Man Accused of Using Pitbull to Assault Another Tased in Ukiah: Dog Peppersprayed

This is a press release from the Mendocino County Sheriff’s Office. The information has not been proven in a court of law and any individuals described should be presumed innocent until proven guilty:

On 02-27-2020 at approximately 8:01 A.M. Deputies from the Mendocino County Sheriff’s Office were dispatched to a report of a fight between two subjects, one of which had an aggressive Pitt bull in the 1300 block of North State Street in Ukiah, California.

Deputies responded to the area and contacted a 53 year-old male who stated he was in an argument with a male subject, subsequently identified as Benjamin Kimpton. During the argument, Kimpton commanded his Pitt bull to attack him.

As one of the Deputies was obtaining the 53 year-old male’s statement, a second Deputy contacted Kimpton nearby.

Kimpton was carrying a large Pitt bull dog on his shoulders and would not obey to the Deputy’s verbal commands. Kimpton walked away from the Deputy and refused to follow lawful commands.

Both Deputies followed Kimpton as he continued walking away from them. At one point Kimpton put his Pitt bull down and let it loose. The dog approached the Deputies in an aggressive manner; which caused the Deputies to deploy their pepper spray (oleoresin capsicum) in self defense.

Kimpton continued his attempt to flee the area with the aggressive dog by his side and Deputies were forced to deploy a Taser; which had no effect.

As Kimpton approached a local restaurant open for business, Deputies deployed a second Taser which caused Kimpton to stop and fall to the ground.

The Pitt bull fled the area after the second Taser deployment.

Kimpton was secured in handcuffs and placed in the back of a patrol car. Deputies observed Kimpton displayed objective signs of being under the influence of a controlled substance.

During their investigation, Deputies learned Kimpton attempted to command his Pitt bull to attack the 53 year-old male and had physically assaulted a 48 year-old old male the night prior, causing injury to an area of his head.

The Deputies also learned Kimpton was on active probation in Mendocino County.

As Deputies continued their investigation, they developed probable cause to believe Kimpton committed the crimes of 245(a)(1) PC (Assault With Deadly Weapon, Not Firearm), 148 PC (Resist Delay Peace Officer), 1203.2 PC (Revoke Probation), 11550(a) HS (Under Influence Controlled Substance).

Kimpton was arrested and transported to the Adventist Health Ukiah Valley hospital where he was medically cleared for incarceration.

Kimpton was then booked into the Mendocino County Jail where he was held in lieu of $30,000.00 bail.

Bad dog owner. Time for you to sit and stay- in jail.
Thanks Deputies for only pepper spraying dog and not shooting the dog.
Smart dog for leaving Deputies and it’s owner.
Hope the dog finds a good home. I’ve had 2 rescued pitters ;Ms Petunia Sweet Dudley or Pity for short, and Mr Pitter Corleone Dudley or Mr Pitts for short. Both came from less than ideal situations and seemed to really appreciate the good home with my 3 daughters and myself. Best wishes to the Dog.

They did. The Mexicans gave her back this time; but less than a week later Willits PD did execute Madeline Mayflower-Kimpton.

Why are people thanking the cops for not shooting the dog????? This dog will end up attacking an unsuspecting victim down the line. This dog needs to go.

Owned By TERRIBLE pet owners who should have their right to even own a pet or even reproduce in my opinion for the duration of the remaining years of their lives. This is not the fault of the dog. Any dog could be instructed to protect the person who it has any bond. The breed of the dog is not the only thing that should be taken into consideration. They did the correct thing by not shooting the dog in a situation where they had all the right to do so. Luckily they have a strong moral obligation to act appropriately keeping in mind that any dog in that situation could be acting out of anxiety and or confusion. Keep the train of thought in the right direction. This could have been someone’s child and not a dog. I personally feel a sense of respect and safely knowing that it would not be a knee jerk reaction to immediately taking that child’s life away without first having attempted alternative solutions beforehand.
