Mendocino County Jury Finds Defendant Guilty of Unlawful Possession of Cannabis

A Mendocino County Superior Court jury returned from its deliberations Wednesday morning to announce it had found the trial defendant guilty of a marijuana misdemeanor.

Kimanie Andre McKoy, age 38, of El Cajon, was convicted of unlawful possession of more than 28.5 grams (one ounce) of black market cannabis, a misdemeanor.

The defendant was found not guilty of a separate charge of misdemeanor transporting for purposes of sales.

The defendant was stopped by the CHP half past midnight on November 6, 2023 for speeding (75 in a 55 mph zone) and weaving on Highway 101 southbound between the Crofoot Ranch and Hopland.

During the course of a DUI investigation, it was discovered that the defendant was in possession of 13 pounds of processed but unlicensed marijuana in the trunk of his rental car.

The law enforcement agencies that provided testimony in court on Tuesday was the California Highway Patrol, along with expert marijuana testimony from the DA’s Bureau of Investigations.

District Attorney David Eyster presented the People’s evidence to the jury during the two-day trial spread over three days.

Retired Santa Clara County Superior Court Judge Janet Clark presided over this week’s trial.

While we’re on the subject here, let me recommend a . . . pretty good book I’m just now at the tail end of, Weed Land, by Peter Hecht. It goes through the whole history of all this stuff with the Emerald Triangle, medical marijuana collectives, etc. Quite extensive, if a bit dry in parts (no pun intended).

CrowFoot ranch? Bonehead. I’ve rarely passed through there and have NOT seen CHP or a sheriff cruising around there. It also has spots on either end of that little valley that have taken the lives of people who treat it like a race track.

Pretty common speed on 101 now-a-days.
Sooner or later they usually end up wrapped around a tree, a head on collision, or over the bank.

13,000 lbs on a semi would still be a misdemeanor – for possession, sales or transport –
75 or more is common on the freeway portions of 101 but not so much on the residual two-lane portions – that’s why the dunce was pulled over –

That section of highway has uneven and poorly banked pavement and very poor lighting if it’s raining and shiny. I’ve been straight sober maybe a little tired and pulled over there for “weaving”, It’s a choke point where the cops always have a built-in reason to pull over and search. In my case they only found an ounce of herb in the trunk. They let me keep it and go. But yeah this guy was a moron. Never speed with weed…Sure it’s “legal” but not for poor people- only the permit pansies who paid them off

A jury trial for a non violent cannabis misdemeanor? The fact DA David Easter personally presented this case is ultra shocking . How much did this case cost the county to prosecute ? I am guessing this trial cost the county six figures ..apologies to this jury.
