California Attorney General Rob Bonta Issues Legal Guidance to all District Attorneys, Police Chiefs, Sheriffs, and State Law Enforcement Agencies: We Will Not Cooperate with Out-of-State Demands Criminalizing Reproductive Care

California Attorney General Rob Bonta today issued legal guidance to all California District Attorneys, Chiefs of Police, Sheriffs, and State Law Enforcement Agencies on Governor Gavin Newsom’s Executive Order N-12-22 prohibiting the extradition — or removal — of individuals providing or accessing reproductive care in California. Since the Supreme Court’s decision overturning Roe v. Wade, more than a dozen states have instituted abortion bans and restricted access to reproductive care for millions of their residents. In particular, anti-abortion laws in anti-choice states authorize the criminal prosecution of those who seek, perform, or assist others in obtaining abortions. In today’s bulletin, Attorney General Bonta emphasized that California law enforcement is prohibited from cooperating with the removal of a non-fugitive individual seeking, providing, or assisting with access to reproductive care in California, where abortion is safe and legal.
“Abortion is safe and legal in California — if you come to California in search of reproductive care or if you’re a Californian helping someone to access reproductive care including abortion, we will protect you. Our law enforcement will not cooperate with efforts to remove you or investigate your actions,” said Attorney General Bonta. “Everyone deserves access to a safe and legal abortion, if they so choose. My office will do everything in its power to fight back against those trying to strip individuals of power over their own bodies and futures.”
Currently, anti-abortion actors in anti-choice states are considering ways to track and monitor potentially pregnant individuals, their providers, and those who may assist and support them in receiving abortion care. Many anti-choice states are also considering legislation to attempt to extend criminal and civil liability outside their own state borders to patients, providers, and those who assist others in obtaining abortions. Under California Penal Code 1549.1, the Governor has the discretion to deny the extradition of a non-fugitive whose surrender has been demanded by the executive authority of another state. The Governor’s Executive Order explicitly states that he will deny all requests for the extradition of non-
fugitive individuals seeking reproductive care, or anyone assisting them, within the state. In today’s guidance, Attorney General Bonta outlines the following steps for law enforcement who are asked to surrender non-fugitive individuals providing or accessing reproductive care in California:
- Under California law, law enforcement has no obligation to make an arrest based on an out-of-state warrant;
- Law enforcement should closely examine any out-of-state warrant before taking an individual into custody;
- Before bringing forward any charges, prosecutors should closely review an out-of-state warrant and verify access to reproductive care is not misconstrued under other California criminal laws such as child neglect, child abuse, drug use, or murder; and
- Law enforcement agencies should immediately contact the California Attorney General’s Office if they have any questions regarding an out-of-state warrant or the Governor’s Executive Order.
California Attorney General Bonta has been a staunch supporter of reproductive rights. In June, the Attorney General issued guidance on abortion rights and protections under California law, which remain fully intact, following the U.S. Supreme Court’s decision overturning Roe v. Wade. In preparation for the Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization, Attorney General Bonta issued an information bulletin to law enforcement to remind them of state laws protecting access to reproductive healthcare and security for providers. He also issued a consumer alert warning Californians seeking reproductive health services about the limited and potentially misleading nature of the services provided by crisis pregnancy centers, and emphasized health apps’ obligations under California law to protect and secure reproductive health information.

Has any other state requested, even once, records of their citizens getting a California abortion or is this just a political stunt?
Actually, since it has been proposed in a couple of States to criminalise travelling to another State go get an abortion, getting the information about the governor’s EO out before it happens seems reasonable. Waiting until it happens would be too late.
This is an indication of the gross stupidity of the Supreme Court in shuffling off such a basic rights issue to the State legislatures. Imagine if a State declared gambling illegal there but also wanted to arrest everyone who went to Los Vegas to gamble so asked the Nevada polce to get records of anyone who they thought might have gambled. Or if a State with restrictive gun legislation wanted to be able to get the local police to find out who shot an illegal gun in another State even though that gun was never taken out of the area. Or anyone a hundred other things. Most States would not try but more fanatics at every level of government, it will become a problem where there wasn’t one previously.
Or the converse, if refusing to honor an extradition order becomes so controversial and non routine, that it becomes a tool for criminals to evade consequences because the law is not applied uniformly. This started with illegal immigrant sanctuary but can obviously apply to a lot of other things. No that’s wrong. It started with Congress refusing to legislate a better law involving any controversial issue.

Arkansas, Louisiana, Texas, Alabama certainly hold political and social ideas similar to your own. I’m very happy here. The joy of waking up in our beautiful little home here was worth all the effort to be here and it wasn’t easy either. I agree with our states efforts on so many political and social issues. I moved here because of those issues. Don’t spend another day being unhappy. Giddee up and go where you would be happier. It’ll be like a ton of bricks was lifted off. Go check it out as soon as possible then come back with a sound decision and tell us all about it!
A state’s laws only apply within that state, that is the beauty of federalism (let each state make its own laws and govern themselves as they see fit). USA is too big and too varied for the one size fits all approach to always work.
If we want to avoid dictatorship in USA, the states have to claw back power from the federal govt and Congress has to claw back power from the courts and President.
But Federalism exists because a bunch of different laws inside a State de facto create problems in other States. Treating States Rights as an absolute mean fifty one seperate countries. The Constitution recognized this is defining which powers are assigned to which entity and allowing those definitions to expand. It’s like slavery issues that created a war between States. Such a powerful issue could not be confined to those States that permit it and those that don’t. Will there be an Underground Railroad for abortions? Because while anti abortionists are adamant and there have been almost universal laws against it throughout history, those laws only made abortions dangerous but could not stop them just like pro slavery laws could not stop slaves from escaping.
California does what it wants despite federal laws? Too bad California does not back its commercial driver license holders. Federal law defies it and California goes along with it. There is a crisis pregnacy center in Ukiah that tricks women into ultra sound when they come in for a test. If you are looking for a pregnancy test and the clinic starts about scheduling an ultrasound women should go somewhere else to keep their options and not be guilted and lied to and forced to have a procedure women don’t need or want.
I had an ultrasound on my heart (echocardiogram) and it didn’t hurt in any way so why not look at the ultrasound of the baby if it’s free? In fact, get a copy for the family album!

First here was never Mexico. In fact even the Spanish did not really claim Alta California until the early 1800s. If you mean Spain as a colony, well they claimed all the Pacific as their own without any more justification than any other colonists of the time. Actually less. Nonsense. The Supreme Court is trying to make it a state rights issue and the anti abortion States are mulling over telling other States that they hold sovereignty over what their female residents do in other States. That’s pretty out of state.
Hopefully Congress will develop a backbone and put some limits on these out of control anti abortionist. Congress can certainly do something about States trying to tell their citizens what they can’t do in another State even if they can’t muster the voyage to protect women from arbitrary control of their pregnancies. If Congress can’t frame a significant law about that, then the Civil Rights Act, Indian gaming laws or a host of other things will fall under the same thinking.
