Some Changes in Cannabis Related Code Enforcement This Year

Humboldt County Code Enforcement uses a variety of tools and information sources to actively identify, investigate, and notice property owners who have unpermitted cannabis operations on their property. If you intend to legally cultivate cannabis in Humboldt County in 2019, you will need both an approved county permit and a state license. However, if you do not have both approvals when you are cultivating, you are in violation and are likely to receive notices from Code Enforcement in 2019.

You can apply for a cultivation permit, by coming to the Planning and Building Department. County staff much prefer helping cultivators achieve compliance through the permit process rather than taking Code Enforcement actions on those who are cultivating outside the local and state permit processes. If you are unsure about what is or is not allowed please see the Commercial and Personal Use Cannabis Ordinances which are available on the Planning and Building web page.

Taking into account feedback from the public, property owners, and counsel from both sides of the process, this year’s notices will look a little bit different than the nearly 700 cases from 2018. The Planning and Building Department issues civil code Notices to Abate Nuisance and Notices of Violation and Proposed Administrative Penalty for unpermitted cannabis operations, which often also include violations for unpermitted structures such as greenhouses, unpermitted grading over 50 cubic yards, and unpermitted development in streamside management areas.

Last year’s notices were more generally worded and the fines were consolidated into a category. That will not be the case this year. These changes will provide Code Enforcement staff more flexibility based on the scale and impact of an unpermitted operation when issuing notices, as well as when resolving these cases though abatements, compliance agreements, and appeal hearings. The bottom line is active enforcement on unpermitted cannabis operations has continued through the rainy season and staff will begin issuing notices again in the near future.

True, hopefully Steve Madrone elected official will carry out his campaign platform w/ under 1k sq ft… read an article today that legal permit farms are pushing towards making home cultivation totally illegal. Let’s see how they stand up for us after we helped them getting laws passed. I think they’re too selfish & self-centered to bargain or advocate for home cultivation & 215. The least these farms could do is hire locals to help the local economy but, they don’t.

What could have been a great thing for Humboldt has only become another awful move by the county. If the county could have had enough insight to have seen what working together with the great people of Humboldt could have done, they would of had more money than they could have dreamed of. Humboldt was famous, and now thanks to politics, Humboldt is just a county where it’s citizens are having to struggle to do what they do best. Also treating Medical and Recreation policies the same, is just ignorance! When you enter the data into the system at a dispensary do you understand that Medical 215 information should be covered by the HIPPA privacy act, and that by treating them the same you can not be protecting medical patients information as the federal law requires. Don’t clump Medical and Recreation policies together, there are privacy, and major health issues that your ignoring by doing so. Amazing how bad politics can ruin a good thing.

~usually The County’s Annual Financial Report comes out a month later than last year’s report. Used to be done by December at the latest. Last year was February. If it’s done yet, i’ll get 2018’s this week. But by all means, the more who get a copy the more we can compare notes. In the Finance Dept., 1st floor to your right, then left one door. No cost. The City of Eureka’s usually isn’t done until the end of the fiscal year – May, maybe. Ten cents per page – about $18.

A “Budget” does not show the standing value of a corporation. The gazillions languishing in “investments” are not on a Budget schedule.

This is absolutely abuse of the tax codes. These fines and taxes are exceedingly excessive, and abusive. Seriously small grows shouldn’t not be fined or taxed on the same scale a huge grow would be. Small grows are no bigger than a victory garden. On that scale, not much water is even used. No more then a veggie garden at that size. Drawing from our own springs from on that level, should not even bat an eye. Anything less than 2500 ft should be taxed at a smaller rate and held to lighter standards. Actually when 64 passed it was stated that anything less than 2500 sq ft would be a very simple and inexpensive permit. Why is that not the case?
No Government adgency should be able to seize your property over farming cannabis with a small group. That is draconian.
I realize there are some bad players out there.. but that does not justify abusing everyone. Cannabis is legal. 6 plants is not even enough to make Simpson Oil.
And the Government should not be the one to tell you how much medicine is needed. If you get a 3 acre conversion, and clear some land and grow a small garden, you are interfering with no one. The government is encroaching on its citizens liberty when they apply these fees. $10,000 for a cannabis fine is massively exssesive and abuse of power.
Medical Cannabis should did not go away, and the Government should not be able to fine you to oblivion for engaging your rights to access medicine. Or tell anyone they can not grow cannabis collectively. To assume all are guilty, and issue fines based on this is abuse.
Check out other counties.. thier fines are no where near Humboldts. In Nevada County, it’s $25,000 tops for the worst of fines. This is seriously fraudulent!

Small Fry- Thank You! What you say is true. People who wanted to grow small amounts were misled and bullshitted into voting for this “legalization” which is abusing them. We have some mega-scenes and some environmental disasters out there…but now everybody -big and small- are being equally attacked. You can’t even grow your 6 plants on your own property without now getting a permit to use your own water! Because it is the “legalized” cannabis now those 6 cannabis plants must be singled out in the state’s quest to regulate your own water from your own spring! We need supervisors who not only stand up for the little people in this draconian abatement program but who actually stand up to the state water board in defense of small garden landowners. Instead we have 4 supervisors- minus Madrone- who seem quite happy with the destruction of the many little people they have bullshitted. Corrupt AF…and this is only one way they have favored their wealthy friends with the permitted mega-grows who still evade track-n-trace. You might suspect there is collaboration between them and Newsom to clear the fields in preparation of extreme corporate takeover for the coming federal “legalization” scam (whose propaganda points are exactly what they fed us here in CA).

I was not aware that Nevada County growers of less than 2000 sq.ft. have been exempted! I thought it was State of CA Water Board rules which required registration for ANY water use on any cannabis. That’s how it is for Mendocino County. For my 6 plants on my own property I must register and pay an annual fee for using MY OWN WATER! Water that does not require registration or annual fee unless it is for cannabis. It isn’t a county regulation but a new state regulation. I hope to be corrected. I believe our own supervisors should be fighting this state regulation by our sides, not helping to attack us on all fronts. I believe many people voted for this “legalization” thinking they would actually be allowed to grow 6 plants…Surprise! Never trust the government.

Ya. The new regulations are excessive. Expecially the water board. From what i understand.. you do not have to register your water to the water board under cannabis cultivation unless you are commercially applying for a permit. However… all water sources supposedly need to be “permited” through Domestic use registration. The difference PER YEAR.. is the cannabis permit is $750, plus $750 filing fee, and the donestic registration is $350 per year plus $350 ap fees.
It’s redundant because the domestic application is more than enough for a small cannabis garden.. but once you have a small garden.. nope more money to the gov. Completely excessive! They cant say anything about wells though.. yet.. but they are now claiming they can.. and if you have a spring that doesn’t leave your property.. you are exempt from paying every year.. but you have to prove it to them..
However.. the truth of the matter is.. it is the county thst will have to enforce these regulations.. so I am assuming Nevada County just wrote it into thier ordinances. They also did a county EIR, But so did humboldt.. The stare is not going to “enforce” every little trickle that comes from a pipe.. that burden lies on the counties…
I believe the water board is out of touch. And thier regulations do nothing but throw everyone into the same pot… And assumes everyone is guilty, and everyone is a bad player.. when that is not the case..

Actually, I think the 2000 square ft exemption is now part of the updated water board policies this year.. I beilive….
a. Personal use-exempt cannabis cultivators are very small, non-commercial cultivators that are exempt from the Cannabis Cultivation General Order. (See the Exemptions for Certain Cultivation Activities section.)
Outdoor commercial cultivation activities that disturb less than 2,000 square feet may be conditionally exempt under the Cannabis Cultivation General Order. (See the Exemptions for Certain Cultivation Activities section.)

. And it should be at least 2500 square ft… that is a super small garden anyway.. and their smallest “tier”.. Re-read the requirements again.. and your right.. I believe it is for the “waste discharge requirement” , as far as I understand what they are saying it is also “disturbed space” and not the “canopy space”.. and I beilive it says that you still have to “get permission for the diversion” even if it is for your 6 plants within 1000 square ft. Small Fry and Anon- Thank you! This is my understanding also. 6 plants are legal to grow but if you want to use any of your water on them you must register and pay For Your Own Water!!! Form 19332.2(b)(4) must be filed if it is from a spring that does not flow off your property. However if you want to grow anything but cannabis this rule doesn’t exist…I think if more people realized what is happening they would be angry. And I think our supervisors in all counties should be our allies in pushing back against this. Also- where are the regular private property rights groups on this?!

The legal market absolutely has too much regulations and red tape and questionable outcomes for most those that wanted to “come out of the shadows”.

Some people have a half-million to gamble on their future. Many dont.

It’s unfortunate. The transitions will be bumpy.

But I’m still happy that weed crimes are nill, this was a crucial aspect of the law; to retroactively eliminate weed charges from criminal histories.

I don’t know what Newsom’s real intent is with the California National Guard. We’ll see. If he does use them to raid private property I think things could get real messy really quickly. He needs to step carefully. If the intent is for public land then I expect the majority of the effort will be in Shasta county since there are way more massive cartel grows out that way than anywhere in the emerald triangle.

I think the whole regulation scheme was set up intentionally to prop up a black market. The State needs the black market for liquid capital and has needed for many years.

Here’s a great primer on that (a little dated now) by Catherine Austin Fitts the former Assistant Secretary to HUD under Reagan. She’s written a lot on how the CIA and Wall Street used Columbian product to finance themselves. Cannabis does the same thing for California.

I’m hesitant to research claims like that. But it is possible and there is historical precedent.

9-0, that is extremely rare for all the justices to agree; heck Brennen and Ginsburg agree that property rights are a privilege granted by the states. Ginsburg wrote the opinion. As for Estelle and co. they are now in dishonor of being our public servants and should do the honorable position and resign. If you voted once to take our rights away you will do it again! I cannot trust you Estelle to be my public servant any longer.

This is great news. A class action suit against humboldt should begin immediately before they have a chance to cover their asses.

To be clear, “rights” are not a privilege that is granted by any government body. Rights are innate, bestowed on us by birth. “Privileges ” are granted by an authority and are issued by contract e.g. your driving privileges are contracted with your drivers license.

Although there is clear precedent that freedom of travel is a right and not a privilege. .. but that is not the point of the example.

351-4. Other Definitions

(m) Personal Property. Articles of personal or household use or ornament, including, but not limited to, furniture, furnishings, automobiles and boats, as well as precious metals in any tangible form, such as bullion or coins. As used herein the term “Personal Property” does not include intangible property such as evidence of indebtedness, bank accounts and other monetary deposits, documents of title or securities. (Ord. 2576, § 4, 06/27/2017)

351-15. Sale of Materials

Any Personal Property collected by the Code Enforcement Unit during the correction or Abatement of the condition or conditions causing the Nuisance on the affected Property may be sold in the same manner as surplus Personal Property of the County of Humboldt is sold, and the proceeds from such sale shall be paid into the revolving fund created pursuant to the provisions of this Chapter.
