Attorney General Becerra Files Brief in Supreme Court in Support of Sierra Club in Border Wall Case

Press release from the California Attorney General’s Office:

California Attorney General Xavier Becerra today, along with New Mexico Attorney General Hector Balderas, filed an amicus brief in the U.S. Supreme Court supporting the Sierra Club and opposing the Trump Administration’s attempt to overturn an injunction issued by the district court pending appeal in Sierra Club v. Trump. The Trump Administration seeks to reverse a previous ruling by the U.S. District Court for the Northern District of California blocking the Administration from unlawfully diverting $2.5 billion of Department of Defense funding not authorized for a border wall. On July 3, 2019, the Ninth Circuit denied the Trump Administration’s emergency motion for stay of the injunction.

“Allowing the Trump Administration to move forward with construction of an unlawful and disputed border wall would cause severe harm to our states,” said Attorney General Becerra. “Once this damage is done, it cannot be undone. We ask the Supreme Court to reject this impatient attempt by the federal government to rush President Trump’s previously rejected pet project.”

The States’ and Sierra Club’s challenges to the border wall are currently consolidated in the Ninth Circuit Court of Appeal. In the brief, the Attorneys General assert that the states would suffer irreparable harm if the Trump Administration were allowed to proceed with the construction of the border wall in California and New Mexico.

The federal government is requesting that the U.S. Supreme Court issue an order staying the injunction, which would effectively allow the government to begin building a border wall using unlawfully diverted funds before the Ninth Circuit Court of Appeals can hear the merits of the case. In the brief, the states ask the U.S. Supreme Court to reject the Trump Administration’s request for an emergency stay. They also present the unique harms to the states posed by the diversion of funding to construct the wall that was never authorized by Congress. The Trump Administration’s unlawful actions threaten the states’ sovereign interests and their ability to enforce laws within their borders to protect water and air quality, as well as wildlife corridors and endangered species.

But what people are missing is the blatant attempt at circumventing the congress and the legal system.

He won’t win. He will win an injunction at the 9th Circuit Court with one of his tame judges but the Supreme Count will not uphold it and will remand it back. The Court rarely gets between Congress and the President in a matter of politics , the President has the right to void international agreements and they won’t buy the fiction that Migratory Bird and Game Animal Treaty with Mexico can be used for this purpose. It’s just another delaying tactic.

A treaty is not an international agreement. Words have specific meanings and yes, a President can create an “international agreement” when up he can’t get Congress to approve a treaty. But then the next President can cancel it. That marks the importance of compromise and negotiation to get Congress to act and why the current extreme partisanship and insult politics is dysfunctional.

And we are not a “pariah” nation. We are just not paying for everything at the whim of the European politicians any longer while they pronounce judgements that makes them look like equals to their constituencies. If they want something, they can pay for it. They object to that.

That’s very true Kym.. Good Analogy! Extended members of my family, did end up here with all her babies! Unfortunately, me personally, I am also seeing a lot of Homelessness and Disparity in the US population. I would luv to see all the young and mothers cared for, and I appose the conditions at the boarder currently! And I am opposed to building the wall, but I do think there needs to be tougher entry at the boarder..

Like say for example, Unions and Union workers, or better paying jobs.. many of these companies have hired internal non citizen labor, and I am not just referring to farm Labor.. but typically higher paying positions, now companies can skirt the unions and pay much less..
Not to mention, America really has to deal with and solve its very extensive Homeless population.. Personally, it’s not just security at the boarder, or a certain race. I sincerely appreciate American Diversity! I think just America needs to slow down on Immigration in general, for the time being… I actually think America can do more good by helping other countries in Maybe different ways. Building enterprise or Infrastructure services.. Maybe that’s idealistic because the Gov isn’t very well intentioned for the most part.. Major conflicts though, I am not opposed to seeing the US take in refugees.. Myself..
I know, it’s not on par with certain Liberal Ideologies.. or conservative thoughts.. I basically think everyone is full of it so.. I just try and find balance wit it all..

Like all simplistic views, that is focusing on a small portion of the truth to prove what is wanted to be believed while disregarding anything that proves the opposite. Guatemala’s history has been one of violence, conquest and junta long before Europeans ever arrived. It has almost continuously had a history of military takeovers where one military general overthrew another. Even the civilian leaders either aligned with those currently in military power or military rebels- no one was independent of military pressure which always favored what benefited itself.

Somehow it is convenient to forget that the very idea of a reform movement that was suppressed by the US government necessitates the existance of something that needed reforming. There were mass slaughters of Guatemalans before the US ever intervened.

Yes. Although without the US (or the Soviet Union through export of Cuban revolutionaries) there is every indication from their history that military coup after coup would have still happened. It’s no excuse to allow the U.S. To suffer a gutting of our own society that has a Constitution allowing changes in policies without needing a military coup every 20 years. I cannot trust that anyone so focussed on imposing their own will with such hostility will ever consider my safety at all. It seems so foolish to condemn without pause the very entity that protects its right to complain that I can not trust them with power to act.

Its not that simple. The problem has gradually evolved for a multitude of reasons, but now its overwhelming. We can no longer be all things to all prople. We must have realistic immigration laws that are enforced. Asylum laws have been liberalized to the point of being ridiculous. Donald Trump did not cause this problem. Overly liberal policies and lack of enforcement by prior administrations did. Since the democrats all hate him, congress will accomplish nothing and the problem will grow worse. And then there is the California government that is without question the worst in America.

Kym- Like everything else in the world, it was not that simple. The US expelled a tyrannical, remote and ineffective Mexican government. If the people of the area had risen up, an American army of 5000 poorly equipped American soldiers a long way from supplies would have never managed invade and hold the capital of Mexico. What you persist in viewing with modern filters was probably seen by most in the area as a war between foreign invaders over the governance of lands stolen by both. They chose for individual reasons to work with which one seemed to offer the best protection for themselves and Mexico was not the overwhelming winner in that.

I think that you ought not use a news site to promote a version of history twisted into a convenient tool. That the US government was expansionist was probably viewed by many of the local inhabitants as a good thing over an equally foreign but weak, venal and far more remote government that would not address their complaints.

But totally obviously, many in the area did not hate it. Many looked on it as saving them from intolerable conditions. You apparently think of it as some massive aggression by the US against a helpless small Mexican Stare. Well Mexico at that one was a European colony- it was governed remotely by Spain. A lot of the people congregate tried for independence from Spain including local Spainards and Americans.

“Starting in 1810, the territories of New Spain north of the Isthmus of Panama (including Texas) sought independence in the Mexican War of Independence. Many Americans fought on the side of Mexico against Spain in filibustering expeditions.” Then, leaving out a lot of give and take, the newly independent Mexican government tried to remove Americans from land granted by the now defunct Spanish government. That lead to the republic of Texas, a lot more maneuvering, incidents and political turmoil, which addressed the issue of its times, slavery, without an emancipation, thereby earning the eminty of abolitionists. The Republic of Texas in the end several times petitioned the US government for admission as a State which was rejected a couple of times before being approved. The new Mexican government disputed the right of the Republic to exist much less seek Statehood, Polk sent troops and diplomats which were attacked. In the end the Mexican government,with their nebulous claims no more valid than anyone else’s at the time when little was settled after the colonial eras ended, signed a treaty lest the various other rebellious groups threatening them broke off too.

Mexico resented and continues to resent the loss of territory they claimed but never really occupied. They sought to define their territory by the claims of colonial Spain. Hos righteous was that. Just like there are people in the Southern US States who continue to resent losing in the Civil War and constantly refight 150 year old political debates. Doesn’t mean that anyone should swallow their resentments as truth just because it suits. Picking and choosing from the varied political opinions of those times to support current ill informed misuse of history in an agenda that never existed in those times is wrong. Nothing anyone did at that time of fluidity in America can be interpreted through modern political correctness. And people should be embarassed by the attempt.

Reading what I said instead of what you choose to respond to, I never said anything about Trump’s good sense. I said the LEFT has no good sense remaining. Trump is (surprisingly to me at least) much better at slamming back the crap that so many creepynpeople are crazed enough to confuse for thought than anyone else on the public stage.

Of course he is winging it. If he had gone up through the usual training for the current herd of politicians, the public would still be served up the same dish but it would have been hidden under inedible garnish. That is one of the two things I admire about Trump. He is just as nasty as his opposition and so far has out lasted them. And you are right- nothing lasts forever. But I do not share your optimism about something better following. I worry more about a true tyrant coming. The left loves a tyrant as long as he believes what they do and the right might think that is the only solution to the left. The coming years will be a test for the minority that treasures their freedom of thought. Can they hold back the tide of the unthinking coming from both sides?
