Woman Convicted of Second Degree Murder for Killing Two Hoopa Girls and Injuring Three Other Hoopa Youth While DUI

Information from the Shasta County District Attorney’s Office:

Kendra Andersen-Schwegerl

Kendra Andersen-Schwegerl

Kendra Andersen-Schwegerl, 27, was found guilty by a Shasta County jury of two counts of Second Degree Murder and other related charges this afternoon.

On November 3, 2017 at approximately 12:35 a.m. the defendant hit a car full of five teenagers that was stopped at a red light at the intersection of Churn Creek Rd. and Hartnell Ave. in Redding. The defendant was travelling at 100 miles per hour at the time of impact. Erica Young, 18, and Lacy Jackson, 19, [both of Hoopa] were killed in the collision. Clifford Bailey, Daisy Reece, and Ralph Sorrell [also of Hoopa] were injured.

The defendant had just left a bar where she had been told by a friend to not drive. She also refused an offer of a ride home. The evidence showed that the defendant consumed beer in her car and at two separate bars over a three hour period. The defendant’s blood alcohol concentration approximately an hour and fifteen minutes after the collision was .254%.

The defendant did not have a prior DUI arrest or conviction, however, the evidence showed that she had knowledge that driving under the influence was dangerous to human life. Additionally, she acted with conscious disregard to human life.

This case was prosecuted by Deputy District Attorney Rachel Donahou. Supervising Agent Luke Blehm of the Redding Office of CaliforniaABC was the investigating officer. Redding Police DepartmentOfficers Provencio and Mack conducted the DUI and collision investigations. CHP – Northern DivisionMAIT provided expert testimony regarding the speed and acceleration patterns of the defendant’s vehicle. The victims and their families were supported by Victim Advocates Deb Heide and Candice Maxwell.

Sentencing has been set for July 19, 2019 at 10 a.m. before the Honorable Judge Tamara Wood. The defendant faces forty years to life in prison.

What a waste of lives due to a poor decision. It’s all about making the right choices. May the victims rest in peace and may all drunk drivers rot in Hell.

A tragedy. However…this is what other counties do. Unlike Humboldt where we cater to drunk drivers- even those who kill children and drive away like Marci Kitchen. Other places are actually tough on assholes. We are not. And that is why we have more criminals and assholes than other places. Our county is known for this in the criminal/asshole community. It’s really quite simple…

You ought to rally for a new DA if you feel that way. Cops can only do so much abd just fyi marci has not been sentenced yet so ya cant really use it as an example. Her court case was pushed back multiple times due to everyone in the DA office quitting openly after Fleming and Board of supes backed tje hiring of an awful guy who harassed everyone in the office&hadnt even been in a court room for 10 years. Can you say cronyisn?!

Take it up with DS- I agree with most of what you said. But we are limited by who runs for DA! Gallegos was a train wreck but had no worthy adversary for years. Now we are still the easiest county so …maybe it’s institutional in our county? Anyways…Marci was sentenced….https://lostcoastoutpost.com/2018/oct/11/marci-kitchen-has-been-sent-prison/

The bartender and owners of the bar should also do some heavy time. How many times have you seen visibility intoxicated persons being served at local watering holes?

I think instead of “hard probation” in Humboldt, the judges should just start handing out ruler slaps like when I was in grade school. Thieves = 10 Ruler slaps. DUIs= 20 ruler slaps and so on. At least it would be entertaining!

Anyone out there; if this happens to your friend, disconnect the coil wire on the distributer or disable the car in some other way. Two flat tires usually works. Better a DUI or attempted DUI than the death of innocent people. So sad, for everyone. But the driver is still alive, and will get out someday. The young women are gone forever. Maybe it’s time to hold the bars partly responsible. A BAC of 0.254% is extremely high.

Funny. Someone did that to
My friends truck decades ago on an old Toyota pickup they pulled 4 of six plug wires on truck. Took us hours to get back to town with truck running on 2 cylinders, if the tires were flat, probley would have drove on those too. Old Briceland road on 2 cylinders! Lol. Ahhhh the good ol daze

A BAC that high she could probably barely walk! That is almost to comma status that high and an hour and a half after collision. At some point the bars become responsible for something like this and bar tenders or bouncers can’t let her drive and if need to use force to stop her then they need to and let law arrive before car starts . Too bad for life’s lost and affected including the rest of hers!!

Exactly and this girl has never been in trouble with the law before. Bartender should have been more responsible her so-called friends should have stopped her from getting in the car or disabling the car like you said.when you drink you do not know what you are doing at some point that’s why people get naked when they drink that’s why people have affairs when they drink that’s why office parties have the stories they have.as drunk as this girl was she had no idea what she was doing somebody else should have taken control. I feel there are three lives taken here the two but died God bless them that was drunk driving.

I agree. This is how we should be operating in HC but essentially in Humboldt you have to kill two times via DUI before anything real is done. As a victim of a similar crime I know this to be the case. Anyone this day and age knows… “knowledge that driving under the influence was “IS” dangerous to human life” which should be the assumption from the get go in any DUI this day in age with all of the education in schools delivered on drinking and driving and yet it is not in HC. I am thankful that the families involved have received some justice but ashamed that it wouldn’t have happened here.

Damn I remember this story those kids were probably having a blast on a little road trip , RIP to your friends maybe this is some closure . Humboldt county courts is a disgrace to human life , wtf marci didn’t get nothing for killing her own child and she looked at the judge and excepted her sentence.that judge in Shasta is setting an example , she should have got worse.

OK, that seems just. Tragic and incredibly sad, but it was a horrible crime and a fittingly harsh judgement. Nice to see the justice system working once and awhile.

Those 5 kids were not on a road trip, they were simply taking a friend back home which was 5 minutes from their house. Sentencing does not happen until next month however we are hopeful that judge Tamara Wood will uphold the law and give her the time she deserves. Maybe this case will pave the way to a more strict ruling against DRUNK DRIVERS here in Humboldt county.

No, here in Humboldt County we give drunk drivers like Ryan Sundberg their own hotel against the wishes of the voters. What is Ryan Sundberg going to call his horrible hotel in Trinidad? The Trinidad Drunkeria? Get hammered and lose all your money at our crooked casino, then stay the night at our overpriced monstrosity of an eyesore hotel, or so says Ryan Sundberg and his daddy Garth.

Marci Kitchen had money and connections within the legal system, That’s why she got the softball treatment , This woman had neither, so she’s going to prison.

Has there been anyone sentenced for a first time death DUI that was not prosecuted as a manslaughter as opposed to murder? And even then juries seem to feel sorry for the person on trial rather than the victim.

The parents for all involved must be suffering tremendously. I can’t even begin to imagine what it would be like to never talk with my daughter again or have to go visit her behind bars for the next 40 years.
