Mendocino County Residents Protest the Tasing, Pepper Spraying, and Beating of Mentally Ill Man by Officers With the Ukiah Police Department

Approximately fifteen Mendocino County residents gathered at noon in Ukiah in protest of what demonstrators saw as a case of excessive use of force when Ukiah Police Department officers tased, pepper-sprayed, and punched Ukiah resident Gerardo Magdaleno on April 1, 2021.

The small protest took place on the corner of Ukiah’s Low Gap Road and Bush Street, in front of the Mendocino County Administrative buildings. At approximately 12:45 p.m., the contingent took their demonstration on foot walking across Ukiah’s Westside gathering on the steps of the Ukiah Civic Center where the Ukiah Police Department has its headquarters.

One participant told us, “I am here to support awareness of mental health. Violence does not help anyone with mental health issues.”

Another said, “Ukiah Police were abusing this man who was clearly in critical condition mentally. That is not okay, The police need to be reigned in.”

One protestor’s sign had a rendering of an open eyeball drawn on it they said was a reference to George Orwell’s novel 1984 and the concept of “Big Brother” along with text that read “UPD: We Are Watching! We See!”

One protestor told us the violence wrought on Magdaleno was representative of the “system of violence that killed George Floyd and other people of color.” 

The fact that not all residents were critical of UPD’s use of force was made clear when a passing motorist shouted, “He deserved it.”

Ukiah Police Department’s reputation in the community has suffered over the last two months since charges came to light against since fired UPD Sergeant Kevin Murray accused of two separate incidents of sexual violence. Those charges include a November 2020 incident of sexual battery, burglary, and drug possession and the second set of charges were filed one month later accusing Murray of rape and forcible oral copulation in 2014.

Since the video footage of UPD officers using force on Magdaleno went viral, the Ukiah Police Department has released a statement speaking to the circumstances that led up to the use of force. They characterized many of the punches seen on the video as “distraction strikes” which multiple protestors at today’s demonstration were critical of. UPD did state they would be further investigating the circumstances to determine whether the use of force was appropriate.

Ok…. this is so different than George Floyds murder.. this Man was running Around naked going Crazy. He wasn’t “Mentally Ill” he was HIGH.. no ones child should have to witness a NAKED adult going nuts in the streets!!! The cop asked over and over for him to get down. He didn’t!!!! What the heck were they supposed to do?? Let the man go about his business?

I work in Eugene. The program you are referring to is called cahoots. It works pretty good and they have a great working relationship with EPD. But they won’t go near a person being violent.

I don’t know about down there, but at least in Humboldt, with the exception of Eureka, going around town naked is not a crime. Regardless of how unpleasant seeing dangly bits might be, it’s not something for which pounding someone’s face into the pavement is an appropriate response. He was unarmed and not acting in a threatening manner towards the police or the public. He maybe a total scumbag, a drug addict, or otherwise not a good person, but at the time, nothing he was doing seems to have warranted a beating. Or do you really want to live in a world where not immediately doing what the police tell you to do is grounds for being beaten or being killed? Would people still think this was an appropriate response if someone refused to comply with a request by the police to put on a face mask?

Beating Rodney King didn’t change his behavior of PCP use, and was arrested for it more than once. You people want to protest, protest the importation of these drugs, or local manufacture of them. Protest that cops can’t bust these people, even though they know where they are. Protest the govt not being able to fly drones over poppy fields and coca fields, and spray them with something to kill the plant, start in south America. Protest that there are no facilities to house these freaks permanently, keeping them off the streets for good. Protest the trauma the 10 year old endured by this animal. But stupid signs saying stop the violence? We agree, stop the violence against the innocent and law abiding victims. Or, let’s have a day where all cops stay home. Everyone of them. Have all cameras off. Then. let the private citizens go around and take care of the problem.

And my gut tells me that you and your ilk would be ecstatic to see someone beat to a pulp for refusing to wear a useless obedience mask. After all, look at the hate filled rage directed at the guy from Fiddleheads, who’s only crime was trying to survive in business and live free amongst others who feel the same. Which is not surprising in a group that deliberately seeks outsized influence in making change. Change is generally not a big deal in conservatives. That innate bias can be counteracted by a professional standard that values objectivity more than change. Unfortunately in a place where their own voices are the only sounds, bias is has become hard to perceive. So objectivity has become a ugly stepsister in the fairy tale. Journalists resist looking at it. And take personal umbrage at the allegation they should.

One time I was in a similar state of mind as that man, but I was at Earth Dance. It took 4 men to subdue me and velcro me to a medical stretcher. They were medically trained professionals from Rock Med. While I still felt like I had my ass whooped the next morning, I dont believe they punched me once. All the brusing was on my wrists, ribs and thighs, from them holding me and pinning me down. I was all scraped up on my face, hands and shoulders from being pinned to the ground.
I done blame them one bit for what they did, I’m actually glad they were there to take me down. It was a very humbling experience. And I learned alot too.

In all fairness the Ukiah Police Department image and reputation has suffered for decades ever since they began welcoming and hiring dangerous officers who were let go from other departments. A thorough background inquiry into these officers histories would make many people lay awake at night. Wolves guarding the chicken coop is an understatement. They beat and abuse people routinely, it is very rare it is caught on tape, if a witness saw this incident it would be your word against the officers word…. “now who they gonna believe”….. thse cops lie…. and whitewash each others wrong doings…. they lie to keep eachother out of trouble while they kick our doors in and steal our posessions. They are the worst type of criminals; criminals with badges and guns…

Schizophrenia is a disease that generally becomes only noticeable around age 20 to thirty. People who never do drugs, even alcohol,or suffer what you’d see as traumas can develop mental illness. Some are diseases of old age like Alzheimer’s. Many people also struggle with mental diseases for a long time before losing control.

I have just recently come across a book. “Hidden Valley Road”.

A family of 12 children. 10 boys and two girls. From 1945 to 1965.

Six of the boys developed schizophrenia. One committed a murder-suicide. At least two died from heart aliments brought on by the medication needed. The three surviving brothers with schizophrenia all live in group homes, at best.

The other brothers lived their younger lives waiting for the hammer to fall, which, thankfully for them, didn’t happen.

It’s an horrific story, for a lot of reasons, but the one positive was that this family’s tragedy helped researchers understand the disease, and it’s genetic roots.

Trauma or drugs. Trauma can cause addiction. Unrecognized Trauma can push a person to drugs. It is not like they woke up and said,” I want to be a drug addict. ” Certainly this man is someones son, or brother, or neighbor! There has to be something disturbing to cause such a person to go bat-shit crazy. When it comes to police protecting us from such things. Its not always black and white. The Police have a lot of variables to deal with. Not only that they say that there is an abuse of power. Yet if you are not a police officer how can you really understand what all they have to deal with? Certainly if the person on drugs or in a total state of panic how could they get him to comply and peacefully subdue such an individual. There seems to be a lot of picking at the police for doing their jobs. Even where there is not a lot of racist biases. When it comes to police and the bad things that some have done have overshadowed the heroics that put on that uniform and get behind the wheel of a police cruiser.

The police are trained on how to handle someone on the ground, they could have gotten him on his stomach then a knee on the back would hold him, especially if there was more than one cop. Some policemen seem to have the attitude that if you don’t do exactly as they say, you are in deep doo doo. And some of them have a big chip on their shoulders and here they showed how tough they were by beating someone while they were on the ground. The police really know how to write a report also, like saying they were beating him for the safety of the bystanders. In a court room it sounds good. What is a judge to do if a cop says that and there is no one there to dispute it. Where is the proof that the cop was just being an asshole. We can hope that the film is enough to show that.

“California Penal Code section 148 (called “PC 148”) defines the crime of resisting, delaying or obstructing a police officer, can be either a felony or misdemeanor. No violent act is necessary for a conviction of PC 148, and spoken words can sometimes be enough for a conviction.” The requirement of not delaying a police officer covers a lot ground. Simply refusing to comply can do it.

I’m all for protesting if the facts warrant so. Wave your signs, try and effect change. Great. But… this happened like 2 days ago. No one knows shit about the situation. Facts are still coming out. Our social media world view means we react to a stimulus without even giving enough time for the facts to come out. Demanding change and accountability when in fact change and accountability might have been taking place here – but these morons who just have to protest something and right now would never give anyone in power a chance to explain that.

Yep it’s true- people want to protest anything right now. If it’s not one side protesting against wearing masks it’s someone else protesting about police. I think this guy should have been handled the way he was, the police are there to protect public safety and that is what they were doing. We see enough publicly intoxicated people and its time we step up policing and enforcement, and give the police the credit they deserve for dealing with this shit.
Speaking for myself, I want more money spent on good policing and cleaning up the dirtbags on the streets. I don’t care if they’re white black or Mexican, they need to know that they can’t do shit like that and get away with no consequences.

Beating Rodney King didn’t change his behavior of PCP use, and was arrested for it more than once. You people want to protest, protest the importation of these drugs, or local manufacture of them. Protest that cops can’t bust these people, even though they know where they are. Protest the govt not being able to fly drones over poppy fields and coca fields, and spray them with something to kill the plant, start in south America. Protest that there are no facilities to house these freaks permanently, keeping them off the streets for good. Protest the trauma the 10 year old endured by this animal. But stupid signs saying stop the violence? We agree, stop the violence against the innocent and law abiding victims. Or, let’s have a day where all cops stay home. Everyone of them. Have all cameras off. Then. let the private citizens go around and take care of the problem.

So who sets an example? No one? Should not those in authority be setting an ( good) example? Maybe that’s a problem too. Nobody knows what good personal conduct looks like. Yes, I agree (with myself, apparently) that’s it’s alot more work to be the one who strives for excellence. But it’s clear there are low expectations of personal conduct … in public service. Or anywhere for that matter. It doesn’t seem to be expected or valued in society anymore.

I know what you want to see. You want to see something that doesn’t offend you. You want to see the man persuaded by logic and kindness into not being a problem. But if he had darted off into traffic while the police tried talking to him, would you not also blame them? Because they lost control of the situation?

Nothing in being mentally ill, disruptive and on drugs in a street is dignified. It is a crap shoot whether he is safely taken into custody or he hurts himself or someone else. The police don’t know, the people who called the police didn’t know. I suspect the man himself doesn’t know. But the police are the ones responsible if any of it happens. And they knew what he had been convicted and sent to prison for a previous assault on police. Could it have been handled better? Maybe but neither you nor I know that nor do we know what happened before the video started.

The headline is sensationalism at its best. It makes it sound like the cops rolled up on some poor guy doing noting wrong but just acting crazy and they got out and attacked the man. Please Kim you are better than this. They would not cooperate and fought the cops. Why is that not put in the headline?

Outside of saying a very few protested alleged mentally ill man being whatever, it was either cover the protest or not cover it. Headlining any protest as if what they are protesting is unquestioned is a common display of bias in reporting. But how much of a qualification should be in a headline? Judgement varies.

The protest was against what the officers did to the suspect.

Some people think the actions by the officers was justified and necessary. But they did happen…and the protest was against that happening. Thus the title.

How about something less bias sounding like “Protests of Ukiah PD Use of Force in Arrest” Your headline makes it sound like they just rolled up on him for no reason and started beating him. I have no issue of your reporting what is going on just the bias headline intentional or not.

I am starting to like the idea of getting rid of police all together however. My neighborhood would probably have a drop in crime

Anyone who refuses to comply with law enforcement directives deserves what they get. So tired of everyone claiming mental health issues for every situation that arises with law enforcement. He was on drugs. To bad for him. Choices people. You play you pay. Bummer.

Hope DA Eyster prosecutes these officers for assault, assault with a deadly weapon, assault with serious bodily injury; excessive force.
This is textbook excessive force. New Videos Have surfaced as well.
Having known mentally ill individuals as well as having the statistics that 80% of Americans will experience mental illness or adverse drug reactions, I can honestly say that this type of response by “trusted police officers” simply for being naked and not complying raises my eyebrows in anger! How could being naked warrant an ass beating? It would be a simple misdemeanor not even a felony crime! Those cope beat that man for the shear joy or beating him. They plainly already had prior contacts with him and knew who he was by name. They took their frustration of dealing with a nude mental case out on this mans body with fists and batons. It is very possible the intitial tazing gave the man a concussion when he fell on his head! This is unreasonable use of force! I hope DA David Eyster prosecutes these officers. Main stream Bay Area news outlets are picking up the story on tv as we speak and a public outpouring of rage is coming for UPD. Any upstanding Chief of Police would immediately decry this behavior; officers like these give all men and women in blue a very bad name and reputation. This is disgusting to watch. Police are way outta control and need to be brought in check by the chief and District Attorney. Clearly Assault with deadly weapons with serious bodily injury. 7 year sentence Bam!
