Cal/OSHA Aligns COVID-19 Workplace Rules with CDPH Guidance

The Division of Occupational Safety and Health, better known as Cal/OSHA, revised COVID-19 safety regulations for California’s workplaces. [Thursday], Gov. Gavin Newsom issued an Executive Order to implement the relaxed rules effective immediately.
Some of the revised regulations include:
- Only unvaccinated workers are required to wear face coverings indoors or in vehicles.
- Fully vaccinated employees are not required to wear face coverings, and no one is required to wear face coverings outdoors.
- In certain high-risk settings such as health care facilities and during workplace outbreaks, all employees must wear face coverings indoors and outdoors when physical distancing cannot be maintained.
- Fully vaccinated workers without symptoms of COVID-19 do not have to be tested or quarantine after an exposure to the virus.
- Physical distancing and physical barriers are no longer required with exceptions only for outbreaks in the workplace.
- Upon request, employers must provide unvaccinated employees with respirators at no cost for voluntary use.
- Employers must offer no-cost testing for COVID-19 during paid time to unvaccinated employees who develop symptoms or are exposed to the virus, vaccinated employees who develop symptoms, unvaccinated employees in an outbreak, and all employees in a major outbreak.
Employers are also required to maintain confidential records of vaccination status for any employee not wearing a face covering. Options include:
- Employees provide proof of vaccination (vaccine card, image of vaccine card or health care document showing vaccination status) and employer maintains a copy.
- Employees provide proof of vaccination. The employer maintains a record of the employees who presented proof, but not the vaccine record itself.
- Employees self-attest to vaccination status and employer maintains a record of who self-attests.
A person is fully vaccinated 14 days after completing a two-dose vaccine series or receiving a single-dose vaccine authorized by the US Food and Drug Administration or the World Health Organization.

This decision by Cal/OSHA aligns rules for workplaces with the State Public Health Officer Order issued on June 11, which outlines ongoing COVID-19 safety measures, and the California Department of Public Health’s (CDPH) masking guidance that allows fully vaccinated people to go unmasked in almost all public settings.
Unvaccinated people must continue to wear masks in indoor public settings, and all people must wear masks in the following places, regardless of vaccination status.
- Public transit and transportation hubs
- Indoors in K-12 schools, childcare and other youth settings
- Health care settings
- State and local correctional facilities and detention centers
- Homeless shelters, emergency shelters and cooling centers.

Cal/OSHA establishes masking policies for workers, while customer masking is determined by each individual business. According to CDPH (cdph.ca.gov/Programs/CID/DCDC/Pages/COVID-19/guidance-for-face-coverings.aspx), businesses have three options to accommodate unvaccinated individuals:
- Provide information to all patrons, guests and attendees regarding vaccination requirements and allow vaccinated individuals to self-attest that they are in compliance prior to entry.
- Implement vaccine verification to determine whether individuals are required to wear a mask.
- Require all patrons to wear masks.

Relying on antibody testing at this time is not advised because of the high prevalence of false positives. The tests need some work yet. You seem to be mixing politics and medicine and they do not mix.
False positives are the issue. But not in antibody testing.

Except that studies to determine the effectiveness of the vaccines all found the vaccines were effective at preventing infections. If they were not effective, and instead a large portion of the population had natural immunity, these studies wouldn’t have found the vaccines to be effective. Unless you want to claim that only people who had natural immunity got the vaccine, including in a couple of randomized controlled trials, your theory simply doesn’t match the abundance of available data. When this happens, you need to decide your theory is false, and revise or replace it.
It’s a basic math problem, at least, at least 180,000,000 Americans have had covid. That’s at .33 percent fatality rate which is on the high end of the spectrum. At every different possible mathematical equation, it all comes to a similar number, usually a little higher. Did vaccine save allot of life’s? Absolutely. Not as many as you think though. If herd immunity is 70 percent, then .33 percent fatality rate of America would be roughly 770,000 people. So at this point if the deaths stopped, which they almost have, the vaccine saved 170,000. Doesn’t seem so miraculous in a math equation.
That 180 million figure is pure guess work as there have only been 33,341,986 confirmed cases. That gives us a 1.79% fatality rate for confirmed cases. It doesn’t mean it’s bad guesswork, just that it lacks any hard evidence that it’s correct which the confirmed cases and case fatality rate has. We know the confirmed cases are an under count but we don’t *know* by what magnitude because we don’t have extensive enough testing and won’t ever have it.
149.1 million people have been vaccinated although some percentage of those will be people who had COVID but got vaccinated anyway. If all of those folks had a confirmed COVID case and using the case fatality rate of 1.79% you would end up with 2.7 million deaths avoided.
Combined, the vaccinated and confirmed cases give us about 53% of the population with some level of protection against the disease. The remaining 17% (between 53 and your number of 70% for herd immunity) is around 57.8 million additional cases. If we just use those at the case fatality rate from the CDC that would be around 1 million more deaths so even at the lower vaccination rate you’d have avoided 1.7 million deaths.
Admittedly this is all just playing with numbers and suppositions and there are very large uncertainties with the data. You can either take the data that we know (confirmed cases and case fatality rate) or you start guessing about how many people had the infection but never got tested for it either because they didn’t have serious symptoms or they refused to acknowledge the existence of the virus.
Not trying to minimize covid, but you have to read up on IFR compared to CFR. You can’t use CFR in your equation, it’s not a accurate number. You’re 6 months behind in the arguemnet. CFR is useful for many things but not that. Admittley there are problems with my math, herd immunity is a pure assumption, but once again a agreed upon assumption by experts, fauci doesn’t count as he said he raised the number to combat vaccine hesitancy. Brazil’s numbers also throw a slight wrench into the equation,
I agree that the Infection Fatality Rate is a far more useful number, the problem is that no one knows how many people have actually been infected with COVID. There simply isn’t any good data yet so the numbers are what we call SWAG (Scientific Wild Ass Guess). There have been a few serology studies but those are extremely limited in scope and not readily generalizable to the population as a whole.
Herd immunity isn’t a set number because of the different rates of communicability of different diseases. And with COVID variants themselves having different rates of communicability, the job of deciding what the number should be is difficult. So I’d cut the folks a bit of slack.

Oh, and did you mean the vaccine was found to be effective at preventing some infections, but that it actually doesn’t literally prevent infection?

They’re not completely tracking breakthrough cases because they decided to respect your privacy in the vaccination process. Quite simply, other than asking you, they can’t really tell if you’re vaccinated. And a certain percentage of people refuse to talk to them. Since you can assume the same people who refuse to talk to them are the same people who didn’t get vaccinated, chances are they actually can make a pretty good guess, but it’s not perfect.
The vaccines have been found effective at preventing infections. I have linked you to the studies before. Multiple studies have found they were over 90% effective at completely preventing infection, and even more effective (96-97% for pfizer) at preventing serious illness and death.
Some of the studies have used control groups with placebo vaccinations to confirm the vaccine’s effectiveness.
Please come up with a coherent theory as to why Fauci would want you experiencing vaccine side effects. Such a theory should have a clearly described method by which this would benefit him.

The big pharma effectiveness numbers are fake. Australia and Israel are reporting that 98% of the hospitalised patients are fully vaccinated. That is why they brought back the mask mandate for all. I find all of these comments fascinating. Had a great time last night, went out for a friends birthday.
