Sheriff’s Office Tries to Question ‘Involved Parties,’ Attorneys Advise Them Not to Talk

This is a press release from the Humboldt County Sheriff’s Office. The information has not been proven in a court of law and any individuals described should be presumed innocent until proven guilty:

CaptureOn Thursday, November 19, 2015 at approximately 4:05 p.m. the Humboldt County Sheriff’s Office received a call from Humboldt Bay Fire to respond to a suspicious residential fire on the 1200 block of Freshwater Rd, Eureka. Deputies responded and spoke with Humboldt Bay Fire’s Battalion Chief who stated he believed the fire was caused by a hash lab explosion from inside the residence.

The Deputy spoke with one of the persons who was in the residence when the fire started but was interrupted by their attorney. The attorney advised the involved person not to speak with the Deputy in regards to this incident. The Deputy was informed of two additional subjects who were in the residence during the fire and they were now at a local hospital. The Deputy responded to the hospital and began questioning the involved party when their attorney appeared and advised them not to speak with the Deputy in regards to this incident as well.

Due to the lack of cooperation with this incident this case has been forwarded to the Sheriff’s Office Criminal Investigation Division for further investigation.

Thanks to the 911 Setup and the Patriot Act, we have given away the protections previously guaranteed us in the 4th Amendment to our Constitution.
That is why anyone now invoking their right to be secure from unwarranted searches and seizures (like these folks) is AUTOMATICALLY presumed guilty of whatever crimes the cops perceive.
Habeas Corpus (where’s the body?) is also defunct. The result is that now we assume guilt, not innocence, until proven otherwise. We even assume a crime HAS been committed, whatever it is/was….
And looking suspicious to each other is the predetermined outcome; it divides us, and the government conquers us.
We have failed to heed Ben Franklin’s warning: “Those who would sacrifice Liberty for Safety deserve neither.” af

Yeah true yet not so much the case here.
There were no warrants needed as they set their house on fire & received public service assistance. The cops werent busting them when they blew themselves up, tho if they had been looking to bust this house it woulda saved a lot of money in public service dollars, 18 firemen plus cops adds up quick.

This kind of talk about situations that are not serious civil violations can take away from ones that are. Like anyone lying about an assault, it takes away from serious assaults. Our liberties are violated all the time. Lets save that rhetoric for the serious stuff, it sounds silly to say rights were violated by cops finding a lab thru it blowing up.

Its pretty easy to tell if a hash lab causes a fire. Most folks dont have large amounts of butane canisters just sitting around the house, nor the equipment needed to make this kind of hash.
The evidence must be strong for them to get a lawyer so quickly, so I imagine they are most likely “trustafarians” & had a lawyer retained already. Rich kids usually have that.

A bomb on domestic soil and concentrating a schedule 1 narcotic, turn it over to the feds. If this were to happen, they could make examples out of somebody and then people might think twice.

AFAIK this is standard practice – if you’re smart you will do the same – insist on lawyers from the get-go, and if they advise you to shut up you do so…..That’s how the system works they tell me…..

The problem with talking to the police is that often they don’t seem to really get what you are saying, so it shows up in the reports with implications (or statements) that you did not actually make. You are always better off having an attorney if you are being questioned by the police – even witnesses often get attorneys. I routinely recommend to clients that they tell questioning police “my attorney told me not to talk about the matter without him being there.” The police usually honor this statement, but, a word of caution: if you are not going to talk to the police, don’t talk to the police about anything. One thing leads to another and before you know it what started off as a conversation about the weather turns out to be about something else.

And that’s exactly why it’d be idiotic for them or anybody in their situation to speak to the police. As if law enforcement doesn’t stack as many charges as possible regardless. You take it a step further by suggesting a very draconian, very cruel and unusual punishment. You know there was no bomb. You know they aren’t “terrorists”. You know marijuana and its derivatives should not be schedule 1 narcotics. And also contemplate the hate you and other readers impose upon people who may well be friendly associates in your daily life. What they did (or didn’t) do may be very stupid, but not deserving of anything you suggest.

Completely decriminalize marijuana and these problems will go away overnight. Attacking the symptoms has never done anything. Our prisons have been full of “examples” for way too long already.

You put terrorists in quotes, I never said that. Yes, it is a bomb, not intentional, but thats exactly what it becomes when you concentrate a volatile gas in an enclosed space. While some can pull off this type of activity without any problems, it’s obvious others can not. “cruel and unusually punishment”? Is that not what is inflicted on the poor children and innocent bystanders when they get 3rd degree burns or people loosing their home and belongings so someone else can make a profit? A child in a burn unit isn’t very irie. Whats wrong with ice hash? My comments do make it seem i’m disconnected from these “friendly associates in your daily life”, but quite the contrary. I might know people doing this exact type of activity. They however, might be on property they own, in the middle of acreage with no minors involved, doing it in a very safe manner. Thats a bit different than the stories that have hit the news. Again some people can pull this activity off. As for cannabis being a schedule 1 narcotic, complete bullshit! I’ve been consuming cannabis in may different forms for over 30 years. In my opinion, it’s one of the best plants on earth. It should be legal and affordable. I’m sorry, but there is a big disconnect with this whole dab movement and the plant. When something as harmless as cannabis puts a baby in a burn unit and you blow up your neighbors, yes, call in the feds and make an example. Stop the carnage. Leave the concentrating to people that actually know what they are doing. People should look down on BHO and start supporting kief, water hash or rosin. Make the BHO folks feel uncomfortable like they are tweekers producing meth. Your heart seems to be in the right place, but is BHO in an unsafe setting really worth rallying for? “Completely decriminalize marijuana and these problems will go away overnight”, really, will it?
