Covelo Man Arrested After Restraining Order Violation, Found With 12-Gauge Shotgun in His Vehicle, Says MCSO

This is a press release from the Mendocino County Sheriff’s Office. The information has not been proven in a court of law and any individuals described should be presumed innocent until proven guilty:

On 05-07-2021 at about 10:30 AM, Mendocino County Sheriff’s Deputies were dispatched to contact an adult female regarding a violation of a temporary restraining order.

A Deputy responded to the Covelo area and eventually made contact with the adult female in the early afternoon.   The Deputy learned Cort Miller had been served earlier in the day with a temporary restraining order where the adult female was the protected person while Miller was restrained from having any contact with her.

The adult female noted approximately 30 minutes after Miller was served with the restraining order he violated it by telephoning her phone and leaving harassing messages.

Present with the Deputy was a California Fish and Wildlife Warden (CFW).  The CFW Warden was provided a description of Miller and a vehicle he was last seen driving.

A short time later the CFW Warden located Miller in a vehicle at about the 25000 block of Barnes Lane in Covelo.

The Deputy responded to the location and met with Miller, subsequently arresting him for violation of restraining order.

While inventorying Miller’s vehicle prior to towing and storage, the Deputy located a single shot 12-gauge shotgun in the trunk of the vehicle.  Miller is a convicted felon and prohibited by from possessing firearms or ammunition.

Miller was additionally arrested for being a felon in possession of a firearm and possession of ammunition.

Miller was booked into the Mendocino County Jail where he was to be held in lieu of $25,000.00 bail.

Man these gun laws are really keeping guns out of the hands of criminals. For those that do not know here is a short lesson……….

1. Illegal at the federal level for a felon to posses firearms since the 1930’s

2. CA law prohibits a fwlon to posses a firearm or ammo

3. CA requires a background check whenever a firearm is bought since 1994 or so

4. CA now requires buying ammo you get a background.

5. 15 day waiting period when you buy a firearm. If the young lady needed a gun for protection she would have to wait 15 days to pick it up.

6. Illegal to own or posses a firearm with a restraint order against you at state and federal level.

Yea gun laws do not work. All they do is keep firearms out of the hands of honest people and do not let them protect themselves. Criminals are not going to follow gun laws as this case and many others posed here on a daily basis proves

When did they change it from a 10 day wait to a 15? Less access to mental health facility’s=more mass shootings. I’m almost always against more government spending but maybe we could bomb less kids in the Middle East and use the money to hire some psychotherapists for the schools to help diagnose and treat mental disorders of all kinds at a younger age? That might work better than argueing over what color your gun is.

I just purchased a handgun and the waiting period is ten days. Although I certainly agree that law abiding individuals should be able to keep and bear arms, we also have ridiculously high levels of gun violence in the US that would be immoral to ignore. What are your solutions? Studies of background checks and gun violence indicate that they do save lives. Unfortunately, laws are different from state to state. Our neighboring states have very liberal gun laws. Additionally, only recently have background check ammunition laws been in place so we still don’t know what the outcome will be. Finally, there are new laws regarding locking up weapons and immediately reporting them missing which should help. What would the US be like if we had unrestricted access to guns? Again, ignoring the extreme rates of gun violence in the US is immoral. Further liberalizing gun ownership and carry without proper scrutiny, which is what the right seems to think is the answer, is immoral.

In my opinion, these are some of the things we should be doing nationally to reduce gun violence:
1) Expand background checks to all purchases and transfers of all guns.
2) Expand background checks to the purchase of ammunition on a national level
3) Initiate red flag laws and establish a system where checks on mental illness are possible
4) Apply more scrutiny to those who want to own modern semi-automatic weapons with high capacity magazines. They must undergo psychological evaluation, provide character references, and must be open to unannounced inspections of weapons and their storage. Additional fees must be paid to own these weapons which will pay for implementation of these measures.
5) All gun purchases shall include testing similar to that required for California handgun purchases.
6) Increase scrutiny of parolees and felons with violent crime convictions so that at least annually they are subject to unannounced search for the possession of weapons or ammunition.
7) Change the focus of our penal system to one of rehabilitation instead of retribution. Criminals need the opportunity to rehabilitate and become productive and law-abiding members of society. Legalize drugs/end the war on drugs and focus on recovery and rehabilitation.

Number 7 is a very important one. Anyone who watches this site knows very well that the vast majority of all crimes are drug-related and are done by repeat offenders. People who make mistakes and try to re-enter society face multiple obstacles which makes it so much more likely they will return to a life of crime to survive.

These laws won’t end gun violence, but they can be effective. Anti-gun lawmakers need to move away from banning guns and idiotic scrutiny of how guns look because they hurt opportunities to pass laws that may actually be effective at reducing gun violence. Micro-stamping ammunition and forcing gun manufacturers to pay a fee to get guns to market as California has done will do nothing to reduce gun violence. Laws regarding how a gun looks as has been done in California will not reduce gun violence. Restricting CCW permits will not reduce gun violence as they actually increase scrutiny of gun owners. We need to put more focus on who owns or has access to guns instead of trying to ban guns.

Most mass shootings are with guns legally purchased in states without wait periods or background checks. Thats the problem most states are not as strict as California and yet most mass shootings are not by felons with stolen guns and ammo.

Instead of ‘mass’ shootings let’s go with shooting deaths in the USA with registered vs non registered. All I know is in California is strict enough you won’t pass a backround check with outstanding parking ticket even..to buy ammo if you have changed you address since you bought your firearm prior to 2016 you need to reregister your firearm and pay to do it for a second time . Why can’t the state find that data. I already paid once for my right to own it why should pay to do it again. Yes there should be background checks but I have news for some folks. Who is they biggest arms dealer in the world. Yeah You guessed it. Who sold the truckload of ar-15’s “assault rifle” to Mexican cartel that was liked to a border patrolman’s death. Remember Operation fast and furious. The burgler came before the alarm which means bad people will always find a way. Just let the good people have theirs if they want em. If you don’t want one that is your choice. In a perfect world we could all hold hands sing and dance which I would love but we live within a broken system and that is the reality. We see enough just on this site that justifies my feelings.

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

So I hope all you gun totin’ cowboys are fully signed on with the California National Guard. That’s our well regulated militia. They should have guns, but nobody else.

The second amendment was written when the US didn’t have a DoD that was spending $721,531,000,000 a year but relied on volunteers for the defense of the free state.

How about all the other righs? Do you need to join an orgnization to use those as well? Why is the 2nd amendment diffrent than all others?

The most important being the laws on the books right now are not being enforced.

1. Illegal at the federal level for a felon to posses firearms since the 1930’s (Use a gun in the commission of a crime go to jail, end of story…..we are not doing this)

2. CA law prohibits a fwlon to posses a firearm or ammo (felon in possession of firearm, go to jail, we are not doing this….this guy was a repeat felon that was let out)

3. CA requires a background check whenever a firearm is bought since 1994 or so (this guy obviously would not have passed a background check)

4. CA now requires buying ammo you get a background. (same as above)

5. 15 day waiting period when you buy a firearm. If the young lady needed a gun for protection she would have to wait 15 days to pick it up. (this is a classic point, the lady could not have bought a gun legally to protect herself from this repeat felon in possession of a firearm illegally!!!!!!!!!)

Definition of insanity, maybe, more like it is California being ruled by Demoncrats for decades now, making law enforcement less, and lessening charges for crimes.
