19-year-old Allegedly Assaults Teenage Male on Hammond Trail and Flees With Cell Phone of Victim’s Female Relative

On April 7, 2020, at about 3:05 p.m., Humboldt County Sheriff’s deputies were dispatched to the Hammond Trail in the area of Hiller and School Roads in McKinleyville for an assault that had just occurred.

Deputies arrived on scene and located a teenage male victim injured on the trail. The victim was transported to a local hospital in stable condition.

Upon further investigation, deputies learned that the victim had been walking on the trail with family members when an unknown male suspect, later identified as 19-year-old Kyle Cole Berger, reportedly approached the victim and hit him in the head from behind. Following the assault, Berger was confronted by family members of the victim, at which time, he physically assaulted a female adult relative and fled the scene with the female’s cell phone.

Witnesses to the incident followed Berger to a residence on the 1600 block of Fischer Road. Deputies responded to the residence and located Berger. He was taken into custody without incident.

Berger was booked into the Humboldt County Correctional Facility on charges of robbery (PC 211), felony battery (PC 243(d)) and child abuse (PC 273a(a)).

Is the 19 year old assailant a adult, or is he a youth?
It’s unclear if a youth can simultaneously be an adult.
Please clarify.

Does one definition supersede the other, and if so, why not just call a spade a spade, instead of some form of euphemism?
Or, ..change the definition entirely, to reflect the leniency some wish to project.
In such a case, adulthood could be postponed till 28, for instance, and the parents can regain much needed dependents for their tax filing status

Why do you ask about “youth”? Nowhere in this press release do they use the word “youth”.

To clarify: 18 years old is considered adult. Has been for quite some time. So, 19 years old would be an adult also.

To clarify, bug on a windshield, I am teasing at a point kym made weeks ago about the term “youth”.
She basically claimed that a “youth” can be as old as 27.
I disagree.
Look at how the assailant is said to be 19, and the victim is a “teenager”, we are told.
Well both are teenagers, actually, but one is a minor, and one is a adult.
Now maybe that makes sense.
The term youth should not be applied to adults, and yes, I am aware the word was not mentioned in this article.
It’s apparently stuck in my craw from a article weeks back.
The passage into adulthood is not a snap of the fingers, I get it.
But legally, I think it is.
