Humboldt Superior Court Criminal Jury Trials to be Reset

Due to the continued, evolving public health emergency related to COVID-19, Humboldt Superior Court requested and has been granted an Emergency Order wherein all criminal jury trials scheduled to commence between January 25, 2021 and March 1, 2021, will be reset. The current, ongoing criminal jury trial is not affected by this Order.

While the County remains in the purple tier related to COVID-19 restrictions , no jury trials will proceed for at least the weeks of January 25th and February 1st. During this period, the Court is hopeful the County will be moved down to the red tier, so it could proceed with jury trials with the current safety protocols in place. Also during this period, the Court will be investigating additional safety measures, if it becomes necessary to proceed with jury trials while the County is in the purple tier.

The Implementation Order pertaining to the resetting of jury trials is attached to this press release.

The Courts goal is to reduce the spread of COVID19 and to ensure that jurors, judicial officers, and court staff, as well as other individuals involved in trials, are not unduly or inadvertently exposed to COVID-19.

They asked 1000 potential jurors if they would come in now to be at a trial. Thirty seven responded. Not a lot of popular sentiment for being in a small space with 15-20 strangers for 2 weeks. The press release seems conflicted about whether they can restart Feb 8, or March 1, but I’m predicting even March 1 is unlikely. I’ve already had one virus shot and assuming I get the second on the schedule recommended by the manufacturer, I still will not be up to full immunity by March 1. And unless the entire jury is going to be made up of people over 65 who got their shots already, and anti-vaxers, they still won’t be able to get one. Now that I think of it, I wouldn’t take a chance of having anti-vaxers on the jury. The vaccine immunity is not absolute, just really good The authorities say we won’t approach herd immunity until late summer. Probably we won’t approach jury trials till then either.

My son has not lived in California for 7 years. He got a jury summons on Friday. He is currently in Indonesia. I don’t think he will be showing up.
