Cannabis Church Sues County and CDFW for 1st & 14th Amendment Violations

A church called Redwood Spiritual Healing Ministry filed a lawsuit Thursday, June 27 against the County of Humboldt and the California Department of Fish and Wildlife (CDFW) alleging violations of its 1st Amendment right to religious freedom as well as due process violations when a multiple agency task force destroyed cannabis as well as private property during the execution of a search warrant. The case further alleges that the County of Humboldt may have withheld relevant information from a judge by having CDFW file the Affidavit for the search warrant without informing the judge that the property in question may be a church under the law.

Attorney Matthew Pappas explained that the Redwood Spiritual Healing Ministry views marijuana as a sacrament just as many Christian faiths view wine as a sacrament.  Pappas listed a number of religions that have used cannabis religiously over the generations including Hindu, the Sufi, Rastafari, Shikhs and Taoists.

When asked why a church would need so many greenhouses of sacrament, he explained that the Redwood Healing Ministry is part of an association of 40 Sacramental Life Churches, and that church members in more urban areas of California cannot easily obtain marijuana that has been grown with spirituality in mind. As a means of comparison, Pappas said that people looking for Kosher products need to know that the process of production meets their spiritual standards. “They don’t buy just anything to have it blessed later and wonder how it was produced,” he explained.

The major issues raised by the complaint allege 14th Amendment due process violations, and 1st Amendment freedom of religion violations. Pappas explained that the due process claims raised by this case are not only relevant to churches but to all citizens.  In particular Pappas noted, “It is not the job of law enforcement to execute punishment.”

He argued that destroying the cannabis without a trial violates the American standard of justice that ‘we are presumed innocent until proven guilty’. He went on to say that, unless there is an immediate danger to the public or the public interest, any actions beyond investigation and collecting evidence are unreasonable, “When you go in with a search warrant, it is the investigatory stage. It is not the time when you execute a judgement and render punishment and that’s what these law enforcement folks are doing.”

Pappas, said the County knew the property near Island Mountain that was raided on June 11th was a church because Pappas had written to Humboldt County Planning Department’s Code Enforcement Officer last year informing the Planning Department that the property was a church after the parcel owner had received an Abatement Notice.

Pappas said that at the time of the abatement,

The property was then leased by the church [and had a] planting for sacramental cultivation. I notified the County that I represented the church and the property….The County was well aware that the church was moving forward, at least the Code Enforcement people were.  So then the church began the cultivation process [in 2019 and] on June 11th… Fish and Game got a warrant and came out to the church cultivation property, and just went in and destroyed everything.

While CDFW did not issue a press release on this raid, they did, according to Pappas, file the affidavit with the court for the search warrant.  Pappas said CDFW also rented a helicopter to take aerial photos of the site to establish probable cause that marijuana was, in fact, growing inside these greenhouses.

While not asked about this lawsuit or these photographs specifically , CDFW spokeswoman, Janice Mackey, was asked generally if CDFW policy permits crop eradication or property damage during cannabis enforcement operations. Mackey acknowledged that it is CDFW department policy to eradicate unpermitted cannabis plants without a trial. She writes,

“If by “crops” you mean illegal cannabis plants, then yes, we may eradicate plants grown illegally, only after retaining representative samples as required by the law. Commercial cannabis cultivators are required to have both a state license and local authorization to be a legal. As part of the licensing process, cultivators are required to check in with CDFW to either apply for a Lake and Streambed Alteration Agreement or written verification that one is not needed. If we suspect illegal cultivation activity near a sensitive watershed, we have various avenues to check for compliance.

 

In addition, when serving search warrants, we may also alter property in order to gain access to a site or the illegal marijuana plants. The includes breaking locks, cutting a cable, taking down netting on plants or forcing entry into a locked door. We will eradicate plants that are not permitted or licensed by the state.  We focus our efforts on those sites doing the most environmental damage.

Pappas reiterated that the due process clause means Humboldt County and the Department of Fish and Wildlife were authorized, with a search warrant, to investigate, document the growing conditions, collect evidence and make a referral for prosecution where a court would determine whether their church was breaking the law or not. The agencies were not authorized, legally, to make the determination and take action.

Pappas said the greenhouses “were completely destroyed.”

Pappas used a popular coffee chain as an example. He said, “If [that coffeeshop] were in violation of the Health Code, we would not see the County smash up their equipment, inventory and furniture. They would get a Notice. If they failed to act, they might get shut down, but their property wouldn’t be damaged, and they wouldn’t be attacked or disrespected.”

Both the California Department of Fish and Wildlife and the California Department of Food and Agriculture were asked what department policy says about crop destruction or property damage during the course of serving search warrants and investigation of unpermitted cannabis cultivation.  CDFW was also asked why its personnel tend to arrive at enforcement actions wearing flak jackets and carrying weapons.

Only CDFW responded before the holiday weekend.  Information Officer Janice Mackey wrote,

We enforce both civil and criminal violations. If wildlife officers at the California Department of Fish and Wildlife are involved, it is usually because of Fish and Game Code violations and other criminal activity. This typically involves environmental harm, habitat destruction, illegal water diversions, illegal take of fish or wildlife (poaching), and other such criminal activity. In regard to illegal marijuana cultivation, we focus our efforts on unpermitted/non-licensed sites doing the most environmental damage….

Our goal is to preserve the state’s natural resources for everyone, whether or not they are growing cannabis. The majority of cannabis violations are criminal and can be found in the California Health and Safety and Fish and Game Code.

Our wildlife officers enforce all state laws and are sworn peace officers (like the CHP or County Sheriff’s Department).  An illegal grow can be very dangerous. Many individuals we have encountered at these sites are often linked to organized crime and ready to protect their grow at any cost. We have frequently found automatic firearms, body armor, fake police badges and other dangerous elements.

A majority of our officer involved shootings have taken place at illegal marijuana grows. Like other enforcement entities, when search warrants are served, the safety of our staff and anyone on the property is our first priority. Our tactical gear helps keep everyone safe.

Regarding the lawsuit’s allegation that the County and CDFW violated the church’s 1st Amendment right to exercise its Freedom of Religion, specifically its right to use cannabis as a sacrament, the complaint cites a chain of law beginning with the No Discrimination Clause of Article 1, Sect. 4 of the California Constitution and the Religious Land Use and Institutionalized Persons Act described in the complaint as “a federal law which prohibits discrimination against religious entities through … land use and zoning actions and laws.”  The citations end with Masterpiece Cakeshop Ltd v. Colorado Human Rights Commission et al from which the complaint quotes Justice Gorsuch in his concurring opinion, “In this country, the place of secular officials isn’t to sit in judgement of religious beliefs, but only to protect their free exercise….Popular religious views are easy enough to defend.  It is in protecting unpopular religious beliefs that we prove this country’s commitment to serving as a refuge for religious freedom.”

Back in March of this year, Rolling Stone covered the issue of the cannabis church movement in a somewhat cynical article. The author, Amanda Chicago Lewis summed the movement up like this,

Pot churches … reject the new system of state licensing, regulations and taxes entirely but still claim to be legal under a mix of federal and state laws protecting religious civil liberties — especially those that uphold the right of Native Americans to use the otherwise illicit drugs peyote and ayahuasca in religious ceremonies. Other marijuana traffickers have been trying this tactic for years — most notably a controversial, multi-state organization called the Oklevueha Native American Church — and failing. Oklevueha has won the legal right to perform peyote ceremonies with non-Native folks, but hasn’t been able to budge the courts on pot. While peyote and ayahuasca involve long, vomit-inducing trips that are generally overseen by some kind of shaman, weed has a milder high and therefore is seen as having a bigger potential for diversion to non-spiritual users. However, now that a majority of states have legalized medical or adult-use cannabis, the movement for religious marijuana has grown in size and fervor.

In the article she mentions Matthew Pappas and outlines the legal criteria to exempt cannabis churches from commercial cultivation laws, ordinances and taxes,

Even if the IRS were to accept Phan’s pending application for tax-exempt status as a church, a court must separately determine a) the sincerity of his belief, and b) whether his violation of the law for religious purposes substantially undermines the government’s ability to otherwise enforce the law(s) he’s breaking.

At the end of our conversation, Matt Pappas was on his way to court in San Bernadino County.  In that case, the judge has already found the defendant meets the ‘sincerity of belief’ criteria.  And they are now working through whether the defendant’s actions will ‘substantially undermine’ the State’s ability to enforce its new regulations.

When Matthew Pappas was asked why he works so hard for the Sacramental Life Church and the First Amendment protection of cannabis as sacred, he became another man for a few minutes.  He explained that he works in memory and in honor of his daughter, Victoria, who after surviving a “vicious” and life-threatening attack came to believe with all her heart that sacramental cannabis would bring Peace on Earth. Victoria subsequently died in February of 2018.

The Humboldt County County Council’s office declined to comment on imminent litigation.

The USHA Research Institute won its case, that victory included the right to practice the healing traditions of our forefathers by using herbs and other nutritional substances that are consistent with our genetic structure.

During the Vietnam era marijuana became a symbol of Peace and Freedom. Even as the military industrial complex was gearing up flowers were being put in the barrels of their AR-15s. The National Guard open fire on protesters and students at Kent State San Francisco Haight-Ashbury became the heart of the movement. The US government buryed love on Haight Street some of the military were firing up instead of killing each other we are still going through this today. My point of view marijuana is a Sacrament and should be shared, helping the world be more Peacefull. Thanks for bringing the Blessings

Drugs are a great escape during war.

If you were in Vietnam anything would make a day better than thinking of the 5 bros you just saw get ripped in half. You likely being next tomorrow.

Most likely none of it should be considered sacrament, as you were traumatized. The best way to deal with trauma is to deal with it.

PTSD psychologists exist, and I highly recommend it for those that are quietly dealing with trauma, even if from 45 years ago.

No Brian. You missed the part about “sincerity of belief”. A judge has already ruled in favor. What’s left is some convoluted description of what do the enforcers think, say, or do. As if a church needs the permission of law to exist.

For the past 50 centuries, returning warriors have turned to cannabis for help in healing the trauma of war. What is the problem with that? It’s an old treatment for an extremely pervasive illness.

No problem with PTSD treatment with cannabis.

I know a number Operation Enduring Freedom veterans that use it.

But I would consider the best use of that is in conjunction with other ways to cope with trauma.

Talking to a specialist helps too.

And I’m glad Churches have to abide by some sort of law, though as we see through, many priests get around it.

I’m sorry if you got the impression I’m anti-cannabis. I’m definitely not.

This could be a very interesting case. A big issue is separation of powers. The CDFA says it has authority to destroy illegal cannabis. Maybe so, maybe no. But does the CDFA have the authority to determine which cannbais is illegal. That right is reserved to the courts, I believe. “Commercial cannabis cultivators are required to have both a state license and local authorization to be a legal.” says the CDFA, and that is correct. But who determines if a cannabis cultivator is “commercial”? If the church is not a commercial cultivator, then the licenses are not required even if the law is as CDFA says it is. Again it is up to the courts and not the executive branch of government to determine if the cultivation is illegal or not. The courts define “commercial” not the bureaucrats. So the lawyer is correct (what fun it is to say those words) when he says the proper execution of a search warrant in a cultivation case is to document what is found, and then go to a court to see whether it is illegal.

That does not mean that in the end the courts will decide the cultivation is legal. US Courts are very timid when it comes to new religious claims. Their problem is that in the broad sense almost all beliefs about the purpose of life and how to properly live it are religious. In the 50s the US government was happy to proclaim that communism was a religion despite communism’s own claims that religion is the opiate of the masses. But if all the varied beliefs and belief systems are exempt from the law, what is left for the law to do? And that’s not a joke question. There are ancient Christian writers who say “property is theft.” So does it follow that if you are that kind of Christian you can freely make use of what others consider their own property? Suppose your religion believes, as the Hebrew bible seems to teach, that God punishes nations for the acts of individuals. Remember Sodom and Gammora. (sp?)? Does that give you or your government the right to stop those individuals from committing those acts, or to punish them in the name of God so that God doesn’t get mad? And don’t get me started on sacred cows. They are not a metaphor. Anyway the courts have really tried to stay out of the legal hornets nest of defining religion. They also tend to believe that secular law trumps religious belief – you can believe what you want, but you can’t necessarily act on those beliefs. This very idea was the cause of many of the Christian martyrs of the early days. It wasn’t illegal to be a Christian, but some Christian acts (like not worshiping the pagan gods) were illegal. Still true, only the acts have changed. Growing marijuana may be one of them – or, now that it’s so close to being universally legal, perhaps a church can grow it’s own sacramental herb. I guess we’ll see. So I offer admiration to the lawyer who takes up a case like this. It’s difficult to win, probably hard to get paid, and definitely time consuming.

Can you reasonably call this property a “church” if it only sent a letter to the planning Dept. after being given an abatement notice?

Not being a lawyer but knowing a bit and referencing to rastafari has won cases and other parts of the country establishing themselves to have marijuana as sacrament but that I guess is not the full issue it is whether they need permits are is God’s blessing good enough

It’ll be interesting. We know that, even today, Abrahamic religions commonly receive religious exemptions to mutilate infant or adolescent genitals because of an alleged covenant with God or whatnot. Historically, religious exemptions allowed for the torture and murder of millions.

The early Christians demanded freedom of thought and conscience. Many died for it. Then, when Christianity conquered Rome and Europe, Christians applied torture and death to atheists, pagans, and other infidels. One of the great historical tragedies.

Wine is used at every mass, as well as in some protestant churches as a sacrament. Difference between wine and pot is wine is legal, pot is not, especially to the fed govt. The wine used in churches is legally grown, processed and distributed. If you grow pot, it must be done in the manner prescribed by laws, or you get busted. The wine used in sacramental activity is taxed, regulated for quality, and the churches pay for the wine, and the taxes also. The wine producers do not send letters of intent to grow wine for sacraments and there for are not going to pay taxes on it, or grow it without permits and licenses. Either you go through the process of licensing, taxes, land permits, etc., or you get busted. Personally, i do not consider pot a sacrament, but rather just a way to get high, change the way you feel, or for entertainment. Like if you watch the “Isle of man” motorcycle race, and you are stoned, what a blast. It’s just recreation folks, just a toy, nothing more.

Because, I believe in allowing a place to speak for those who have uncomfortable and even unpleasant views. And I do not think I am right all the time so stifling opposing views concerns me. I would like to think that people of goodwill understand the dangers of muffling those who think differently than they do.

Also, CHC is not a troll in the traditional sense. I believe she is a good woman with mental health issues. She might say she knows a truth we don’t know. I think that’s bull. But, allowing her and others a place to speak their truth means I have to constantly be aware that there are different and competing world views, that has value that I wish more people would acknowledge instead of trying to suffocate those whose worldviews differ from theirs.

I believe in the need for moderating social media, but it’s a fine line. I do not believe you should determine, for all your readers, that this person has a mental health issue. Your not a professional and, unless I’m missing something, why would you discuss someone’s personal health without their consent? Would you state you think a person has cancer and the pain of that is why their opinions are different?

Okay, let’s look at the Paradise Fire logically. Why? Why would the government use satellites to take out its own people? Costing Millions upon millions to put out the fire…? You can look for the improbable (government satellites) or recognize that the facts show that at 6:33 a.m. on November 8 2018 a fire was reported near a power transmission line and at 6:15 a.m. in the same area a line stopped transmitting power. And a PG&E utility worker saw the fire in the same area as the line that was having problems. AND anyone who listens to the scanner knows that power lines cause a number of fires.

So why go looking for weird, unlikely “explanations” when you have a perfectly reasonable explanation that fits all the facts.

That’s roughly equivalent to having forgotten to put gas in the car, having the tank register empty, but then claim that an alien force beam could have sucked the juice from your engine. Sure…it could be true but one theory is much less reasonable than the other. Why go with the one that doesn’t make sense?

Ok, ok, ok, here it is, so.. the ting about the flat earth conspiracy, is that you can indeed convolute facts and make people beilive something that their better sense knows is not true.. I am not a flat Brainer, (flat earther) by any means..but it is a testament to how far a conspiracy theory can convolute minds and make them beilive anything.. at least that is my take..
Also, don’t think that the US has not been threatened with attack’s from forest fire’s before. This is not new. In WW2 Japan threatened attacks to start massive forest fires in the Pacific North West. I do not think that the fires here were started with “laser beams”.. not by far. But when the fires started, I was concerned it might be more than PGE, especially how severe they were.. I also do think HARP is real.. and I am very Suspicious of chem trails. However honestly, I would not be suprised that a laser beam that powerful could exist. I just seriously doubt it was used to start the fires, though personally..

I understand that TRB, and whatever else moniker he rolls by has moments where he shines.

I understand that he’s trapped in an elitest world view, and most likely would be smashing CHC, and Shaks, and others windshields if he had a chance to “teach them a lesson “.

Plenty of people who have risen to the ranks of somewhat relevant in their pursuits.

The problem I have noticed is when the limelight and attention fades, there is still that desire to be wanted, to feel needed, to maintain relevance in a world that changes its outfits….multiple times within a news cycle.

My problem with you is the your elitist attitude in dealing with countering viewpoints, and dealing with everything you’ve figured out about this world.

You are simply another bag of bones who feels like he’s got all the answers in his 38 years of age.

There’s more to life than believing highly of yourself…

Being published means nothing when your tantrums prevent your message from landing, or from preventing anyone from experiencing trauma from reading countering beliefs.

You want to prevent trauma, go do something about mandatory vaccinations that have resulted in real trauma for the victims.

Some people ride that fine between gifted and dangerous.

Be more dangerous to the establishment that is a much larger threat in creating trauma than anything youve complained about from commenters.

My personal opinion is to merely look at how whistle blowers have been prosecuted and persecuted. The fact that there is a real effort to cover up some information, and keep some people quiet, simply points to a larger and hidden side of life we may have the opportunity to peek at from time to time.

I believe what’s more important to understand, is how people can push their own confirmation biases, based on main stream media sourcing, and how so much that we hear is in the form of talking points forced fed to the public.

I know enough to keep my mouth shut about things I have learned, that would definitely attract more attention by speaking out and being ridiculed or challenged, because the source of this information is simply not for most people.

I think most people understand there is good and evil in the world, in varying degrees, similar to intelligent and mentally challenged people.

People are concerned about the increasing amounts of EMF, RF, and the loss of privacy. It doesn’t take a genius to connect the dots, but having aceess to the white papers, is different than being able to share that information with others.

Any suggestion that manipulation and greed, and power is healthy for humanity is simply ludicrous. We are being manipulated, and what is incredible is that we can actually act more like useful idiots, who contribute to the program

It’s not the job of Law Enforcement to punish law breakers. For example if someone is speeding, it’s not CHP’s job to Billy club you and say don’t do it again. It’s there job to ticket and send you to a judge whose role is to hand out punishment.

Law Enforcement sent out to check out greenhouses with a search warrant, really has no right to pass out punishment such as, to destroy your property, such as greenhouse plastic, hose lines, water tanks. Doing so is passing out punishment without Do Process.

My personal opinion is to merely look at how whistle blowers have been prosecuted and persecuted. The fact that there is a real effort to cover up some information, and keep some people quiet, simply points to a larger and hidden side of life we may have the opportunity to peek at from time to time.

I believe what’s more important to understand, is how people can push their own confirmation biases, based on main stream media sourcing, and how so much that we hear is in the form of talking points forced fed to the public.

Before the current adult-use reforms really got going, case law on religious cannabis use tended to trip up plaintiffs at the stage of determining whether government can provide an exception to the prohibition on unlicensed cultivation without undermining the legitimate purpose of the law.

The size of the cannabis market, and the threat of diversion of religious weed to it, has been one of the key factors that distinguish religious freedom cases involving cannabis from those, like O Centro, involving substances with smaller recreational markets.

In general it’s much easier to clear the sincerity hurdle than to clear the rest of them. I am skeptical that the advent of the rec market will help their case. But I hope that it does.

Well yes, maybe, but not based upon religious first amendment rights. Shall Kosher Cannabis, Navajo Peyote or Catholic Wine also be re-scrutinized? Yes.

It ain’t a First Amendment of our Constitution unless ALL sacramental substances receive equal protection. To continue to repeatedly single out cannabis as an exemption to religious freedoms, is tyranny. It’s not constitutional.

Case-Law is based on yesterdays’ winners, moral rights are based on now. Going forward in time, the previous Cannabis Case-Law will be discarded as being wrong. Shall we consider cannabis reparations?

The Newsom/Ajax loophole has caused millions $$ of easily avoided harm to the already existing Cannabis Culture. Is that something guaranteed by Constitutional Law? No it’s not, in fact arrests and imprisonment are called for. The OG are being systematically criminalized by low and middle level bureaucrats.

Religious exemptions to drug laws and other statutes have lately been established not with reference to the 1st Amendment per se, but to religious freedom laws enacted by congress and the states, the Religious Freedom Restoration Act above all.

This extremely robust law protects religious freedom by requiring government to show that laws credibly alleged to infringe on religious liberty pass tests of “strict scrutiny” (the highest standard of judicial review of government actions). There has to be a compelling government interest in the law’s objective; the law must be “narrowly tailored” and applied in the “least restrictive means” with respect to religious practitioners.

In sum, RFRA puts the burden on the government to show that it can’t accommodate a religious exception to a law that infringes religious practice without seriously compromising an important objective. The power of the law was such that, in the O Centro case, it overrode government arguments about the dangers of schedule 1 drugs, when the government could not demonstrate that the UDV’s ritual use of ayahuasca posed an unacceptable threat to themselves or others. The usual drug war scaremongering was not accepted by the court.

That’s big. But one of the star witnesses in that case was drug “expert” Mark A.R. Kleiman. His testimony was powerfully convincing, but it relied in part on distinctions often found in the weed case law to argue that the illicit markets for ayahuasca and DMT were so small that it wasn’t worth worrying about because there was not a great danger of diversion.

Here, I feel sure, the government will be staking their case on arguments about diversion and commerce in the (very much larger) unregulated weed market. And I’ll be surprised if the courts aren’t sympathetic to those arguments. Best of luck to Pappas et al.

About all I got left to discuss is … The legal side versus the Original side is a true firefight. Left to our own, we’ll make course corrections and revert back to peace and goodwill. However, Governor Newsom is the largest antagonizer to the positive relations. It’s join my sicko movement or I’ll destroy your time left on Earth. His “Legal” authority appears to be overreaching on everything relating to his plans for $64.

I asked around and came to the conclusion that Newsom is actually saddened by the huge split his baby caused. He’s on thin ice when it comes down to death threats towards everyday folks. We’re keenly aware of the necessary violence he’ll finally order. The real truth as always is, politicians lie 100% of the time. Which means for the “legal” side a serious self examination is due. Peoples lives will be lost to enforcement of “legalization”. Did we vote for that?

No, our votes aren’t being honored.

Newsom is providing government protection and the eradication of an entire generation of OG. He lied in the campaign for pro-legal and still the “legalites” worship his promises. He planted a seed where greed could flourish while decency and respect were ground underfoot.

And then of course, how many “legal” State Tax Collectors can he sign-up? Will it be enough to stamp out the honest cannabis culture? Yes, easily, when the fire gets too hot. We’re watching in slow-motion a form of California Government spreading hate and division.

There was a small study done with the help of Oregon U Eugene. It explored “Collaborative Governance”. Social media has opened the access to communication with a super benefit.

Everybody gets to be heard. Online we’re equals in every way. The debate is everything. Professionals are being paid to sort through our conversations. Creativity in governance, in a perfect world, becomes more and more valuable. The backwaters of governing indifference seem to be less useful than normal people’s comprehension. Thanks social media.

The largest example I know is our current POTUS tweets profusely. It’s a first.

Most anybody wants to help and assist understanding of what’s going on this moment. We don’t wait a week until the media filters the data. We all like to feel that the information we chose to grasp is unadulterated.

Totally Rod, from what I understand Canada does extensive surveys, before enacting policies. A lot of it is probably statistical data, however. Voting is great, but it kinda seems like whats missing in the whole scenario, is the actual voice of the people. IMHO
However, I have actually seen certain things change rapidly, because of a few comments on social media. THEY ARE LURKING.. LOL..
Social media can be a very powerful outlet, why do you think in Egypt they shut the mobil media down on multiple occasions? And it is an interesting way to actually hear what people are thinking. Yeah, we’re on the same page. Social media is indeed a love/hate technology. If we can get over the abuses where the biggest providers alter content and composition, we can enjoy our constructive conversations.

I think a society where social media is somewhat too assertive or quick to sensor counter thoughts, offers the best chance at getting truth published. The reader must sharpen it’s ability to believe nothing of what you hear nor half of what you see. We still seek some sort of litmus on truth in commenting.

I’ve never seen it but it could be that I am simply never under moderation. What happens varies. Some comments post right away and stay there. Some comments seem to post but then disappear, not to resurface for days. Sometimes comments show in the recent comments section but they don’t actually appear until much later. It seems rather random as one might not show and another one made shortly after does show. Since I have seen that happen to your own comments, I just assumed it was a program issue.

It still looks like an unprofessional personal attack by the officers to cut the plastic when the door is open, when they serve a warrant at a house they don’t break the windows when the door is open lol.In the murder mountain series they showed officers do the same thing at a legal farm.The doors were open but first thing they did was slash the plastic.After finding out it was legal they left without compensation for any of the damage they did.

That’s a double standard that’s well known, but which I’ve never seen LE-positive commenters acknowledge.

For years and years there have been remarkably consistent stories of officers defecating in ice chests and other places during raids. There were those gopher-themed profane T-shirts in San Diego. There are the (copyright-infringing) patches distributed amongst task forces.

Just three examples chosen from the many available.

Failure to acknowledge the animus that’s behind “just enforcing the law, ma’am” when it comes to weed is a sure sign of bad faith in discussions about it.

Maybe the issue is that complaints about police behavior belong in an article about police behavior, not used as a counterpoint or diversion to comments about the bad behavior of growers. Somehow these issues are always presented as if the police doing something wrong negates the wrong doing of the criminal. It doesn’t. Criminals seem to be very focussed on the police not treating them with respect while they themselves are universally disrespectful. It seems to be a pattern of thinking among criminals. And maybe it rubs off on police too. They might learn to divide the world into criminals, who deserve no respect, and law abiding people who they only have contact with as victims who have been treated with no respect by criminals.

Although i do support this groups right to use of Cannabis for a religious purpose. Having a cannabis church does not exempt you from taxes nor does it change Humboldt county building codes and regulations. This is more reason why the CDFA needs to issues non profit caregiver licenses. Hypothetically had this group paid its taxes and fees and have building permits and followed fish and game rules they could of cultivated the cannabis. If they then wanted to give it all away for free or use it in there religious ceremonies they should be allowed too. We need to create another system for these types of cultivators. Perhaps they needed a amended Micro Business license, that way they could distribute there own cannabis from the farm to there members.

The only religious tax exemptions involve things directly participation in a religious practice and only within limits of meeting other legal requirements. For example just because a body of people believe in human sacrifice and even found a fool to offer himself for sacrifice doesn’t mean that are given a free pass to do it. For a religious exemption of property tax a property must be used excusively for religion. For it’s practices to be protected, the government must have no compelling interest (a legal term) in preventing it. So no murder, no growing for profit but yes to pot use inside a religious ceremony (but not partying with a group of friends.)

Complex issues and people’s eyes should not light up with dollar signs because they think they found a loophole. The law doesn’t work so simply as all that.

Churches are not automatically exempt from permit fees (building permits etc.) under which cannabis cultivation fees would fall. They are also not generally exempt from collecting excise and other taxes (such as the cultivation tax) and passing those on to the governing entity (think sales taxes, etc.).

Being a church does not automatically give you the legal right to run roughshod over local, state and federal laws, it only offers very specific (and long legally settled) protections.

He should also use the Administration Procedures Act and follow up with a civil suit in the event he is denied satisfaction with the current court system, after exhausting his legal remedies with CDFW and Humboldt County. Administrative Law gives a different approach and awards levied in civil suits can be punitive, and in excess of the value of what was actually lost. The APA can be used to reign in on excessive power grabbing by state agencies, which seems to happen more and more these days.

“Illegal cannabis” is a misnomer. The unpermitted cultivation, possession, use, transportation may all be considered violations of civil, criminal, health and/or building codes but the plant itself is not illegal. That requires intent and the courts would be hard pressed to grant that capacity to a plant. If it was the plant they would simply throw the plant in a jail cell for punishment. … it sounds absurd, but that is the very premise that is used for asset forfeiture of Federal Reserve Notes. The money is seized as “illegal monies” not the possessor of the money. If you sue to get the money back the court docket is written up like this, for example, “The State of California vs. $2,322.45”.

Our legal system is built on common law. If there is no victim there is no crime. The bureacratic state has perverted our justice system into a revenue generator that stifles inherent freedoms.

Tax evasion has been frowned on from the inception of the very idea of government. Blasphemy, not banking down fires, prostitution, leaving the city gates open, malfeasance, public intoxocation. failing to attend court, etc have a long history of being punished under common law while some practices injuring victims such as slavery, wife beating, rape, child labor, etc that creates great harm is not considered a crime. Common law is a very tricky thing to use as an absolute. It does not always say what you want it to say.

I don’t understand why it would acceptable for a church to cultivate cannabis without having 501c3 status.
If the church does have this determination. Should they not have to go through the same or at least a similar permitting process as for profit grows? Perhaps the CDFA can set up an alternative permitting system that takes its non-profit status into account but allows the same environmental and safety standards to be met in order to be allowed cultivate. Also shouldn’t they have to participate in the track and trace program in order to insure their sacrament is being used as that, as opposed to the assumption that it is being used as for profit?
The article states that they informed Humboldt County Planning Department of their claim of religious exemption, AFTER they received an abatement notice. It looks like the kid who got caught with it’s hand in the cookie jar.
If a non profit wants to establish a system to cultivate their sacrament, I would assume they would be fighting to bring this practice into the legal market. Not fighting to justify their needs after the fact.
As a disclaimer, I am not claiming this church is not using the cannabis they are cultivating for the purpose they state they are. It just looks shady based on the information provided in this article. Maybe there is more information and maybe there is a more beneficial way to attack this issue that would be better for all involved. The argument that a non-profit doesn’t have to play by any of the rules for-profit does devalues the standards being placed on the for-profit market. Some of which are actually incredibly beneficial and necessary.

I am a very open minded person but I do feel under the circumstances, the church organization should have to follow the guidelines and at least be inspected for an environmentally clean grow. Regarding withholding information to the judge;

Pappas, said the County knew the property near Island Mountain that was raided on June 11th was a church because Pappas had written to Humboldt County Planning Department’s Code Enforcement Officer last year informing the Planning Department that the property was a church after the parcel owner had received an Abatement Notice.

Read that a few times.

They recieved an abatement notice.

Then Pappas writes a letter claiming to be a “church”.

But surely, there is a process on any property and group, beyond “writing a letter” to the Planning Dept. to be recognized by law as a 501c3 church building / property.

Kelley, maybe a good follow up question would be:

Why didn’t the “Church” attempt to be recognized by law before attempting another “sacramental” unpermitted cannabis grow.

Yeah, personally, I am loving that Pappas is ready to give them Hell. Heaven knows CDFW deserve it. Pretty lame to have FG smashing things up and acting like a bunch of outlaws themselves… This ones deep. On one hand you have a deep need for civil liberties, the complete abuse and overuse of power, the protection of constitutional rights… On the other environmental protections, over saturation of markets, and a need to maintain civil stability.. And that is very much an over simplification…It’s a very deep picture here, and it will be difficult to descern the right answer in my mind. It’s probably not good for me personally to speak to these ends, but I honestly am compelled to. Is this an issue of balancing the rights of an individual(s) as apposed to protecting the common resource people all share… in this case the rivers.. and the water courses, and protection of the fish and rivers which are in critical condition in the area.. Honestly, I don’t know, I don’t want to see a million gazillion Grows go up overnight in the name of “religious freedom” certainly.. but when I see ripped up greenhouses out of spite, I also see the “law” acting essentially like “outlaws” … and a gross overabuse of power, and authority… which makes me question the “laws” true intent. Is it to protect the commonwealth, or is it to protect $$$ interests? And I think what ever means I speak too, someone may get pissed…But in my mind the system doesn’t really speak in terms of sanity..
On the other hand, you can get a permit to have an even larger discussting environmentally destructive grow just right down the road.. so is this environmental protections, or is this a power grab in the name of “environmentalism”?
