22-Year-Old Fortuna Resident Arrested With 112 Marijuana Pounds, Alleges Missouri State Trooper
According to a statement of probable cause from Sgt. L. Allen, he stopped the gray Toyota Tacoma with a camper shell driven by Maldonado when he “observed the driver and passenger sitting in a rigid posture.”
He said when he spoke through the open window to them, he believed he “could smell the odor of raw marijuana and dryer sheets.” Eventually, after backup arrived, a search of the truck allegedly revealed “four large duffle bags containing 112 individually wrapped bundles of marijuana weighing approximately one pound each.”
Both were arrested and charged with transportation of marijuana. Dominguez Silva was also charged with being an undocumented foreign national.

You should check further before making so many assumptions just because they are congenial. On the arrest specified above- “pulled the vehicle over after he observed it followed one car length behind another vehicle. After pulling over the Tacoma, the trooper reported he smelled raw marijuana and dryer sheets upon approaching the vehicle’s passenger side. Maldonado admitted smoking marijuana the previous night and possessing a small portion in the Tacoma’s center console.” ICE “was to issue a detainer for him the next day, according to the probable cause statement” due to “illegal re-entry into the United States. ”
On the one with the tonneau cover- Chad Davis, of Anna Illinois, reported he bought the truck with the tonneau cover while on a visit in California and didn’t know that there was 80 lbs of pot in the back.
Apparently typical California driving always offers the police cause for a stop.

The smell and conversation were secondary.
Tailgating was the reason for pulling them over. They could have been in rigor mortis if they had not offered poor driving as an excuse. But basically I agree it was likely that police looked for an excuse after thinking they were behaving suspiciously. Meh.
So it makes this an illegal stop right. They cant pull just anybody over without a crime being committed. That violates the subjects rights. They neeed an actual violation or crime to even had taken place to be a reason for the stop.
Seems like the story will read more to humboldt county liking if pertinent facts are left out…and if you pay attention, California drivers are great at following too closely, pay attention to the vehicles around you on your next road trip and you will notice California plated vehicles are usually the rude drivers. If you are going to “drive dirty”, then drive defensively.

Even though this report says nothing about the driver being under the influence of THC and nothing in my comment shows even a hint of my views on driving under the influence of THC I will answer your question. I would gladly share the interstate with drivers who smoked some pot over drivers who are under the influence of alcohol.

They won’t get tossed. Judges no longer care about constitutional rights. They are on the same side as the lying cops. Most folks don’t get caught but the ones that do are fucked and sso are their homies.
People get pulled over for “looking away from the LEO” or “looking at the LEO” as both raise reasonable suspicion that a crime is being committed.
It all comes down to the attorney. Judges may no longer care about constitutional rights but reputable attorneys are right there observing and developing new strategies to challenge these changes in the system as they happen. It’s one thing that makes them reputable.

The vehicle that Davis (a separate arrest) was driving was a 2000 Dodge Dakota and that matches the tail lights in the photo.

It is common for out of staters to get tickets. I have been driving for 54 years with a CA license and the only two tickets I received were from out of state, both in Oregon. The hurtful part was a car with an Oregon license plate passed me and I got the ticket for speeding. I questioned the officer about that decision and he did not bend. He knew I would not come back to Oregon to fight the citation.

All somewhat true, if disingenuous, but the same can be said for murder, pedophilia, extortion, gambling, etc. A society judges what harms it and how much effort will be spent it holding which particular evils at bay. And when the cost is too great or too ineffective.
I see a world of routine pot use as a dangerous thing. It creates people impaired in their work and personal lives. And worse, unlike most who recognize alcohol as impairing, even if they indulge, pot users seem to be unaware of their impairment. Pot takes so long to leave the system that even a person who uses it a few times a week is never unimpaired. It take months to regain clear thinking or at least as clear thinking as nature gave them. And if it is suggested otherwise, they get angry. They do rely on being soothed when they do screw up so that it’s a vicious cycle of screw up, sooth and screw up again. It becomes an avalanche of small messes triggering a general catastrophe. Society will be an increased tangle of more defective manufacturing, medical practice, bad repairs, driving failures, poor schooling, etc. A nation of 3rd raters in competition with first raters. Never instantly fatally so but so gradually becoming less they never notice.
However, once there is a critical mass of users, the rest of the population can’t effectively prohibit it. It best turn its attention into surviving it. So pot should be legal and the ramifications dealt with. At least the music will be more plentiful.

They did not have a tonneau cover. The non related arrest of a man with Dodge Dakota had a tonneau cover. If that makes any difference.
I can’t remember the details but someone recently got their charges dropped bc the search was based on rigid posture and not looking at the pig when they passed. The search was deemed unreasonable. I think they found 500 in the vehicle it was in one of the Dakotas.
