Rio Dell Aims to Bolster Cannabis Industry Within City Limits

On Tuesday, March 19, 2019 the Rio Dell City Council gave final consideration and approval to a series of legislative items aimed at bolstering the cannabis industry in the city. The reforms will impact municipal ordinances related to the reformation of the City’s taxation system, expansion of allowable land uses related to cannabis and the institution of Rio Dell’s first cannabis equity program.

“This package of cannabis reforms will lead to even more industry investment into the community, helping to revitalize the downtown, stabilize tax rates and provide tools to those interested in getting into the legal cannabis industry and doing it the right way.” Stated Rio Dell Mayor Debra Garnes.

Specifically the cannabis reform package includes:
1. Streamlining and reducing the City’s taxation system, locking in the tax rate at $2.00 per square feet for cultivation and 2 percent of gross receipts for all other activities. City Finance Director Brooke Kerrigan stated “In the past the tax rates could be as high as $5.00 per square foot or 10% of gross receipts. With this new legislation the Council has committed to eliminating industry concern about overtaxation.”

Kerrigan concluded by saying that “there may be concern with other jurisdictions that they need to institute or raise cannabis taxes due to dramatically increasing pension costs, but that is of no concern in Rio Dell. We have no unfunded pension liability and therefore no need to raise the taxes beyond what we’re calling the ‘Two or Two’ tax program.”

2. Land use reforms that will allow up to three retail dispensaries in the Town Center Zone. Retail outlets will need to compete through an RFP process. “Not just anyone can get in.” Stated Community Development Director Kevin Caldwell. “The process will be vigorous and the expectation of the City Council is that Rio Dell will have quality facilities. Developers with no business acumen need not apply.” Caldwell concluded. The reforms will also allow distribution and testing laboratories in the Town Center Zone while cultivation will be allowed on the Dinsmore Plateau, a remote area of incorporated Rio Dell located to the west of the city center.

3. Institution of the Rio Dell Cannabis Local Equity Program (RDCLEP) using state grant funds, if awarded. The program aims to provide grant dollars and assistance to those negatively impacted by the legal status of cannabis prior to 2015. Potentially over $100,000 could be awarded to the City that can be
used as a tool to “spur further business development especially for the disadvantaged.” Stated City Manager Kyle Knopp. “Anyone interested in applying to the City for these funds should call City Hall as soon as possible to get on the registry. Please call (707)764‐3532.”

“2 percent of gross receipts” HOLY SHIT, this is too funny!! Get the f@ck out of here!!!!!!!! And it was 10%?????? we are business partners at that point and you can be on the hook for 10% of the expense and if any legal trouble happens, you are in the same boat.

The roads are payed for with gas tax. Use taxes makes sense.
Taxes on top of taxes is just theft by the government. You pay a property tax(government rent); why should there be a tax on top of that… taxing how you use your property?

All the cannabis taxes should be on sales.

Property tax goes to the county. Big gas tax goes to the roads. Sales tax and it’s added local add-ons….Income tax…etc. etc… I agree with Gorilla Grower for the most part. When the taxes become too hard to bear it’s time to resist. I drive an old beater truck while county employees drive nice new cars and still they keep putting their hand in my pockets. Yes- I donate to the local firefighters voluntarily because somehow even with all the taxes they get shorted and that is a disgrace. “Legalization” is a corrupt money grab and a means for government to take your private property rights. I will be glad to see the Original Market capsize that ship full of greedy opportunists.

First you got to pay the state tàx and then you got to pay the county tax and then you got to pay the city tax then if you employ anybody it comes with a whole new set of taxes state and federal income tax and insurance along with unemployment disability and Social Security if you ain’t broke yet and then we’re going to make you analyze the stuff and put you on a track-and-trace system with radioactive isotope bands that we can keep track of you and your product from outer space and we’re going to charge you for that too

2 or 2 means 2% or $2 per square foot.

I suspect a tidal change in direction is about to inundate California. Excess taxation has been a cruel and unusual punishment that attempted to test just how far neubees and prohibitionists could legally push decent hard working people. Some very ugly pranks have been pulled on undeserving folks.

Before the next election, we’re gonna enjoy watching incumbents squirm and squeal. The good ol’ boys are going to be replaced by intelligent pro-cannabis candidates. It’s long over-due.

2% of gross is insane!! Margins are so tight in the industry right now that basically you are working for free day and night just to give rio dell thier cut. 2 a sq ft I can make sense on but what if the business is operating at loss thier first year then they still have to pay 2% off gross. Sorry rio dell but that is just plain greedy and extremely short sighted.
