Industry Braces for More Raids

The medical marijuana world shivered as Federal agencies stepped up their enforcement of federal law which contravenes state law. Yesterday’s raid at the home of Matt Cohen, a pioneer advocate for the Mendocino 9.31 Compliance program (aka the zip-tie program), rattled already worried activists.  The raid which had at least 6 DEA agents, as well as one state official (BNE) and one Mendocino sheriff’s deputy occurred early yesterday morning.  The officers had a federal search warrant signed by a federal judge.  KZYX out of Mendocino interviewed Mendocino Sheriff Tom Allman who was instrumental in developing the 9.31 program. (Listen on KMUD archives of Thursday night news) Allman confirmed the raid saying he had spoken briefly to Cohen on the phone.  He said that as far as he knew Cohen was following all state and local laws.  He added that Cohen was not arrested though his plants were removed and he had several pieces of personal property confiscated.

Allman, who like many good people here in the Emerald Triangle finds themselves pinched between a rock and a hard place, pointed out that while cannabis is federally illegal, voters in California and in Mendocino have unequivocally affirmed their support for medical marijuana. Nonetheless, 9.31 only provides growers with protection from state and county enforcement.  Federal law enforcement can choose to enforce federal law on even the most compliant and clean grower.

The fed push back against medical marijuana began with a tax case against Harborside dispensary in Oakland.  They claim that the large nonprofit must not only pay taxes but cannot deduct business expenses like any other organization. Then the four US Attorneys in California held a conference stating their plan to go after dispensaries that were close to schools etc.  One of the US Attorneys, Laura Duffy, announced that she planned to go after media outlets that were selling advertising to dispensaries.

Industry insiders who just last week comfortably gave their name and occupation are pulling back. A story that I was doing photography for had the driver, who was transporting California legal medical marijuana, normally very outspoken and willing to be interviewed, unexpectedly requesting anonymity because his wife was fearful of federal attention. When I contacted formerly public medical marijuana activists and growers for comment about the Cohen story, all declined to be quoted.  However, one industry insider speculated that Cohen’s raid may be part of a plan by federal officials to mark their territory.  If Cohen, who is known as an upstanding businessman and completely compliant with local laws can be taken down, then officials will have effectively terrorized everyone in the medical marijuana community–whereas raiding someone who was more relaxed about legality, could actually encourage folks to become more compliant with local and state law in an effort to avoid prosecution. Furthermore, one source said going after Cohen was “a direct assault on the Mendo program.”  It is an assault on a program in which law enforcement is working with the will of the people to manage the harmful effect of crime and provide the best possible protection for the people in their jurisdiction.

Mendocino Co. Supervisor Dan Hamburg said on the Mendocino Discussion list,

One of my ongoing concerns about 9.31 (and while I opposed its passage in 2010 I voted in favor of some revisions to the ordinance in 2011) is that it paints a nice bright target on our collective backs here in Mendocino County. Some would argue that Measure G did the same (with its 25 plants/person language). One difference is that G was simply a “sense of the voters” measure  whereas 9.31 is a county ordinance.

In light of the raid of Northstone Organics (our “poster child” for above board medmar operations) and the recent federal court decision that caused the city of Long Beach to rescind their medical marijuana ordinance, we may need to re-think our direction here. A complicating factor is that 9.31 has become something of a “cash cow” for the MCSO, bringing in around half a million dollars in the last fiscal year.

The Federal officials actions seem to be having the desired effect.

The goal is to curry votes inland and down south. This is all presidential politics. The White House knows that the MJ community will vote for them, but this get tough approach may get some of the needed swing voters looking their way.

Like I wrote in the previous thread on this topic, the Feds are terrified that the voting public might notice how few actual problems there are when local communities adopt and successfully implement reasonable regulations on growing and distributing cannabis.

They can’t allow the existance of responsible, “good neighbor” growers and distruibutors who have few (if any) negative impacts on the community, because that kind of success leads to people realizing that 99.9% of the problems “caused” by cannabis are actually caused by Prohibition, not by the herb itself.

Nope, the Feds need greedy, messy, irresponsible “bad neighbor” growers and dsitributors, because those are the sort of bad actors that help justify the continuation of the War on Pot gravy train.

Perhaps they realize that, given their previous statements that they wouldn’t be targeting people who were following state and local medical cannabis rules, they might have a VERY hard time getting a jury to convict someone who appears to have, in fact, been diligently following all state and local laws. Seizing or destroying the crop, on the other hand, doesn’t require the involvement of a jury.

But if anyone thinks that the occassional eradication of a crop or closure of a dispensary is going to dissuade people from growing, distributing, buying or using cannabis, then that person hasn’t been attention for the past few decades. If there is anything the last 40 years of Federal cannabis prohibition enforcement efforts should have taught the Feds, it is that even with large-scale eradication, PLUS arrests, prosecutions, and incarcerations, PLUS property seizures, even with ALL of that, they have never been able to put a real dent in the amount of cannabis grown in California.

So as far as making any real impact on cannabis production and cannabis use, they’re wasting their time, and they know it. However, since it’s the taxpayer’s money that they’re being paid to waste their time, they can afford to waste it on these essentially symbolic efforts.

They are stronger than any one individual, but not the group as a whole, so they must pick out a few individuals to beat up from time to time, reinforcing the fear that they command, intimidating the rest of the group into allowing them to maintain their Bully status.

The answer, or course, is that the group as a whole must refuse to be intimidated, and must stand up for and defend those who are targeted by the Bully, and when necessary, fight back.

Anyone thinking this will drive up the price is dreaming… 2800+ dispensaries in CA and these busts are intended to intimidate.
Dan Hamburg is a smart guy and caring for his county in an appropriate way. From a Federal perspective, the Mendocino County Sheriff si corrupting the office by receiving money from an illegal (Federally illegal) source. The threat to the County is very serious and Hamburg is to be commended for his desire to get the threat reduced.
9.31 is probably history…

The real reason that the feds have reared up again is to protect corporate interests. No one disputes that pot is the biggest money maker around and the drug companies want to control it. Obama is a pro corporate puppet and he is doing what he needs to do to keep the corporations happy. Simple, flat out legalization, won’t make any money for anyone. Regulation is a method of taking a government cut. Tom Allman is a good sheriff and a conscientious public servant, but the zip tie program is a protection racket. The proceeds go the the sheriff’s dept rather that the mafia, but it is still a protection racket.

You’ve got to compliment the feds on their machiavellian strategizing, hitting Matt Cohen and the zip-tie program like that. (Just like they made examples of WAMM, Marc Emery, Tommy Chong, Dale Shafer and Mollie Fry, in their own ways.)

Domino and tra both have good insight here. One may of course wonder just how much control Obama has got over the DEA at this point, as well.

The sincerity of many drug warriors should not be doubted, either. People like So Cal’s Paul Chabot (who just released a book linking drugs and terrorism and the devil called “The Eternal Battle against Evil” or something), not to mention many concerned citizens over here in Shasta County, seem really to believe that cannabis holds within it the very essence of evil, and that those who consume it are themselves consumed with this moral corruption. I am not kidding.

To my mind, that’s part of the reason for the intent, and efficacy, of this “Back-in-the-closet-you-stoners” effort, which I think is rightly labeled a terror campaign.

The state’s largest doctor group is calling for legalization of marijuana, even as it pronounces cannabis to be of questionable medical value.

Trustees of the California Medical Assn., which represents more than 35,000 physicians statewide, adopted the position at their annual meeting in Anaheim late Friday. It is the first major medical association in the nation to urge legalization of the drug…”

Marijuana has been reported to reduce nausea, arthritis pain, and symptoms for glaucoma. It reportedly works for many as a sleep aid, an antidote to depression and/or anxiety, an appetite stimulant and more.
Of course Big Pharma is doing all it can to eliminate this competition!!

Im not against marijuana but alot of legal drugs do these same things…..so I dont see that as an effective argument for why marijuana should be legal for medical uses.
There is a lot of hashing out the details and making sure that regulations are written and everyone is on the same page before medical marijuana should be allowed legally.

My point is that the pharmaceutical firms want to maintain their corner on the market. Read their cautions and side effects disclosures and you can see that if marijuana were a readily available alternative, lots of folks would switch because marijuana is safer, not to mention that even at prices inflated by its illegality, it’s a lot cheaper than lots of the synthetic alternatives.

Read their cautions and side effects disclosures and you can see that if marijuana were a readily available alternative, lots of folks would switch because marijuana is safer, not to mention that even at prices inflated by its illegality, it’s a lot cheaper than lots of the synthetic alternatives.

WHY is there nothing about the Thursday before raid on Bell Springs Road at 5:20 in the aftn. (HUMBOLDT INC. end)? KMUD broadcast it as it was happening.
The next time you have an opportunity to chat w/an Officer ask her/him…Are you a Peace Officer, a Law Enforcer (oxymoron), a Code Enforcer (Tom Allman said this in print in a Willits (news)paper last year when Joy Greenfield’s crop was destroyed w/o arrest, hint: Allman owns part of a dispensary and she was selling to a dispensary in San Diego), a Corporate Profit Protector, a Revenue Troll, a Mentally Incompetent Fact Witness, or a Public Nuisance? And/or: Do you have the ability to make a legal determination? What is the difference between an offense, a code violation, and a crime? Answer: the difference is crimes are arrestable. Which is why Matt Cohen wasn’t arrested. THEY are ONLY there to perform armed-robbery–$$, destroy his livelihood, possible injury, remove guns–dis-arm the population. The ONLY reason a PERSON in uniform can pull you roadside when traveling is IFF THEY witness a crime, and THEY best have a second witness on hand. Uniform reports are hearsay. That’s what an alleged judge told me as I was 2/3 of the way thru my trial (w/o a liar/lawyer).
When confronted ask: for THEIR Oath (THEY can’t remember), Bond # and the name of the Surety that issued the Bond. IFF THEY can’t recite THEIR Oath – to protect We the People and uphold the Constitutions (National & state) then THEY best be on THEIR way. IFF THEY don’t know why THEY are there, then what purpose are THEY serving?

Wow Kym! You have the greatest photos. A word or three about Canibis…it will NEVER be ‘legalized.’ Why? Because the mind can’t be controlled. Plus, ‘legal’ means words on paper, i.e. the Administration’s TAX CODES. The word ‘law’ implies morality-not tangible. Law is a shared perception. THEY think/talk in words. We think/talk about ideas. ‘Duty’ is a moral or legal obligation. Regarding today’s raid in Hydesville…follow the pattern. Thursdays -Bell Springs Rd.(Humboldt), Ukiah/Matt Cohen (Mendocino), Hydesville (Humboldt). Wow Kym! You have the greatest photos. A word or three about Canibis…it will NEVER be ‘legalized.’ Why? Because the mind can’t be controlled. Plus, ‘legal’ means words on paper, i.e. the Administration’s TAX CODES. The word ‘law’ implies morality-not tangible. Law is a shared perception. THEY think/talk in words. We think/talk about ideas. ‘Duty’ is a moral or legal obligation. Regarding today’s raid in Hydesville…follow the pattern. It’s not what THEY do, it’s what WE do. And, what some of us (myself) have done, is THE ONLY thing that does work. File your docs./Affidavits, under Oath (the main thing Notaries skip over). THEN, go to the Admin. Bldg. (as all Notaries in the county have their signatures on file there) and have a (alleged) Court Clerk, or a Notary there to Certify the first Notary’s signature. Notaries are recognized as Court Magistrates. You’ve just been in the presence of two judges. This is Check & Mate. Record. Make at least two copies to have with you. (I’ve simplified the steps & explanations). Have I gone blue-in-the-face approaching some of the growers w/this knowledge? Oh yeah. Spent 2 hrs. last Thurs. waiting to talk to Tim B—- at A— 101. I do know him. Talked to his G-d dtr., showed her the documents, she was interested, then departed. I find most PERSONS to be lazy, distracted or not interested. I waited, then left. Same response in Redway. Have traveled (not drive) to Garberville three times and talked w/Jim Lampost regarding changing Garberville to ‘Emerald City’ by INCORPORATING!! Geeze Louise, how’s CORPORATIONS workin’ for ya Jim?
Why would anyone of us trust a system that has proven to be so untrustworthy? The plates on my truck read: NO EXP., w/ California in red. And SUI JURIS in dark blue. I have no contracts with CA. INC., i.e. no d/l, REGIS tration or insurance. We don’t have to fight for freedom, just STOP complying and cooperating. I am not a PERSON, CITIZEN, RESIDENT, DRIVER OR PASSENGER (those are THEIR magix slave words). NONE of THEIR rules, regulations, codes, ordinances, resolutions, etc., apply to me. WHY? I’m not a government employee. The same as McDonald’s rules don’t apply to me. BEEcause I’m not employed at McDonalds. The Illumined only want the truth, and they want it from the tree’s root. I have documents, as well as Supreme Court rulings regarding Sheriff Mack, Sheriff Printz, Sheriff DeMeo to name a few, who have issued statements to the FEDS., that if THEY come into their counties, THEY must come to them first, or be arrested. Rulings regarding the right to resist arrest, the right to keep and bear arms, etc. I hand delivered to Sheriff Downey notice of Sheriff Mack’s first National Sheriff & Police Convention, in Texas (long star state, the ONLY Republic state), he scoffed. Two weeks ago I read Psychology 101 to the Supes., in the PEOPLE’S chamber. The week before that, w/Sheriff Allman on my left & Sheriff Downey sitting back to my right I read, straight out of a newspaper, that City/County Ordinances cannot be enforced (Dah!), where Monterey v. Del Monte Dunes, 526 US 687 (1999) the private property owner was awarded $8 million for Code Enforcement’s illegal trespass, and for restriction of his business another $1.45 million. BOTH Sheriffs KNOW about Sheriff Mack. Both Sheriffs KNOW that FEDS. have no jurisdiction in ANY of the states. Anyone who can read the Constitution/Bill of Rights KNOWS. I will gladly share with anyone of us who have eyes to see and ears to hear. No wonder we’re viewed as incompetent/slaves/debtors/victims. 94 average per day (in 4 rooms), going thru THEIR de facto, fraud system, Administrating(the US INC’S pretend debt) rooms, labeled court. The herd sits waiting on the bench in the middle of the third-floor, THEY call a NAME and one of the herd jumps up and leaves the ground and enters the ship where the Pirate dressed in a black robe hooks the victim up to the milking machine to be milked.
