22-Year-Old Fortuna Resident Arrested With 112 Marijuana Pounds, Alleges Missouri State Trooper

Missouri State Troopers arrested a 22-year-old Fortuna woman, Rosa Velasco Maldonado, and her companion, Daniel Dominguez Silva, on October 22 for allegedly transporting 112 pounds of marijuana.

According to a statement of probable cause from Sgt. L. Allen, he stopped the gray Toyota Tacoma with a camper shell driven by Maldonado when he “observed the driver and passenger sitting in a rigid posture.”

He said when he spoke through the open window to them, he believed he “could smell the odor of raw marijuana and dryer sheets.” Eventually, after backup arrived, a search of the truck allegedly revealed “four large duffle bags containing 112 individually wrapped bundles of marijuana weighing approximately one pound each.”

Both were arrested and charged with transportation of marijuana. Dominguez Silva was also charged with being an undocumented foreign national.

You should check further before making so many assumptions just because they are congenial. On the arrest specified above- “pulled the vehicle over after he observed it followed one car length behind another vehicle. After pulling over the Tacoma, the trooper reported he smelled raw marijuana and dryer sheets upon approaching the vehicle’s passenger side. Maldonado admitted smoking marijuana the previous night and possessing a small portion in the Tacoma’s center console.” ICE “was to issue a detainer for him the next day, according to the probable cause statement” due to “illegal re-entry into the United States. ”

On the one with the tonneau cover- Chad Davis, of Anna Illinois, reported he bought the truck with the tonneau cover while on a visit in California and didn’t know that there was 80 lbs of pot in the back.

Apparently typical California driving always offers the police cause for a stop.

Tailgating was the reason for pulling them over. They could have been in rigor mortis if they had not offered poor driving as an excuse. But basically I agree it was likely that police looked for an excuse after thinking they were behaving suspiciously. Meh.

Seems like the story will read more to humboldt county liking if pertinent facts are left out…and if you pay attention, California drivers are great at following too closely, pay attention to the vehicles around you on your next road trip and you will notice California plated vehicles are usually the rude drivers. If you are going to “drive dirty”, then drive defensively.

I was detained at ACV and searched because a dog hit on my bag in Minneapolis. Nothing in my luggage, they spent 30 minutes digging through my dirty underwear.

During the search, once they realized I was not the droid they were looking for, the agent in charge told me about Lt. Steve Knight’s dog. They nicknamed him “French Fry” because “all that dog could find was your lunch. “.

So Missouri has gotten to the point of not even bothering to use an actual infraction for their lie that will hold up in court and cover up the profiling for traffic stops they are so famous for to now making up laws that I really hope do not actually exist. Even in the state of Missouri driving while “sitting in a rigid posture” should be an easy toss out for these two as long as they hire a reputable attorney.

Even though this report says nothing about the driver being under the influence of THC and nothing in my comment shows even a hint of my views on driving under the influence of THC I will answer your question. I would gladly share the interstate with drivers who smoked some pot over drivers who are under the influence of alcohol.

They won’t get tossed. Judges no longer care about constitutional rights. They are on the same side as the lying cops. Most folks don’t get caught but the ones that do are fucked and sso are their homies.

People get pulled over for “looking away from the LEO” or “looking at the LEO” as both raise reasonable suspicion that a crime is being committed.

It’s absolutely clear that Cannabis is in wide general use throughout the United States! Whether or not cannabis is legal does not seem to make much of a difference regarding popularity and consumption. It’s perfectly clear that cannabis is much safer than booze. The only open question is who will profit from the sales of cannabis, organized crime and criminals, or legitimate business with regulation and Taxation?

The FBI estimates:

* 100 BILLION dollars in black market recreational cannabis sales every year here in the United States and all that money goes to criminals and organized crime.

* 30 BILLION is lost in potential tax revenue.

* 15 BILLION is wasted on the capture and persecution simple cannabis consumers.

Legalization solves all these problems and kicks organized crime out of the cannabis sales in favor of legitimate business.

Just think how better the dropping of American IQ would be if pot didn’t impinge on thinking. Maybe Martha Stewart wouldn’t have lied to the Federal agents and ended up in prison or Bill Clinton would have kept his hands to himself or Hugh Hefner not required someone to buy his home with the proviso that he be allowed to keep living there, etc.

Carl Sagan was one very, very physically sick man relying on pot to soothe himself. Not exactly definitive.

On the other hand, for personal experience a pot using neighbor once burned his house down while high, another pot smoking neighbor was persuaded to drive down the road with his 8 year old son clinging to the roof of his SUV because the kid thought it sounded like fun, another burned his brush pile under some trees “because the ground was clear in the shade,” another simply sat all day every day, and two died of COPD. And as I said previously- just google “stupid things done while high.”

Tailgating or following too closely or failure to signal properly are all bullshit reasons to stop vehicles that the cops already know have dope in them. The locals and feds are tracking cell communications. Drop phones offer no protection. They simply connect the dots from one dope dealer to another. No need to profile anymore. They follow the vehicle’s progression past toll booth cameras. Once popped they use ‘parallel reconstruction’ to make the arrest appear that it was for cause. Anyone who has been in contact with this crew will be or has been under surveillance. These mules will be looking at 10+ years in a MO prison which we certainly get them talking.

YOu need to do better research on your facts. smoking cannabis cause the same lung damage as smoking tobacco – it impairs your bronchioles filling them with gunk. CDC has no such published article if so please post here. Cannabis impairs brain development in kids below the age of 21 and can lead to higher incidence of schizophrenia google that one.

Cannabis is not harmless and is highly addictive just like tobacco. Put that in your proverbial pipe and smoke it.

It is common for out of staters to get tickets. I have been driving for 54 years with a CA license and the only two tickets I received were from out of state, both in Oregon. The hurtful part was a car with an Oregon license plate passed me and I got the ticket for speeding. I questioned the officer about that decision and he did not bend. He knew I would not come back to Oregon to fight the citation.

I have friends in Missouri. While visiting a couple of years ago, the Anti Marijuana folks were campaigning. Cannabis prohibition criminalizes people for selecting a product that is safer. Cannabis prohibition is a ridiculous waste of police, court resources and taxpayer funds!! The madness is over! Legalize!!!

The FBI estimates up to:

100 BILLION a year is spent on “black market” recreational cannabis in the USA and all that money goes to “criminals” and drug cartels instead of legitimate business with regulation and taxation.

30 BILLION is lost annually in potential tax revenue.

15 BILLION a year is spent enforcing draconian cannabis laws that make no sense and destroy people’s lives daily.

Data from the Center for Disease Control proves beyond doubt that cannabis is much safer to consume than booze or tobacco!!

The madness is over!!! Legalize, regulate and TAX recreational cannabis!

All somewhat true, if disingenuous, but the same can be said for murder, pedophilia, extortion, gambling, etc. A society judges what harms it and how much effort will be spent it holding which particular evils at bay. And when the cost is too great or too ineffective.

I see a world of routine pot use as a dangerous thing. It creates people impaired in their work and personal lives. And worse, unlike most who recognize alcohol as impairing, even if they indulge, pot users seem to be unaware of their impairment. Pot takes so long to leave the system that even a person who uses it a few times a week is never unimpaired. It take months to regain clear thinking or at least as clear thinking as nature gave them. And if it is suggested otherwise, they get angry. They do rely on being soothed when they do screw up so that it’s a vicious cycle of screw up, sooth and screw up again. It becomes an avalanche of small messes triggering a general catastrophe. Society will be an increased tangle of more defective manufacturing, medical practice, bad repairs, driving failures, poor schooling, etc. A nation of 3rd raters in competition with first raters. Never instantly fatally so but so gradually becoming less they never notice.

However, once there is a critical mass of users, the rest of the population can’t effectively prohibit it. It best turn its attention into surviving it. So pot should be legal and the ramifications dealt with. At least the music will be more plentiful.

Driving pounds across the country in a Toyota Tacoma with CA plates and a Tonneu cover is really stupid. I’m surprised they made it all the way to Missouri.

They did not have a tonneau cover. The non related arrest of a man with Dodge Dakota had a tonneau cover. If that makes any difference.

I can’t remember the details but someone recently got their charges dropped bc the search was based on rigid posture and not looking at the pig when they passed. The search was deemed unreasonable. I think they found 500 in the vehicle it was in one of the Dakotas.
