After a last-minute postponement and a misprinted time on a hearing document, former Ukiah Police Sergeant Kevin Murray was finally sentenced yesterday afternoon in a packed courtroom. Superior Court Judge Ann Moorman imposed two years of formal probation, with a two-year suspended sentence. That means that if he slips up once, he’ll be sent to state prison. Moorman told Murray that includes missing one appointment with his probation officer or having one beer.
“One step on this side of the line, and you are going to the joint,” she promised.

Murray was originally charged with multiple sex crimes, burglaries, and possession of narcotics, but pled no contest to one felony count of intimidating a witness and one misdemeanor count of falsely imprisoning another woman. Each crime involved a separate victim who originally accused him of sexual assault. Moorman told the public that “it was very clear to the court” that the District Attorney’s office was proceeding on the good faith belief that if the case went to trial, the prosecution could not prove Murray’s guilt beyond a reasonable doubt.

Deputy District Attorney Heidi Larson said she had “no comments” when she was approached outside the courtroom, so it is not clear why the DA did not summon a third woman, whose claim of an assault in a hotel room is now proceeding in civil court, as a witness. It is widely known that the third victim, a former Ukiah Police officer, is pursuing her case against Murray in civil court because the District Attorney declined to prosecute. In a memorandum submitted one day before the sentencing, Larson wrote that the statute of limitations had expired in that case, but that “this possible third victim…may still have her day in court.”

Larson’s memorandum referred extensively to a probation report prepared by the Sonoma County Adult Probation Department, which recommended a stiffer penalty than the one agreed to by Murray’s defense attorneys and the District Attorney in July. The written memorandum supporting Sonoma County’s recommendations did not mention a significant omission. But yesterday in court, Larson declared that “It is a bit dismaying to the People that Sonoma County did not get Jane Doe’s report.” Jane Doe is the woman who accused Murray of sexually assaulting her in her home, and the report included the information that he was armed at the time of the alleged assault. That charge was later reduced to misdemeanor false imprisonment.

Moorman invited Jane Doe to speak to the court, but due to difficulties with the remote connection, only several loud shrieks of sustained electronic feedback were audible. It is unclear if Jane Doe knew she was being offered an opportunity to speak. Multiple people who were tuning in to the proceedings via zoom complained later that they were unable to see or hear what was taking place.

In her memo, Larson wrote that her office now disagrees with the indicated sentence of probation with no additional jail time that Moorman telegraphed she would impose at a hearing in July. Larson wrote that the prosecution did not join in that sentence at the time, and urged the court to impose “additional punishment,” including further incarceration. Murray has served 104 days in county jail, and is out of custody at this time. But Moorman said the lawyers on both sides, whom she estimated have 65-70 years of legal experience between them, worked out the plea deal between themselves and brought it to the court. She said it was “readily apparent that Murray would be receiving probation. The prosecution was not surprised by probation.”

He was originally charged with breaking into a motel room twice in one night, each time sexually assaulting a woman known as SY. Though that charge was replaced with the felony of intimidating a witness, which means he will not have to register as a sex offender, Larson asserted that “the court is required to consider the crimes originally charged and factor in those facts in crafting an appropriate criminal sanction.” The City of Ukiah settled with SY for a quarter of a million dollars, which former Police Chief Noble Waidelich insisted was not an admission of guilt. Waidelich has since been fired for reasons that have still not been shared with the public, and he is being sued for domestic violence in civil court.

Moorman told the public that, given the much-reduced charges, she could only legally sentence Murray to 16 months or two years. She said she does not believe the charges merit 16 months, and that if she sentenced him to a three-year suspended sentence, it would be overturned on appeal. However, she dismissed an alternative recommendation, that Murray go to county jail for 364 days, as “unsound,” because that would knock out the possibility of supervised probation. “We won’t have anything left to sanction him with if he goes to county,” she said. “Do we want the sanction to be nominal, de minimis? No, we do not.” She insisted that the sentence “should not be interpreted as a slap on the wrist, or disparate leniency not accorded to other defendants;” and that the victims as well as Murray himself “deserve finality.”

Moorman ordered Murray to report to Mendocino County Probation, which will then refer his case to the probation department in the county where he resides. She ordered him to continue receiving counseling from Veterans Affairs for PTSD he claims to suffer as a result of his military service and his time as a police officer. He has also been diagnosed with bipolar disorder, and is under psychiatric treatment for the condition. She also ordered him to participate in a certified treatment program for sex offenders for at least one year. It remains undetermined exactly which program he will participate in, since her preferred program is three years long, and Murray will only be on probation for two years.

Murray is also forbidden to own weapons, including pepper spray or bow and arrow, or have alcohol, any drugs including marijuana, or any drug paraphernalia on his person or any property he controls. He will not be allowed to go to businesses whose primary business is selling alcohol. He must submit a DNA sample to the court, and he will be subject to search and seizure and drug testing at any time of day or night by any sworn police officer.

Moorman told Murray she believes he is genuinely remorseful, as he expressed in a letter he wrote to her earlier this month; but that genuine remorse and the harm caused by his conduct are not mutually exclusive.
“The damage you have done to the Ukiah Police Department cannot be underestimated,” she told him near the end of the proceeding. “It will take generations for trust in law enforcement to be fully restored because of your conduct.”

It keeps happening that men are prosecuted for abusing women that the man has an improper relationship with…

This guy, a sworn officer, continued to work for Ukiah, for years, while a co-occurring multiple felon!

While it seems easy to get cops fired, it seems easy to collect damages from cities, and it’s apparently easy to get off pretty unscathed from committing crimes under the color of law…

Ukiah is a shining beacon of corruption, high order incompetence, and automatically promoted leaders who have few qualifications (and are touted for their “experience”) and exceptionally slow course correction coefficients…

Only in Ukiah, would a serial rapist/drug user/police officer be sent back to the streets to continue to wage war against Women…

The other thing which suffers, is the descriptions of the victims and the exact crimes committed, which we will probably never be subjected to in the press…

This officer will undoubtedly be hired somewhere else, or he will become just another Mendocino Drug Kingpin, or he will be found guilty of increasingly serious offenses, until he is killed in a State Prison.

Written by a man who worked with abusers and rapists in prison and out in court ordered therapy. They do not change. There is no therapy that stops a man from beating and raping women. Maybe it’s time the bailiff change the courtroom announcement to, “All rise for the dishonorable judge Ann Moorman.” It’s not likely to happen to her or any of the other “judges” who disgrace the bench, but one again it proves we have an injustice system, not a justice system.

This is shitty. This guy should’ve got prison time. He used his position as an officer to break the law, acting like he was above it. This should carry a heavy penalty for putting mistrust of law enforcement in the public. Imagine if one of the victims had defended themselves with deadly force. That’s what things like this will come to. Protect yourself and your loved ones. Law enforcement and the justice system will not.

Since this does not seem to happen to the hundreds of violators reported on this site and in other media, why would anyone believe it in this case.
This sentence is a brutal slap in the face to the victims of this disgusting person and to the entire community. SHAME SHAME SHAME.

It’s the plea bargain, agreed to by the prosecutors, not it’s resulting reduced sentence, that is the slap in the face.

This lenient sentence isn’t on the judge so much, as it is on the prosecutors.

The prosecutors let him slide…

Murray probably “knows where all the bodies are buried”, so to speak…

If he decided “to spill the beans” on what he knows of the UPD, their reputation might be properly tarnished.

They let him walk to keep him quiet.

I’m sure that there is lots of other shenanigans that UPD has a history of.

Exactly. This way there is no witnesses telling stories and opening the can of worms. Instead, now they can ignore all that and hope they can throw him in jail for something they won’t have to open cans for. It is a cover up.

Plea bargain is on the DA.

Maybe the DA thought this was best deal she could get (knowing that perp is extremely likely to violate parole).

Maybe DA was afraid to go to trial cuz she does not like to litigate and much prefers plea bargains.

Maybe the DA is overwhelmed with so many perps to prosecute and wants to lighten her case load any way she can.

Maybe the DA is corrupt.

The DA agreeing to a plea bargain and then trying to back out of her deal at the last second means her word is not her bond.

Ex Willits PD officer Derek Hendry under investigation for sexist racist remarks about former Willits PD captain who was a black female. He created a hostile work environment. Sheriff deputy JD Comers son , Bailey Comer arrested for child porn viewing on home computer…… this is just the recent cases. What is wrong here. Cops on duty assaulting local women. This is just what we have heard about RECENTLY. Then there is the RICO case involving multiple law enforcement. Mendocino County needs to be investigated. This judge just proved it is invasive toxic environment.

This sucks but there’s a lot of unfairness out there. For instance why wasn’t there a committee appointed to investigate the race riots like the Jan 6 committee? Why was the fbi instructed to stop Hunter Biden investigation prior to 2020 election? Why did Dems order raid on mar a lago? It only gets attention if it fits the political agenda that’s why. Got Fox? They can investigate Biden (any Biden) all they want as far as I’m concerned. But the whole narrative that the Dems ordered the FBI to raid the Trumpster is absurd. The FBI bent over backwards to get DT to return the stolen, highly sensitive documents from his not-very-secure resort, with all kinds of people filtering in and out who could have had access to them. There was even a Russian woman staying there recently under a fake identity as a princess from wherever.
Trump’s whole theme all along has been “they’re picking on poor, innocent me”, while in reality he has gotten away with more than any president by pushing and crossing the lines of legality, morality and decency in his narcissistic need for power at any cost. He even tipped his hand by admitting before the election, when it became clear he might lose, that he would call it a rigged election. And people fell for it. But I think his days as a gov’t employee are over, and like everything he touches, he leaves behind a trail of destruction.

Fair enough, but you forgot to punctuate every talking point with a “cmon’ man”. Look I don’t know why trump kept documents but all presidents do and I understand trump declassified everything prior to removal. Can you really say, with a straight face, that dems are not looking to covertly eliminate a political dissident because they fear him? The election was rigged to some degree from open borders to mail in ballots. Remember early 2020 during the height of covid, one of Newsome’s first moves was to establish mail in voting. Seemed odd even at the time. So yeah mendo’s open air asylum issues pale in comparison.

Mail-in voting during the height of covid made sense since it allowed people to avoid crowds and reduce infection rates. Makes perfect sense. All Oregon voting is mail-in, has been for a while, and works fine. If you track Trump’s plainly displayed egomaniacal personality, it makes sense that he would take classified material with him for nefarious purposes. Presidents may take papers with them but not box after box of documents classified or not. He clearly has love and respect ONLY for himself, certainly not for the nation that has allowed him to amass great wealth despite his malign personality. No respect or love for the “last great hope of humanity.”
yeah, I can say it with a straight face. The Jan-6 Hearings are not “covert”. They are wide-open and public. You can’t handle the truth. Hillary made a gracious concession statement in 2016. Trump’s bogus moaning about fraud with no evidence sets the stage for Dems or anyone to do the same thing which will destroy America. Why is that so hard to understand? You have elections and you win or lose and go on to try again. I fear Trump like I would a rabid skunk.
Trump took an oath in public to defend and protect the Constitution. He violated that oath in front of millions by calling his MAGA maniacs to attack our Capitol. Did you miss the videos? Trump must be prosecuted for crimes committed in front of millions of witnesses.

Declassifying those documents is not a thing. He can’t do it and he didn’t do it, just making that claim now.

The “race riots” you refer to were not ideal, but peaceful, vociferous public demonstrations in response to the police murder of George Floyd and others are NOT in the same league as Traitor Trump calling in his MAGA Morons to attack our Capitol because Big Baby lost a free and fair election.
Donald John Trump and his sycophants, supplicants and mendicants are the biggest domestic threat to the United States of America since the Confederacy. So proud. Proud Boys. Proud Punks.

He will never make it if properly supervised by probation department “in the county where he resides”.
