Can you legally detain someone? Isn`t that perilously close to kidnapping? I know the sheriffs do their best to look the other way in favor of the victim. However, for a few dollars of tools or etc. it doesn`t seem worth it to risk a big lawsuit or charges.

Any cops or lawyers out there care to comment?

Yes, you can. And you can do it with a gun in your hand if you are in your house.

Making a Citizen’s Arrest

Tell the suspect plainly that you are making a citizen’s arrest and that you are holding him or her until police arrive.
Call the police.
Ask explicitly for his or her cooperation until police arrive.
Avoid using force, if at all possible, and use it to the minimum possible otherwise.

Don’t forget central air/heat, color TV, a large selection of books and board games. not to mention a free visit to the Infirmary, hot shower and a phone bank you can use all day… it’s not called The Humble Hilton for no reason. Shit it’s better than most hotels in Eureka these days.

I’m glad home owners are catching these POS people. This happened in Benbow a bunch. After we had a neighborhood watch meeting and found out it’s up to us neighbors to take care of things ourselves, that’s a guarantee that’s what’s gonna happen. The sheriff can come clean up after we’re done!! Great job homeowner!

A neighborhood meeting -your/our ‘grassroots’ actions are where change happens. Glad to hear this.

I do have an issue with the mob mentality of the holier than thou assholes who stand on their soap boxes as part of their little war on drugs. He’s still young enough to be redeemable and turn around. There are obviously some psychological issues happening and people who have no clue about the human condition and are too lazy to think about it in depth are going to treat him as if he is some rabid dog. You’re probably all part of the po-po clique that looks at everything in black-and-white; ZERO critical thinking skills. He’s gonna have to work hard for a long time, to stay turned around, but the sooner he does it, the easier it will be.

It’s an aphorism that the victor writes the history. Your post is a perfect example of the contempt of the victors for the losers, in this case for the losers on the War on Drugs. Congratulations on that victory where drug users have won and those who oppose it are told they have “ZERO critical thinking skills.” Drug abuse of illicit substances is killing so many people while destroying and chance at happiness for so many more but as long as people are told that they should not blame themselves for it because of “psychological factors” , it’s all fixed.

Critical thinking might be better represented than identifying with drug abusers as victims and hating those who complain about being ripped off by them as in the wrong. Superficially it may sound like a emotionally adult idea but it is more likely to be the kiss of death.

TQM – The assholes are the tweaker thieves, not the people who call out the entirely unacceptable behavior of those tweaker thieves.

Do you realize where you are commenting and to whom? Most of these folks are exactly as you described. Nuance and critical thinking are not in their tool set.

Of course, he’s just a kid at 19 years old. His brains not developed, he obviously didn’t know that breaking into somebody’s house and stealing their stuff was wrong. How Dare Society look down on him for his actions.
I know from personal experience raising my kids. If I catch them stealing cookies out of the cookie jar, then they don’t eat their dinner. Instead of punishing them for their actions, such as sending them to bed with no supper or giving them added chores, it is in everybody’s best interest to just give them more cookies. If they had more cookies then they wouldn’t have to steal the cookies in the first place. Of course for some reason, they always end up wanting more cookies.

the kid did nothing wrong. just the same as a speeding ticket. and if you were to beat this kid up you would be in real trouble. he is allowed to take your stuff without punishment (up to $950) prop 47

The measure required misdemeanor sentencing instead of felony for the following crimes:[1][2]

Shoplifting, where the value of property stolen does not exceed $950
Grand theft, where the value of the stolen property does not exceed $950
Receiving stolen property, where the value of the property does not exceed $950
Forgery, where the value of forged check, bond or bill does not exceed $950
Fraud, where the value of the fraudulent check, draft or order does not exceed $950
Writing a bad check, where the value of the check does not exceed $950
Personal use of most illegal drugs

Others viewed Proposition 47 as being short-sighted. Los Angeles City Councilman and former LAPD chief Bernard Parks noted that while drug-related arrests fell, thefts and residential burglaries rose. He stated, “But what they failed to consider is that people who are using drugs are also committing other crimes. How do they stay heroin users? How do they support their habit? … People don’t want to understand that I can’t be a crack addict and have a profession. Nobody’s giving me drugs. I rob and burglarize and steal.”[17]

I am convinced in this day and age if there was a zombie apocalypse there would be zombie activists. And most likely they would be from Arcata.

even though I don’t live in Arcata, I sent both of my kids there for a reason. EHS and MHS both have a hard drug problem. AHS doesn’t and also has a great AAI program.

If AHS doesn’t have a drug problem something changed in the decade ago when I went to school. Or is it just the definition of hard drug that’s changed?

the definition of hard drugs and soft drugs hasn’t changed since Nancy Regan. AHS hasn’t changed either in a decade, except for the building PICO built.

the difference between 10 years ago and today is that there is less of a treed area down the hill for stoners to hang out at. the new trail changed that area, but I am told that they still hang there, and teachers still bust them there. here’s some info that has feather brow in the mix from 2 years ago. using arcata for your deflecting seems fruitless. the majority of the problems are from non-arcatians, its a fact.
