Eureka Police Officer, Daniel Kalis Pled No Contest to Felony Possession of Heroin

Humboldt Co. District Attorney Press Release:

Former Eureka Police Officer Daniel Jason Kalis, 36, of Arcata, pleaded no contest yesterday to felony possession of heroin. He also pled guilty to misdemeanor vandalism and a misdemeanor count of unlawful disclosure of Department of Motor Vehicle records.

The Honorable Judge Christopher Wilson sentenced Kalis to 200 hours of community service and three years probation, pursuant to the California Penal Code. Kalis is also required to go through diversion, which includes participation in a drug education program. He faces up to three years of prison if he fails the terms of probation.

During the proceedings, Kalis also pleaded guilty to an outstanding 2009 Fish and Game violation and received a fine and one year of probation, to be served concurrent with the three year term.

“Mr. Kalis should get no more, nor any less, punishment than any other citizen would get if he or she engaged in similar conduct,” noted district Attorney Paul Gallegos.

In January 2011, the Humboldt County District Attorney’s Office (HCDA) Investigations Bureau began receiving reports of alleged criminal conduct on the part of Kalis, who was then employed as an officer with the Eureka Police Department (EPD).

In March, the Eureka Police Department and the Humboldt County District Attorney’s Office initiated a joint investigation to examine Officer Kalis’ potential criminal conduct while he was a member of the Eureka Police Department and on April 14, 2011, Humboldt County District Attorney’s Office filed criminal charges against Kalis as a result of that investigation.

I was in court once when the traffic judge said and I quote.” cops dont lie and I will never believe you that they are being misleading or could ever lie in court. I will always believe them over you.” I had been planning on fighting my ticket cause I thought the court system was fair. lol how wrong i was. Its nice to see a cop finally going down for their misconduct. They are just people and just as capable of evil as the next person, There are still a bunch of crooked cops out there like the CHP driving up private roads in the southern humboldt area claiming he is PATROLING! If you see him on your private road or off public highway thats against the law and he can be brought up on trespassing and other charges. PRESS THE ISSUE CAUSE THEY DO!

The problem with that statement is that “any other citizen” who is not a cop would not have been able to engage in similar conduct, because they did not have a badge and gun and police authority that they could abuse in order to commit their crimes.

Seems to me that this guy is getting off with a pretty light sentence, considering all the charges against him, which included felony heroin possession, misdemeanor vandalism, unlawful disclosure of Department of Motor Vehicle records, false imprisonment, unlawful communication with a prisoner, petty theft, the unauthorized access of a computer network and possessing marijuana and other controlled substances without a prescription.

The light sentence is especially galling in light of the fact that several of his crimes involved abusing his authority as a cop to harass and terrorize his ex-wife. According to the Times-Standard, the justification the judge gave for this leniency was that Kalis has already “suffered and fallen from grace.”

So if you’re a cop, and you have successfully fooled a lot of people into thinking that you’re a great guy adn a pillar of the community, then when it turns out you’ve been abusing your authority and breaking the law left and right, the fact that you can no longer fool all these people and you no longer have that authority to abuse, that means you’ve “suffered” enough, there’s really no need to punish you much beyond that.

So the message from the DA and the Judge to any rogue cops out there seems to be “carry on — and don’t worry, if you get caught, we’ll keep you safely out of jail.”

Really? After reading the above quote I’m compelled to ask, Is Paul Gallegos mentally capable of making any sort of judgement? That a LEO shouldn’t be held to HIGHER standards than Civilians because of the authority he wields, and the Knowledge he has the he’s been breaking the law he was sworn to uphold.

Is it really so corrupt in Humboldt County that your DA can make such outrageously insane statements and nobody CALLS him on it? That’s RECALL material folks!

Really? After reading the above quote I’m compelled to ask, Is Paul Gallegos mentally capable of making any sort of judgement? That a LEO shouldn’t be held to HIGHER standards than Civilians because of the authority he wields, and the Knowledge he has the he’s been breaking the law he was sworn to uphold.

I find it very odd that nobody wants to talk about this……nothing on The Humboldt Herald ( no surprise there), Sohum Parlance II, Lost Coast Outpost, The Mirror……
