A chat with Eureka lawyer Fred Fletcher, who’s repping Humboldt local Emma Nation in a case that may’ve partially prompted stories like this one from Fox Business: “White House to unveil federal cannabis reform ‘very soon,’ says GOP lawmaker.”
Nation believes when the FDA approved a cannabis-derived medication the feds acknowledged marijuana has medical value and her eviction related to the plant was unlawful.
The feds are scheduled to answer the lawsuit on December 19.

The minute a cannabis based drug was FDA approved, rescheduling at least will be automatic. But it is likely that recreational pot will be Federally approved in some form next term if Trump wins reelection. He has never been against it. But he will use it as a bargaining chip to get something else he does want. That is his way. The left just refuses to recognise that a person can be conservative on some issues and not fit into their stereotype belief system in others. It would make their outraged, unthinking hate harder if they did that.

Marinol was approved in the 90″s. Nothing happened.
Marinsol was a synthetic derivative and is a shedule 3 . Epidiolex is pot, not synthetic, with THC removed. It is a schedule 5. At least I think that’s what makes it different.
Sorry, I left off abuse potential which is low in the case of Epidiolex and higher in the case of Marinsol.

I think it’s easy to guarantee that this eviction absolutely had nothing to do with what Trump babbled about. Gimmie a break.
I don’t want to speak for Fred, but as I understand it from our conversation he wasn’t saying this case alone caused anything. Here’s his quote from the interview after talking about recent federal cases regarding cannabis and employment law: “U.S. Attorneys have to brief the Department of Justice, Jeff Sessions, Trump… this might have been one of several things that tipped it over the edge including legalization in Canada and legalization in California…”
Might be tough if this goes to the Supreme Court, not exactly the most progressive bunch.
Who knows, Kavanaugh has sided with the FDA before…
“Kavanaugh is a strict constitutionalist, but he is also likely to support the FDA. The FDA recently approved Epidiolex after years of stating that marijuana had no medicinal value. Epidiolex is the first and only cannabis-based drug to be de-classified as a Schedule I substance and reclassified in Schedule V. CBD otherwise remains in Schedule I. If the FDA changed their tune, will Kavanaugh follow suit? These variables should factor in while predicting which way Kavanaugh will rule on cases that involve cannabis.”
