Humboldt County Planning Commission Holding Public Hearing on Commercial Cannabis Land Use Ordinance

This is a press release from the County of Humboldt:

Humboldt County Seal 2017 featureOn Thursday beginning at 6:00 pm, or as soon thereafter as possible, the Humboldt County Planning Commission will be holding a public hearing to consider making a recommendation to the Board of Supervisors on the county’s Commercial Cannabis Land Use Ordinance (CCLUO)  and Final Environmental Impact Report (FEIR) for the proposed ordinance.

A sampling of the principal changes to County code being considered in the ordinance include:

  • Repeal of the current permit application deadline (12/31/16) to allow for submittal of applications for commercial cannabis activities, including cultivation
  • Broadening the scope of the current regulations to encompass commercial cannabis activities for recreational users authorized under the recent passage of the Adult Use of Marijuana Act (AUMA)
  • Providing for a greater diversity of areas where cannabis cultivation will be allowed to expand or occur
  • Developing performance standards for controlling odor impacts from cultivation
  • Special requirements/limitations for projects located within spheres of influence or community areas

    • Without the cole memo protection for following state and local laws . Any attorney advising clients to go forward with a business plan is engaged in malpractice in my opinion. A legal malpractice action, however, is not likely to succeed if the lawyer committed an error because an issue of law was unsettled or debatable.

  • Because there’s not enough weed in Humboldt.

    • There is not enough legal weed in Humboldt. Legal weed needs to replace black market, pesticide filled, chem shwag grown by shitheads.

  • Afterwards can the county have a free bbq and offer a symbolic “key to the county” to anyone who wants to come and blow up a scene in our upslope watersheds? Perhaps they can tack on a property tax break to this ordinance to entice the best and brightest from other states to try their luck. We clearly need more incentives for attracting growers.

    Lol, they want to take more money from more applications that won’t be approved.Not surprising they decided to make one last quick cash grab before sessions starts busting everyone that signed those papers admitting to a federal felony.For those that went legal it was a bad move as of now, why would more people rush in to admit guilt in the face of upcoming federal invation ?BTW do you really think the state is going to approve the permits knowing the feds view on this just went back to what it had been?

    • to little to late. these dumb f—ks making videos and posting on you tube are in for a big surprise. just like you said. i read where the government said they have videos on you tube and other places with with the owners are throwing them self under the bus. just go look on instant gram. they are admitting to lots of stuff. remember Mendocino a few years back. lately its been fish and game, but now the feds are back. all you smart guys playing weed growers and big shots there coming after you. i have a friend who got 25 years for talking on the phone about how to make meth and the cops were listening. you dumb f—ks are posting you name address what you do, how you do it, where, when, and all your friend. the feds have a name for people that get together and form what they call criminal enterprises. your not going to like it. your done. lots of land going to be up forsale. nice trucks too. :). the feds said easy work . all they need to do is show the videos in court. case closed. wait until the fed judges start passing out time like it on sale. everyone is going to give everyone up. all the stuff these low rent pot lawyers are telling there clients inst going to hold up in fed court. so much for in entrapment. you guys have broke federal law and made a video about it. see ya in the paper.

  • The CHANGES they NEED to make are the tax and fee rates they are charging people who are trying to do the right thing. Those rates were set when pot as selling for at least 50% more than it is now. They should make the tax rates float, tied to the price the farmer can sell his crops for.
