The Humboldt County Sheriff’s Office has been notified that the California Department of Justice has concluded its review of the past Public Administrator’s handling of estate property in Humboldt County and will not pursue criminal charges in the matter.

We would like to thank the Department of Justice for their thorough review of this case and recognition of the steps the Sheriff’s Office has taken to increase controls and accountability.

We recognize the errors that were made in the past handling of Public Administrator cases and have taken the following actions to ensure that the Public Administrator division of our organization adheres to the California Probate Code and the Government Code.

  • We have updated our Public Administrator policy and procedures manual, with employees closely adhering to this policy.
  • As part of our new policy, the Coroner-Sergeant does a weekly review of all open Public Administrator cases to ensure accuracy.
  • This policy also requires receipts have complete details including information identifying all parties and the estate associated, a Public Administrator case number and a complete description of the property.
  • All deputy coroners and Public Administrator staff are members of the California State Association of Public Administrators, Public Guardians, and Public Conservators, and are staying up to date on the education/training requirements set forth by the law.

FREQUENTLY ASKED QUESTIONS ABOUT THE PUBLIC ADMINISTRATOR DIVISION

What is The Public Administrator?

The Public Administrator serves in a fiduciary capacity to provide professional estate management services to county residents who die without someone willing or able to handle their affairs. The powers of the Public Administrator are mandated by the Probate Code of the State of California.

When is an estate handled by the Public Administrator?

The Public Administrator may be appointed under the following circumstances:

  • When no executor or administrator has been appointed and the property is at risk of waste, loss or misappropriation.
  • When appointed by the Court.
  • When an heir nominates the Public Administrator or the Will names the Public Administrator as Executor.
  • When there are no known heirs of the estate.
  • For an heir who resides outside of the State of California and requests the Public Administrator.
  • When the named Executor fails to act on a Formal Probate and no other person has a preferred right.
  • In situations where the person with priority to act is not a resident of the United States.

Categories of Estates handled by the Public Administrator 

  • Indigent Estates
    • These are estates without sufficient funds for disposition of the decedent remains and no heirs to take care of disposition arrangements. In situations where the assets of an estate are not sufficient to pay for disposition, the law requires disposition by the relatives of the decedent. If there are no relatives or other persons to act, the County assumes that responsibility.
  • Summary Estates
    • Estates not exceeding $50,000.00 in value. The Public Administrator may act without court authorization to marshal and distribute the assets of these estates pursuant to the Probate Code.
    • Estates valued at $50,000.01 to $150,000.00. The Public Administrator may act after an ex parte application seeking authority to summarily dispose of a small estate is approved by the court.
  • Probated Estates
    • These are estates over $150,000.00 in value. An estate of this size is handled by the Public Administrator under the jurisdiction of the Superior Court. The proceeding commences from the first filing of a petition and appointment of the Public Administrator. Other procedures subject to court approval include proving a will, sale of property, paying taxes and distribution of assets. An accounting is completed and submitted to the court to show what was done before the Public Administrator is discharged.

What is the overall objective of the administration of an estate?

The overall objective of the administration of an estate is to:

  • Collect a decedent’s assets (including partially owned assets)
  • Determine and pay the debts, expenses, and taxes
  • Distribute the balance of the assets to the persons (sometimes trusts) entitled to them.

So, there were findings, but because the Sheriff claims steps have been taken to “change policies to correct mistakes made in the past” nothing is being done. If it were civilians “making mistakes” you know damn well they would be charged, sentenced, fined and anything else the Sheriff could throw at them. But since it was a law enforcement agency it’s just words stating “shame on you.” This of course is legal code for “shame on you for getting caught.” The Sheriff Office has been corrupt for the duration of the last two Sheriffs at least, the current being the worst. A big thank you to the state DOJ for just turning a blind eye to a fellow agency. I wonder what corruption should be pursued at the state level?

This was all going on before this current Sheriff was even here, Alf! I’d say this Sheriff here has conducted himself with nothing but integrity since he took over that piece of crap department.. No other Sheriff has ever dealt with the sh*t that’s been thrown his way. He can’t make a right decision to save his life in the eyes of folks like yourself. Just go ahead and crawl back under that rock..
This was an investigation sent to the DOJ. HCSO had nothing to do with it. You might want to get your facts straight before you comment, Alf..

Nothing to do with it? HCSO were the ones being investigated among others. Multiple deputies were the ones with the property in question. And you are wrong about Honsal. He has zero honesty or integrity. He supports Bohn and Fennel, the two most corrupt Supervisors in the County. He loves to talk, but has no job skills. I know him personally. Because I know him well, yes my facts are straight. He is just another good-ol-boy who can be bought by the most corrupt with very little effort. He just hired the most corrupt former Sheriff from Mendocino County. The list goes on and on.

So, I guess you are right about one thing, he can’t make a right decision, or at least he hasn’t yet. A right decision would be to admit he is in over his head and resign.

Alfie – I happen to know Honsal personally, as well, and have for many years. You know nothing about him. I can tell by your assumptions. He goes against what the good ol’ boy mentality stands for and that’s why the last Sheriff hired him – because he had enough sense to understand his dept needed a change and the balls to hire outside his bubble. Honsal has more experience than you’ll ever know of because you’re probably assuming again he’s only worked in Humboldt. He has cleaned shop at the Sheriff’s dept and your county doesn’t know how lucky it is. You all don’t even know what he’s done to improve the integrity of that dept. And in my eyes don’t deserve him. Don’t know why he’s even wasting his time with a liberal county like yours.. A man of his caliber should be running for governor.
Sounds like you have conspiracy theories about Bohn, Fennel, and this other sheriff as well.. Let me ask you.. Been smoking marijuana a while, Alf? How about other drug use? Ever had any cognitive testing done?

You clearly know a different man than I do. His incompetent policies got a friend of mine killed. He’s either digressing or never was very good. The department has gotten progressively worse under both him and his predecessor. A call to the Sheriff used to mean you would get a responding deputy or at least a phone call. Now you might as well not call at all, because responding deputies and “far too busy” to help. Phone calls take days to return if they are returned at all. I know from multiple experiences. Twice, two years apart his office promised CCW renewal in two weeks. Try two and a half months. All other renewals from other Sheriffs were in two weeks. The entire office is worthless. Plus, Both the Sheriff and the EPD Chief did nothing to prevent or stop rioting. They actually caused more problems than they fixed. I could go on for many pages, but clearly you have a puffed up opinion, so I won’t bother.

And just because you asked, I am a college graduate with some post graduate study. I’ve never touched alcohol, drugs or any other mind altering substance.

Alf… or maybe we can just both admit that you don’t know the man at all. About the CCW renewal, you are throwing out blanket statements and obviously don’t know how the system works. First of all, not all sheriff departments give out CCW’s. It is not solely dependent on the sheriff’s dept how quickly a CCW comes back. They always get sent out to the DOJ to get verified and fingerprints passed. Sometimes it takes longer than others. Here’s an idea.. How about not waiting until the last minute before renewal so you don’t have to stress about if it takes 2 weeks or 2 months? But wow, sounds like you are still really upset about it. Must have traumatized you..?
And the rioting.. wow.. I’m sure you think that trying to make peace is weak, too.. but you seem like the type to be out there stirring up sh*t and starting the riots. Last I checked, the officers were supposed to be peacemakers.
Maybe educate yourself a bit more and don’t assume so much next time BEFORE you comment.

I filled 30 days in advance, which is what the CCW instructor said was the earliest I could. I called the Sheriff Office after about 3 weeks, was given the runaround, told the deputy in charge would call me. Three more weeks, same runaround. I called the NRA and made a 2nd amendment violation complaint. NRA called Sheriff Office. Still nothing for 3 more weeks. At the same time, Sacramento County was indeed renewing in 2 weeks, even though their volume is exponentially higher. (I spoke with someone in their issuance office – yes they actually have people who will talk to you)

As far as the riots are concerned, lawbreaking is lawbreaking, violence is violence. Somehow it didn’t occur to the Sheriff that all lawbreaking must be stopped. A hugfest did nothing but give the rioters more time to figure out what businesses and property to destroy next. Tell me how many of the hundreds committing these crimes are behind bars and you will be able to calculate the effectiveness of the Sheriff. And, by the way, peace must sometimes be forced, because the average rioters aren’t looking for peace.

We tried showing honsel a video of a home invasion,this crazy guy has had a pattern for a past 6 months or so,and even tried talkn to D.A and rex bohn and cws or cps,and they all helped cover it up,did nothing and this guy assault this other guy in front of his little girls and wife,split his head with like weapon nobody really know but he gashed him ,i have the video ,they violate penal code and constitution,in said video,and tday the same punk tried running my 19 y/O DAUGHTER off the road,my other 17 year old daughter,also in the car,my 2 year old grand baby and my nephew,this punk s been doin this to several families and honsel keeps allowing it and letting him do it.i kinda thought constitution meant something for my kids and grand baby,that guy also has open charges recent for slapn his eoman around and got caught with 2 unregistered pistols maken death threats to multple families with babies sick child,mexdical issues ,harrassing elderly women,and the sherriff keep letn him out.aaron lee stephenson,i can tell you his whole crew but sherriff is helping him violate peoples right attempt murder,child harrassment mayhem tried running my grandbaby and kids off the road,yeah thanks for yours and honsel help way to be protecting the people open your eyes.

humboldt’s corrupt sheriff’s department fought legalization because they were trafficking in black market weed themselves. there’s so much graft and grime going back so many years. then there’s all the racism. and we have sheriff antifa buses running the show now, commenting on things entirely outside of his scope of work and arbitrarily refusing to enforce public health edicts.
