Guidance on Evictions for Humboldt Renters

On March 16, California Gov. Gavin Newsom took Executive Action authorizing local governments to suspend enforcement of evictions in California during the COVID-19 pandemic. On March 18, the Humboldt County Sheriff’s Office announced that it would not be enforcing evictions “effective immediately until further notice.”

On March 27, Gov. Newsom took Executive Action to protect renters throughout the State of California. The new executive order prohibits landlords from evicting tenants for nonpayment of rent and prohibits enforcement of evictions by law enforcement or courts. It also requires tenants to declare in writing, no more than seven days after the rent comes due, that they cannot pay all or part of their rent due to COVID-19. These protections are effective immediately and extend through May 31, 2020. However, there are some things that renters should understand about these new protections:

  1. If you can pay your rent during the COVID-19 pandemic, you should. The new rules don’t excuse renters from backpaying on rent or being evicted after May 31, 2020.
  2. If you can’t pay your rent due to COVID-19, let your landlord know by text, email or letter no later than seven days after rent was due. Make sure you save a copy of the text, email or letter with proof of when you sent it. Be sure to include documentation of why you can’t pay your rent. (For example, you might have a doctor’s note showing you were ill with the virus and needed to stay home, or a letter from your employer showing that you were laid off due to COVID-19.)
  3. If you receive an eviction notice during the COVID-19 pandemic, please do not ignore it. You can reach out to Legal Services of Northern California or the Humboldt Superior Court for more help.
  4. Finally, local cities and jurisdictions may have passed additional protections for renters, but none of the local protections waive rent. You will still need to pay when you are able. You can call Legal Services of Northern California to find out more about what’s going on in your city.

There’s a grey area. What if a tenant continues getting paid but refuses to leave, pay rent, or pay utilities? We are facing just that situation, although it hasn’t been bern made completely clear yet. It’s a triple burn for us as we pay mortgage and are forced to pay utilities while our tenant hangs out in our rental home, gets a paycheck and we keep her comfy with utilities. Does the state want to compensate us for getting ripped off due to this order?

That person will have to contact you within seven days of rent being due. You should deliver the above list of regulations, underlining the fact that rent and utilities may be postponed but not waived altogether. Be sure they receive the info and be sure you have confirmation they received it. Be kind.

We are kind. But our tenant is not. She has already juked on last month’s utilities. We won’t turn her out during an emergency, but she’s getting paid, and not paying.

Exactly… their work status has not changed, they are recieving assistance, doing drugs and HAPPILY NOT PAYING RENT, they actually are living their life of luxury… no bills have to bvb e paid and good luck finding them to collect when this is done, if ever.
Gavin Newsome is holding the state of California property owners as hostage with their hands tied behind their backs all to PROTECT ILLEGAL ALIENS at the expense of American Tax Payers.

Look at the guy who signed that executive order. It’s no wonder folks like you are getting screwed over. This state skews so heavy toward favoring deadbeat renters it was hard enough to get them about before this. You know there are going to be plenty out there able to pay who will now see this as a free for all tho scam the system knowing they can’t face repercussions. Thats the problem with government and law, too broad sweeping regulations based on the lowest common denominator and little to no room for situational nuance. I know many renters and many property owners and I would without a doubt trust the latter group with making ethical decisions if it came down to the two.

Help me!! I’ve lost my job… (cruise industry) for a long, long time. I have a rental, and paying a private loan. Staying with my elderly parents. What do I have to do to protect me? How do I survive?

I would like to know the same thing.
On top of that, the renters just laugh, refuse entry and tell us, dont come back.
I thought only the government had the right to confiscate property.
Giving freeloaders 10 years to pay back starting in 2024 for a total of 14 years to pay back, back rent and only offering property owners a tax credit that can not be used is an injustice and wrong.
These scammers that are/were Motel dwellers could not rent any place if they wanted to.

Why are you providing utilities? You signed a lease, abide by it. You’re making a lot of presumptions about your tenants’ financial situation during a WORLDWIDE PANDEMIC. Perhaps the person is expecting a layoff or end to their job. And let’s not forget MOST Americans can’t afford a$400 emergency, especially after forced Pg&e shut offs. This country has often expected us to “ do our part” and make sacrifices. It’s now your turn. Though I feel for your predicament, let’s not forget you’re financially secure enough to own more than one home. Surely you feel more blessed than those RENTING right now. Perhaps you should contact your mortgage company like every other homeowner right now

The landlord is providing utilities because the landlord is kind. So they’re an idiot for providing utilities, then an asshole for wondering what to do if they’re stiffed rent. A sorta double standard you have there. You acknowledge every other homeowner is contacting their mortgage company right now as well. So in turn, understand how everybody has to work together, tenants with landlords and vice versa, and realize that freeloaders really do exist sometimes. Better safe than sorry, just lookin out, right?

Can’t afford a 400 dollar emergency boggles my mind completely. I know they don’t teach shit about money management in public school, but come on that just downright irresponsible to have so little savings. Especially when most I know like that are walking around in $100 jeans with a $1000 phone in the pocket sipping on a Starbucks every day. I know I have been preparing for something like this ever since my childhood. I have months upon months of food and supplies at my house and would share with anyone I know who was living a truly responsible lifestyle and is really struggling now, but for many Americans this needs to be a serious wake up call.

I don’t wear $100 jeans, mine came from a thrift store close to 5yrs ago. My phone is the same one from 4yrs ago. I don’t own a car so no payment or insurance.
I make $13hr and rent, utilities, & food is where my money goes. We don’t go to bars, the movies, buy expensive toys, maybe 1x a month we get a pizza or burgers to go around $25. But maybe not even that.
I might have $100 emergency money for 10-15 days out of the month(this isn’t extra it just hasn’t gone to a bill yet.) Explain how I should be responsible I’m being responsible by working and paying my living expenses. Where is this money for the saving fund to be found?
Most months have a $10-$30 window. I’m not being sarcastic I’m asking because I would love to have $400 saved for whatever. Heck just to feel better knowing I’m not penniless after paying rent, lights, propane, phone, food.

Is there a way to actually get your money back when you get screwed over by a renter? My buddy who owns a bunch of rentals never goes after people who burn him, besides taking their deposit. I’m not talking about going after single moms who got laid off, just the people taking advantage of the situation.

🕯🌳My building has so many code violations and they allow one story of the building to steal electricity from the floor upstairs and when you complain your threatened, so for a I’m pay for someone else’s housekeeping and drug dealing. 🕯🌧🐸 Only in Fortuna. 🇺🇸👍🏽

This is necessary, BUT short version. Renters can’t pay rent, mortgages can’t be paid because no income, banks aren’t paid, definantly can’t refinance because they can’t technically print money. Stock market takes a dive very similar to the last one in 2008, because they continued on as usual using real estate as if it couldn’t break, again. Then out comes the TOO BIG FO FAIL BANNER for the banks and stock market, adds trillions to the debt which is put back on the lower class, but whatever.

Just listen to this Profit over people bullshit. In many situations, the landlords are likely to loose profits.. But many people could actually lose their lives over this! For sure documentation of your situation should be in order, and given to the LL.. Maybe people could try and pay partial payments? Or maybe the landlords could make efforts to temporarily lower the rents so utilities are paid! I bet the many LL will not even be flexible on payments! Time to practice some values of Humanity for Earth’s sake!

From what I’m reading at RE forums, some landlords across the country are lowering rents for good tenants. It’s good business for some- less vacancies, less headaches.

Greed , never a valid compensater for genuine intellectual problem solving abilities. Correcting a problem of this size and magnitude is more difficult to do, because the mathematical equation that drives the real estate market is completely incorrect. As many numerical equations are faulty, an thus produce a complex maze of masterful illusions.

How can I get a person to leave my home? The sheriff says I have to evict him. He knows the law isn’t enforcing evictions right now, so he’s making no effort to look for another place to live. We fight all the time, and I just can’t take it anymore!
