Redway Man Arrested After Fleeing Law Enforcement in Stolen Vehicle, Says HCSO

This is a press release from the Humboldt County Sheriff’s Office. The information has not been proven in a court of law and any individuals described should be presumed innocent until proven guilty:

201600244 Miller, BOn Friday, January 15, 2016 at approximately 11:50 p.m. a Humboldt County Deputy Sheriff observed a vehicle matching the description of a stolen vehicle travelling on Myrtle Ave, Eureka. The white Jeep Wrangler was involved in a vehicle pursuit earlier that evening with the Arcata Police Department.

The vehicle had prior damage from the earlier pursuit and only had three working wheels. The deputy attempted a traffic stop, however the vehicle accelerated in an attempt to evade the deputy.

The pursuit continued and the suspect vehicle ran over street signs on Myrtle Ave at 7th St. The suspect vehicle eventually collided with a parked vehicle at O Street and 7th Street.

The driver, 45 year old Brian Miller, of Redway, fled on foot. The deputy pursued on foot commanding the suspect to stop or he would be Tased. Miller continued to run and ignored the deputy’s verbal warnings to stop. The Taser was deployed but was not effective. Miller continued to flee but soon tripped and fell to the ground.

The deputy apprehended Miller, who sustained minor injuries from the fall.

Miller was taken to a local hospital and treated for his minor injuries. Miller was transported to the Humboldt County Correctional Facility where he was booked for vehicle theft, evading a peace officer in an unsafe manner, hit and run, resisting arrest, and buying or receiving stolen property. His bail has been set at $50,000.

Anyone with information for the Sheriff’s Office regarding this case or related criminal activity is encouraged to call the Sheriff’s Office at 707-445-7251 or the Sheriff’s Office Crime Tip line at 707-268-2539.

“evading a peace officer in an unsafe manner”

So just evading is ok as long as we do it in a safe manner. Got it.
