The tax cuts enacted in 2017 were written so that they sunset for the lower 4 tax brackets in a staged fashion with the last one sunsetting this year for the lowest bracket. Tim, let me break this down in layman’s terms:
If you bought a house in 1980 for 80K. Then in 2025 you sell the home for 481K, there are 401K worth of long term capital gains, which puts you above the 400K threshold of investment income. Therefore you would owe the Biden administration 44% of that 401K, or $176,440, and you walk with $224,560. Your investment, your risk, Biden takes half. Same goes with cashing your stocks that you bought 30 years ago for retirement, now Biden takes half of your gains.
Except for the minor inconvenient fact that any money you spent on improvements would be added to the basis, hence you wouldn’t be starting at 80k and you get a $250k ($500k if married filing jointly) real estate exclusion from capital gains. Plus you’d never pay the top 44% on the entire amount, only on the part over the $400k limit. And that would only apply if you also had a taxable income over $1million. Otherwise your rate would be 0% or 15% depending on your income.
The proposed taxes on unrealized gains or capital gains at the top rate only apply to those with a taxable income of over $1million and over $400k in investment income. Hence if you sell just some of your stock each year you’d likely stay well below the $400k limit. And if you aren’t, you only pay the top rate on the amounts that exceed those limits. You never pay the top rate on the full amount.
You folks are getting bent out of shape over something that will never affect you. If it does affect you, I hope you’ve got a decent tax adviser because you clearly don’t understand how the system works.

Nope. It’ll put a dent in the current budget deficit which will slow the growth of the overall debt but that’s all. The problem is we are so used to kicking the can down the road that no knows how to stop.
That’s not the likely result for the vast majority of people. Few people own multiple homes and one home is pretty well protected with home exemptions from capital gain taxation. However it may serious reduce the current tax advantage for companies buying homes who use the lower rate of capital gains taxation to lessen their tax bills as a business. And it may cause the housing bubble to burst. We all know what that looks like.
Frankly the whole darn tax code is too complex and is designed to be a tool for Congressional power mongering. And always results in massive efforts to find was to minimize taxes. It needs an overhaul but that is never going to happen. Instead people will continue to be taxed based on politics.
