In an email to us, Humboldt County District Attorney Maggie Fleming noted there has been “interest in Wade Harris’ recent arrest.” Many in the community have expressed frustration after Harris, who was suspected of having been involved in a burglary in the Salmon Creek watershed on Sunday, January 26, was released from jail early Thursday morning. Though he was remanded back to jail about a day later and remains there today, community members (including this reporter) were confused about the situation.

DA Fleming provided the following explanation of the ongoing situation in her email:

In general, under current California law people accused of a crime have a right to bail, unless the crime carries a possible death sentence. However, the law allows judges to deny bail or alter bail amounts for people who pose an extreme risk to public safety or who cannot show they have a legitimate source of bail funds. Harris has been able to make bail in all of his preceding cases, including bail set at $500,000 in one of his burglary cases.

Within 24 hours after he was booked into jail on his most recent arrest on January 26th, a Humboldt County Sheriff’s Office (HCSO) sergeant filed declarations concerning his criminal record, prior criminal acts while out on bail, and the source of his bail funds, in an effort to get the judge to deviate from the standard bail schedule.

Based upon those declarations, Judge Canning had Harris held in jail without the opportunity to make bail.

In the next step in the process on January 29th, Harris was arraigned for burglary, auto theft and felony reckless evasion from law enforcement. We have also charged him with an allegation related to the fact he continues to commit new felonies while out on bail. (The investigation of his actions that led to his arrest continues and we may add or revise charges in light of more evidence.) At that time, the file on the case available to Judge Wilson did not contain the declarations made by HCSO and the Judge set Harris’ bail at $75,000. (We have alerted the Courts to the issue of judges not having needed documents – HCSO had properly filed the declarations with the jail and the courts.) Harris posted bail and was released.

Harris then appeared in court on Friday (January 31st) for his bail hearing. The declarations by the Humboldt County Sheriff’s deputies involved in the case were available for review by Judge Killoran. At that hearing, our Office requested that Harris be taken into custody and Judge Killoran agreed. Harris remains in custody today.

Another hearing is scheduled for tomorrow (February 4th) at 2 pm in Court 3 of the Humboldt County Courthouse to address the issue of whether Harris has a legitimate source of bail. If the judge determines he does, he might again be allowed to make bail if the judge does not find the public safety argument reason enough to keep him in custody. Tomorrow’s hearing is open to the public.

So he was released on bail and you think that he would not have been released without any bail? Not to mention the only reason he is now in jail was that he showed up for a – tah tah- bail hearing. As for community action, this guy happened to catch the attention of this reporter because of her personal ties in the area. That wouldn’t have happen if the guy was a Eureka criminal.

If he hadn’t stolen at least 50,000 dollars worth of other people’s stuff, he wouldn’t have bailed out. This system benefits only rich criminals.

(Edit: I have learned that its possible to pay your own bail in cash. So maybe he stole half-a-mil? I wouldn’t even be able to afford the cash deposit on bond.)

People are released on their own recognizance all the time. So in essence, as the judge currently has a very wide latitude in deciding whether to release without bail, a very low bail, a very high bail or allow no bail at all, the “no bail” idea simply gives the judge less options. It certainly will add another layer of public bureaucracy because there will have reports supplied.

The result will likely be that the pressures of costs in keeping prisoners will make more people like this man released on OR and the government can look to bearing all the costs of hunting down the many who do not show up for their hearings . Or the judge will hold more who he judges have now no financial incentive to reliably show up. Knowing the government, it is more likely they will release people that will commit more crimes rather than come up with the money to house them for the dragged out procedures that already plague courts. And public safety will take another hit.

Is it fair that a person has to lose the money they pay a bondsman for providing fiscal assurance they will show up, especially if they are found innocent? No. But then insurance, which is what a bail bond is, is never is.

It is never as simple as being “unfair” to poor people when you think of the criminal nature of people involved. It is only unfair to those the judge already thinks will not bother to come to court (like unemployed or a previous history of not showing up) and can’t afford the insurance premium to the bondsman willing to take a chance on them when a richer person could find the bond. Then again is it “fair” to release people who are likely commit more crimes while free because they have nothing to lose but the judge has to set them free? Looking at the lists on LOCO, the same people already get released on their OR all the time and commit crime after crime until they finally held long enough to actually get to trial.

It was a bail bond. You can’t bail out of jail using you own cash, it has to be provided through a bail bondsman. It’s a system that serves absolutely no purpose.

Well, you can be bailed out of jail with your own cash, it’s called a cash bond. Just few people would be able to provide a liquid surety of $500k so there’s bondsmen who provide what is effectively an insurance policy that if you run their insurance will pay the $500k. For this service you owe them a negotiated fee of 6-10% of that amount. You used to have to have some kind of pretty solid collateral but I think you can’t use houses any longer so I don’t know what folks use nowadays.

The charges listed are from ONE DAY. We want to see all the charges for at least the past 3-4 years.

I for one, am tired of seeing this guy’s face.

Whatever else is going on in his life, he gets arrested dirty way too often. Obviously, he is a master manipulator, probably some kind of central figure in a group of criminals, and, he needs a time-out, preferably at one of our lovely state correctional facilities.

Get this guy off the street, along with his associates! That is my best advice.

Somehow, I doubt that he can be rehabilitated, though…

We all know what he does is wrong it sucks. And yes he has been to jail and yes he has served time. However, there are many others who do way worse, murder, rape, etc. He needs to end this crime spree he’s allegedly on and stop. But the comments about killing him, putting bullets in his head. His girlfriend, (baby mama) inherited a bunch of money when her grandma died a few years back. Upwards of a million. That’s where he’s getting his money for bail. I’m sure the money is almost spent …hitting licks to compensate at this point.
