‘Local Attorneys Needed to Service as Private Defense Counsel’: County of Humboldt

Humboldt County Seal 2017The County of Humboldt is seeking private defense lawyers to serve as panel attorneys in Humboldt County’s Court-Appointed Attorney Program (HCAAP).

Through this program, private attorneys represent public clients when defendants’ cases cannot be handled by either the Humboldt County Public Defender or Conflict Counsel, primarily due to conflicts of interest, such as when either agency has already represented or currently represents a co-defendant in another case involving the client.

Attorneys who are interested in serving as a private defense attorney with this program must submit an application. The application form is available online by visiting the Humboldt County Court Appointed Attorney Program’s web page.

Once attorneys are approved through the application process, their names are added to a panel, which lists the attorneys available for assignment. Attorneys are then notified when clients need representation and staff works to match attorneys up with cases.

Well, Attorneys may well be needed for some other jobs, in Eureka and beyond…

Your erstwhile new Mayor, Eureka, may well cry herself to sleep after the trend to clear the homeless bleeds over into the unhoused bleeding the towns dry of funding with specious lawsuits charging cities and towns everywhere of “violating their rights and destroying their property”…

I predict that Ms Bergel will quickly become the ex-mayor, over this mess, when she is in line to be personally sued…

Meanwhile, a visit to Yuba City revealed an abandoned looking town, with many “Help Wanted” signs on well established businesses, like Future Toyota and McDonalds and many others, a large population of guys with “anything helps” signs, and a town utterly incapable of delivering goods and services in a reliable and organized fashion…

Attorneys love suing insured incorporated towns, and Eureka, as well as Humboldt, may soon need every hand on deck…

Also, a ghastly economic meltdown, unlike any to ever hit this planet, is predicted, and the country you live in could easily no longer be able to cope with the sheer number of people living in the streets and forests…

The legacy of COVID, the “great resign” and the destruction of every economic entity extant could easily make this above notice moot, and the loss of a trailer with shredders in it will be the least of all problems…

It is also significant that the County is paying attention to “Conflicts of Interest” during legal proceedings, when several of the County Supervisors have apparent “Conflicts of Interest” within their personal businesses and concerns…

They need attorneys without conflicts of interest? Wow, I agree with that. I am not going to tell the story of my personal experiences but be careful who you let volunteer, thoroughly vet them to make sure they really have no interest conflicts.

They need private criminal defense attorneys. The Public Defender and Conflict Counsel provide indigent criminal defense. Sometimes both of those offices can have what is called a “conflict” due to the fact that their office has previously represented a codefendant, a witness, a victim, etc. When that happens the county farms the cases out to private defense attorneys, who contract with the county for indigent defense, for representation of criminal defendants. This is what they are talking about when they say they are in need of local defense attorneys to serve as private defense counsel. They will be representing criminal defendants who are facing charges. The private defense attorney would have no conflict of interest unless they too had represented an involved party in the case, or are closely connected with a party.
