Appears to Be Self-Defense, Says EPD, About This Morning’s Shooting Death

Press release from the Eureka Police Department:

On May 22nd 2020, at approximately 2:40 a.m., officers from the Eureka Police Department were dispatched to the 1300 block of West Avenue on a report of multiple subjects involved in an altercation. During the altercation, an occupant of a nearby residence confronted the subjects from his porch and advised them to leave the area. The subjects then confronted the resident and became hostile toward him and entered onto his property. The resident attempted to use pepper spray to deter the subjects, with no success, as he entered back into his home. At least one subject entered the residence and attempted to assault the resident. During the altercation inside the home, the resident fired multiple shots from a handgun, which he had retrieved from inside the residence, striking the subject who was assaulting him. This subject was pronounced deceased at the scene. A second subject, who was on the porch, was struck in the leg by gunfire. This subject was transported to St. Joseph Hospital for treatment. This injury is believed to be non-life-threatening. Officers were able to locate and detain everyone who was involved at the scene, including the shooter. The individuals involved in this incident were unknown to one another.

EPD Detectives responded to the scene, along with Evidence Technicians, and took over the investigation, which is still ongoing.

At this point in the investigation, Detectives have completed their interviews with everyone who was on scene and involved. After completing the interviews and upon initial review of the evidence at the scene, the shooting appears to have been done in self-defense. The Lead Detectives have conferred with the District Attorney’s Office and based on the investigation no arrest will be made at this time. The completed report will be forwarded to the District Attorney’s Office for review.

Really why would you say something like that you don’t know what you are talking about just a good laugh at the expense of my family member. Kids went to a party like we all do when we are young they were being loud asshole came out and confronted them sprayed them with pepper spray. Why didn’t he just stay in his house and call the cops if he was disturbed. He had that gun ready and wanted to use it.

While the disturbance was outside and he was inside, he could have called it in without the idiots even knowing. The call-in was for an altercation, not gunshots. His confrontation might have been after it was called in (which would also explain why everyone involved was detained before being able to flee after the gunshots). Having the crew identified after the incident, which was a result of the call-in, also provides a deterrent for anyone who might get a notion to take revenge on the shooter.

The realization that most people will do nothing but hide in their homes and call the cops is what gives these punks the balls to act the way they do.

My understanding is that the people who got shot were Native. They knew behavior like that would have gotten them shot on the rez.

They also knew that most white people are too chicken-shit to handle things on their own, preferring to hide in their homes and call the cops, giving them plenty of time to get away.

In this case that wasn’t true. They overstepped their boundaries and they got shot for it.

And one of the commentators is correct it is predicted to get worse. We have considered upgrading our weapon of choice. The one we have now is more geared towards rabid squirrels. I agree. There is only one reason to confront anyone (or 6 individuals) outside your home in the middle of the night. And that reason is: if someone else is being hurt to the extent that it can’t wait for police to get there. Loud noises in front of a neighbor’s home is not a reason to confront.

I’m sorry for the loss of life. There are way too many assumptions in this thread…

I live in the county jurisdiction, so I most certainly wouldn’t hesitate to use deadly force. The EPD response is faster than the Sheriff Office, but I would still act with whatever force is necessary in town. No criminal whose actions cause anyone to fear for their own life deserves anything other than deadly force. If it is my life or that of the criminal, or my family’s lives or that of a criminal I will always choose deadly force. If that means I have to live with having taken a life, I will always choose to be alive to be able to live with it. It’s that simple.

What sickens me and turns my stomach is the catch and release the idiots leading this formerly great state are causing. No jail, just a scolding. There has been more crime on my street in the 2 months of shelter in place than the rest of my 11 years living here combined. At least in this case one is off the streets permanently and the other was or will be for a short time. Until we get a Governor with some backbone, a Sheriff who does more than crave media like maybe responding to calls for service, and a DA that will prosecute, I am ready and willing to protect myself and my family. I will never apologize for wanting tougher crime fighting law enforcement agencies. I can’t believe anyone would tolerate the current lawlessness. These losers got exactly what they had coming. EPD might have responded eventually, but SO never would have without shots fired.

The man went out and started another altercation by macing the who party arguing because he had a gun anf intended to shoot them who ever chased him as soon as be ran his but in the house. Lets all just make it okay to mace a crowd of people when you run and have to go into your house for protection then you premeditated your acts and shooting someone dead that doesnt have a dildo or a weapon is murder and a unlawful demoralizng disrespeck to the whole damn town. Your version of the events is false. He told the boorish louts creating a disturbance after 2AM to leave. That’s when they came onto his property, threatened him, and got pepper sprayed. Had they simply apologized for creating the ruckus and left, the situation would never have escalated to violence. But that’s not what you and your friends do, right?

Before you get all pious about how the dead man was a new father, consider this. Good fathers aren’t out after 2AM creating a disturbance and assaulting someone who objects to the disturbance. If the deceased was that prone to impulsive violence there is a good chance he would have become a child abuser. Or his dysfunctional habits could have made him incapable of providing for the child. Was he married to the mother? If not, why?

BTW, would your attitude to the person getting shot be different if they did have a dildo?

There are many who are missing the part that the call in was for an altercation. The resident could have been the very same person to call in the incident. He may have stepped outside onto his porch to inform the belligerent crowd that he had called the police and that it was time for them to disperse. At that time, the individuals could have very well chose to disperse instead of attacking the resident. They chose the latter, which resulted in deadly and tragic consequences. And though a life was senselessly lost, I don’t blame this on the shooter. He has a right to maintain peace within his neighborhood. Nowhere in the story did I read that the he acted unreasonably, as it’s not unreasonable to ask an unruly crowd to reduce the noise or vacate the area at 2 am on a weekday, when people are typically sleeping. What is unreasonable is to attempt to enter a resident’s home and assault him. The man used mace to defend himself from the subjects when they entered onto his property, which did not deter them. The gun was used only after one of the subjects illegally forced his way into the residence and attempted to cause great bodily injury and harm to the resident.
Though the incident resulted in a tragedy, as any loss of life is devastating, the man did not bring this onto himself. I’m sick of the victim blaming. The guy attempted to keep peace within his neighborhood which is reasonable. There is no evidence to suggest that this man’s actions were premeditated, and it’s absolutely preposterous to draw that conclusion.

These young adults were waiting for a ride after a party by their parked car when they were confronted by a man with mace for being too loud. The man maced them instead of calling the cops and they defended themselves! They were not armed. Why doesn’t the article say that?!? The police are lazy and covering up this murder! Everyone wants to say what they would do if they were followed into their home by someone, well then what would you do if someone maced you and the women you were with, one being your sister? Why they were waiting for a ride by their parked car.

Why they were all waiting outside when it only takes one person to spot a ride. Were they kicked out of the party?

Why they thought it was ok to be loud after 2AM on a week night.

How you know the man did not call the cops before telling those making all the noise after 2AM to be quiet. Somebody did. Either the man called the cops or more than one person was bothered by the noise.

How you know the man brought out “mace” before asking them to be quiet.

Why the group didn’t simply quiet down when asked.

WTF they were doing having a party when there is a shelter in place order. Didn’t they care about spreading coronavirus to vulnerable members of their families?

I live a few doors down form here, If I heard this happening which every so often I do…and it’s keeping me up and my kids up, I would’ve went out and told them to leave and get away from my property.. And just an example this could’ve happened to me with my kids in the house because someone was drinking and decided to Stop in front of my house And the car was parked halfway in the street and run their mouth..
