Humboldt County Sheriff’s Marijuana Enforcement Team in Bayside and McKinleyville

Humboldt County Sheriff Marijuana

On July 18, 2019, deputies with the Humboldt County Sheriff’s Office Marijuana Enforcement Team (MET) served two search warrants to investigate illegal cannabis cultivation in the Bayside and McKinleyville areas. The Humboldt County Planning and Building Department assisted in the service of the warrants.

Two parcels were investigated during the service of the warrants. The parcels did not possess the required county permit and state license to cultivate cannabis commercially.

During the service of one warrant in the Bayside area, deputies located a large two-story structure with multiple rooms growing cannabis inside. Deputies eradicated approximately 477 growing cannabis plants at this parcel. Also at this parcel, the Humboldt County Planning and Building Department found one building, plumbing and/or electrical codes violation.

During the service of the second warrant in the McKinleyville area, deputies located two greenhouses with cannabis growing inside. Deputies eradicated approximately 378 growing cannabis plants at this parcel. Also at this parcel, the Humboldt County Planning and Building Department found the following violations: building, plumbing and/or electrical codes violation and commercial cannabis ordinance violation.

No arrests were made during the service of these warrants. The cases are being forwarded to the District Attorney’s Office for review. Additional charges and arrests are anticipated as this investigation continues.

Worth billions if they could clear out the mom and pops and other marijuana-related grows. They will soon figure out how to get those with permits by controlling the White market, they will crush the rest of the non-corporate marijuana growers. Leaving them with full control of their poisoned corporate marijuana in a store near you.

We demand that supervisor Fennell pass an ordinance preventing any law enforcement or code people from interfering in growing food. If we are not growing pot, but instead fruit and vegetables, we must be left alone. We want the county employees who send out abatement notices for veggies must be reprimanded or fired. We will grow our food in any kind of method we want, smart pots, in the ground, in raised beds. Stay the fuck off our land, and Estelle, you get busy passing this ordinance. We demand you stop the government intrusion into our lives, or we will recall your ass out, and put some one in there who will protect our rights, not take them from us. Right now, you are the problem Estelle. We can also file a class action suit against the abatement people, naming you and those in charge of these agencies, go after your pocket book. Everyone call Estelle and demand this. She may not even be aware of the veggie enforcement, but we are.

Red States are the poorest and the biggest suckers of the government tit. 9 of the top 10 poorest States in the Union are run by Republicans. Trump would call them “shit hole states.” Like Miss., Ala, Louisiana, Kentucky, Arkansas, W. Virginia, etc. They’re also the ones that need the most government assistance. Government assistance paid for mostly by Blue States that have surpluses run by Democratic Gov. and state houses. Republicans cannot govern. They can only deregulate and cut taxes for the wealthy.

Steve, If you’re too faint-of-heart to buy your own straws, soda or coffee-cup lids, or take a simple concealed-carry class in CA, maybe you need to toughen up a little. And if you’re this devastated by straws and coffeehouses, I’ve got news for you. Not everything in life is going to be easy, so grow up.

Us hardy CA liberals are tough enough to take hardship in stride. We drink our beverages with our mouths like mother nature intended, take CCW classes so we can legally carry our guns around, and actually walk a few feet to smoke a cigarette, instead of complaining about having to move outside. Then we walk an extra step to put our trash in a trashcan, instead of dropping it in the sand.

It’s a tough life, and it’s not for everyone, but we see people from other states crying and begging for straws and cigarettes so they can suck like a baby without regard for the oceans or their neighbors, and we Californians nod knowingly to each other, pat our shoulder holsters, and shake our heads at the childishness of others. 🙂

The times coming when the hcso will get an unwelcome welcome at the door. People will only put up with this crap for so long. It seems our rights are violated daily now. I can’t wait tell they bust my door down. I have a 50’ hoop house full of vine ripe tomato’s ready for the picking and cameras all over ready for the show. I’m using smart pots and have illegally ran a hose without a permit to water these beauties. I expect at some point the county will show up to collect there fair share of early girls!

I was given an abatement and the building department came to my house. Walked my entire property, found ZERO cannabis and are still saying that even though the only plants they found are vegetables, i have to remove my smart pots (which have been established for years with only vegetables) , dump out the dirt onto a tarp ( heaven forbid that perlite derived from rocks and minerals touch the ground) and build garden beds. Let me ask this , won’t the perlite be closer to the ground if it is in a bed? Now it is contained in a pot, so this makes zero sense to me! They have zero images of cannabis ever being in them, but say because it looks like a cannabis garden i have to remodel it. Well, my ground is hard clay and I am not physically capable of doing this type of labor. Nor do I have the finances to build wooden beds. Not only that, but all their claims have been unfounded and proven wrong, yet they still want me to pay a 700$ “PAPER PUSHING FEE”. When they were the ones that made this asinine decision to abate me!! It is at the point where I am ready to speak to an attorney and see if I have the right to file a lawsuit for harrassment and extortion. I am ready to also file a class action against them if there are others who are dealing with this same scenario. Let’s unite against this infringement of our rights!

Hi, I suggest digging deep holes and/or beds for your veggies… I have hard pack clay and it works really well, super water efficient… next spring think about it! Often there are young local bucks or does such as myself willing and able to do the labor, sometimes can barter for a share in the produce… good luck!

Not everyone wants to grow vegetables in the fing ground.. Why should anyone on thier private party “have too”? I prefer raised beds, because they are much easier to work on and get to for me.. I have done both..

It’s a matter of principal. My rights to grow my own food, on my own property, with my own methods. The principal of them trying to tell me that i cannot use pots to garden that are specifically made for gardening. They were already in place when i bought the property and i can see no reason that i should have to dismantle them to accomplish the same outcome. I cannot bend down to garden, so to me the set up was perfect. Now they are telling me that i have to cause myself physical discomfort in order to do something i enjoy doing. I would understand to an extent if there was a true environmental issue. But this is all about money, and extortion.

Tom- Yes. The perlite is an interesting issue! My neighbor and I have looked into this weird situation about perlite. It is on the “bad” list- but only in Humboldt County. Not by the state, not by CDFW or Cannabis Control, not in Mendocino or Trinity counties. There has been no reasonable, scientifically-based reason given for it’s demonization. Yet when people wanted to get compliant they were told they needed to remove it all from their places! Our conclusion is that it was included as an “environmental hazard” mostly to add another hoop for the ones seeking permits to jump through and it adds another violation that the county can collect fines over. I am shocked that they are still pursuing this very weird perlite idea. Perlite (naturally derived) absorbs moisture and releases it when needed- similar to those jelly-like “guerrilla crystals” (derived from plastic) that growers used to use. Perfect stuff to use in your garden bed and- very smart to use IF IT ARE ALREADY THERE!! Please somebody educate me if we got it wrong…And yes- I am hoping somebody begins a class-action lawsuit against the county. John Ford and the Planning Department are way out of bounds as are the supervisors! How dare they file civil charges on us for having greenhouses to grow winter vegetables and then force us to drive to Eureka to defend ourselves. When we prove our greenhouses clean of weed they should have to pay us for gas, travel and time taken off work! I charge $50/hour for things I don’t enjoy doing.

I always enjoy your thoughts Farce. I’d like to expand on what you say. I am very tired of our representatives, i.e. Supes, Judges, D.A. and the planning dept not upholding their oath of office which they took willfully, without reservation or duress. My punishment will be at the end of this article. I am going to quote a couple of State of California constitution LAWS. Here goes; Article 3.5 states: An administrative agency including an administrative agency created by the Constitution or an initiative statue ‘HAS NO POWER”, (my capital letters) That seems very clear to me that agencies which the State water board is, the CDFW is an agency, the Humboldt Co. building and planning is an agency, and there is a lot more agencies that seem to think they have authority over “We Te People” By the words of the Constitution they do not. Now I am going to quote article 2 which states: The power of the state government are legislative, executive and judicial; it says no mention of the administrative state that seems to say “We have authority over “We The People”. NOT. O.K. now onto Article 1 section 3. The people have the right to instruct their representatives, petition government for a redress of grievances, and assemble freely to consult for the common good. To me that sounds like I can instruct (to tell) my public servants what to do. The slave (maybe a bad word) cannot tell the master what to do, how to do it and especially if you want to do something you have to pay us monies and lick my boots/shoes. What say the Humboldt Co. D.A., Judges, Supes, building and planning dept have to say about these State LAWS. Do you honor/agree that codes, ordinances, by-laws of a corporation over- rule the State Constitution and its LAWS. I’d like to petition the people in these positions of public service to answer truthfully as you have sworn to do. Definition of a “Public Servant”: A servant is someone that is in service to another. They look to do right by and make “HAPPY” the person or people that employ them. And next but not last. Article 1 section 1 states: All people are by nature are free and independant and have inalienable rights. Among these are enjoying and defending Life and Liberty, acquiring, possessing property,and pursuing and obtaining safety, happiness, and privacy. What does this mean to our “Public Servants” I’d really like to know D.A. Judges, Supes and planning dept through this petition through Kym’s site. I am instructing you to answer. Basically I want to know does “We The People” have the power OR does the Administrative State have the power? That being said; what about the word “HAPPINESS”. Who gets to decide what makes each of us HAPPY. I believe only I can determine that and not my public servants. While still on the state constitution, one more quote: Article 1 section 2 states: Every person may freely speak, write and publish his or hers sentiments on all subjects, being responsible for the abuse of this right. KUDO’S Kym for this–Someday I hope you get an award for Freedom of Speech. You have earned it. You let all of us speak with very, very little restrictions. THANK-YOU KYM. Last, I believe a proper punishment for our “Public Servants” for taking our RIGHTS away per Constitution should be $10,000 fine per day for each offense coming out of their own pockets, not the taxpayers. And they have 10 days to change their ways. And all we have to do is accuse them of wrong doing, not proving it, D.A. Judges, Supes and building and planning dept has to prove they are obeying the Constitution of California instead. I think an initiative at next years voting time might sound like this. All administrative government agencies can only make and pass LAWS that honor and further “WE THE PEOPLES” rights to Life and Liberty, acquiring, possessing property (to do whatever we want on which doesn’t hurt the environment or my neighbors rights), and pursuing and obtaining safety, happiness and privacy.

I have a certified handwritten copy from the former SOS, and a 1998 L.A. Appellate Court case that takes it all back to 1849. The people of California didn’t want or vote on the 1879 version, making it void. Not one amendment, to the void 1879 version, was EVER Legislatively performed correct –sound familiar?

HALE v. HENKEL 201 U.S. 43 at 89 (1906)

Hale v. Henkel was decided by the united States Supreme Court in 1906. The opinion of the court states:

“The individual may stand upon his Constitutional Rights as a citizen. He is entitled to carry on his private business in his own way. His power to contract is unlimited. He owes no duty to the State or to his neighbors to divulge his business, or to open his doors to an investigation, so far as it may tend to incriminate him. He owes no duty to the State, since he receives nothing there from, beyond the protection of his life and property. His rights are such as existed by the Law of the Land (Common Law) long antecedent to the organization of the State, and can only be taken from him by due process of law, and in accordance with the Constitution. He owes nothing to the public so long as he does not trespass upon their rights.”

Hale v. Henkel is binding on all the courts of the United States of America until another Supreme Court case says it isn’t. No other Supreme Court case has ever overturned Hale v. Henkel. None of the various issues of Hale v. Henkel has ever been overruled since 1906. Hale v. Henkel has been cited by the Federal and State Appellate Court systems over 1,600 times! In nearly every instance when a case is cited, it has an impact on precedent authority of the cited case. Compared with other previously decided Supreme Court cases, no other case has surpassed Hale v. Henkel in the number of times it has been cited by the courts.

Central Hum- – -Hale v. Henkel wraps it up well doesn’t it. “WE THE PEOPLE” have authority and power over all that we do for our posterity. We don’t need no sticking badges. I just don’t understand how the courts, supes, and all the Agencies that believe THEY have authority over us. The LAW clearly says otherwise but THEY get their way all the time. I blame the local courts for this. If the local judges would HONOR their OATHs which they took willingly instead of honoring maritime, gold fringed Color of Law flags we wouldn’t be in this situation. THEY know it takes many dollars to challenge their administative rules in the courts. Gold fringed flags are against U.S.Code 4; since the supes and courts display this illegal flag willingly could they be considered for a big fine per day until they change back to a legal American flag? Just a thought.

Synchronicity. The following just came in in an email from a friend in Washington;

Recently I decided to write the senate, and ask them to abolish WA State, since the people didn’t vote on or ratify the 2nd state constitution, they blocked Trump’s executive orders, they allow murder, rape, child molestation, drug sales, they kidnap people’s children… and the list goes on. Well I started getting some support on this. People asked me if they could write affidavits about what WA State has done to them, for me to include with my letter I’m sending to the senate.

The idea is to abolish WA State, and start over with a Sovereign Nation in it’s place, that follows the laws of God like the early settlers in the colonies. If we get enough support, and ship them huge boxes full of people’s affidavits in support of this, we might be able to get what we are asking for.

Yeah.. Farce, I would say polymer Crystals are not so good. Essentially, they are are a petroleum product, I DO NOT think they are actually super bad for the environment, as they do break down.. The Article states, sometime used for erosion control….Sorry, someone told me once, a long time ago, WHY Water crystals were not good, and it’s filed in the memory pretty far, lol..(I think it’s because they are essentially petroleum) that then break down, or petroleum in some derivatives, sooo, I essentially stopped using them because of that long time ago.. Sounds like nazi environmental police. They’ve done a huge amount of preparation to make sure the environmental police can kill your ability to live free from harassment.

Typically, they still push those details that rarely get ticketed when they want to intimidate you into not pushing back.

I am very surprised that a private property group has not filed a lawsuit yet. Y’know- somebody like that group that Estelle used to front! I guess they’re all okay when it’s weed – but it is so much more than weed. More than gov’t, the problem is neighbors who cook meth and use banned pesticides, wreck watersheds and pollute.

The County and gov’t are on the hook for expensive chemical cleanups, diesel leaks, making sure water quality and zoning laws are enforced. No one wants to find out in 5 years that the rivers we depend on for water are polluted beyond repair. No one wants fishing industries killed when everyone sucks water out of the rivers to feed their grows.

Gov’t only steps in as a last resort, when neighbors and community pressure doesn’t stop people from poisoning the environment. And then they sometimes go too far. It’s better if it doesn’t get to that point.

So work with your neighbors, push people in your community to be responsible growers.

I’m a lawyer, and I don’t think you need to dump or get rid of your pots if you were not growing pot for sale without a license. I also don’t think you need to pay “administrative costs” or “administrative fines.” This nonsense is the reason that everyone getting abated should call a lawyer immediately, not the Code Enforcement Unit. They are not lawyers, and they don’t know what the law is. You should never ask a cop what the law is, and you should never ask the county’s code enforcement people what the law is. You wouldn’t ask a random person to give you an eye exam, or compute your taxes, why ask them what the law is. Sorry for the rant but I get tired of this stuff. Good luck with the case.

I’m a little interested in this:

During the service of one warrant in the Bayside area, deputies located a large two-story structure with multiple rooms growing cannabis inside. Deputies eradicated approximately 477 growing cannabis plants at this parcel.

Also at this parcel, the Humboldt County Planning and Building Department found one building, plumbing and/or electrical codes violation.

Did the search warrants relate because of parcel ownership?

Interesting that one parcel, by the wording in the PR, didnt have any plants outside to meet typical search warrant criteria.

I would speculate that these grows were or very big, hence the lack of pictures, and due to their proximity to town and the lack of address, I.e. 400 block of so and so Ave. These raids were probably due to neighbor complaints rather than size or environmental degradation. The sheriff did say they were complaint driven. Purely speculation though

So then i must have had a complaint about my veggie garden then? Or did the just rely on an image from the sky and make assumptions? This is now my second time being abated. They couldn’t get me the first time, i took all the pictures they asked for and was cleared, then they came at me a 2nd time (supposedly for a completely different reason) which made them come to my property and they found nothing, and their accusation were incorrect. Now they are saying i have to completely change my veggie garden, or they will slap fines on me for looking like at one point in time, there could have been cannabis there. Well hey, i say that’s bullshit and just a way, whether it be fines or ” fees for paperwork ” for them to obtain money and weaken my independence. I have now spent over 1400$ bc they decided they want to harass me, and have found zero cannabis. At this point I feel as though it is straight harrassment. Not only that, but i have had to adjust MY schedule to be here so they can come onto my property. When i told them i was unable to meet them a specific day, they threatened to bring the sheriff up here with a search warrant. Now that would have been fine, except i did not want to have to spend weeks cleaning the mess they would have left behind. Although i would have laughed when they found nothing. But what a waste of taxpayer’s money, and a complete waste of my time.

Umm.. TRB.. Most vegetables have naturally accouring amounts of formaldehyde in them, in fact our bodies use small amounts of Formaldehyde.. It also breaks down in water, so if your hyper concerned about the teen tiny fractional amount your plants MAY be absorbing.. Wash the vegetables and it will cut any formaldehyde significantly back.. Lots of info on Formaldehyde on line, what was not apperant was just how much Formadehyde could be absorbed by plants… Again very little info on if cannabis will absorb Formaldehyde, and even if it did, it’s water soluble, so I doubt it would accumulate in the trichomes heads… Vegetables, again contain levels of Formaldehyde naturally

Soo.. TRB is super concerned about the small amounts of essentially unabsorbable Formaldehyde in smart pots (also Formaldehyde off gasses and out doors, in smart pots. very little concern) on Someone else’s property.. but absolutely no concern for Glyphosate or Aluminum in like everything.. OK..
I actually like smart pots and they can look good.. they are not that ugly.. not in my book..

I referred to the girl in a box story not to imply that all growers do that.

My point was that if you go back to the earlier stories on his arrest, it was aided by inside information from people who worked at the farm, “truth tellers” or “snitches” helped save that girl.

I think there needs to be an allowance for medical cannabis.. and small collectives… Who says it isn’t medicine?
It really is not up to the BCC to decide.. they need to allow for small collectives, and 1000sq ft should be straight medicinal…
A garden below 2500ft or say shouldn’t be messed with at all.. that is so small, and essentially has very little impact.. to the environment or does something that size affect anything really…

There needs to be greater protections for residences from these fines and Abatments especially if you have a small grow of little impact or no importance…

Tax larger cultivators at higher sq ft rate, tax smaller cultivators less.. Larger grows have larger impacts..

They also need to stream line the permitting process and make it simpler and more affordable.. enforcing stuff like “no perlit” is really messed up and stupid… make it harder to get larger permits..

Give small cultivators time to work up to the water requirements..

Yeah, I wish there were more minds putting solutions forward.And the NG needs to be stopped from raiding small grows of little importance! It’s not a National Emergency That a few folks have a small grow in thier yard that bothers no one…

I would say that those ideas sound fine, mostly.

I completely agree on streamlining the permit process.

We all are rightfully upset about the 1 acre cap being taken out.

No perlite is excessive, but too much perlite wastes water. Maybe a small percentage per sq. yard of soil instead of outright banning it….

But there are alternatives, and they should be promoted as perlite is not a “heady” or problem free medium. It’s a hybrid of materials created under excessive heat to make a new, much less degradable material.

The other thing that needs more thought is the “bothers no one” notion.

There should be no lights allowed in any situation.

Keep it covered or go buy a warehouse.

Dark skies are a must.

Noise pollution too, is a bother.

I would also say I’m not convinced there isn’t a National interest in reigning in CA weed outlaws.

There even are international reasons, in my opinion.

Otherwise, nice thoughts.

Yes, I agree with dark sky’s! I actually think tho, that possibly keeping Shade cloth, and turning to Lower LIMITER of light, or perhaps a different spectrum, might be better? Shade cloth during veg, actually seems to improve plant growth, and helps with heat, at night the light is much more discrete.. much better.. just a thought..
And noise pollution, for sure.. Very important.. But good thoughts there too TRB.. TY..

The speaker at the townhall meeting held before legalization replied to the question of whether or not their ‘6 plant limit’ was limited to just mj. He said, (paraphrased) ‘Yes, we will be going after all plants, even orchards and veggies, … we won’t be allowing more than 6 plants of any type. BUT, that’s not our top priority at this time.” He then mentioned something about a strawberry farm he wants to bust.

In my opinion, Shak(espeare)s video link to Michael Shaws talk on Agenda 21, should help remind everyone why the distracting nature of our differences in opinions about the left-right paradigm, that Mister Rover recently reminded us, is merely an attack on private property rights across the board.

I think Tom”s abated veggie patch in perfect pots is a clear indication of this behaviour, targeting people’s rural and homesteading lives.

I think everyone should put this talk at the forefront of their respective to do lists, if they are interested In a clearer picture of the broader agenda.

This isn’t your run of the mill conspiracy theory, with psychological beta testing of people on both sides of the enforcement /abatement issue, as It clearly is being used to justify the corporate takeover of the cash crop of the resistance.

I say resistance, because not everyone who farms the highly desired cannabis, was exploiting land and archaic legal abuse of the people’s right to grow whatever they wanted without interference of the Authorities.

This, in my opinion, is fundamental to understand where this started and where it’s headed.

I’m sure this behavior has its roots In man’s earliest ambitions to control his environment, with advances in technology and communiciation being deigned with power always focused in the ruling class.

There’s an incredible history lesson here, connecting the dots

realizing the illusion of freedom that we’ve been taught to accept, and reinforced through societal and cultural programming is a carefully manufactured LIE.

We certainly have bought into it, much the same way livestock has been domesticated to live in cages, and they /we have little to no ability to focus on the perpetual shifting reality that distracts attention away from the story of our enslavement.

My gratitude and support to all those who preach it, who teach it, and those who continue to expose the truth and remind us of our duty to speak truth to power, and fight the illusion of our separation.

In reference to the scrutinizing of smart pots ; I am proposing that community members who are affected by this join me at the board of supervisors meeting this Tuesday the 23rd at 9:00 am to stand up for our rights to grow our own food! The county is trying to use them as leverage for abatements, and ban the use of smart pots and anything circular completely. This year it’s smart pots and circular shaped gardens, next year it will be garden beds! Soon you won’t be able to grow anything at all in any manner. It’s unjust and illegal and we as a community need go fight this! Please join me!

The Planning Department is out of control and the Board just sits on their ass! How many folks have been abated, no violation and still asked to pay money? I heard grading violation for clearing slides.

Apparently there is a Warren Black who works at the Planning Department, Code Enforcement. Many say he is a power hungry, rude, arrogant liar. Rumor has it he apparently had a previous career in the black market. Did those folks up in Willow Creek have to pay the “administrative costs”? File complaints with the Grand Jury! An Attorney (Mathew Pappas?) should take them to task. I have to believe there would be hundreds of residents who would donate money to the cause.

By the way, an article in the July 18th edition of the Times-Standard, “After mistaken abatement notices, Humboldt County adjusts cannabis enforcement” has John Ford’s following quotes:

“We refined a lot of things”

What are you refining and how are you doing it? Please explain!

“We want to make sure that when we do post a notice, it is truly someone who has been engaged in cultivation”

Does he mean currently or in the past? How are they going to do that? Please explain!

“Frankly, one of the things we’re doing is refocusing a little bit”

Please elaborate!

Which folks in willow creek? I got an abatement notice for 996 square feet of greenhouse space in downtown willow creek, we took the garden down in ten days. Have not received an administrative fee yet but assuming its coming. We got to keep 6 plants though.

So, this is what it has come down to. The Sheriff, the National Guard, the county agencies, all turn out to bust an indoor grow of less than 500 plants. Pitiful. Perhaps instead they should figure out what it’s going to cost to put gas in everyone’s truck, and pay everyone to stand around all day during the raid, then before the raid, offer it to the grower if he’ll stop. It’ll be cheaper and keep the courts time for actual crimes.

Ed- I believe these busts in Bayside and McKinleyville were done by the HCSD alone, not including National Guard or other agencies. It seems like there is only ONE multi-agency collaboration including National Guard operating and it is busy in Spy Rock/ Laytonville area this week. I may be wrong- I’m just reading between the lines of various reports. (Btw- Thank You eternally for your years establishing CLMP and training many of us in documenting civil rights violations)
