Man Sentenced for Attempting to Murder CHP Officer Near Willits

MAXSTADT, RYAN JOSEPH

Press release from the Mendocino County District Attorney’s Office:

An unrepentant defendant who attempted to murder a California Highway Patrol officer in south Willits in December 2016 was the recipient of a well-earned life sentence this morning in the Mendocino County Superior Court.

[Ryan Joseph] Maxstadt, age 29, of San Jose, was sentenced by Mendocino County Superior Court Judge Ann Moorman to 38 years, 8 months, to Life in the California Department of Corrections and Rehabilitation. This sentence flows from convictions by jury of attempted murder of a CHP officer, assault with a firearm on a CHP officer, personal discharge of a firearm, felon in unlawful possession of a firearm, and vehicle theft

Interestingly, as allowed by the Realignment laws enacted by the Legislature in 2011, Maxstadt was supposedly “serving” a county prison sentence for a felony conviction in Santa Clara County at the time the above offenses were committed in Mendocino County. He also has served two prior state prison sentences – one in 2010 and another in 2012.

The prosecutor who conducted the two jury trials leading up to today’s sentencing hearing is District Attorney David Eyster. The law enforcement team who investigated and put together the case was the California Highway Patrol, the Mendocino County Sheriff’s Office, the Willits Police Department, the California Department of Justice crime laboratory, and the District Attorney’s own investigators. Special thanks are also extended to Stutchman Forensic Laboratory in Napa for expert forensic audio/video assistance and testimony.

This guy is the perfect reason why we need to add on to existing jails/prisons or build new ones. I’m sure some people will say he needs mental health help and should be rehabilitated back into society. As people like this become a repeat & bigger threat to society, we can’t just say our jails/prisons are full and keep ‘greasing’ the revolving door that is getting worn out. Lock ’em up and make our streets safe.

We aren’t foolish enough to think it will ever completely stop. We just understand that when you are dealing with such huge numbers of people that we have in populated civilizations these days that there will always be a few that act against the commonly held “values” of said society. It’s kind of the cost of doing business. At least this dangerous individual has been deprived of the opportunity to repeat this kind of behavior. H was evading the police and endangering lives all over the road while driving in excess of 100 mph. Should we ban all 6 cylinders and up too while we are at it?

The problem began with the move from the California Dept. of Corrections to the California Dept. of Corrections and Rehabilitation. With a 70% return to prison rate, what in the hell do we expect. Build more prisons and throw away the friggin key!
