[UPDATE 5 p.m.] Unidentified Passenger Dead After ATV Accident; Driver Invokes Rights Refuses to Answer Questions; Can You Help?

A man is dead and unidentified following an early morning accident in the Alderpoint area today. The driver of the UTV reportedly involved in the crash did not provide all the information needed by the California CHP.

“We had limited contact,” the CHP spokesperson said. “He invoked his rights and did not provide any additional information. We still need the passenger’s name, the scene of the collision, and the vehicle.”

The CHP is hoping that members of the public can help. They have provided the following press release:

chpstarOn September 15, 2015, at approximately 0330 hours, a side-by-side UTV, driven by a 30 year old male of Garberville, CA was traveling on private property off of Alderpoint Road, near Blocksburg.  For reasons still under investigation, the UTV was involved in a roll-over collision.  The front right passenger, known only as “Smokey” (white, male, approximate age 25 to 40, numerous unique tatoos) was transported by the driver of the UTV from the collision scene to Jerold Phelps Community Hospital.  The male passenger was pronounced deceased shortly after his arrival at the hospital.

This collision remains under investigation by the Garberville CHP Office and the Humboldt County Coroner’s Office.  Alcohol impairment does appear to be a factor in the collision.

The public is urged to contact the Garberville CHP Office with any additional information regarding the collision (707) 923-2155.

UPDATE 5 p.m.: Update from the CHP:

UPDATE: The Humboldt County Coroner’s Office has identified the passenger of the UTV.  The name of the passenger is currently being withheld pending notification to next of kin.

If u release the name of the driver it might help someone connect the dots.

Blocksburg is some distance from Alderpoint. At least 10 miles I’d say (and so would Mapquest). The accident, if it occured at Blocksburg, was not “in the Alderpoint area” any more than the Redway house fire so wonderfully captured by kim Salaway was in the Briceland area. It’s not a vital point, but poor Alderpoint has enough troubles without taking on those of Blocksburg too. I can see what led to the problem: the Alderpoint road is 30-40 miles long. It runs from Garberville to Bridgeville – and is a wonderfully scenic road if one has time to traverse it. Alderpoint is the most important town on the road, (it seems to us residents, rather than its terminus.

I don’t get how they are trying to issue a DUI unless this was publicly accessible private land.
Quote from California law pertaining to this issue:

“law enforcement can issue citations for DUI on lands other than highways that are open and accessible to the public except private lands under the immediate control of the owner or his or her agent where permission is required and has been granted to operate a motor vehicle.”

While this is a truly sad story one has to wonder why they think they should pursue justice against this man who while clearly intoxicated and who should obviously not have been operating machinery also has to live with what he did for the rest of his life. One has to assume that both individuals in whatever limited capacity available to them were of mutual consent as they both entered the vehicle with intent to travel. Bad decisions are made and people suffer the consequences, unless the poor guy was taken in the vehicle and restrained and forced to ride with the driver they really need to throw this one out of the courtroom, he is going to suffer in many ways on his own as it sounds as though they were friends going for a ride.

Rest in peace smokey aka anemal

He was a famous artist from Hawaii who lived in the Bay Area. He was a huge personality, known for high risk stunts and party animal extraordinaire. He survived being shot by a stray bullet in Oakland one night. He’s climbed the sides of buildings, hung off moving railway cars, and will forever be remembered by many in the Bay Area.

It’s bizarre they didn’t identify who he is. But it seems like the deceased in this apparent DWI DUII ATV crash is a man named Nicolas Barclay, a graffiti tagger who go under the tagging name ANEMAL and SMOKY from Hawaii living in the Bay area. Google it.
