Sheriff’s Office Releases Information on the Man Shot After Barricading Himself in McKinleyville Apartments

201604167This is a press release from the Humboldt County Sheriff’s Office. The information has not been proven in a court of law and any individuals described should be presumed innocent until proven guilty:

On Wednesday, August 17, 2016 at about 9:00 a.m. Humboldt County Deputy Sheriffs responded to the Redwood Creek Apartment Complex on Sutter Rd in McKinleyville for reports of shots fired. It was reported to law enforcement that 59 year old David Alan Fulton had fired shots into the area of the apartment manager’s office. Shortly after Deputies arrived on scene and set a perimeter around the complex, Fulton fired shots at Deputies with a long gun. Deputies returned fire and Fulton retreated into his apartment.

CHP, APD, EPD, Cal Fire, State Parks, and Fish and Game responded to the scene and assisted Sheriffs Deputies. The Sheriff’s Office SWAT team was deployed and the Mendocino County SWAT team also responded with their BearCat rescue vehicle to assist. Residents in the area were advised via mass notification system, to shelter in place.

It was later confirmed that a female was with Fulton in his apartment. She has been identified as his long-time girlfriend. She voluntarily stayed with Fulton claiming she had a calming effect on him. Deputies requested the female leave the apartment but she refused and chose to stay with Fulton. Sheriff’s Office Crisis Negotiation Team responded and attempted to negotiate with Fulton throughout the night. Fulton refused to cooperate with negotiators.

Deputies continued to attempt phone contact with Fulton without success. At about 1:10 a.m. the female in Fulton’s apartment shouted to law enforcement that she and Fulton were not coming out. Phone contact continued to be unsuccessful. At about 1:20 a.m. the female voluntarily exited the residence, shortly thereafter Fulton fired more shots at law enforcement from inside the apartment, at which point Deputies briefly returned fire. Deputies prepared to use chemical agents and soon noticed black smoke coming from Fulton’s apartment. Moments later Deputies saw flames inside the apartment. Fulton exited the apartment and fired several shots at Deputies, at which point Deputies again returned fire.

At 2:05 a.m. Deputies moved in and located Fulton. Fulton was not moving and was pronounced deceased by on scene medical personnel. Fire personnel responded to the back of the apartment and suppressed the fire. No members of law enforcement or uninvolved citizens were injured during this incident.

Did audio exist with video prior to and leading up through the flash bang grenade launch?

Curious to hear gun shots at 1:00 am and 1:05 am, along with video and location of swat/snipers.

There was also an interview statement that cops shot the guy again after he was already down….the excuse was he did not follow orders and showed his hands and kept moving.

First, when shot, it is painful. People move when in pain. Bogus not to neutralize only.

Did body cams or private video catch it all or just bits and pieces?

Sounds like a classic suicide by cop scenario. It’s a shame the girlfriend couldn’t talk him down to the point of surrendering. At least no cops or anyone else was hurt or killed though. Wonder if he was getting evicted or something, and is why he shot into managers office initially.

Actually the manager had been harassing him for months and had just had his car towed illegally the manager was against him because he was mentally ill and bullied him to the point of him breaking

As a former medical professional who needed mental health help i can tell you there is no adequate mental health services available. The system is nonfunctional and not working.

I agree with everyone who’s citing the lack of mental health available to those who need it most. However if you have loads of cash on hand there’s plenty up here saying they’re here to help lol.

No, there is not enough mental health assistance in this county for all the men, women & children of all ages that need it. Such a problem with loneliness – yet no one goes out of his or her way to say a kind word – & PTSD is epidemic. Just look around & you’ll see evidence in all parts of our county; I don’t have the answer but it can’t hurt to try being more compassionate, show some empathy for those struggling – it won’t kill you. It could BE you.
Mr. Fulton is dead; y’all think it coulda/ shoulda had a different outcome. If he had lived, y’all would want him dead for all the drama he caused. Another sad ending.

Interesting the youtube video was taken down. It must have recorded a different series of events. Was there something the video showed that the powers that be didn’t want shown to the general public? First hand accounts of reporters who were there and in the vicinity watching seem to tell a different story about thay fateful night… what about the percussion granades?? Why are they being used in a crisis intervention, could they be responsible for the smoke and fire and the further agitation of this mentally disturbed individual? Were the deputies getting tired, it was 2:00 am, and they just wanted to “end it” as witnesses have stated?

I know Witnesses at the apartment who said the police threw grenades into the window and it was on the YouTube video which they have gotten rid of

The above comments regarding the lack of mental health assistance are very valid. It would be tax payer money well spent. Cheaper than cops, who are already fully engaged fighting career criminals.

Good to hear some empathy occasionally.
