Aligning Himself with Other Emerald County Sheriffs, Humboldt County’s Billy Honsal Emphasizes Education Over Enforcement of Pandemic Curfew

With yesterday’s announcement that Humboldt County has been moved to California’s purple tier, residents are now advised to follow the limited stay at home order requiring that all non-essential work and activities stop between 10 p.m. and 5 a.m. Humboldt County Sheriff William Honsal published a statement on HCSO’s Facebook page regarding enforcement of the curfew positioning himself similarly to Mendocino and Trinity County Sheriffs: education over enforcement.

In the statement made on Facebook, Sheriff Honsal states, “From the first Stay at Home Order issued in March of this year, the Humboldt County Sheriff’s Office has prioritized education and voluntary compliance, rather than criminal enforcement of health orders.”

He added, “We have seen overwhelming success with this approach and we will continue to take an education-based approach with this new order.”

This focus on education is reminiscent of Trinity County Sheriff’s Tim Saxon perspective on curfew enforcement: “My position throughout this pandemic with the various Health Orders has been to focus on education and self-compliance rather than enforcement.”

Both Sheriff Saxon and Sheriff Kendall expressed concern that strict curfew enforcement could infringe on their residents’ constitutional rights.

Sheriff Honsal harkened to this concern stating: “We recognize our duty is to protect the rights of our citizens and to that end, the HCSO will continue focusing our resources on issues relating to crime and the prevention of criminal activity.”

Sheriff Honsal goes on to invoke Humboldt County’s citizens’ duty to protect one another inspiring compliance with pandemic protocols: “We trust and rely on the members of our community to assess the risk and take precautions as necessary to help reduce the spread of COVID-19.”

Sheriff Kendall made a similar appeal to Mendocino County resident’s sense of communal duty stating: “ “We all live by an unwritten rule,” he said. “[W]e look out for our fellow man. You’ve got to look out for your family, friends, and community. I want people to continue doing that.”

Yesterday Humboldt County’s Public Health Officer Teresa Frankovich implored Humboldt County residents to follow pandemic protocols as local numbers strained the county’s ability to contact trace:

We can move back from this purple tier. We can get this under control. It’s going to take using all the steps we’ve talked about- masking, distancing, doing things outdoors as much as possible, in addition to not traveling, not gathering over this holiday weekend. Doing so will allow us to step back into our less restrictive tier. It will allow us to protect our businesses, our schools and our healthcare capacity and it’s important that we all do it so we’re asking for cooperation…from the entire community, in getting us back to red tier and then below.

Sheriffs swear an oath to uphold the Constitution. Thats it. Nothing more. They do not swear an oath to any person, much less any elected official. The reason for that is so that they do not become militarized against the general population for political reasons, instead they are bound by the document that guarantees our inalienable rights.

It’s hard to imagine him saying anything else, honestly. Like Trump saying the pandemic was “Totally Under Control” a month in and then that we’re “Rounding the Corner” right before the election.

At this point, after he was exposed for helping people circumvent the state’s prohibition on large gatherings last summer, Honsal has nothing to lose by denying reality and doubling down.

The curfew is moot anyway. In Humboldt it’s legal to impersonate a police officer and pull off home invasions, as long as you promise to come to your court date if you get caught.
How can he expect the people to listen to anything he says about public safety when they book and release known dangers to into our community?

Covid is spreading in spite of mask wearing because the reusable cloth mask is a supper spreader:

Any virus laden droplets/aerosols that can be breathed in to infect you can get in your eyes with or without a mask. If a mask stops them, they evaporate and release the load of virus in them to be easily breathed in or blown out into the surrounding air.

The typical cloth mask ‘filter’ has holes that are 100 times larger than the virus. But what about stopping your own cough or sneeze from reaching others, you ask? Again, the droplets evaporate and release the virus.

ALSO, try coughing or sneezing into a mask. 95%+ of the forced air and droplets will escape around the edges. They can disperse in a room quite quickly. Think of smoke.

If you light a match in a room, within a minute or so, you can smell it in the whole room without having even blown the smoke. Smoke is much larger than the virus but can be about the same size as droplets/aerosols.

BTW, if you are wearing a mask and can smell any odors or smoke, you are NOT protected at all. READ the manufacturer’s warnings. Masks will NOT prevent bacterial or viral infections or their spread!

Mandates aren’t laws. No legislative process has been carried out to create these mandates. They are 100% executive actions which violate the Constitutional guarantee of a Republican form of government.

You might want to brush up on the Constitution. It is quite explicit. There is no mechanism – other than Impeachment, the 25th Amendment, death or resignation, to remove a president once he has been sworn into office. Sore losers notwithstanding.

I think you are a bit misguided in your ranting.

You should ignore Trump simply because he’s an idiot. He has been consistently wrong on this particular issue just as he has on so many others.

You shouldn’t pay attention to Biden on his own but rather that he’s at least listening to the experts and willing to take their advice, something Trump hasn’t yet grasped.

Newsom, while perhaps one of the slimier politicians we’ve had recently, is at least trying to manage an outbreak in a state that has over 10% of the countries population in the absence of any coherent Federal strategy (see comment on Trump above).

Is he overstepping his authority? I’m not sure since I’m not a law expert but the State Code does grant pretty broad powers to the Health Department of the State to control infectious outbreaks and he oversees the State Health Dept so there’s at least a tenable argument to be made for it.

In any case, none of this is relevant to the Federal Constitution because the 10th Amendment clearly gives the states the authority to make rules and regulations inside each state as long as they don’t violate any of the other enumerated Constitutional requirements and a Health Mandate doesn’t appear to do that.

The problem with the “education” approach is willful ignorance, such as is displayed regularly by several commenters on this site. Education can tell us that covid-19 is a dangerous threat and that wearing masks, distancing, etc are an effective way to reduce the thread.
