A crowd of 50 to 75 people is gathered at the Mateel Community Center at a meeting hosted by the Civil Liberty Monitoring Project to discuss the community’s concerns after low-flying helicopters and confirmation of the National Guard joining the Humboldt County Sheriff’s Department in marijuana eradication activities this summer upset many.

      • First of all it is Sheriff Billy Honsal, not john brown. It has been county law for years that you cannot doing anything illegal on your land Ernestine. Fishing in creeks, shooting protected animals without the proper permit, logging before your land is checked for the Spotted Owl, burning trash, grass, trees, etc., when not allowed, shooting within a certain distance of neighbors, and the list goes on. If you follow these and the other laws all will be fine. Give law enforcement a break, they are only doing what is required of them.

      2 big issues are HOW the busts are handled and what we as citizens want our local state and federal police to focus on; they’re using our money. Personally Id way rather see resources go towards eradication of meth, heroin, cocaine, human trafficking, strong arming of locals by eastern european cartel members and the white supremist dudes who’ve been lurking around Garberville harassing anyone of color on the street and even employees of stores……these things need attention amongst many more issues. Also the amount of unsolved murders of locals here.
      We shoukd get a say in what we want authorities to focus on and a way to hold them accountable.

      Its pretty annoying to see the timber harvest cuts carving the hillsides while our taxes pay for enforcement only if pots growing. They dont clean up the grows they just bulldoze everything which is even worse for the environment.
      If it were across the board enforcement i think everyone would feel better but to see one industry severely punished while others operate legally doing even worse environmental atrocities is ridiculous&infuriating. Timber companies still get to spray pest herbicides mixed with diesel fuel all over the forests and it gets in the water, the water your kids drink. Maybe we shuld go throw some plants on recently sprayed timber land and see if they bust em.

First of Honsal is an appointee of the disgraced sheriff who was auctioning of deceased persons property with no bids to deputies and other government employees, like a 76 Corvette, and then swept in under the rug. The sheriff is now also the county adminstrator and coroner so they can swept murders and government wrongs under the rug too. If you haven’t been paying attention, which most of you actually don’t, is this country is run by wealthy elite good ol boy club that doesn’t care for you all as well as wants to monopolize everything here, and there is a criminal element that has captured our local government for their own interests.           • How much of other people’s money are you entitled to use? Everyone wants what they want and they seem to also whant others to pay for it.

            While Obama made a very stupid remark about individuals not building a business themselves, he had a share of right too. Unless you are a subsistence farmer, everyone has a sliding scale of interdependence. They use infrastructure held in common like roads, schools, health care, water and sewerage, defense,etc. It isn’t like a sliding scale, where self sufficiency reduces pooled resources though those whose every need from eating to shelter comes out ofpooled money. It’s more like reciprocal dependence where, if you personally have enough land to support yourself, you have more that needs defending. You rely on public property laws, police enforcement, fire protection, etc to keep those resources in your own hands. It’s a delusion to believe yourself to be at the top of the food chain. One one human can make that claim and that one is not doing subsistence farming.

            What is wrong is the tendency to tax solely to create control or benefit those not producing at all. Every tax needs to be able to justify itself as producing benefit to the society at large, including the taxed; neither targeting one for the sole benefit of the other nor being so extreme as to be in essence punitive forced labor just for being enterprising.

            • Using taxes as a benefit to our common interests is an obvious use of our money. I don’t have any problems paying a tax on gas knowing the tax goes to the roads. Or a sales tax on non-essential items, etc. But these are “use” taxes. I, essentially, volunteer to pay these taxes by using the service provided. Income tax taxes my labor which solely belongs to me. It takes money from me regardless. Property tax is, de facto, rent to the government.

          Well considering I pay the government 30% of my income and another 10% for the privilege of higher education so I can not be poor and pay more taxes (i.e. 40% income to govt) just so they don’t ever give anything back to me or my community and continue decades of war. Then I gotta listen to Baby Boomers say how easy it was for them. But hey, those rich guys paid 19%, while getting bailed out for their wall street gambling, hid the rest in investments, and thanks to Citizens United v. Federal Election Commission those rich guys not only get to run the government making the rules but their money also gives them more equality and freedom than me or you.

          In this country taxation is theft from the little people. Socialism for the rich and bootstrap capitalism for the poor working folk.

    John Ford and Estelle are just cornering the market for their family and friends which hide behind “permits” and sell to the original market while pretending to promote environmentally friendly ideals. All they care about is money and their bottom line. John ford was on K-Mud the friday morning I received my abatement notice talking about how they were going to direct their attention to farms not holding up their half of the compliance agreement, instead of focusing on smaller mom-n-pop scenes, then boom my 996 square foot grow abated. The fact is if you can afford to pay the county off you can grow all you want and break the law and sell to the black market, everyone I personally know who is permitted does. If you are a small mom-n-pop who can’t afford to do that well then you end up like me ABATED. It’s a shame government is full of corrupt soulless people who care about nothing but money like most in America. Honestly I’m happy they abated me and now I am in a way better area with way less corruption and alot more opportunity. Good luck Humboldt when all the good folks leave and there’s nothing but a few big corporate farms and no economy and lots of crime and hard drugs(not that there already isn’t) you’ll be feeling it. It’s already happening Humboldt will look and feel like a third world country. Have fun living in a police state

    • Ya it’s pretty ridiculous that you got abated for less than 1000 square feet. But all the good folks arnt all going to leave, a lot of them were here before anybody was making money growing pot. Those same people and their descendants will be here long after the easy money is gone.
      It seems like the county is kind of toning down the abatements. They are only sending out around 10 notices every two or three weeks. Maybe next year people can do six huge plants without getting abated. If they would let people do a 1000 square foot green house that would be even cooler.

When the legal market is cornered by a few huge corporations there will be nothing left for Humboldt. Yes alot of good people are getting out because they didnt want to blow it up and the county made it impossible for them to survive so they are moving out. I know a ton of people who are moving to other counties and states as Humboldt is a bust now. System is rigged and you wonder why people are resisting becoming legal!! Maybe if the whole thing wasn’t rigged by big money interests and corporations and the government wasn’t so corrupt and actually favored small business more people would of signed up to go legal.

I was dumb for actually believing what he was saying he also said they weren’t going to go after peoples properties and they don’t seize or won’t seize properties that don’t comply. Mean while the folks who have permits get a free pass to blow it up and sell on the black market without any enforcement and can break the law and drain vast amounts of resources while your small fish with 20 plants or a thousand square feet gets the book thrown at them and extorted to all hell by the county.

        What do you consider a mom and pop size? Two plants? 996 square feet can produce 60 pounds @ 1k a pound thats 60 grand and a modest living for California, considering the high cost of living. Most of that would go back into the local economy.

    Mess with a wetland while growing marijuana, they’ll throw the book at you. Remove vegetation so carelessly on the shoreline that federally delineated (permanent) ponds and marshes are literally erased, they don’t notice.
    The National Wetlands Inventory NWI, the California Aquatic Resources Inventory (CARI) and County GIS still display aquatic resources that I can confirm no longer exist. Reported to County years ago, never recorded.

They worked on the current mode of “legalization” for years, and what did they spend that time doing? There’s no reason whatsoever they couldn’t and shouldn’t have capped grow sizes to allow more true mom-n-pop cottage grows to be financially doable. A real community of small family farms could be the reality right now. Instead they made the law enable corporate mega to instantly dominate the whole scene, family friends and brown-nosers first. And that’s what we see now. Gigantics, huge indoors and mixed lights, funneling money to their out of state corporate sponsers. It’s not the legalization we wanted. Estelle Fennell doesn’t represent Humboldt. She’ll be replaced soon.

    • No one threw anyone under the bus. Any county issuing commercial cannabis permits have to meet state standards.
      The county can’t make getting a County permit less strict than what the state regs mandate.
      They could go ahead and rubber stamp your commercial grow like you want , but you’ll never get a state permit cause your county permit doesn’t meet state standards.
      The majority of permits being issued at the county level are to small craft farmers under 10,000sq ft. that’s a matter of public record whether you want to believe it or not.

      Without this being a statewide action, I’m not sure it would have had the impact you wish for. The economic realities of competing with the readily available ag lands of other counties means unfortunately that size matters.

      This really went south when the State decided to allow growers to stack licenses. Without that protection, smaller growers is ALL areas of the state were basically deep six-ed.

          The compact was more like an ’employee’s agreement’ that the people wrote out for the employees to ‘sign here or eff off’.
          It’s the ‘eff off’ part that’s gotten toned down into a cotton candy burger of ‘pretty please, play nicey nicey or we’ll have to abide by YOU instead of YOU abiding by our compact’.

            • Contracts are agreements ‘between’ two or more willing entities. Even a contract between an employer and employee is ‘between’ the two entities. I think your issue is that the People forget that We are the employer and have the authority to terminate the contracts with the Administrative state. Especially the contracts we have been coerced into entering.

              • Yes, and a Compact is an agreement between the states who willingly signed up in agreement to abide by the Constitution that limits the central govt and which secures the rights of the people. The govt itself takes an oath to abide by the compact that limits them. Their oath to office (any position) signifies that they are very much aware that their powers are limited and defined. The govt is not a ‘party’ to the constitution/compact, they are the guards of the constitution/compact. When they fail to guard, they are supposed to be changed out. Then and there.
                We don’t terminate the compact, we change out the guards.

                Are the employees of McDonald’s burger chain a party of the compact between all of the stores within the chain? No. The employees just follow the rules or get ‘changed out’.

                    No, we’re not. I was in the same trained of thought that the two of you are still in. Now I ^know^ better.
                    Employees don’t usually sign a contract with their employer. They declare themselves to be fit enough to fill the position. They then fill out their W2forms with the unconstitutional IRS. They don’t usually fill out a contract with the boss. Sometimes they have to sign a sheet with the rules on it… after they’re hired… to prove they understand the rules.
                    Our elected take an oath (declare themselves fit for the position of abiding by OUR rules). After they’re hired, they then get the rule sheets to read and ‘sign here’. They did NOT sign those BEFORE being hired. Their position is unique to all other positions and require special rules to follow. They are NOT a part of the rule sheet they signed, they are a subject to it. They are not the creator, they are the creature.

                    So, please, drop the ‘a contract BETWEEN’. Because there is no such thing. It’s a declaration of being fit for the position hired for, AFTER they’re hired. If they can’t abide by the rules, they’re out of there. (in the real world, not in our fake ‘elected’s rule’ world).

                      Why did the Constitution separate the Senator from the rest of the mess? Why did the rest of the mess unconstitutionally change that law? Why do the Senators and the rest of the mess now support each other? Who is protecting the people’s State’s sovereignty? What does protecting the state’s sovereignty mean?
                      The constitution forbids personal federal income tax. The Federal govt was supposed to get their necessary funds from Tariffs and each state’s choice of selected businesses or goods to tax. Which California businesses were nominated for special taxing? Why weren’t all businesses and goods special taxed? What is happening today? Why are they trying to tax & control the air we breathe, the water we use, the food we grow, the clothes we wear, the shelters we build, the property we own… ?
                      Which amendments are repugnant to the Constitution?
                      Why do people insist on blaming the ‘Constitution’ and ‘Founding Fathers’ instead of where the blame literally belongs? Who’s being protected by pointing the fingers elsewhere? Who benefits? What will it take to turn things back to how it’s supposed to be? Who controls the media? Why?
                      Why do people think that the Founding Fathers were ‘government’ and that it was the government that created the Constitution in order to govern over we the people? Who benefits from that ‘train of thought’? Why? Who REALLY created the Constitution? If the People (founding fathers) created the Constitution in order to create a central government to secure it, then how in the hell could the government be a ‘party’ of the constitution when they (the govt) weren’t even created yet? The 2016 OIG report had a nice graphic showing the scheme they were using. I don’t think I explained that very well, sorry.   • A Day Late And One Woden Nickel Short

    The H.C.S.O. M.E.T. has said before on a Kmud news interview that in there helicopters they can see on there computer witch parcels are legally permitted and witch ones are not how come the National Guard Blackhawk helicopters don’t have the same technology or do they ? I would also like to mention that since all the Coast Gaurd and Law Enforcement gets to step up there technology to Black Hawks Helicopters so they can see at night it would be real nice if they could use that same technology to apprehend criminals in home invasions and Cannabis Farm strong arm robberies .

    • This technology has been available for about 5 years or so and as you describe it can overlay GIS over live video in a HuD (Heads up Display) for the pilot, or a simply screen in the craft. I’m one of the inventors on the patent (patent #9215383). We initially invented it for graphics overlays at televised sporting events. The Americas Cup was it’s first use.

      Our helicopter pilot for the AC also flew for utilities and told us we had a product utility companies could readily utilize (right of way information is overlayed on top of the live video from the heli-cam).

      Municipalities are also starting to utilize this technology as it allows police helicopters to overlay address info etc. over the camera output. Imagine the pilot seeing a suspect run into a house and being able to immediately give those on the ground the address, etc.

      The downside is that it’s a very expensive system at more than a million bucks a pop. The adoption of such will continue to grow, but currently it’s something you’ll find on a utility company helicopter rather than a National Guard rig.

    This is simple, it’s referred to as “pay to play”. Your permit from the county is gonna cost around 10k per year for 10000 sq ft. You now have to get your county completed before the state. That’s a drop in the hat compared to what one can make growing 10k sq ft. of pot. Even with lower prices.

    That buys piece of mind. No abatement notices, no raids, just stick to your plot plan and you get years to bring things up to code. Really one is just investing in their land by making it more valuable as things are improved.

From what i could gather about helicopters flying so low over permitted grows and no grows, like over the speaker’s grandmother’s home, and flattening rows of vegetables, Honsal implied that the helicopters do not have the plot plans that tell them where what is growing.

      It was so hot there -compared to forest living. When Honsal arrogantly, unconstitutionally, unlawfully and immorally said – “If you have a permit, you don’t have to be afraid,” i left.

    Small world syndrome. His point that it’s very hard to get through the Humboldt County process because that’s what it takes to stand up to State scrutiny is born out by the numbers.

    Santa Barbara had the most State license applications of any of the counties (about 15% more than Humboldt). As of this morning there have been only 192 State annual cultivation licenses issued – state wide. These 192 are the ones whose County (or City) CEQA reviews have been properly completed as determined by the State (it’s the Counties that do the CEQA, not the State — the State merely checks it for compliance).

    In spite of the fact that Humboldt County has a FAR harder physical environment for meeting CEQA (dominantly mountains and woodland conversions vs. dominantly open, current farmland), and less applicants than SB, want to take a guess as to how many of the entities in Humboldt vs Santa Barbara have made it through the full State licensing process?

    Santa Barbara? … 2 (yes, that’s a two)
    Humboldt? … 68 entities, 121 licenses

    That’s 121 of 192 full State licenses that are Humboldt County.

    In spite of the millions of dollars that the large growers have to throw at the CEQA process, the State has not approved a SINGLE mega grow in Santa Barbara for an annual license.

    Santa Barbara (the County) got greedy and made it easy for mega growers to get a *County* license (which at the time meant an automatic State Temp). Most of these County licenses have been unable to even get through to a State Provisional license process. (SB County says 77% have failed totally and are dead). Nearly none of them have yet been able to get through the full State licensing process.

    Humboldt, based on their near 35 to 1 ratio success rate vs SB county, has clearly taken a different tack to SB and while it may seem like a hard ass wringer, it’s clearly working.

    Humboldt knows how to get licensees through the CEQA process in a way that stands up to State standards. Santa Barbara is struggling

    I do understand how most who haven’t done the research blame the county (and I’m sure the county isn’t blameless), but this CEQA stuff is the shits, and unless your County plays the hardass, you can’t get through State.

        There around 16-19 (depending on how you divide them) studies/considerations that must be considered and documented to pass CEQA:

        They include:
        1: Aesthetics
        2: Air Quality
        3: Biological resources
        4: Cultural resources
        5: Geology and Soils
        6: Greenhouse gasses
        7: Hazards and hazardous materials
        8: Hydrology and water quality
        9: Land use and planning
        10: Mineral resources
        11: Noise
        12: Population and housing
        13: Public Services
        14: Recreation
        15: Transportation and traffic
        16: Tribal cultural resources
        17: Utilities and service systems

        Each of those items must be studied in the context of the ‘project’ no matter how silly it is. This is how you can end up needing a $10k sensitive/rare plant study on regularly tilled and farmed soil or a $5K traffic impact study to consider how many trips to town will be needed to buy trimming scissors for the Cottage grow.

        CEQA was specifically triggered by Prop 64 – it can’t be avoided (traditional farming does not trigger it).
        Tradition farm land can fail for any one of those reasons above. For instance, the visual impacts of the hoop houses are being fought tooth and nail in SB county right now. The air quality (odors) are a regular challenge/fail point. Traffic (cannabis is an extremely high labor crop currently with many employees) is regularly a challenge point. Water usage and water quality same.

        Add in the DFW and the Water Boards and it’s downright crazy.

        Example: Our farm has surface water rights of 11,000,000 gallons (36 acre feet) PER DAY that have been deeded to the farm since the 1800s. We can spew this water any which way we want for any damn crop we want in any wasteful way we wish … except for cannabis. We can’t use a SINGLE drop for cannabis.

        We had to have a study done to ensure that our 1 acre cannabis farm (entire fenced area, not canopy) didn’t impact the migratory patterns of the local deer in spite of the fact we’re a one acre parcel in the middle of a +400 acre farm. Of course we can fence anything, anytime for any other crop because it doesn’t trigger CEQA.

        I agree, but your claim was that Humboldt made it hard for no reason while Santa Barbara made it easy — and was getting mega-grows through with “no issues”. Turns out it’s hard *everywhere* because the State has made it hard. Any county that tries to jump the gun (as SB did) is learning that they now have to come up to the standards that Humboldt has been executing all along.

        Yep, and not one week after the LA Times did that story, that farm went from being the biggest in the State to being the biggest busted farm in the state (and totally out of business).

        It’s really HARD to get a big grow past CEQA. The biggest so far is only 3% of that 140 acres (less than 4).

        Humboldt has some of the lowest fees and lowest cannabis taxes in the entire state — and often by a quite a large margin. Remember, whenever CEQA is triggered, large hours are required by the county staff for each project (the County acts as the ‘lead agency’ when it comes to CEQA).

        Nope. Prop 64 triggers CEQA, DFW and Water Boards. There is no “simplified permit” that can get ANY cannabis cultivator around this.

        That is certainly the case at the State level. When they removed the acreage cap, little guy was toast.

        Humboldt is doing so much with so little. Farmers there don’t have the millions that SB farmers have. The County doesn’t have the massive revenue that SB has. All that and yet they are the ones who have managed to dominate the full permit numbers (121 of 192). This really should be a celebration of how committed and tough the Humboldt cultivators are — as well as some credit to the county for getting those folks through the system in a way that the State is awarding full licenses.

        A hatefest just isn’t going to serve Humboldt. Change is hard. You guys have rocked stage one ahead of everyone. Tough bunch up there. Kudos.

          It seems like extreme overkill to initiate CEQA over small gardens.. Larger grows, I am not necessarily opposed.             You are absolutely correct and I’ll give you a personal example:

            Our (in process) grow facility is on a +400 acre and +100 yo livestock and alfalfa farm. Give that river bottom soil, country air and great sun are sort of useful in growing plants, we assumed that getting an outdoor permit would be straight-forward, and yet we kept running into great pain.

            As our year and a half process dragged on, we finally straight-up asked the Water Board and DFW (as they were standing on-site IN THE MIDDLE of our agriculture field), “What’s the easiest fastest permit to get … indoor, greenhouse, outdoor?” Oh, there was no doubt they responded … indoor, and not JUST indoor, but sealed indoor with an asphalt or concrete floor. In other words, NOT using the soil, air and sun was the easiest permit to get through CEQA. (and so that’s how we started).

            The fact that in the middle of an existing farm, it’s easier to get CEQA approval to put up a new building, cover over the soil with petroleum products, burn bright lights and run air conditioners than it is to pop seeds and grow plants outside tells you how fucked up the system is.

          • I’ll give you another example of how counterproductive these environmental rules are:

            Again, +400 acre farm with less than 1/4 acre canopy. We got tired of trying to meet their composting requirements for our waste and instead haul it up to the County transfer station.

            Literally, easier to use fuel to haul it to the station, and then THEY use fuel haul it wherever and then use fuel at the landfill to spread it around than to use it in our garden as mulch.

            That certainly IS the result, but where you and I differ is that with the understanding of all the State mandated CEQA requirements, I realize that it isn’t an intentional thing on a local level. John Ford had zero option when it comes to forcing EVERY cultivator through the maze of hoops — even when he knows that most of the small farmers will get drowned. I’m not pretending Humboldt makes all the correct decisions here, just that along with the cultivators, they’ve been given a shit hand to play.

            We’re fortunate in that in addition to all the deeded surface water rights, the farm also sits on an overflowing aquifer (there are artesian springs on the farm). This aquifer is ranked such by the CASGEM system (CA groundwater monitoring) that we can use all the ground water we wish with no issue or oversight. As I said, we’re fortunate.

            I agree, but it’s only productive if we have to take it out where the blame lies, and focus on where change CAN occur. Burning Ford at the stake will change nothing — he didn’t make this mess, he’s just trying to figure out a way to get people through it and he has had more success at it than anyone in the state so far.

            Sadly, 64 being a voter initiative, it can only be changed via another voter initiative. Don’t fool yourself into thinking otherwise — there is no other practical option (that’s a legal statement, not one of opinion — short of a civil war that’s not going to happen over cannabis, there is no other option).

    So, the typical helicopters buzz treetops to catch those not signed up and registered in the money-gobbling bureaucratic machine, while below the copters are those who throw out rat poison like candy at the Rhododendron parade and pollute the ground, groundwater and waterways with over-use of phosphates and/or no regard for the environment.

    So, the typical helicopters buzz treetops, so that the decent longtime growers become fearful while below the copters fly over organized crime — be it from Eastern Europe or San Jose, or wherever, with no roots in the community.

    Why not focus on environmental polluters, organized crime, those who degrade the environment, and those who finance the supply and distribution of hard drugs in North Coast communities — whether such businesspersons are from Humboldt County or from cartels in Mexico?

    To me, the choice is clear; to the Humboldt County sheriff, he’s just repeating what I saw 30 years in Garberville and SoHum. I thought it was a mistake then; I think it is now. RAMBO cops got a lot of overtime bucks. They’re now laughing at you from where they now live in Idaho — a quasi-white supremacist stronghold.

    All the CAMP raids, all the illegal asset-forfeiture seizures didn’t put a small dent in the market for marijuana. It remains to be seen if this effort will have a lasting effect on already suffering longtime decent growers.

    SoHum should be thankful it still has the Civil Liberties Monitoring Project.

    And I’m “conservative,” but it doesn’t blind me to the injustice.

      Senators no longer represent the state. They represent their own agendas and the agendas of the corrupt legislators.

      With that said, what about all the other ‘appointees’ the legislators created? They must have the power of authority to recall any and all of their appointees, despite their ‘oh, but there’s nothing I can do about the ‘regulators’ we unconstitutionally appointed’.
