Cops are supposed to be the most honest & honorable people in our society… yet now CYA (Cover Your Ass) seems to be a part of daily law enforcement.

Think about this: People are sometimes told to yell ‘fire’ to get peoples attention instead of ‘help, call the cops’…

A lousy $850,000 for this kind of completely inexcusable incident of terror and torture at the hands of Sonoma County Sheriff’s department? As already mentioned (upvote not working again) this is a paltry sum after attorney fees and the amount of pain and disability the victim endured and will endure indefinitely. He almost lost his arm over police incompetence.
Something is very, very rotten in Sonoma County. The responsible deputies and the Sheriff should be OUT of law enforcement forever, and tried for criminal negligence for good measure.

OK, I watched the Sonoma Sheriff’s report on the incident and the testosterone overdose left me gasping like a fish out of water. If it was me, I would be out on the ground PRONTO without a lot of haggling. Despite the difficult to comprehend resistance of the former Marine M.P., the Sonoma officers’ response with the dog was absolutely unconscionable.
It seems obvious, in retrospect, that the aggrieved citizen had his BLACK JAGUAR stolen by some dude who drove up in a Subaru, which was left behind by the car thief!! They KNEW this! Other cops, following the news, pulled over a BLACK JAGUAR that night aaaaand, THAT was the stolen Black Jaguar!!! Amazing! It ain’t exactly “Colombo.”
i hope the voters of Sonoma County will muddle through the folks in charge of the funds and guns of the Sonoma County Sheriff by the next election.

His lawyer should be disbarred. An assault like this should result in a much more substantial settlement, like an order of magnitude greater. The dude should never have to work again. And that deputy should be busting rocks for the rest of his miserable life.

But count on it: we will see a LOT more of this kind of shit over the next four years, if not in perpetuity. Welcome to the police state.

Sorry to hear this tragedy befell a Marine veteran and a former MP at that! Was a firearm used for the carjacking? Poor police procedure at the least. Dog should not have been deployed! Why was this case not in the national news like so many others?

He should have went to trial. He would have won and his attorneys fees would have been paid by the SCSO. On top of that, a personal injury verdict with physical injuries is tax exempt. If I’m not mistaken, a settlement is taxable by the Federal Government and the State. Your attorney probably received at least 30% (255,000) plus all the fees he put out upfront for the past two years. In a civil suit he could have received punitive damages on top of his damages to punish and force SCSO to change. A Sonoma County jury would have been very favorable to this Plaintiff.

The SCSO and the deputies are complete liars. This is why citizens hate cops. The video doesn’t lie. While he is complying and after the tell their dog to attack him, they can be heard lying and saying you’re resisting. This is the same old tactic. They assault you while verbally saying stop resisting. The camera doesn’t lie. This is how they try to deceive and manipulate the video because they know their voice is being recorded and often the view is obstructed. This is to mislead anyone watching to believe what they are hearing, “Stop resisting”. I think we all recall watching a standers cell phone video as the cops murdered George Floyd and as the murder took place, the cops kept saying. “stop resisting”. The man said you’re killing me, I can’t breathe, they laughed and kept saying, “stop resisting”. After he was unconscious and had urinated himself, the three officers continued to hold him down while one officer continued to strangle him from unconsciousness to death. If it wasn’t for the bystanders videos, only the officers voices would have been believed with their obstructed close up views. I didn’t see a single good cop in the video stand up. I didn’t see a single good cop call for an ambulance. That means they all agreed by non action to deny this man medical treatment for the serious assault with serious injuries they just inflicted on him. They should all be ashamed. Y the way, not a single one of us believe the lies put out in this video that we are looking at a green car. It’s a silver car, far from green. Your mouth lies but the video doesn’t.
